REPORT OF ATTY. VINCENT P. COURTNEY Sign andBillboard Ordinance At'by. He stated that, in his opinion. the Ordinance is enforceable regarding non-conforming signs, except when the C0l1tr2ct~ has a substantial invested interest, then compensation should be con~ sidered. He said that he believes thet the contractor should be given suffic lent time to fulfill his co n'bract and each caee should be evalul',tec1; he recommended issuing licenses at the usual license fee Lmt:U 'bhe expiration of the contracts. Clerk Lorraine Stromquist submitted a list of non=conforming signs in the Vil1aeej she informed the Council that one sign company had sub~ mitted exp~r~tion dates for their contracts. Mayo~ Kennedy requested the Clerk to obtain expiration dates on all the contracted non=confo~m~ ing signa. Mayor Kennedy reca~ended that sign contracts extending more than m70 years be considered individually~ Trustee Nethercut moved, seconded by Trustee Crepeau, that the Cle~k be authorized to issue licenses for signs for the period of the present contracts, but not to exceed two years; motion carried. Clerk, Lorraine Stromquist stnted that the direotional sign owned by Kem Milling Co., New Brighton, 1s on State Highway property and the Highway Dept. has requested its removal. Mayor Ke nnedy !'equested the Clerk to contact the owners of I'Fo!' SaleH signs, or signs implying property for sale, should be contaoted and info!'med that the signs must comply with the Ordinance in size = not "flo exceed 2 ft. x 2 ft. Trustee Nethe!'cut moved, seconded by T!'ustee Lang, and Carried, as recommended by the Board of Appeals in their letter, dated March 4, 1965. that the Skyline Motel on Highway #8 be given an extension until June 1, 1965. to remove their sign, at Which tile they have agreed to move the sign out of Arden Hilla. The mat'ber of signa for presblterian Homes, Bethel College and the St. Paul Bible College was re erred to the Board of Appeals. Dick Jones appeared in behalf of the Trinitr Lutheran Church on New Brighton Road. According to the Ordinance 'hey are slloweu one bulletin board; the Church feels that it should not be required to obtain a lioense for the second bul1e'~in bosZ'd. Clerk Lorraine Stromquis'b said that she had talked with Rev. Baltz and he had requested that she p~esent the matter. Trustee Olmen, a mamber of the congregation. had also talked with Rev. Beltz. Kennedy suggested that the Board of Appeals should consider possible amendments to the Ordinance, Trustee Nethercut moved, seconded Qy Trustee Olmen. that the Schutta Nursery sign be licensed for one year, motion carried. '. Clerk Lorraine Stromquist informed the Council of sign owners who have not responded to notification of the Sign Ordinance. Karis Drive~In = Clerk LOrraine Stromquist informed the Covncil that she felt Mr. Karis would comply with the Ordinance as soon as he returns to Minnesota from Wisconsino Anton Peterson sign and Brennan's Turtle Lake Sign ~ Clerk requested to contact these two by telephone. if no response = matters should be referred to the Atty. The matter of the numerous signs on service station property was dis= cussed. Trustee Nethercut stated that he believes only principle signs should be governed by the Ordinance. Trustee Crepeau believes that the Council could use discretion on 'this ma..~'~er. TI'ustee Lsng inquired whether a distinction had been made between fixed and portable signs. Mayor Kennedy said the purpose of the Ordinance is not to en= fOl:'ee licensing of temporaily signs; he also suggested that when Clerk Lorraine Stromquist wntacts sign owners she should emphasize that the purpose of the Ordinance is ~o eliminate signs and was not intended to raise finances. . Ordinance Committee Meetin! Clerk Lorraine Stromquist nfOrnledthe Council that the Ordinance Committee has requested a joint meeting with the Council and the Village Atty. regarding the oodification of the Villare Ordinances whioh they have now oompleted, The Council agreed to a meeting at the Village Hall on May 3 and requested the Clerk to verify this date with John Sexton, Chairman of the Committee, and to send notices of the meeting to the Council and Atty. Mayor Kennedy suggested that I , consideration be given to a loose leaf type of note book to keep the Village Ordinances current ,after their adoption" Multiple DwelliOt Complaints Clerk Lorraine S romquist info~ed the Council of a complaint from a Village resident that 3252 Lake Johanna Blvd. has possibly been converted into a two family dwelling. This matter and~ pOSSible similar situation existing on' Glenpaul ROad were referred to Trustee Crepeau. REPORT OF VILLAGE ENG1NEER Possible Feasibility Report - Sewer for Northern Arden Hills Wm. Banister. at the request of Mayor Kennedy. was present to report on the cost of a feasibility report from the Village Engineer regeTd= ing sewer service for the northern area of the Village. Wm. Banister gave the background of attempts to sewer the north area of the Village through the arsenal" He believes that mt this time it is not pOSSible =2= . . He stated that St. Paul and Roseville have issued statements that they do have the facilities to servioe the unsewered area of Arde n Hills 0 Wm. Banister informed the Council that N.S.S.D. at this time has some capacity available, but is not sure for how long ~ the completion date is September 1, 1965. He said that membership is obtained by a referendum vote by residents in the area to be served. The procedure for contracting for service with them is not very clear. He stated that the cheapest and most attraotive plan could only be determined after a detailed study. He estifuSted the cost of such a study would be about $5,500.00; this cost oould be spread over a period of t~e in consideration of the Village budget and could be included in the cost of the project when the improvement is made. Mayor I~nnedy recommended that the matter be referred to the Counc~l for study. He believes we should have a study made so the Village is in a position to give possible fUture industry, etc., an idea of what we propose to do. He also stated that such a study by the Engineer should not be authorized for at least mvo months to see what happens in legislature. Highway Plans ~ 35W and #694 Trustee Crepeau moved, seconded by Trustee Lang, and carried. the approval of four resolution. as attached. regarding the State High~ way Dept.ts plans and special provisions for the construction of State Highway 35W and #694. Oak Avenue Improvement Claim Engineer Don: Lund confirmed that materials used by the road contractor for the Oak Avenue Improvement project were used for compaction onlyo The Council Was satisfied that the charge is proper and requested the Clerk to so advise Atty. Courtney and Engr. Hendrickson. REPORT OF TRUSTEE NETHERCUT Planning COmmission Matters Trustee Netnerout reported that the two public meetings sponsored by the Planning Commission were well attended. He informed the Council that the proposed changes to the Platting Ordinance are to be considered by the Planning gommission and requested the opinions of the Council. Mayor Kennedy. Trustees Lang, OlIDen and Crepeau were in agreement that developers should not be required to donate an area for recreational facilities; they felt that possibly if we felt that such an area could be used, we could request a dona'~on. REPORT OF TRUSTEE CREPEAU County Road E and #51 Lifhti~ Clerk Lorraine stromquis informed ~e.2~>>pcil of 8 letter, dated. March 25. 1965, ~om Floyd Snyker, ~llighway Dept., which sts"ed that County Road Kwould soon be removed from their system and they felt that lights were not necessary at this location; however, they stated that the Councy would have no objection to the Village install= ing and maintaining the lighting. Trustee Crepeau stated that he is concerned with the safety factor at this location; Mahor Kennedy suggested reviewing the matter when County action is taken. REPORT OF TRUSTEE LANG Reoreational Contracts Trustee Lang requested the Clerk to type in titles on thB signe~ contract for the Mounds View Athletic Association. He stated that a contraot had been sent to the Little Lakes L~ttle League. which will be fo~arded to Atty. Courtney. Mayor Kennedy informed the Council that a prospective buyer is interested in purchasing property south of Floral Drive for an engineering opera= tion. but when Mayor Kennedy checked the zoning of the property with Carl Dale he was informed that this parcel which is now zoned industrial is proposed to be zoned residential in the overall plan. Carl Dale suggested that the owner of the property be informed of this situation. Trustee Nethercut requested the Clerk to check when this property was zoned industrial; Trustee Crepeau requested the Clerk to also check the number of acres involved. Matter referred to Trustee Nethercut to present to the Planning Con~, Mid-Decade Census In reply to an inquiry from Mayor Kennedy. Clerk Lorraine Stromquist informed the Council that the census is set up to be taken this Oct. She stated that she expects to be contacted by the Bureau of Census probably in July as this project will be under their direction. REPORT OF CLERK IiJRRAINE STROMQUIST Commercial Sewer Rate Changes Clerk Lorraine s~romqu~st informed the Council of the changes in sewer rates from the City of St. Paul for commercial establishments in the Village. . Rea portionment of Assessments Trustee en moved, seconde by Trustee Nethercut, the adop/Gion of a resolution relating to apportionment of assessments relating to Sanitary Sewer Improvements Nos,. 1. 2, 3 and 5 and Stree'h Improvement No.5, as attached; motion carried. Extension of T.H. #51 Clerk Lorraine StromqUist read a letter, dated March 24. 1965. whlc11 informed the Cour~il that the State Highway Dept. does not contemplate any construction of an extension of Highway 51; part of this property is still under the jurisdiction of Ramsey County although the State has aCquired the right of way. Complain'hs Clerk Lorraine Stromquist informed the CoUr.cil of the complaints of a resident concerning the Village storage building and property on New Brighton Road. Clerk requested to contact the resident and explain that the street maintenance equipment stored at this location will be moved after it is no longer needed for snow removal and the trees in the property next to the storage building are to be used as fill and will be covered with fill dirt as soon as possibleo Continuation of Public Hearing = Husby Property Clerk reminded the Council that the continuation of t:tis public hearing will be held April 12. the evening of the Regular Council meeting. Financial Statements Clerk distributed to members of the Cour;ci1 oopies of 'Ghe Village Financial Statement for 1964. Village Health Officer Letter Clem Lorraine Stromquist read a letter. dated March 27, 1965, from the Village Health Officer, Dr. John V. Falcon Heights, to divide property located be'GWeen Forest Lalls and Skiles Lane, for which he had plans. Allen Metcalf was present earlier in the meeting, but had departed before Clay Kelley arrived. Matter referred to the Board of Appeals. Olman, Nethercut & Lang and the following were absent: None Trustee OImen introduced the following resolution and moved its adoption: RESOLurION RELATING TO APPORTIONMENT OF ASSESSMENTS RELATING TO SANITARY SEVlER IMPROVEMENT NO. 2 BE IT RESOLVED by the Village Council of the Village of Arden Hills, Minnesota, as follows: V~EAS, the assessment roll for Sanitary Sewer Improvement No, 2 as last finally amended and adopted on October 12, 1961, was filed and certified to the County Auditor of Ramsey County on November 8, 1961, for the purpose of including installment~ thereof to be collected along with real estate taxes commencin~ J.n 1962; and WHEREAS, a hearing on supplemental assessments, reassessments, and apportionment of previous assessments in respect to Sanit3~Y Sewer Improvement No, 2 was held on July 16, 1962, at which time assessments for Sanitary Sewer Improvement No. 2 were amended as provided by said resoluticnof said date and certified and filed in the office of the County Auditor of Ramsey County on October 3, 1962; and . I WHEREAS, since that date a number of parcels of property contained within said assessment roll as amended have been divided and conveyed by previous property owners; and WHEREAS, the County Auditor of Ramsey County requires that apportionment of the original assessment against each original tract where it has later been divided, sold or conveyed, be made by the Village Council of the Village of Arden Hills, in order that the proper assessment can be extended by the County Auditor against each parcel of property thereafter, commencing with an assessment to be collected in the year 1963 and thereafter.
