Mr. Be rger: The Fifth and Final Application for payment on the above referenced project was submitted to the City of Arden Hills on October 9, 1990 and has not yet been paid. We have completed our contractual obligations in complete compliance with the agreement we signed with the City of Arden Hills. Our Application was submitted in accordance with paragraph 14.13 of the General Conditions referenced in Article 5.2 and final payment should have been received by Lametti & Sons, Inc. by November 9, 1990. Therefore, according to Article 6 of the Agreement, we are also entitled to interest on the unpaid amount of $9,661.62 for the period from October 9, 1990 to the date of payment. The calculation for interest at 18% thru April 15, 1992 is as follows: 485 days x .05%/day = $2,342.55 . fl SKILL RESPONSIBILITY INTEGRITY . . . You have stated that you are withholding payment to us because of your discontent with with SEH. If SEH has not performed satisfactorily, your action should be against SEH under the terms of the Agreement you have with them.
