Mr. Morton, 1446 Rice st., inquired about tnezoning pertinent to 3205 No
Lexington Ave. His intent10ns 8re to demolish existing buildings, except
the hOUSe tacing Lexington, re-arrange the remaining taree lots and build
three ODe family dwellings. Mr. Morton presented plans similar to the
d1llellingshewisbed to oonstruct w1 th changes to meet the building code 0

Mr. Olmen reported the t the low area around the Fira Department Building
has been adequa tely filled end all low property belonging to the Village
has also been sufficientl;y leveled.
Mr. Olmen suggested tha t excess earth be hauled to bui lei a road to the lift
station on Johanna Blvd. and County Road E.
Mr. Olmen inquired as to the legal1tr of filling a playground on Ridgewood
Road in Arden Hills #3 which is jointly owned by residents of Arden Hills #3~
The Council agreed tha t it is legal to fill the playground with excess earth
from Arden Hills H2.

Mr. Kennedy inquired 1f the existing equipment on the playground on County
Road E and HEmline Ave. is allowed to be moved (specifically the backstop).
Mayor Aahbach suggested telephoning the lannasota State Highway Depa~tment
for verbal permission.
Arsenal Sand &: Gravel Co. = Re. Nulsaac\9 Complaint - Refel'l'anCe was made
to a letter on ;t'lJ.e from the Arsenal Sand and Gravel Co. stating confusion
as to the exact nature of the camplaint. whether the actual operation of the
plant 01' the truck tl'anspollDt10n 1s the real nuisance. The Public Rela tions
Department of the above mentioned company stated it would set up Q committee
to investigate this matter if the problem could be ascertained. Referred -
to Mr. Courtney to write to Mr. Joe Donohue. Shoreview Village AttorneYg
requesting that he meet with the Arsenal Sand and Gravel COog representative,
as tne complaints were from tne res1dents of Shoreviewo

collection of pending asseesments on property condemned by the Highway
Department. Collection oan be made on assessments already levied. Mro
Courtney verifIed this statement.

THE SANE Felt PUBUC HIGHWAY PURPOSES.
'T!1HEREAS, the Vila.age of Arden HUls desires to obtain the necessary
dght-of--W for the purpose of widening Stowe Avenue in the Village of
Arden Hills to the width of 66 feet betwen New Iilrighton Road and Lake
Johanna Boulevard, as the same are presently laid out, and pe1'lllf.t the
same to be used for pmlic highwli\Y purposes, and
WHEREAS, in order to accomplish such purpose it is mcessary to
obtain an easement for public hig~ purposes over the following described
land in Ramsey County, to-witl
The north thirty three (33) feet of the North 422 feet
of Lot 32, Auditor's Subdivision Number 80, lying West
of the following described linea Beginning at a point
on the lllorth line of said Lot 32, 656.82 feet West of the
~ Section Corner in the center of Section 33, Township 30
North, Range 231iestJ thence South 422 feet to a point
657.31 feet West of the North and South ~ Section line in
said Section 33, and
1lIEREAS, it is necessary, adviSable, and in the public interest that
an. easement for public highway purposes be obtained OV'er the properly
hereidlefore described, and
Tt!IiREAS, the Council is advised and believes that the most feasible
and practieall:lcation for such road is aver the land as hereinbefore des-
cribed, and
mmEAS, the Council is advised that it will be umble to acquire
the necessary easement over said land from the owners of said land at a
:fair and reasonable price, and
ltiEREAS, by reason of the inability to obtaill. said land it has become
necessary to procure the aforesaid easement by right of llIllinent domain,

NOW 1HEREFORE, BE IT RESOLVED, that. the Village of ~den Hills proceed
to acquire the aforesaid easement for public highwey purposes in said
land under its right of eminent domain, and that the Village ~tt01'ney :be
instructed and 'directed to file the necessary complaint therefor 8Jld pro-
secute such action to a stlCcessful conclusion 01' until it is abandoDBd,
dismf.ssed or terminated by the Village or by the court} that the Village
Attorney, the Mayor and the Clerk do all things necessary to be dODB in the
commencement, prosecution and sucoessful termilllition of such action.
