Roger Short informed the council the plans for the ~proveilient had been
approved by the Villsee of Rosevilleo Motion by Mr, Crepeau, seconded
by Mr, Kennedy. that Petel' La ;'lett1 be awarded the sewer contract for
Improvement #5, subject to APproval of the city of St. Paul and the
Engineer. - carriedo .

Mr. Stepnitz, the third property owner, did not appear, but the council

preferred immediate action.

Mr. Courtney requested the. councll to establish e. procedure on petitions
. from small areas. beCAuse of financing. The discussed petition had 14
signatures and involved a smoll area located In the northwest section of
the village - referred to Rorer Short for a preli~inary report with
remommendations on the size of an area feasible for an improvement.

RESOLUTION ORDERING THE I1IBTALIATION OF THE
SANITARY SEWER S"YSTEM TO BE KNOWN AS SAlI1ITARY
SEWER IMPROVEMENT NO. 5~ AND ACCEPTING BID THEREON
WHEREAS~ a Resolution of the Village Council adopted the 30th day of
October~ 1961~ fixed a date for a Counoil hearing : on the 27th day of
November~ 1961~ at 8100 o'olock P. M. in tha Village Hall, for a publio
hearing on the advisability of instalJ1ng.ng a ,smitary sewr system in the
. area in the Village of Arden Hills located generally on the Northeasterly
intersection of HAm11ne Avenue and County Road E~ and described as follows~
to-wit:
That portion of swi of SEi of Section 27, Township 30,
Range 23~ lying southerly of Minneapolis~ St. Paul and
Sault Ste. Marie Railway Company's right of way~ all
in the Village of Arden Hills, Ramsey County, MiImesota~ and
WEEREAS~ said Resolution was based upon plans and epecif'ieations for
said Sanitary Sewer Installation prepared by the Villaga Enginser and approved
by the Council, which plans and specifications indicated that the oonstl'llct-
ion would involve the installation of approximately 1,050 lineal feet of
sanitary sewer varying in size from 8 inch to 12 inoh~ together with
apP11rtenances~ and
WHEREAS~ ten days' publiShed notice of the hearing through two weakly
publioli4tions of the notice was duly given and the hearing was )1eld thereon
. on the 27th day of Ma.rch~ 1961~ at whioh time all persons desiring to be
heard were given an opportunity to be heard thereon, and
WHERE:AS, John Rysgaard and Oscar Husby, representing Husby Properties~
Inc., were present at said hearing and stated that they, representing two
of the property owners involved~ favored said improvement. The Counoil was
further advised by Mr. Husby that Walter Stepnitz~ a third property owner
involved~ was also in favor of the improvement. There were no statements
in oppoaition to the improvement~ and

. WHEREAS, ptll'Suant to an Advertisement for Bids, for the a:foresaid
projedt in accordance with the Council ResolutioJ1Pl;ssed October 30, 1961,
bids for said project were received, opened and tabulated according to law
at the Council Meeting on. November 27, 1961, and nine bids were received
in compliance with the Advertisement, which bids were received, opened and
tabulated according to law, and a tabulation of said bids prepared by the
Village Engineer is atteched hereto and incorporated herein, and
WHERI!:AS, it appears that the bid of Peter Lametti Construction Co. in
the amount of Seven Thousand Six Hundred and Twenty Four Dollars ($7,624.00),
is the lowest and best bid submitted,
NOW HREFORE, BE IT RESOLVED BY THE COUNCJL OF WE V!IJ.AGE OF A1lDEN ,
MINNESOTA, AS FOIJ:.a.1S. TO-WIT:
(1) The aforesaid improvement is hereby ordered as proposed in the
. Council Resolution adopted Ootober 30, 1961, in aocordanea with the plans
and specifications as submitted by the Village Engineer on said dste.
(2) Said improvement shall be made in accordance with the a:foresaid
plans and specifications submitted by Banister Engineering Co, Village
Engineers, and approved by this Council on Ootober 3D, 1961. Banister Engin-
eering Co. ars hereby designated as the engineers for this improvement.
(3) The Mayor and Clerk ars hereby authorized and directed to enter
:Into the proposed contract with Peter La.matti Construction Company in the
nama of the Village of Arden Hills for the improvement as hereinbefore des-
cribed, all in accordance with the plans and specifications heretofore
approved by the Village Council and filed with the Village Clerk.
(4) The Village Clerk is hereby authorized and directed to return forth
with to all bidders deposits made with their bids, except that the deposit of
. the successful bidder and the next lowest bidder shall be retained until a
contract has been signed.
Adopted by the Village Council this27th day of November, 1961.
