~pproval of Minutes
The minutes of the regular Council meeting of June 14, 1905 were
approved as amended; the minutes of the special Council meetIng of
June 21, 1965 were a~proved as submitted.
New Brighton Dairy Queen
Clerk Lorraine Stromquist read e letter from Mr. and Mrs. H, R.
Bernhagen. franohise dealers for Dairy Queen products, located In
New Brighton. Said letter reque sted a license to pel'mit them to msk e
scheduled stops in their franchised area in Arden Millo Which doss
not include the area east of Snelling Ave.
After disoussion. the Council still felt that this operation would
not be desirable in the Village. Mr. Berngagen was prssent and portio
cipated in the disoussion. Atty. Courtney informed the Council that
he will have a draft of an ordinance concerning this type of operation
for the next Council meeting.

REPORT OF ENGINEilli DONALD LlND
Cuo~ings Lane Sewer
Mssrs. Riohard O'Kelly. 1378 Cummings Lane. Jerome TimID. 1400 Cummings
Lane and Donald Selleok, 1399 Cummings Lane. were present and voiced
their concern regarding the delay in the construction of the sewer
improvement project scheduled for early this spring on Cummings Lane.
Mr. O'Kelley .informed the Counoil that he is having sewer problems
and the delay is oostly.
Engr. Lund informed the Council that the sewer improvement project
could be constructed in a couple weeks. but he does anticipate a
problem on the east side of Hwy. 51 because of the peat. He also
recommended that the street improvement be delayed until next spring
to allow for settling. Engr. Lund stated that the fessiThility report
has been submitted to the Council. but it does not include the cost
of the additional roadway.
Trustee Crepeau moved, seconded by Trustee Nethercut, the adoption
of a resolution, as attached, di!ecting the Banister Engineering Co.
to prepare plans Bnd specifications for.sewer and street improvement
for Cummings Lane and have them available for the regular Council
meeting-~f July. 12, 1965; motion carried. After some discussion.
the Council determined that a public hearing date will be set at the
'meeting of JUly 12, 1965.

Mr. O'Kelly thanked the' Council for its consideration and Mr. Timm
requested that since the street improvement project will possibly
be delayed. that.Fred Nixon fill the holes on Cummings Lane.
Playground Dr&1na~e
Engr. Lund SUbmit ed a map showing the existlng drainage faoilities
on the playground at'County Rood Fand Snelling Ave. and a proposed
covered line to run adjaoent to it, which he believes will be the

solution to the problem. He also submitted an estima-i;e of ~:;2.000 for
material only with the Villare furnishing the labor.
Trustee Nethercut reoo"mended that the project be delayed for about
a month to enable the Little Lakes Little League to complete the
season. Fred Nixon stAted that this would be better timing for him
also. Trustee Nethercut moved, seconded by Trustee Crepeau. that the
matter be referred to Trustee Lang and the Parks and Playground Corom.;
mO-Gion carried.
Chan~e Order No, 1 = Oak Avenue
Cler Lorraine Stromquist read a letter. dated June 21. 1905. from
Engr, Lund which described the work covered in Change Order No, 1.
Trustee Crepeau moved. seconded by Trustee Nethercut. the approval
of Change Order No, 1. Oak Avenue Street Improvement, in the amount
of $787.86 to be paid to Bituminous Roadways. Inc, for the repair of
settled sewer trenches; motion carried.
Clerk LLrraine Stromquist also read a letter. dated June 24. 1905$
from Minn=Kota Excavating, Inc, to Atty, Courtney, which stated that
they felt the deduction of this amount from their contract amount wes
excessive and unjustified.
REPORT OF ATTY, COURTNEY
Vessey=Thompson Matter
Atty, Courtney reported that Mr, Jmmes. attorney for Alan Vessey, had
informed him by letter. th~t Mr. Vessey has now agreed to give the
two easements desired by the Village.
Clerk LorTaine Stromquist informed the Cour.o:U that Mr, Thompson is
concerned with the placement of the garare l~, Vessey pToposes to
build on the lot he intends to purchase from the Village.. ~he also
informed the Counoil that this matter had been before the Board of
Appeals and in the minutes of the meeting of May 30, 19~~. the Boa~d
recommended the issuance of a building permit with reasonable variances.
The Council deoided that the matter will be heard at the Council meetQ
ing of July 12, 1965. and request Mr, Vessey and r~, Thompson to
appear and Mr. Vessey to bring his plan for the garage.
Rezoning of Property South of Floral Drive
Trustee Nethercut moved, seconded by Trustee Crepeau, that the publi@
hearing date be set for July 12, 1965, for the rezoning of property
south of Floral Drive and west of Hamline Avenue. and directed the
Clerk to CaUse the publication and mailing of notioes. motion carried.
Atty, Courtney to furnish the Clerk with the ownership report for
notices to be sent on July 1, 1965.
2Q14 Thom Drive
Atty. Courtney informed the Council that Mr. Jos, Tracy, attorney for
the estate at 2014 Thom Drive, has assured him that if this property
is not sold in the very near future. corrective action will be taken;
if the property is sold, the purohaser will be advised of this oommitt=
ment.
Mr, Kelley. Buimding Inspeotor, reported that there ire no grounds
for condemnation as the house_is__ s.tl'llctural.-ly sound and the!'6- ,is 110
danger of it COllapsing.

Little Lakes LlttleLeague
Trustee Lang moved, seconded by Trustee Crepeau, authorizing the ]fuyor
and Clerk to execute the contract between the Village and the Little
Lakes Little League; motion carried.
Mounds View Athletic Ass'n
Trustee Lang explained that the M.V.A.A. cannot meet the insurpnce
requirements to enter into a contract with the Village this year.
Atty. Courtney informed the Council that he believes tha.~ the purchase
of equipment for its use cannot be done legally.
Uniform Building Code
Matter rei'erred to Clerk to determine t he status of the Uniform
Building Code.

Nordin Rezoning Request
Trustee Nethercut moved. seoonded by Tl'ustee Crere au. tha'G a letter,

Snelling Ave. and County Road F Intersection
Trustee Nethercut requested the Clerk to contact the ham~ey County
Highway Dept. andinquire as to when it intends to resmme work at this
intersection as the playground projeot is dependent on it.
REPORT OF TRUSTEE CREPEAU
Fire Arms Ordinance
Trustee Crepeau moved. seconded by Trustee Nethercut, that the second
reading be $iven to an Ordinance relating to the discharge of weapons
and the use of other dangerous devices. regulating the use thereof.
providing for speCial permits in specified cases, and providing pen=
alties for violations; motion carried.

Playground Project
Trustee Lang reported that the backstop on the playground at County
Road F and S:enlling Ave. is being installed.
REPORT OF MA'YOR KENNEDY
street Sweeping
~~yor Kennedy stated that many complaints and comments have been
received from Village residents concerning the inad~quacy of the street
sweeping. He :requested that Fred Nixon. ~aintenance Dept., cons ide!'
the matter and determine if the sweepe:r attachment is the correct one
for the job.
The matte!' of a wash=out on Siems Court was referred to F:red Nixon
for repair.

Trustee Lang moved, seconded by Trustee Nethercuti. thot the rules be
waived and the second and final reading be given to an Ol:dinance
amending Ordinance No. 85 to substitute the 1964 safe.GY code for
mechanical refrigeration as the standard for mechanical l:'efl:'igeration
systems; motion oarried.
Request for Sewer for Trailer Court
Clerk Lorraine S'Gromquist informed the Council thnt Ml'. Fred Kosslck,
owner of the trailer court on Highway No.8, had inquil:'ad as to tho
possibility of having sewer facilities installed for the trailer court;
if this is not feasible. then he will consider clearing "Gl-le trail'31'S
and selling the property for industrial use. Trustee Crepeau stated
that the area is too difficult for sewer installation.
Trustee Nethel:'cut informed the Council that this area is designated
as general commercial in the Comprehensive Plan. The Council felt
this to be a more desirable use of the land and referred the matter
to TrusteeNethel'cut 'GO contact Mr. Kosslak and suggest th."t he
appear belore the Planning Commission.
19bo Budget Figures
Clerk Lorraine Stromquist rer<uested that figures for the HJ66 Village
budget be submitted by August 1 for preparation of the budget by the
Clerk with study by the Finance Committee to follow. She informed
the Council that the Finance Committee has scheduled a meeting
for July 14 at which till.e 'Ghey will consider val'iol1s plans for
:Pinancing proposed land purchase as recommended by the rJ L.~~.
