MiNUTES OF REGULAR COUNCIL MEETING

I The meeting was called to order by Mayor Kennedy at 8:02 P.M.

Also Present - Attorney Courtney, Engineers Short and

REPORT OF ATTORNEY COURTNEY
Hansen StreeT Vacation
Following discussion of technicalities Involved In the Hansen
petition, Trustee NeThercut moved that a Public Hearing be held
on the petitioned street vacation on January 31, 1966, conditioned
on Mrs. Hansen Joining In the peTition for vacation, and sutject
to a proper survey being furnished to Attorney Courtney prior to I
the Public Hearing. Seconded by Trustee Crepeau. Carried.
The Counc II requested that Building Inspector Kelley be advised
not to Issue a building permit unTil Attorney Courtney Is assured
that all legal technicalities have been cleared.
Peiffer DralnaQe Easement
Attorney Courtney reported that PeIffer requested $250.00 for grant-
Ing this drainage easement. Trustee Crepeau moved That Attorney
Courtney be authorized to negotIate the easement at a cost nOT to
exceed $250.00 and authorized Engineer Lund to prepare the contract
for construcTion. Seconded by Trustee Bjorndahl. Carried.
Skelly Station
Attorney Courtney reported that under present zoning regulaTions, no
commercial or residential uses were permissible in an I ndus'~r I a I
area such as the Twin City IndustrIal Park. The Council requested
t~Qt a copy of Attorney Courtney's opinion be sent to the Planning
Commission.
I :~, Husbv land Purchase
Attorney CourTney reported that the tiTle search has been completed

and the Contract for Deed prepared for Village purchase of The
Husby property. Trustee Bjorndahl moved approval of the Contract
to purchase this property for $11,000.00; $10,000,00 to be paid
on execution of the contract, the balance of $1,000.00 to be paid
on or before December 31, 1966 with Interest of J'$ ,from date of
contract. .Seconded by Trustee Nethercut. Carried. Attorney Courtney
was requested to notify Ramsey County of tax exempt status of this
property being acquired for VIllage purposes.
Robert's Site Plan
Attorney Courtney reported that he had written ~ !atter to Roberts
Developmeni' Co. as requested by the Council, ,

Uniform BulldlnQ Code
Bu i I ding Inspec~or Kelley reported that pp 426-464 of the Uniform
Building Code had been deleted by White Bear because, In their
opinion, some Items were, or would be, covered by Stat. Code and
e others were redundanT. He also staTed that In his opinion there
pages shoUld be Included by Arden Hills; they would be useful to
laymen and would provide a good summary for use by the Clerk's
offrce" Matter referred to Attorney Courtney.
Summons
Attorney Courtney stated that he had received a time exyenslon to
January 12, 1966 to reply to the summons served December 3. Engln-
e~r Roger Short reported on the December 27 meeting on Inter-muni-
cipality storm drainage matters. Mayor Kennedy requested that
EngIneer Short write a letter to Attorney Courtney on the storm
drainage matters related to the summons.
Perry Property
Trustee Bjorndahl Invited discussion and opinions of the Council
and Aytorney Courtney concerning future Village purchase of the
Perry Property. He stated that Mr. Perry might-be Interested In
selling 21 acres (This would exclude the house and lacre of land
from the original proposal). After some discussion, the matter
was referred to the Parks and Recreation Committee for addItional
details on cost etc.
ENGINEER LUND'S REPORT
North End Sanitary Sewer Study
Mayor Kennedy reviewed a letter from Banister Engineering concern-
Ing the advisability of completing a feasibility raport on several
avallaole methods of providing a sewerage system for the northern
portion of the Village. Engineer Short reported on possible sources
of Fesera I Aid for this type of projects.
Trustee Nethercut moved that-Etan-I.s.tel" Eng I_ neer I ng be requested to
complete a study and prepare an engineering feaslblllt9 r~p~rt as
outlined In their December 22nd letter, cost not to exceed $6,500.00.
Seconded by Trustee Crepeau. Carrl~d.
Oak Avenue Sewer
Engineer Lund reported that he Is preparing the fInal estimate for
payment of the Oak Avenue Sewer project. The Council advl$ed Engin-
~ eer Lund that there should be no penalty for late completion since
the Counc II had Instructed MlnnKota Co. to delay completion,

Inspector Kelley reported that e~amlnatlon of the propertIes at
4370 NorTh Snel ling and the old Edgewater MOTel property Indicated
these were_ hazardous. and there_ were grounds for condemnation. -
Trustee Crepeau moved that ATtorney Courtney advise the_ property
owners Involved of the condition. Seconded by Trustee Bjorndahl.

Trustee Crepeau referred a req:uest from the Minnesota Safety Councl I
for an annual ~eport on TraffJ~ Safety Activities to Charlotte McNlesh.

TRUSTEE BJORNDAHL'S REPORT
Skating Rinks
Trustee BJorndahl reporTed That both skating rinks should be open
th I s \1eekend. He also stated That vandals had damaged some of the
hockey boards at the County Road E site, ProtecTive chicken wire
fencing remains to be Installed on porTions of The hockey boards to
safeguard against "flying pucks" etc.
~ MAYOR KENNEDY'S REPORT
County Hlqhway Construction Polley
Mayor Kennedy reported on the new plen to be Instituted concerning
county assistance on highway construction, In order to spread
county funds further, some costs of Improving and constructing
county roads will be borne by The villages or property o.ne~s
ab~ttlng the roads, I.e.. curbing. parking areas etc. The report,
show I ng plans and deta II s. was referred to' Trustee Ne'~hercut.
Board of Appeals
Mayor Kennedy read a portion of an article In a League of Munici-
palities publication on the New Municipal Planning Aci-. The author
stated that the function of a Board of Adjustment or Appeals was
quasi-judicial. Its purpose to handle variances not amendments.
Mayor Kennedy stated he agreed with the author that the Board of
Appeals should be a separate entity and not a sub-committee of
the Planning Commission.
Federa I Recreational Aids
A letter outlining federal aids to recreation was referred TO
Trustee BJorndahl.
CLERK'S REPORT
Licenses for Business Places
Tru~ee Crepeau moved approval of licenses for the following:

Trustee Crepeau moved authorization of payment of claims as attached.

Resignation
Mayor Kennedy read a letter of resignation effective January 3.

tee Nethercut's resignation as Trustee effective January 3. 1966.

Mayor Kennedy expressed his thanks to the Council. Committees.

during the past years.
