Trustees Nethercut, Crepeau: Olmen and Lang. Absent ~ None Also Present 0 Administrative Clerk Lorral~8 Stromquist. Atty. Vincent P. Courtney, Engr. Donald Lund. ,Building Inspector Clay Kelley and Treas. Worth Go Haad. ~ . The minutes of the Regular Council Meeting of May 24, 1965, were approved as submitted. Dairy Queen Request ' . Dairy Queen of New Brighton had requested permission or a license to operate a mobile unit in the Village to sell packaged products, no representatio!:).f.l;'Qm llairy-,Queen was present at the meebing. Atty. COU.'Ptney reported that, it\would be possible to issue such a license under Ordinance No. 12. but, in his opinion, the safety factor should be studied by the Police Dept. He also informed ~.e Council th"t St. PaUl has a specific ordinance for ice cream and confection t~uckso Village Ordinance No. 12 would not provide an opportunity to check where the food is prepared when the vendor is mobile. Mayor Kennedy read a letter fIOm the Village of hoseville which informed the Council that it is considering an Ordinance to control mobile vendors. and is interested in the method to be used by Arden Hills. ".. Mayor Kennedy stated that he does not believe it the best way to Dsll merchandise, that the unit would naturally spend most or the time at the beach area which already has a traffic problem, that a concession stand is already located there wnich is apparently adeqUate. He is in favor of an ordinance prohibiting such vending. Trustee Crepeau agreed with Mayor Kennedy regarding B p~ohibitive ordinance. because of the anticipated traffic hazard and the debris (paperSg sticks. etc.) whioh would be discarded in the area. Matter referred to Atty. Courtney to draft an Ordinance as suggested by Mayor Kennedy. Storage Building Complaint Paul Kazek. 3223 ~ake Johanna Blvd.. was present and enumerated five complsi nts concerni:lg the maintenance of the area surrounding the village owned storage bUilding, such as road equipmentD sand barrels. etc. He stated that he had complained about the situation several times to Clerk Lorraine StromqUist. Trustees Lang and Olmen and that the oondition at this thle 1s satisfactory, but his purpose for appearing at this Counoil Meeting is to request assurance that the area will continue to be kept in an orderly manner. Discussion by Mr. Kazek. Trustees Lang and Olmen WaS carried on during which time Mr. Kazek was informed that future plans of the village are to provide adequate storage faoilities in an industrial area. After thrity five minutes of disoussion. Mayor Kennedy stated that sufficient time had been spent on the matter and informed r~. COURTNEY Vessey Mat'te:r Atty. Courtney reported that he had received two documents from Mr, James. Atty. for the Vesseys, which would give Arden Hills the sewer "IJasement on Lot 19 and also a drainage 8eseme n'G. . Attyo Courtney reminded the Council -that the -two o.thel' easements for snow piling should be obtained as previously determined from the '\l'esseys before the Village owned prope:roty is sold 'GO them. Mr, Vessey info:romed the Council that he has agreed to give the Village -the coZ'ner easement. but he Was not aware of the second easement request although Atty. Courtney stated that the matter had been discussed with him. Matter referred to Atty~ Courtney to discuss the location of the second easement with Mr. Vessey. Ordinance' No. 85 Amendment ~rustee Lang moved, seconded by Trustee NetheZ'cnt. that an amend- ment to Ordinance No. 85 be introduced by title and given its fiZ'st reading to substitute the 1964 Safety Code for mechanical refBiger~ ation as the standard for meohanical refrigeration systems,emotion carried. Zoning Matters Continental Oil Co. Atty. Courtney reported that the re~uired papers retarding the Z'equest to rezone from residential to commercial the no~theast coZ'ner of Hwy 96 and 35W to allow the construction of a Conoco Service Station are in confo~ance with Ordinance No. 60. Trustee Nethercut stated 'Ghat -the Planning Commission l'8commends denial of this request as the area is zoned Nlsidenthl in the Comprehensive Plan. Matter and material referred to Trustee Nethercut to inform Continental Oil Co" that the Council supports the Planning Con~ission's recorumend2~ tion. but a pUblic hearing would be scheduled if they so desire" . Phillips Petroleum Co. '.I!rus 'Gee Nethercut informed the Council th,r t the Planning Commission has not completed its study of the rezoning request for the north- west corner of Hwy. 96 and 8 to permit a Phillips Servlce S.tationo Atty. Area South of F'loral Drive Mayor Kennedy stAted that he is in agreement with Atty, Courtney that action on any rezoning should be a part of the proposed rezoning plan. Trustee Nethercut informed the Cound 1 that the Planning Commission recommends that Public Hearing be ~cheduled ?s soon as possible on the rezoning from ~tl~>Wl to ~.Ai'\3~IiLof the aZ'ea south of Floral Drive and weet-ofHamline Aven'le. The matter will be discussed further at the joint Council and Planning Commission meeting to be held June 210 Non~Conforming Signa Clerk Lorraine StromqUist informed the Coureil of an inquiry regard= ing the rebuilding 01' non-conforming signs aftsr they have been blown down. Atty, Courtney Buggeeted that possibly an amendment to the Sign & Billboard Ordinance should be considered; Mayor Kennedy did not think thie necessarYD in his opiniollD such a sign would be rebuilt only if B contract were involved. Also referred to the Atty. the matter of an open cisterna 4 feet in circumference. on the C. G. Rein property on Lexington Avenue~ south of County Road E. The house which was on this property was destroyed by fire by the Fire Dept. REPORT OF ENGR. DONALD LUND Neamy Drainage Matter Engr. Lund reported that the ponding area on the Ne~my property, 3171 N. Lexingmn Avenue. is a pl'ivate matter and not a Village responsibility. Mr. Lund informed the Courcil "bhat the sewer construction across the Neamy property is not the cause of the ponding, but believes the condition is due to the construction of a home next door. BUilding Insp. Clay Kelley informed the COUncil that drain tile had been installed by the owner of the new home to carl'y water to Lake Josephine ~ perhaps tILls tile needs cleaningo Clerk to so inform Mr. Neamy of the Engr.'s determination. County ROad E2 Sewer Assessment Clerk read a letter, dated June 7, 1905. from County Engineer Deane Anklan stating a sewer assessment was reapportioned to the property after the County aCQuired the l'ight~of=way for County Road E2. He stated that he belives that since the sewer os of no benefit to the County. the Village should make other ?rrangements for collecti@n o~ 'bhe remaining *,102.00 of the original :jj;120pOO assessed. Council requested the Clerk to write to the County Engineer and inform hi~ that the assessment is justified and, therefore. should be paid by them. Cumminp;s Lallie Engr. Lund informed the Council th~t he had talked with Mr. ~icksono Cummings Lane. who informed him that a 30 foot strip would be more favorable than a cul de sac at the end of Cummings Lans. Mayor Kennedy and Trustee Crepeau had also inspected the site and agreed. Referred to Engr. Lund to obnain legal descriptions and ownership l'eports on the property necessary to aoquire for construction of the strip. Playp;roUllld Drainage Matter Engr. Lund. informed the COUncil of two solutions to the drainage problem on the County Road F playground. He stated that a problem exists beCause the property is quite level. ~ngr. Lund suggested a 6 inch corrugated ditch or a series of covered graduated pipes to channel the water to the County ditch. Mayor Kennedy and Trustee Crepeau eliminated the open ditch aolutien because of the safety factor, but referred the alternate method to the Engineer fol' further study. =3= . . ~ Page Po~ t>~. Minutes oZ Regulnr Council Meeting JtUl(J l~}, 1965 REPORT OF BUILDING INSPECTOR CLAY KELLEY Thom Drive Area Mr. Kelley infonned the Council that he had checked the addition to the house at 2015 Thom Drive ahd reported that a building permit WaS not required as the cost was less than ~35.000 He told the Council that the location of the lot line would ~ve to be verified to de~ termine if there is a violation to the Building Code regarding the side lot reQuirement which he will pursUe. Mr.' Kelley informed the Council that he intends to check all the Thom Drive properties for viOlation of the Building Code. Stephenson Matter The bUi~ding plans for the stephenson home on Lake Johanna Blvd. were checked by Mr. Aelley, Mayor Kenaedy and Trustee Crepeau and they agreed that the plana oonform to the Ordinance. Mr. Kelley informed the Council that he is Satisfied that adequate financing 1'01' the construction is available. Mayor Kennedy sta.'GEJd tha't Mr. Stephenson was warned that any nOn=conform~nce to the code will result in red tagging of the property. Industrial Building Permit Trustee Nethercut moved, seconded by Trustee Crepeau. that a bUild~ ing permit be issued. as recommended by the Planning Commission. to allow the construction of two warehouse type buildings as per plane sUbmitted; motion oarried& Mr. Roberts and Mr. Daubney were present; Mr. Roberts stated that he will submit a landscaping plan for the four warehouse buildings. Mr. Daubney informed the Council thot Grey Fox Rond will soon be ready for dedication to the Village. REPORT OF TRUSTEE NE.'THERCUT 701 Plan Trustee Nethercut reported that only one more Planning Commission meeting will be held u~der the 701 Plan with Cerl Dele attending. He infonned the Council that the Planning Commission would li~e Mr. Dale to continue his servioes to the Village at an estimated cost of $150.00 per month; he informed the Council that adequate funds are in the budget to pay for this service. REPORT OF TRUSTEE CHEPEAU Trustee Crepeau reported that the dog problem appears to be under control and the usual influx of heavy summer traffic is .apparent 0 REPORT OF TRUSTEE LANG County Road F Play~roU~d Trustee Lang reported that he and Roy Anderson had staked out the position of the backstop for the balLfield at Coulty Road F and found that the fencing to be installed would be se~eral feet short on both sides. He informed the COUncil that the contractor. Minn. Fence Coo. has agreed to install a fence of adequate length at an additional cost of $219.00 which they would bill the Village under a separate contract. Referred to Trustee Lang to cheek with Atty. Courtney for oorreot prooedure. REPORT OF TRUSTEE OLMEN Street Sweeping Fred Nixon. Maintenanoe Dept., has decided to use the street sweeping equipment between 5 a.m. and 8 a.m. to avoid the dust complaints from the residents. He ieformed the Council tha t due to the heavy accumulation of sand on the streets. it is necessary to sweep each street more thae once for satisfactory removal. -4~ . . ., . Minnesota Municipalities Mayor Kennedy read a latter from L.M.M. inviting the Mayor and the Coullcil to attend the three day Minn. MayOi'S' Convention start= ing on June 17 at the Top of the Mark Hotel, Moorhead, Minn. Council members were requested to contact the Clark for meservations. Variance Matters Clerk distributed copies of ,the BOard or ApJ;E als recom~endation3, dated June 1, 1965, to the Council. Building Variance Request - Brodowy Trustee Lang moved, seoonded by Trustee Nethercut, that Gene Bl'odowy be allowed to construct a house on his lot on Lake Lane, as recommended by the Board of Appeals, providing it is placed no nearer to the lot line than the adjoining homes; motion carriedo Service Station Si!nS ~he Board ot. Appsm s reoommended that s~gns at the Texaco Station, County Road Band Hwy. 51. and the Standard Station, Hwys. 96 and 88 which are over the maximum height o~ 16 ft. be made to conform to the Ordinance. The Council decided not to take any action at this time as regulations concerning this type of sign are being studied by the Planning Commissi6n. 1622 Lake Johanna Blvd. No Council action was taken reg~ding a request from Don Wilsey, 1947 W~ County hoad C, to allow him to remodel a cottage on Lake Johanna if he purchases the property. Trustee crepeau informed the Council that one buyer is interested in purchasing tl~ee lots and demolishing the cottages, including the one at 1622 Lake Johanna Blvd.. and construc,ting one house.
