Treas. Worth G. Head and Building Insp. Clay Kelley. Approval of Minutes The minutes of the ref,u1ar council meeting of July 12, 1905, were approved as SUbmitted. PUBLIC llli./\.R ING Sewer Improvement #8 and Street Improvement #7 (Cummin~s Lane) Mayor Kennedy informed the residents that these i provements were initiated by the Council and Attyo Courtney stated that the necessary notices were published and sent to the property owners. Mayor Kennedy then requested the residents to voice th"ir opinions and there was no opposition to the improvements. Roger Erickson, 1377 Cummings Lene, and Gerald Skildum. 3419 Glen= arden RoAd. presented similar inquiries concerning detached prOpsl'ty located on low peat groul,d which they felt were nO'G really buildable lots. Mayor Kennedy explained that it WaS the underst~nding of the Council that the detached properties would not be included in the improvements and this WaS confirmed by En!'::r. Donald Lund; l1o':'i= ever Mayor Kennedy informed the residents that if they so desil'edc plans could be revised to include these areas. The l'esidents fel';; they did not want to have service to these properties" Mayor Kennedy de~lal'ed the hearing closed. Mayor stated that bids for the sewer improvement only had been :received at the Village Hall this afternoon. -.. Engr. Don Lund reported that five bids had been received, as attached~ The lowest bid was from Nod1und Construction COo. Alexandria. Minn., in the amount of $14.790.00; however, their bid stated a completion date of Dec. 15. 1965 = the completion date stated in the plans ~nG specifications was Sept. 3. 1965. Atty. Courtney determined trlat this variance was sufficient to disqualify the bid and infol:'meo. the Council that they could either re-advertise for bids OT give the contract to the next lowest biddel', which would be McDonald=Luban & Assoco. St. Paul. Minn., who submitted a bid of 0100032.00. Engr. Don Lund assured the Council that McDonaldQLuben ~ Assoco is qualified to do the work. At this time, John Sellick. Richard OiKelly. Jerome Ti~m and HOWard Wallace. Cummings Lane residents. and Jack Counts. 3272 Snelling Ave.>> appeared. Mayor Kennedy informed these residents of the disQ cuesion being held end asked them to voice their opinions on th8 improvement. .All were in favor of the project, bu'h inquirelil aa ';;0 the area involved. Engr. Proposed Rezoning = Floral Drive Area IVlayor Kennedy stated that although the pUblic hr.aring regarding 'l;h:1.s rezoning had been held on July 12, 1965, anyone present could voice his opinion on the matter. One resident was concerned about the change in property valuation; Mayor Kennedy informed her that this wou~d depend on the type of construction. screening, etc. . Trustee Nethercut informed the Council that the Planning Commission has recommended rezoning because to allow this to remain zoned industrial would be spot zoning; Trustee Lang agreed. . He had sent a letter to the Council describJl!iIg the situation copies of this letter were presented to the Councilo Mr. Sullivan explained that the culvert which was installed during the r~ad improve ment was not placed low enough to carry the water to Hyde's pond as intended. Engr. Lund informed the Council tlwt he is aware of the situation and that at the time of the road improvement a drainage easement Was requested by letter from the Piefer's to permit deepen= ing of' the ditch and different positioning of' the culvert. The matter Was referred to Atty. Courtney when the Peifer's did not respond to the easement request. Matter referred to Trustee Olmen. REPORT OF ATTORN:&.'Y COURTNEY VesseyoThompson Deeds Atty. Courtney informed the Council thpt there is a discrepancy in the legal descriptions of the property involved and the matter has been referred to Banister Bngineering Co. He reported that he has a check from Vessey's attorney~ the check tendered some tiLle ago from the Thompson's will have to be re-issued because of' the time lapse. . Sanitary Sewer Rate Ordinance Amendment Trustee Nethercut moved, seconded by Trustee Crepeau. that the rules be waived and the second and final reeding be given and an ordinance be adopted amending Ordinance No. 53, relating to munfuci= pal sanital'y sewer system. by em.ending the schedule of rates and charges to set standard for charges to be llimposed on private schools>> seminaries, rest homes and similar institutions; motion carr.1ed. y title an ordinance prohibiting the sale beverages or foodstuffs from trucks. wagons sale of milk. cream and allied dairy products the consumer, and imposing penalties for Trustee Crepeau moved, seconded by Trustee Lang, that the proposed ordinance be referred to the Planning Commission for study; motio n carried" _9_ r . , . . Uniform Building Code end Codification of mrdinances Atty, Courtney suggested that the Villafe adopt the Uniform Building Code before accepting the codification of the ordinances; Council agreed. Dunlap St. and Grey Fox Road Atty. reported that Mr. Daubney has requested that the Village accept Dunlap St. Mayor Kennedy recommended thBt acceptance be delayed until Grey Fox Road is also read. &0 they can be considered together since Grey Fox Road is the means of getting to Dunlap St. Engr. Don Lund recommended that the Village re~uest the:ieveloper to have an independent testing lab, run tests to give specifications on the roads to verify that an industrial road has been constructed and also he believes that a drainage problem exists at the interseotion of the roads @ Request for Build~ng Variance Edw, }l'yten. 1137 Bdgewater. informed the Council 'met he has a buyer for a 50 ft, lot which he owns; he proposes to s&ll 25 ft, of h~s adjoining lot on which his house is located - each lot would then have 75 ft. frontages 0 He is requesting that the Village consider issuing a building permit for this Iota Matter referred to the Board of Ap~als. The problem of sewer service for this lot Was referred to Engr, Lund. REPORT OF ENGR. DONALD Lund Neamy Drainage Matter EngI'. Lund stated that he had no report on this problem as the St~te Highway Depto is responsible foe the problem. but he has been unable to make the proper contact. He informed the Council that he will pursue the matter. Oak Avenue Impro vement .l:'ayments Engr, Lund stated that the payments to the sewer contrector is being withheld as the contract has not been satisfactorily completed; there is one item unfinished in the road contrnct. therefore. payment has not been approved. The incomplete item coneerns a bank on the Hvidsten' propa~ty which has not been returned to its original grade and. therefore. is difficUlt to maintain. Grading of the bank to its original slope would involve the removal of trees to which the owner objects. Engr. Lund reported that to correct this grade and remove the trees would cost the Village about $BOOoOO additional. Mayor Ken nedy questioned why this problem was not considered in the plans for the improvement. Engr. Lund stated that he will report on the matter after he has obtained all the facts concerning the matter. Siems Court Problem ~ Washouts Trustee Crepeau moved, seconded by Trustee Nethercut. that Engr, Lund work with Fred Nixon to correct the washout pl'oblems on Siem Court; motion carried. =3", ~. . Kelley repor ed th~'1; the exterior of the Stephenson home on Johanna Blvd. will be completed this week. Weldon Pro per ty Insp. Kelley informed the Council that Don Wilsey has purchased the Weldon property on Lake Johanna and Mr. Wilsey believes he has Council permission to repair same. . Mayor Kennedy stated that the matter had been diacusll'ed~ but no asSUrance was given that per.mission would be granted. Due to the amount of repair work necessary. the matter would have to be cond sidered by the Board of Appeals before a building permit could be issued 0 = REPORT OF FINANCE COW~ITTEE CHAIRb~N = WORTH G. READ Worth Read, Chairman. reported on a me9ting held. the Committee determined that there were not sufficient facts end figures available to give more then a px'e1iIJ.inary study to the mat;ter of land acquisi- tion for recreational pu!>poses at this tiIJ.e. Availability of Federal funds is under study and the entire topic will be given continued study by the Committee. Trustee Lang stated that he felt that appraisals on the recommended sites are necessary. MaYOrKenn~dY informed the Council that he would confer wIth Atty. Courtney on the ma tter. Trustee Nethercut moved. seconded by Trustee Crepeau. that the Finance Committee ~e requested to study possible amendment to the Liquor Ordinance and submit to the Council, motion carried. Nei~hbor Complaint A resident on G1enpau1 Aven e complained about objectionable neighbors renting the house at 1900 Glenpaul Ave. Trustee Cre~eau requested the complainant to call him when trouble arises. Trustee crepeau requested the Clerk to veri~y that the swwer service is actUally connected at 1900 Glenpaul. The owner is being billed. but there is a .question as to whether the 5.nsic~e plmnhins 1s connected. Fire Arms Ordinance Trustee Crepeau reported that more study is necessar.w before this Ordinance is ready for Council action. Police Dept. Trustee Crepeau reported that the Police Dept. has been exceedingly busy with juvenile problems at tie hemsey County Beach area and believes that some aid should come from Ramsey County. REPORT OF TRUSTEE LANG Parks and Recreation Committee Trustee Lang informed the Council that the C~mmittee is preparing a list to submit to the Council on playground eqUipment along with at least three companies who sell this equipment. He ~equested that the Clerk request quotations from these companies for Committee cons ide ration . =4= ,,~ . Road Improvement = Amble Road and Thom Drive Trustee Olmen reported that he had estimates from two eoncerns fo!' the repair of Amble Road and Thom Drive = Hennepin Blacktopping Co. for $1.500.00 and Sinna Contracting Co. for $1.200.00. The second estimate would be for sealcoating only with the Village personnel doing the patch worko The Council ag~eea to proceed with the. improvement. REPORT OF MAYOR KIDiNEDY Audit of 1964 Village Accounts Clerk Lorraine Stromquist submitted proposals from three auditing firms to audit the 1964 Village aecounts. After some discussion. Trustee Crepeau moved. seconded by Trustee Olmen. that the Clerk be authorized to enter into an agreement with the Geo. rtansen Co. for this audit; motion carried. Clerk repor ted that Dr. Farkas Villa('e Health Officer> has recommended approval of granting the licenses. and recommended that the Village require each concern to inform us of their means of disposal. . Request for Side Lot Variance Trustee Crepeau moved, sec aJded by Trustee NetheZ'cut, that a variance be granted, as recommended by the Board of Ap~ a1s. to permit Carl Swanson. 1924 Grant Road, to construct a garage five feet from the east property line; motion carried. Sign Ordinance Matters Clerk Was requested to oal1 the following concerns who have COD= forming signs. but have not applied for licenses this year: Texaoo Station Stewart Lumber Co. Carroll Furniture Co. Edna's Truck Stop. CUMMINGS LANE . WIIEREAS, a Resolution of the Arden Hills Council adopted July 12, 1965 fixed a date for a Council hearing on the proposed fmprovement of Cummings Lane by installation of a sanitary sewer from a point on Snelling Avenue approximately three hundred (300) feet north of the intersection of Cummings Lane and Snelling Avenue, thence extending southerly on Snelling Avenue, easterly on Cummings Lane, and then continuing easterly to a junction with the sanitary sewer on Ramline Avenue, and WIIEREAS, ten days' published notice of the hearing through two weekly publications of the required notice was given, mailed notice was given as required by law, and the hearing was duly held thereon on the 26th day of July, 1965, at which time all persons desiring to be heard were given an opportunity to be heard thereon, NOW THEREFORE, BE IT RESOLVED by the Council of the Village of Arden Hills as follows: 1. CTJMMINGS LANE WHEREAs, pursuant to an advertisement for bids for the improvement of Cummings Lane by installation of a sanitary sewer from a point on Snelling Avenue approximately three hundred (300) feet north of the intersection of Cummings Lane and Snelling Avenue, thence extending southerly on Snelling Avenue, easterly on Cummings Lane, and then continuing easterly to a junction with the sanitary sewer on Hamline Avenue, bids were received, opened and tabulated according to law, and the following bids were received complying with the advertisement: McDonald-Luben & Associates, Inc., $16,632.00 James D. Wolff Co. $16,988.50 $18,564.42 $23,462.00 Lametti & Sons, Inc., R. D. McLean Const. Inc. and WBEREAS, an additional bid in the amount of $14,790.00 was received from Nodland Const. Co., Inc., which bid did not comply with the advertise- ment in that it provided for a completion date of December 15, 1965 and said bid wes accordingly disqualified, and WHEREAs, it appears that McDonald-Luben & Associates, Inc. is the Im~est responsible bidder in accordance with the advertisement, NOW THEREFORE. BE IT RESOLVED by the Council of Arden llills, Minnesota, . as follows, to-wit: 1. The Mayor and the Clerk are hereby authorized and directed to enter into the attached contract with McDonald-Luben & Associates, Inc. of St. Paul, Minnesota in the name of the Village of Arden llills for the improvement of Cummings Lane by installation of sanitary sewer as hereinbefore -1- . ......' .. ~ provided, all according to the plans and specifications therefor approved by the Council and on file in the office of the Administrative Clerk. 2. The Administrative Clerk is hereby authorized and directed to return forthwith to all bidders the deposits made with their bids, except . that the deposits of the successful bidder and the next lowest bidder shall be retained until the contract has been signed.
