Olman and Lang. Also Present", Administrative Clerk Lorraine Stromquist, Atty. Vinoent P. Courtney, Engineer Donald LundJ Building Insp. Clay Kelley, Heating Insp. Virgil Keller. Absent '" None The minutes of the Regular Council Meeting of April 26, 1965, were approved as amended. Time Change Matter As advised by Atty. Courtney, Trustee Lang moved that the Village remain on Standard Time to comply with the state statute; seoonded by Trustee Crepeau; motion carried. Request for Rezoning DoUglas De Coster presented a latter, dated r~y 10, 1965, which con= tained the legal deac~iption of tha property which he requested to have rezoned from" residential to commercial at Hi&~ways 8 and 96 to allow the construction of a Phillips service station. He also sub= mitted a preliminary layout and a hignway map showing ~~e site. n~Q DeCoster was requested to send in a certificate of ownership to Atty. Courtney. Matter referred to the Planning Commission; Clerk requested to send maps and a copy of the latter to Carl Dale for perliminary study before the June 1 Planning Commission meeting. REPORT OF ATTY. VINCENT P. COURTNEY Gray Fox Road Atty. Courtney informed the Council that he had been unable to contact John Daubney ooncerning the status of Gray Fox Road, but hoped to have a report for the next council meeting. Unfinished BuildinRs Matter As reqUested by Mayor Kennedy, Atty. Courtney checked the Ordinances and reported that there is nothing in the Zoning Ordinanoe concerning unfinished buildings; however, Ordinanoe No. 37~ an amendment to the Building C~dep states that buildings must be completed within one year of the issuance of the permit. If the building inspector deter= mines that a hazardous condition exists. then action could be initiated i~ediately. Matter referred to the Clerk. Sewer Rates Ordinance Amendment Trustee crepeau introduced by title and give the First Reading to an Ordinance amending Ordinance No. 49 relating to the municipal sewer system by amending the schedule of rates and charges to set standards for charges to be Lnposed on private schools. seminaries. rest homes and similiar institutions and providing for interest charges on delinquent sewer aocounts; seconded by Trustee Lang; motion Carried. Fire Arms Ordinanoe Clerk Lorraine Stromquist informed the Council that ~~. Sokalak of the State Game and Fish Division stated that the Ramsey County Ordinance prohibiting the discharge of fire arms in the County is being dvopped. The matter of a Village ordinance to cover this subject WpS referred to Atty. Courtney. He informed the Council that the improvement would consist of 1,115 front feet for sewer snd 730 front f'eet f'or street; that the property owners have already been assessed ~i2.50 under improvement no. 3 Qnd .60!i under improvement no. 1. The sewer line is already laid under the freeway for this improvement. Lund to check a drainage problem at the playground at County ROad F and Snelling Avenue. Trustee Lang i~= formed the Council that topsoil and seedling grass is being Washed aWay. Polioe Officer Resignation Trustee CrepeaU moved, seoonded by Trustee Olmen, that the resignati~n of Police Offioer Donald BeaUbienD 1823 Gramsie Road, be accepted as of' May 7D 1965; motion Oarried. Tornad@ Cooperation Mayor Kennedy moved, seconded by. Trustee Lang. that the Village pay Fred Nixon and the Village Police Dept. for time and/or equipment for assistance 1n the tornado area on May 7D in the event they are not Paid f~om another souroe; motiop carried. Trustee Crepeau reforted that all the surrounding Villages police of'ficers cooperated during the tornado emergency and the Arden Hills ' polioe made five trips to Bethesda Hospital with injUred people f~om Mounds View. Jailin~ of Prisoners Clerk orrsine Stromquist resd a letter, dated May 3, 19b5, from the County AUditor's offioe whioh oontained a resolution stating that hamsey County would oontinue to inoaroerate and maintain prisoners for the Village of Arden .lUlls. , POssible Health HaZard The matter of a oompost pile composed of materials which result in a health hazard was discussed by the Council. Atty. Courtney advised that if Dr. Farkas, Village Health Off'lcerD believes that a health hazard exists. he has the authority to inspeot the property. Matter ref'erred to Atty. Proposed Zoning Maps Trustee Nethercut Informed the Council that included in the cost of the 701 Plan we a1'e to receive 450 proposed zoning maps with a su~rnary on the reverse side. The Coulcil felt that will be a sufficient quantity. and l'ecommended that they be available at the' Village ,Hall for interested parties. Mayor Aennedy suggested 'i:;hat befol's the maps are prin'ted. Mr. Dale be requested to submi'i:; a list of reasons fol' any reconmlended rezoning for Council 00 nsiderfltion and olso fOl' ;,oity. Courtney's opinion. Trustee Nethel'cut informed the Council that the completion date oIthe 701 Plan is June 30; Mayor Kennedy requested Trustee Nethercut to 8sk Carl Dale if the printing of the maps could possibly be done aftsr this da'te. Y.M.C.A. Site Mayor Kennedy requested the Clerk 'GO send a letts:" 't;c the Northwes':;er!l Suburban Y.M.C.A. offering them the assistance of the Council and the Parks and Recreation Committee in their effort to locate a site for a bUilding in the area and suggesting tha't 'they contact T.:"us.tee Lang or Dr. BUorndahl for this assistance. REPORT OF TRUSTEE LANG Recreation '.I;rustee Lang requested the Cler: to check with C8rl Dale on whe'i:;hGl' any maps are available designating the pedestf<ian 'trails as the Boy Scouts are interested in this stUdy. Trustee Lang reported that the Parks and Recreation COrr@ittee toured the Village looking at rec1'eational sites as proposed by Carl D6le and wIll submit a complete report of their opinions l~ter. Trustee Lang x:eques'ted the Clerk to check 'the ownership of the lJl'Oper'ty as checked by the Committee and he will check the costs. REPORT OF TRUSTEE OLlVlEN None . Repo1't of Mayor Kennedy Annual Weed Inspection Meeting Mayor Kennedy inf~ed the Council that Fred Nixon was attending the Annual Weed Inspection Meeting which is required by laW. Village Planning The Council recommended that the Finance Committee schedule a meeting for preliminary study of the financing for the purchase of proposed recreational sites and also sites for the storage building and village hall;'Trustee Nethercut recommended if the Finance Committee determ~nes the financing be done by bond issueg it should be on the ballot this fall. A joint meet ng of the Finance Committee and the Parks and Play= grounds Committee will be scheduled after prelimina1'y separate meetings. Budget Reports Clerk Lorraine Str~lquist distributed copies of the budget report through April to members of the Council. Variance Request As recommended by the Boprd of Appeals, 'l':rus'bes Nethel'Cl!-C mcived~ seconded by Trustee Lang, that a setback werlance to allow the construction of a house on an undersized lo'b on Lake L3ne be denied; motion carried. The Council agreed with the Board of Appeals that the setback requirement could be adhered to with a diff3rent house plsl1b and requested the Cler{ to so inform the Spring Co.. ~ho requested the variance. ' REPORT OF BUILDING INSPECTOR CLAY KELLEY . Storm Damage Mr. Kelley ihi'ormed the Council ths'l; he had only one l'Opozot of '-stQ~'m damage in the Village. Possible Building Condemnation Clay Kelley reported that he is checking a house on Thom Drive for possible condemnation. ~ortsmen's Club Building . Danielson of the Arden Hills Sportsmen's Club has contacted Clay Kelley regarding the status of their building plans. Stephenson Matter Mr. Kelley informed the Council that Mr. Stephenson has cleared the debrJ from the site where his home was burned and is now ready to start con~ struction of a new house. As recommended by Mr. Kelley. Mr. Staphenso~ agreed to erect a safety bar:ricade; Mr. Kelley also recommended that Mr. Stephenson contract to have this house built rather than doin@ the construction himself. p.mo ~~ D. F.
