Mayor Kennedy read a letter, dated Sept. 13, 1905. from Nilva, ~haw and Frisch, attorneys for the Geo. Indykiewiczes. This letter infor.med the Council that this petition is for a larger area than the previous petition. Referred to Clerk to forward to Atty. Courtney for checking before referring to the Planning Cowmission. Se!vice Station Request A representative from the Standard Oil Co. Wns present and explained to the Council that the reason they are requesting a 50 ft. sign is that the signs al'e made in 30, 40 and 50 f'G. heigh'Gs and the present sign is not of sufficient height. Sanitary Sewer Rates and Charges - St. Paul Attyl Courtney read thnt ~ortion of his letter, dated sept. 13, 1905. relative to hoseviile's invitation to Arden Hills to pass a resolu~ tion SuppoI'ting its action as delineated in Section 115.49 against St. Paul in protest to suburban sewer charges. There was much discussion as to the recourse St, Baul has the right to invoke regarding the withholding of payments. Trustee Crepeau moved, seconded by Trustee Bjorndahl, that a resolu- tion. as attaohed, be Adopted supporting rtoseville's aotion to proceed as outlined.in Sea. 115.49; motion carried. The Council authorized Atty. Courtney to sende letter to Roseville explaining the feeling of the Counoil concerning the withholding of pa Yll1ent . Vessey l.latter Atty. Report No.3 Report No. 3, which'bas been a~roved by the Planning Corumission~ was referred to Atty. Courtney. . ltEPORT OF IDIGR. L~ T.ll. 1O~62 Clerk read a letter, dated Se~t. 1. 1905, from the State Highway Dept. whioh notified us that S.T.H. 10 from Hwy. 96 to County ~oad E and County Road E from its junotion with old Hwy. 51 to Hamline Avenue is no longer needed by the State and will revert back to the Village effective November 1. 1965. . Clerk informed the Council that she had talked with i'llI'. Snykero! hamsey County. The Counoil requested the Clerk to request representsp tion from Ramsey County at the next Coulcil meeting to discuss the possibility of the County taking over these portions of roads. REPORT OF TERAS. WORTH: ltl!:AD Finance Meeting Mr. Read, Ghai~an of the Finance Conwittee, requested a joint meetp ing with the Council to discuss the budget. REPORT OF TRUSTEE NETHERCUT Planning Cqmmlsslon MeetlRg Trustee Nethercut reported that the Planning Commission oequests a replacement for Dr. Bjorndahl and also wiSh this parson to be a I lalson between the Pa~ks and Recreation Committee and the P~annlng CommissIon. The ~ommlsslon felt th~t this appointment should not Include a cheir~~n- ship; however, the obl igatlons at this point ~ra not as great as durIng 'j'he 701 PIOln studies. Civic Center Committee Mayor Kennedy Informed the Council that he beileves that a Committee of three would be sufficient] he felt thtat representation from the PIOlnnlng Commlsslon,'the Parks and RecreatIon Committee and the Council could handle this matter. He requetted recommendBtlons f~om these committees. De Coster Is agreeable to having the VIJlage maintenance, building located as proposed, but would like verification to enable"him to proceed with his plans. REPORT OF TRUSTEE BJORNDAHL Playground Drainage Matter Trustee Bjorodahl Informed the Council that the County has straightened out'the Intersection at County Road F and Hwy. ~! and believes that the ,ralnij9A problem ~t the ~Iayground should be remedied this season. -. ~.~ . P.EPORT OF MAYOR KENNEDY Street Maintenance Mayor Kennedy informed the Council that Tru~tee Olmen and Fred Nixon inspected the seal coating project and are satisfied with the..job",hich was done at a savings of about 4 cents a yard. Trustee Crepeau stated that .the street s\.,eeper is no,,, comple'l;e ,,,itl1 the curb sweeping ataachment. It was used on Connelly Avenue and did a very satisfactory job. Federal Aid Funds Mayor Kennedy r~ported on a letter, dated Sept. 10, 1965, from Mr. Wm. Banister, Banister Engineering Co., concerning .the vario,w Federal funds availa~le for municipal improvem~nts. Variance Requests Don Wilsey Property Trustee Crepeau moved, seconded by TruStee Bjorndahl, that the matter of remodeling a cottage at 1622 Lake Johanna Blvd. owned by Don Wilsey. be referred to the Board of Appeals for report of the detailed construe tic 'details and plans; motion. carried. . . The Board of Appeals in its report, dated Sept. 5, 1965, recommended approval of this request, but the Council felt that plans should be submitted for consideration before action is taken. Garage - 1931 Stowe Avenue Trustee Nethercut moved that the request of M. R. Osterberg be approved, as recommended by the aoard of Appeals, to construct a garage within J' of his property line as the adjacent lot is an unbuild~le corner loc; seconded by Trustee Crepeau; motion carried. Garage - 1857 Grant Road . RESOLUTION RE SEWAGE RATES WHEBEAS, the Village of Roseville, together with certain other Villages in Ramsey County. has negotiated with the City of Saint Paul for adjustment of the contract for the disposal of sanitary sewage wastes, and WHEREAS. said negotiations have not been successful to date, and it is claimed that St. Paul has not cooperated in carrying on said negotiations, and WllEREAS. the Village Council of Arden Hills believes that sewage rates charged to Roseville, Arden Hills and other Villages in Ramsey County are excessive and should be adjusted. and WIIEREAS, t.hecVillage of Roseville has requested a public hearing before the City Council of the City of Saint Paul upon this matter, all in accordance with the provisions of Sec. 115.49 of M1nnesota Statutes Annotated, and . WR1'!RRAR. the Village of Arden Hills is an interested third party in said proceedings under the provisions of said Sec. 115.49 Minnesota Statutes Annotated and desires to participate in said proceedings, NOW THEREFORE. be it resolved by the Village Council of the Village of Arden Hills, Minnesota as follows: 1. The Village of Arden Hills does hereby join in the proceeding instituted by the Village of Roseville under Sec. 115.49. M1nnesota Statutes Annotated, as indicated by Resolution No. 1287 of the Village of Roseville passed August 9. 1965, and requests a public hearing before the City Council of the City of Saint Paul upon the present contract with the City of Saint Paul for the disposal of sanitary sewage wastes. 2.
