HomeMy WebLinkAbout2024-023 -A DEN HILLS CITY OF ARDEN HILLS COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION NO. 2024-023 RESOLUTION DECLARING COSTS TO BE ASSESSED AND ORDERING PREPARATION OF PROPOSED ASSESSMENTS AND CALLING FOR HEARING ON THE PROPOSED ASSESSMENTS WHEREAS, the construction bids have been received for the proposed 2024 PMP Street and Utility Improvements Project, the improvement of: • Keithson Drive from County State Aid Highway(CSAH) 96 West to 800 feet south of CSAH 96 West; • Royal Hills Drive from Snelling Avenue North to Arden View Drive; • Colleen Avenue from McClung Drive to Hamline Avenue North; • Norma Avenue from Dawn Circle to Briarknoll Drive; • Norma Avenue from Briarknoll Drive to Colleen Avenue; • James Avenue from Indian Oaks Trail to Colleen Avenue; • Briarknoll Circle; • Briarknoll Drive from Snelling Avenue North to Norma Avenue; • Royal Lane from Norma Avenue to Floral Drive West; • McClung Drive from Snelling Avenue North to Colleen Avenue; • Colleen Circle; • Arden Vista Court; and the contract bid price for such improvement is $2,238,418.15, and the expenses incurred or to be incurred in the making of such improvement amount to $604,372.90 so that the total cost of the improvement will be $2,842,791.05; and WHEREAS, the City Clerk has prepared a proposed assessment of the cost of the improvement; and WHEREAS, the City Clerk has notified the City Council that such proposed assessment has been completed and filed at City Hall for public inspection; and WHEREAS, on March 11, 2024, the City Council adopted Resolution No. 2024-012, which declared that the portion of the cost of such improvement to be paid by the City will be $2,124,615.05, and that the portion of the cost to be assessed against all benefited property owners will be$718,176; and WHEREAS, that same Resolution authorized payment of the assessments in equal annual installments over 10 years,with interest;directed the City Clerk to calculate the individual amounts be assessed per affected parcel, and to file the same in her office for public inspection; ordered a Page 1 of 3 To view the final document,access adopted Resolutions via Arden Hills Public Laseche Weblink by visiting cityofardenhills.org and clicking on Archived Documents under Helpful Links on our main webpage. hearing before the City Council on April 8, 2024, at which owners of affected properties would be given the opportunity to be heard on the assessment; directed the City Clerk to mail and publish notice of that hearing; and authorized full payment of an assessment at any time within 30 days of the adoption of the same; and WHEREAS, as directed by the City Council on March 11, 2024, the City Clerk mailed to all affected properties notices of the hearing called for on April 8, 2024, which mailing was based on the owner and taxpayer addresses on file in the office of the Ramsey County Assessor; and WHEREAS, upon such mailing, the City Clerk was notified of an error in the County records for the property located at 1570 McClung Drive that resulted in an omission in notice to the owners of that property; and NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF ARDEN HILLS: 1. The portion of the cost of such improvement to be paid by the City is hereby declared to be$2,124,615.05. The portion of the cost to be assessed against benefited property owners is declared to be $718,176, which includes a portion to be assessed against the benefitted property located at 1570 McClung Drive. 2. The assessment against the property located at 1570 McClung Drive shall be payable in equal annual installments extending over a period of 10 years, the first of the installments to be payable with property taxes for the year 2024, and shall bear an interest rate to be determine from date of the adoption of the assessment resolution. 3. The City Clerk,with the assistance of the City Engineer, as directed by the City Council in Resolution No. 2024-012, has calculated the proper amount to be specially assessed for such improvement against the property located at 1570 McClung Drive, without regard to cash valuation, as provided by law, and has filed a copy of such proposed assessment in her office for public inspection; and BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF ARDEN HILLS, MINNESOTA: 1. A hearing shall be held on May 13, 2024,in the Council Chambers at 7:00 p.m. or as soon thereafter as possible, to pass upon such proposed assessment, and at such time and place the owner of the property located at 1570 McClung Drive, which is affected by such improvement, will be given an opportunity to be heard with reference to such assessment. 2. Publication by the City Clerk is hereby directed to cause notice of the hearing on the proposed assessment once in the official newspaper at least two weeks prior to the hearing, stating in the notice the total cost of the improvement is hereby approved. Notice shall be mailed to the owner of the property located at 1570 McClung Drive as described in the assessment roll not less than two weeks prior to the hearings is also approved. 3. The owner may at any time thereafter, pay to the City the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment must be made before November 15 or interest will be charged through December 31 of the succeeding year.
