Tha minutes of the Special Council Meeting of August 16. 1965, were approved as submitted. Little Lea ue Troph Presentation Mayor enne Y accepte in behalf of the Village. a trophy presented by James Lang which was won b;y- the LitUe League Tigers by winning the local championship and going on to win the 6hampionship of the greater St. Paul area. Mr. Lang Stated that he hoped this trophy would be the first of many. Appointment of Council Member Trustee Crereau recommended that Dr. Rob.t, Bjorndahl, 1171 In~e?son hoad, be consl.dered as a replacement; fur ::i'. Atty, Salland administered the oath of office to Dr. Bjorndahl and Trustee Bjorndahl took his place at the Council table. Mayor ~etnedy then"stated that Trustee Bjorndahl would assume Mr. ~ang's Committee. PUBLIC HEARING Rezonin of NorthWest Corner of Hi "hwa #96 and FAl 35W from R=2 esidential to Co~ercial. Mayor Kennedy dedlared the hearine open and requested opinions pro ~nd con on the matter. Chester Partyka, 4676 Highway #8 - a resident for 18 years. inq~ired as to the exact location of the prOposed rezoning. He and three other persons checked the area as drawn on the map by Bagr. Lund, Trustee Netherout infonned them th~t a servioe station has been proposed for this area. -. Mr. Partyka voiced his objeotions to such an establishment. because of commercial lighting which wC4j.ld bother the residents end alsoGlle possibility of an inadequate buffer zone or screening. Mayor ~nnedy informed the residents that the Planning Commission has recol'nll!ended tha t this al'ea be rezoned COL,.mercial because of the freeway and this would be probably be accomplished in a matter of time. pOssibly wi thin 10 years. A representative from the Phillips ietroleum Co. was present and explained that hecause of the area being located at a prime inter- section, the surrounding property will become muChmol'e valuable for resale for commercial or industrial property. He stated his belief that there is a requirement that lites from the station must be directed on the station. Mayor Kennedy declared the hear:!. nt closed. The Phillips ~etroleum Co. representative submitted plans wnich were referred to Trustee Nethercut. The preparation of the required ordinance relative to this rezoning action was referred to Atty. courtney. Request for Trailer Habitation Warren Hanson requested permission to sleep 1n a vacation trailer to be located on his recently purchased p:roperty at 3191 North Lexington Avenue while he is remodeling the existing house; other facilities are usable in this house. He explained that due to the delay in the sale transaction because of the seller living ou'j; of state, he was not. able to finalize the sale on July 1 as planned. He stated that he is in the construction business .9.nd would have this house remodeled in 60 days. Trustee Olmen moved. seconded by Trustee Crepeau. that permission be granted due to hardship to allow 1ir. Hanson to use the traile"' on the premises through Octobar; motion car:ried. Twin City Trailer Park Mr. Fred Kosslak, owner of the Twin City Trailer Park on View Ave. appeared and explained to the Council that due tc ill hf'aJ.th he has his trailer park for sale, but informed the Council that he is unable to sell the park without permission from the Council to en~ large the areB to accommodate at least 50 more trailers. and would also like to request the Village to vacate View Avenue as it is no longer needed by the Village", Mayor Kennedy explained that permission had been granted five years ago to enlarge the park8 but construction of the freeway made the planunfeesible. Mayor read an excerpt from the minutes of that meeting and also of tne publiC hearing held. Trustee Cre!i'!eau informed the Council that Mr. Kosslak has upgraded tpe property and the police have no problems with the area; he feels Mr. Kosslak is entitled to approval of this request. A resident of View Avenue believes that the street ahould be vacated, but re~uested that the drainage problem in the area should be remedied; matter referred to Trustee Olmen. Mayor Kennedy stated that the COllncil has no aut;hority to vacate View Street without a pUblic hearing, but would look favorably on this if a sketch of the proposed layout were submitted. Mr. Kosslak informed the Council that State laws and regulations are very strict on trailer park layouts. . Trus'Gee Crepeau moved, seconded;by Trnstee Nethercut. that al'proval be given to expand the trailer psrk to accommodate 50 more units, subject to the submission of satisfactory plans; motion carried. Fyten Pr~erty Sewer Matter Mr. and s. John Anderson, purchasers of property from the Fytsns. were present concerning sewer service for their property. Engr. Lund stated his belief tnat the line should be constructed in the st~eet which would involve other property owners and a public hearing; the owners would eventually gain from this improve= mente but would not benefft l~~ediately. He stated thAt about . 100 ft. of sewer line would ha~e to be constructed at an estimated cost of $700=*800. An inquiry from Mayor Ke. nedywas answered by Atty. Sslland. who informed the Couici 1 that the 'improvement could be installed on a private basis if all the owners were agreeable to its construction and the entire cost paid by them; this would require that an escrow be set up so that financing would be available = this procedure would eliminate a pUblic hearlng for such a small project. Mr. Anderson was requested to check with the other property o~ners and report to the Council. Sand Stock Pile = Street Mainten~nDe l<'red Nixon in:E'ormed the Council that he had stockpiled a sand and salt mixture on the McCallum property, but was given 2.~ hours notice to move the pile as the property was sold. therefore, he moved it next to the Village stol'age building. He stated that the placemen t of this stock is a problem as its storage makes the eround sterile for a numbe~ of years. He requested the Council to consider a location for this stock piling. Short reporte thnt the Greeley=Hansen report. 1Il.:ich was financed by seve~al municipalities to sttdy tributary sewer rates, has reported that the St. ~aul charres are 50% too high. The prime contractors to the St. raul sewer system have attempted to negotiate with St. Peul. St. Paul stated that if any chsnEes were made. they would be effective July 1, 19u5. After July 1, ~he prule contractors felt that adequate time had elapsed and St. ~aul still had not come through with a rate change. d3d '1 . . Short reI-,orted that the Gontrol Data rood complies with the requirements as set up by Banister Engineer~ng Go. and is ready for acceptanoe by the Village, but there are a few oorrections to be made. Lund. that the construc.tion specirications of Grey Fox Road and Dunlap S+.reet be carefully checked since no representation from the Village supervised or checked the work during construotion. Fred Nixon informed' the Gouncil that a pOl'tion of Dunlap St.reet is already deteriorating. Area Storm Drainage . Engr. Short informed the Council thafu the Roseville storm drainage program would affect only a small portion of Arden .dills - the southwest portion near County Road D and Cleveland. lie stated that Arden Hills drainaGe problems can only get worse, but he does not believe it is an ~ediate problem. LUND Oak Avenue Problem ~ngr, Lund reported that he and trustee Cl'epea! had met at the Hvidsten property on Oak AVenue to view the unsatisfactory grad~ ing of their property to the street by the road contr!lctor. It was agreed that the steep ['rade made mowing impossible, but to regrade the slope to its original r;rrde co~'ld Cause 'Ghe bss of trees. Clerk Lorraine Stromquist read a letter from Bnchman Landscaping to Bngr, Hendrickson stating their solution to the problem would be to ereQt a 60 ft. long by 3 ft. high dry wall at a cost of $702.00. hngr. Lund explained that the road contrRctor has re- tained ;VIOO-125 for the sodding of tl1i~ pl'operty which cOl;ld be used for b~ckfilling behind the wall and the necessary sodding. Bachman Co. felt that at least one of the trees appeared to be a loss. hngr. Lund recoli~ended a cash settlement which would permit the Hvidstens to make the decision and llould also absolve the Village from any further claiu,s. Major Kennedy was agreeable to this and suegested a payment of $525.00, figuring that possibly a lower estimate could be obtained, if this metnod wes their decision. Matter relferred to l!:ngr. Meyor Ke ,nedy stated that he felt a replacement is not necessary since the 701 Plan is completed Rnd there is no further need for a liaison between the Planning Commission and the Parks and Recreation Committee. REPORT OF TRUSTEll: OLMEN None hEPORT OF TRUSTEE BJORNDAHL . Parks and Reoreation Committee Trustee Bjorndahl reported that a group is meeting with 1w. Husby. Mr. Perry and also Bethel COllege to discuss Possible land acqUisi- tion for recreation. He reported th~t the CO~ittee is considering a skating rink on the playground at County l'08d J;; and Hamline Ave.; this would be a hockey rink for the younger age group and could also be Used for free skating with parking at the dead end of Glenarden R~d. . TrUstee Cr'epeau sum:;ested that pos sibly the La.,e Johanna :B'ire Dept. would consider Cioinf, the prLie flGodlng since it would be a Village pro jec t. Trustee Bjorndahl informed the Council that the civic center study deserves more t1.,.e than the Committee can /!live it and reco;..zr.ended that a special committee for this study alone. becauae of its compleXity, he stated that he would be willing to act as liaison to such a committee. Mayor Ken.nedy informed the Council thf!t it is too late to place a bond issue on this year's ballot and the pUblic should be better informed before this action is taken; therefore. he SUff-eated delaying any further action en land acquisition at this tin.e and reql;ested the COllIlllittee to spend the time on the civic center needs and loc.ation. Trustee Hethe~cut felt the land aoquisitioh matter should be pur= sued to a point and Trustee Bjorndahl feels that small parcels could be purchased f:rom the bUdget or over a few years period with= out a bond issue.
