Village of Arden Hills-
Monday = August 16, 1965
The meeting #as called to order by Acting Mayor tienry J. Cre~eau, Jr.
at 8~00 p.m.

The minutes of the Regular Council Meeting of July 26, 1965, were
appr oved ass ubmi tted.
BUSINESS F1i011 TH.ti: FLOOR
Recreation Concensus _
Mrs. Nan Smalley, Local S~Udy Chairman for the League of Women
Voters, presented copies of a concensus on recreation from the
League and gave a short commentary on it.
Acting Mayor Crepeau thanked the League for this report and referred
the concensus to Trustees Lang and Nsthercut for 00 nsideration and
as an aid in budgeting.
Trustee Lang informed the Council that his Committee has worked
out a program which is in complete agreement with the concensus.
Rezoning Request
Douglas De Coster requested the rezoning from Residential to
Industrial of 3 acres of a 30 acre tract located south of Red Fox
Road and east of Hemline Avenue. Since the area is unplatted land,
Atty. Salland requested r~. De Coster to obtain a metes and bounds
description of the 3 acres and submit this to the Atty's office.
Clerk Lorraine Stromquist re~uested Atty. Sall~nd to inform.her
when this is received.
Fyten Matter
Trus tee Olmen moved, as recoI:lluended by the Board of Appeals. and
seconded by Trustee Lang, that Edw. Fyten, 1137 Edgewater, be
allowed to make two 75 ft. lots from his three 50 ft. lots to
enable him to sell a bUildable lot; motion Carried.
Mr. Fyten stated that Engr. Lund had recoliunended tha t the sewer line
for this property be constructed along the road rather than through
the Fyten property. Acting Mayor Crepeau informed r~, Fyten that
this would necessitate a public hearing as it would involve other
property owners.
John Kelly Property . .
Acting !dayor Crepeau read an excerpt from the flanning Conunission
minutes of July 0, 1905, and Clerk Lorraine Stromquist read an
excerpt from the Planning COmmission minutes of August 3, 1905,
both relatIng to the Ke lley property in the Valentine Court area.
Mr. Aelly stated that he is requesting a building permit to build
a home on a portion of this property to be described by metes and
bounds as he does not intend to plat the area at this time. He
informed the Council that he intends to build the road and sewer
as recommended by the Village Englneer.
There was much discussion b:. the Council. Mr. Kelly and Atty.
Salland concerning a private easement owned jointly with several
property owners. Atty. Salland explained the difference between
a private and pUblic easement, stating that the Village could not
accept the road unless all property owners with easement rights
were agreeable to deeding the easement to the Village.

the placement of the road and was invited to look at the plans
which she did without comment.

Trustee Olmen moved, seconded by Trustee LAng. that the building
permit be issued providing that all other rec;yirements of' the
building code are met, and a 50 ft. road right of way be provided
with 30 ft. of this paved, and also a 50 ft. radius cui de sac
right of way with 40 ft. of this paved; these are to be shown on
a revised sketch as recolunended by the Planning Commission; motion
carried.

Cummings Lane Sewer Contract
Atty. Salland reported that there is a matter of obtainine an
easement before the contract for the Cummings Lane sewer can be
finalized.
Bond Issue Matter
Atty. Salland reported that as per letter from Atty. Courtney,
dated August 9, 1905, more detailed information is needed for
specific answers concernIng the placing of a bond issue on the
ballot. He stated that the language can be general, but the amount
of money must be specific and procedure must be in accordance wit h
the State Statutes.
Rezoning of Southwest Corner of Floral Vrive and Hamline Ave.
Acting Mayor Crepea~ introduced by title and gave the first read-
ing to an Ordinance amending Ordinance No. 18. the Zoning Ordlnance.
to rezone to Residential certain property lying south of Floral
Drive, northerly of S.T.H. No. 094 and westerly of Hamline Aven~e;
seconded by Trustee Lang; motion carried.
Uniform Building Code
Atty. Courtney had submitted several copies of a rough draft of
an Ord~aance adopting the Uniform Building Code, and reconwended
in his letter of August 9. 1905, that the Heating Inspector and the
Building Inspector review the drafts before any action is taken.
Pro osed Rezonin of Northwest Corner of Hw 0 96 and 35W.
tty. Courtney reported in his etter, dated ugust . 1905, tha'~
the necessary material is in order on this matter and the pUblic
hearing date is scheduled for Aueust 30, t9ti5. Ownership report
has been submitted to the Clerk for mailing and publication pur=
poses.

Vessey-Thompson Matter
Atty. Selland l'eported that this matter is still not oomplete. but
believes it will be ready for the September 13, .Counoil. meeting.
Bidf':. Insp. Clay Kelley informed the Counc'il that lIIr. Vessey has
the bUilding permit for his garage and the footings are in. but
no further construction is anticipated this year.
REPORT OF ENGR. LUND ,
(Presented by Clerk Lorraine Stromquist)
Neamy Drainage Matter
~ngr. Lund informed the Council that the State Dept. will check
whether this responsibility is the State's or the Villaee's. He
informed the Council that he will propose a plan to the State to
obtain financial aid.
Siems Court Road Hepair
Engr. Lund reported that Fred Nixon is working on this repair walk.
Acting Mayor Crepeau requested her,r. Lund to contact him.

Oak Avenue Road Improvement Contract
Engr. Lund informed the Council that he wi~l have a report on this
at the next Council meeting.
REPORT OF BLDG. INSP. KELLEY
Twin Cit! Trailer Court Addition
Trustee ang moved, seconded by Trustee Olmen, as recmnmended by
Mr. Aelley, that a building pel:'mlt be issued to allow a 12' x 24'
addition to the utility building at the Twin City Trailer Court;
motion carried.
N.W. Bell Stora~e Garage Building
Clerk Lorraine tromquist read the recommendation from the Planning
Corr~ission, dated May 4, 1965.
Trustee Olmen moved, seconded by Trustee Lang, that a building
permit be issued to Northwestern Bell Telephone Co. to construct
a 200' x 60' storage garage in the Twin City Industl:'ial Park, as
recommended by the Planning Commission providing the setback is
the required 50 ft.; motion carried.
Construction without Permits
Clerk Lcrrqine Stromquist inf'ormed the Council that the County
Assessor's office has brought to the attention of the Villa~e
that an addition to a cOll~ercial establishment and two residences
have been constructed in the Villare without permits. Mr. Aelly
explained how this could have happened and informed the Council
that permits Will-be obtained.
Debris Matter
Mr. AeIly informed the Council that according to Atty. Courtney,
the matter of' debris placed along a fence between two village
residents is not a village matter.
Stephenson Matter
Mr. A.elly inf'ormed the Council that the Stephensoh home on Lake
Johanna is being constructed in a s9tisf'actory schedule; the fine
grading is expected to be done over the Labor Day weekend.
REPORT OF TRUSTEE LANG

Parks and Playground Committee
Trustee Lang reported that this Committee has the services of two
appraisers and will have a report at its next meeting from them
ooncerning proposed recreationsl areas.
Trustee Lang also inf'ormed the Council that he is submitting lists
of' playground equipment, suppliers and a proposed f'orm letter
requesting quotations 8S prepared by member Justin Smalley. He
also submitted a proposed letter to be sent to three specified
f'ence companies for quotations for a portion of the fencing f'or
the County Road F playground. Matter referred to Clerk Lorraine
Stromquist.
ResiFnation ~f Trustee Lan~
Trustee Lang submItted a letter of resignation, dated August 9.
1965. to be effective August 24. 1905, in which he informed the
Council that he has purchased a home in New Brighton and, theref~e.
will be unable to continue as a Trustee fo~ the Village of Arden
Hills. He expressed his apprediation for the opportunity of serv-
ing on various village cOWmittees and as Trustee.

behalf of Mayor Kennedy. the Council and the various Committees
on which he had served; motion carried.

lot on Tiller ~ane and Cannmn Avenue; motion carried.
Roseville Sewe~ Rate Resolution
Acting Mayor Clt'epeau moved. seconded by Trustee Olmen, that action
be delayed unt~l the Sept. 13 Council meeting regarding an invitation
from Rosevillel to withhold sew~r payments to St. Paul until an
agreeable basis for rates 'and charges has been determined; motion
carried.
Copies of the Roseville re~olution were distributed to the Council
and the Village Attorney.
Apportionment of Assessments
Trustee Olmen moved the approval of resolutions relating to
apportionment of assessments relatinr, to Street Improvement No.3
and Sanitary Sewer I.provements Nos. 1.3 and 6, as per attached;
seconded by Trustee Olmenj motion carried.

Sewer Connection without Permit
Clerk Lorraine St.l'omquis~ informed the Council that a situation
has been brought to her attention whereby a sinrle sewer connection
was made to the sanitary sewer system which actually serviced two
residences. A permit was never taken out for the one residence nor
has this property ever bean billed for sewer service.
The Council determined approval should be obtained from both
owners for this joint connection and the one property owner should
be backcharged for services fl'om the time of connection. Matter
referred to the Clerk.
BUdp:et Reports
Clerk Lorraine Stromqllist distributed copies of the Village Budget
Relort through July. 1965. She also again reminded the Council to
submit their estuuated budgets for 1966.
Village Audit
Ulerk Lorraine Stl'omquist reported that the audit of the 1964
accounts was completed last week by the Geo. M. ~ansen Co., and
they will submit a report within 30 days.

as last finally amended and adopted on October 29, 1962, was
filed and certified to the County Auditor of Namsey County on
November 30, 1962 for the purpose of including installments
thereof to be collected along with real estate taxes commencing
in 1963, and

OF ASSESSMENTS RELATING TO SANITARY
SEWE1l IMP1lOVEMENT NO. 6
BE IT RESOLVED by the Village Council of the Village of
Arden Bills, M1lUlesota, as follows:
WHEREAS. the assessment roll for Sanitary Sewer Improvement
No. 6 as last f:l.nally adopted on November 1, 1963, was filed and
certified to the County Auditor of Ramsey County on Decmeber 3.
1963, for the purpose of :l.nclucl:l.ng :l.nstallments thereof to be
collected along with real estate taxes commencing :l.n 1964, and
WHEREAS, s:l.nce that date a number of parcels of property
conta:l.nedwith:l.n said assessment roll bave been divided and
. conveyed by previous property owners, and
WHEREAS, the county Auditor of Ramsey County requires that
apportionment of the origiDal assessment against each orig1nal
tract wbere it has later been divided,sold or conveyed, be made
by the Village Council of the Village of Arden Bills in order

BE IT RESOLVED by the Village Council of the V11.1age of

WHEBEAS, the assessment roll for Sanitary Sewer Improvement
No.3 as last finally amended and adopted on october 12, 1961,
was filed and certified to the county Auditor of Ramsey county
on November 17, 1961, for the purpose of including installments
thereof to be collected along with real estate taxes cClllllll8ncing
in 19621 and

WHEREAS, a hearing on supplemental assessments, reassessments,
and apporticmment of previous assessments in respect to sanitary
Sewer Improvement NO. 3 was held on July 16, 1962, at which time
assessments for Sanitary Sewer :qnprovement No.3 were amended as
provided by said resolution of said date and certified and filed
in the office of the county Auditor of Ramsey county on OCtober 3,
1962, and
WHEREAS, since that date a D'''''........ of parcels of property
contained within liaid assessment roll as amended, have been
tivided and conveyed by previous property owners1 and
WHEREAS, the county Auditor of aamsey county requires that
apportionment of the original assessment aqainst each oriqina1

tract where it has later been divided, sold 01' conveyed, be made
by the Villaqe Council of the Villaqe of Arden Hills in order that
the proper assessment can be extended by the County Auditor aqainst
