These planE h8d pre~ viously be given by Clerk Lorraine Stromquist to ~ngr. ~on Lund for study. There was discussion regarding the varied widths proposed snd the walkway on both sides of the road. Floyd Snyker informed the Council that conduit is to be placed for future sigsals at tho intel:'ssc,tion of County Road D and Fail:'view Avenue. Trustee Crepeau moved. seconded by Mayor Kennedy, the adoption of a l'esolu"l;ion, as attached, approving the plans; motion C:::'l'l"ied. REPORT OF ATTY. VINCENT P. Ordinance No. 18 Amendment Mayor Kennedy moved that an Ordinance amending Ol'dinan~o No. 18. the Zoning Ordinance. be introduced by title and given its first read~ ing, to rezone Lot 2, Block 4. Shady Oaks Addition. according to the 'plat thereof on file and of record in the office of the Register of Deeds of Ramsey County from Commercial to Residential; seconded by Trustee Nethercut; motion carried. Ordinance No. 76 = Si n and Billboard Ordinance Amendment Mayor Kennedy move that an Or inance amending Ordinance No. 76 to prescribe penalties for violations. be introduced by title and given its first reading; seconded by Trustee Olman; motion carriedo Circle S Ranch Si~ns Atty. Courtney in ormed the Council that he had written a letter. delivered by certified mail. to the Circle S ~anch snd received no answer. Clerk Lorraine StromqUist stQted that representation froill the Ranch appeared prior to the Council meeting stating that they will remove the signs tomorrow. and inquired if the sign ordinance affected their signwhioh is painted on the roof of one of the buildings. Trustee Nethercut requested the Clerk to have this ch8cked@ Council decided to take no aotion on the roof sign as it is not visible from ground level. Cummings Lane Sewer & Road Improvement Atty. Courtney reported in his letter, dated April 26, 1965, that even though this improvement is smell. the assessment procedure il!lWt be followed as set up by State Statute. He informed the Council that several small improvements can be paid from the General Fund and this refund shall be repaid at a later date from the assessment fund for the improvement. A group of such improvements may be covered by one bond sale. Trustee Crepeau moved the adoption of a resolution. as attached. ordering the preparation of an Engineer's feasibility report on the improvement; seconded by Trustee Lang; motion carried. DONALD LUND Gray Fox Road Engr. Lund reported that Gray Fox Ro~d is constructed on D State drainage right of way; he has checked with the state 8~d was info~med that the State has no intention of maintaining ito I'h was built by' the developer of the Twin City Industrial Park. but has not as yet been t;urned over to the Village. Atty. Courtney aaid that Mr. DaL1bney had told him that the state is willing to release it so it can be dedicated to the Village. Matter referred to Atty. Courtney to checko Control Data Road Atty. Cour'Gney inquired as to the status of the road '!Thich was b0".ilg constructed by Control Data on their property and then was to be turned over to the Village. Mayor Kennedy informed him that the road is not yet completed and that Roger Short haS wl'itten to '1:;h'3 contractor to assure Village inspection of the road construction. Northwestern Bell Telephone Co. Request Bngr. Lund recommended that the Village comply with the ref'luest r:,f the N.W. Bell Telephone Co., as suggested in their letter, dateu March 23, 19t;5. and attach a sticlrer supplied by t,hem 'GO all pe,,;,).te: granted for excavation work. Lund reported that the state of Minnesota, Dept. of Health. has written a letter, dated April 12, 1905, with an attachment from the Minnesota Water Pollution Control Commission and their permlt no. 508, apprOVing the plans for the sewer construction on the Bethel property ~ no oouncil action necessary. Clerk Lorraine Stromquist informed the Council that Bethel Colleg& had requested an estimate of their sewe~ rate charge. The matte~ had been referred to Bngr. Don Lund. who with Roger Short studied the Ordinance and decided that we really did not have a method for determining suoh a charge, but submitted a proposed method which Clerk Lorraine StromqUist read. The proposal was based on two charges - the meter size and a specified no. of gallons of wate~ usedoy residents according to classification as detailed in th~ letter. The O&dinanoe was referred to Attyo Courtney for stUdy" Delinquent Sewer ACCOUnts Clerk Lorraine Stromquist requested the Counci)~ to consider sn amend," ment to the Sewer Rate and Charges Ordinance to allow a penalty charge to be made on aocounts which are certified to the County Audi'Gor for collection. She mentioned that one industrial establish" ment has not paid any monay on their account since they oonnected to the system in October, 1963. The Counoil discussed a penalty of 5 - 6% after 45 days. Clerk requested to send a thank you letter to Centill'Y Fence for submitting a bid. Trustee Lang said that Roy Anderson will stake out the placement or the backstop. Trustee Lang s'Gai;sd 'Ghilt Mrs. Langer did not have a report concerning the library study at their last meetingo REPORT OF TRUSTEE OLMEN Church Bulletin Board T:rustee Nethercut moved. seconded by Trustee Crepeau, that a variance be granted to Ordinance 76, Section 2. Paragraph b. to allow the second bulletin board to remain at the Trinity Lutheran Church on New Brighton Road. motion carried. Equipment PurChase The Council agreed that the Village purchase a street sweeper of the type that can be attached to the tractor owned by Fred Nixon. Said sweeper to pick up rubbish and also load ito Street Signs .I!':red Nixon repor'Ged that Scotchlite street signs are obtainable in g:reen only and the cost is no more than our present signs, except that a different bracket must be purchased as the new signs will be smaller '" cost of the bracket $2.00; cost of the new signs $10000 for cach inter~ section. . The Cou~cil agreed that a program be started whereby all street signs needing replacement be replaced with scotchlite signs. United Nations' Day Mayor Kennedy read,a, let1!er from President Johnson requestdl'1g the Village to start to make plans for U.N. Day, October 24. and requested the name of the Chai~an so instructions can be mailed to him. Matter referred to Clerk to contact the L.W.V. Proposed Zoning Regulation Book. Mayor Kennedy said that he had read through the proposed zoning regula~ tion book and believes that the Flanning Commission should study it before involving the Cour.cil. RESOLUTION ORDERING PREPARATION OF . REPORT ON IMPROVEMImX OF CUMMINGS LANE WHEREAS, it is proposed to improve Cummings Lane and certain adjacent properties by installing a sanitary sewer in Snelling Avenue and Cummings Lane, commencing at a point approximately three hundred feet north of the intersection of Cummings Lane and Snelling Avenue, extending southerly on Snelling Avenue, easterly on Cummings Lane, and then continuing easterly across STH 5l-125 to a junction with the sanitary sewer on Hamline Avenue, and WHEREAS, it is also proposed to restore and resurface Cummings Lane and Snelling Avenue after the installation of aaid sanitary sewer and the necessary appurtenances, which road improvement will extend from Snelling Avenue on Cummings Lane to the easterly termination of Cummings Lane, and WHEREAS, it is proposed to as seas the benefited property for all or a portion of the cost of the improvement, pursuant to Minnesota Statutes, Sections 429.0l1 through 429.11, NOW THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF ARDEN BILLS, lI:I:I:NNESOTA: . That the proposed improvements be referred to Banister Engineering Company, Village Engineers, for study, and that said engineers be instructed to report to the Council with all convenient apeed advising the Council in a preliminary way as to whether the proposed improve- ments are feasible and as to whether they should be made as proposed or in connection with some other improvements, and advising also as to whether it would be feasible to construct a turnaround at the easterly termination of Cummings Lane, and advising on the estimated cost of the - 1 - - . . . .~, improvements as recOIIIIllended.
