:Rei Proposed contract with Banister Engineering Co regarding street
improvement projects
Dear Mrs. Stromquistl
I have examined and return herewith the original and two copies of the
Banistar proposal dated November 9, 1961 on the above matter. I have
a copy which I received last month, when. the metter was first discussed
with Banister's office.
I see no legal objection to the Village entering into the proposed agree-
. ment~ assuming of course that the Council is satisfied with the payment
provisions contained therein. As I see it the Council will pay one and
one half per cent of the cost of construction for preliminary investi-
ation and conferences, which amount will be credited against the fee of
five and one half per cent for preparing plens and speoifications. On
the street improvement projects already commenoed the one and one half
per cent charge would thus be absorbed in the five and one half charge.
In addition the Village willlRY Banistar two per cent of the cost of
construction for supervision, plus seperate charges for staking work and
a full t:!llle inspector, if the latter is necessary. The provision in
paragraph 3 of the proposal regarding these items seems sufficiently
detailed to me to avoid any misunderstanding.
Of course I cannot pass upon whether or not the fees are reasonable, but
I understand the Council has examined thisin detail with representatives
of the Banister office and has decided that these are acceptable. Iam
still holding the checks issued in August in payment of statements to
date, and will hold them until I am advised by the Council that I should
forward them to Banister.
