REGULAR CITY COUNCIL MEETING
May 11, 1992

CALL TO ORDER/ROLL CALL
Pursuant to due call and notice thereof, Mayor Sather called
to order the regular City Council meeting at 7:30 p.m.
Present: Mayor Thomas Sather; Councilmembers JoAnn Growe,
Dale Hicks, Paul Malone. Council absent: Thomas Mahowald.
Also present were: City Attorney, Jerry Filla; city
Planner, John Bergly; City Engineer, Mark Graham; Parks
Director, John Buckley; Public Works Superintendent, Dan
Winkel; Acting Clerk Administrator, Catherine Iago;
Recording Secretary, Foster.
ADOPT AGENDA
Acting Clerk Administrator Iago asked to add one item under
"Council Comments", that being Review of Financial
. Information. Council agreed to this addition.
Councilmember Malone asked to move Consent Calendar item 4b
(Request from Cable Commission to Adopt Resolution No. 92-
28) to the end of Unfinished and New Business as item 61.
Council agreed to this change.
MOTION: Hicks moved, seconded by Malone, to adopt the May 11,
1992 agenda moving item 4b to 61 and adding Review of
Financial Information. Motion carried unanimously (4-
0) .
APPROVAL OF COUNCIL MINUTES
Councilmember Malone asked that two changes be made to the
April 27, 1992 Council minutes:
1) That paragraph 2, page 5 be revised to state that "
.. .
fixed income and elderly persons can apply for
temporary deferral... "
2 ) On page 12, the word "midpoint" in the motion under
Salary Increase for Parks Department Employees be
changed to "maximum".
MOTION: Malone moved, seconded by Growe, to approve the minutes
of the April 27, 1992 Regular Council Meeting with the
. two revisions noted above. Motion carried unanimously
(4-0) ,

MOTION: Hicks moved, seconded by Malone to approve the Consent
Calendar, with the exception of item 4b, and authorize
execution of all necessary documents contained therein.

CASE #92-05 - VARIANCE REQUEST
1173 KARTH LAKE DRIVE
City Planner John Bergly offered the following background .
with regard to an application from Clayton Larson, 1173
Karth Lake Drive for a variance:
- The home at 1173 Karth Lane was built with a building
permit issued in September 1979. plans submitted at
that time did not incl ude a deck. There is no record
of a building permit ever being issued allowing
construction of a deck. In Apri 1 1982 a building
permit was issued to construct a screen porch over an
existing deck. A wooden screen porch, held up by wood
pillars, was built and fastened to the house.
- Recently, the applicant, Clayton Larson, purchased the
property and learned during closing that the screen
porch encroaches upon a utility easement about 6.5 feet
which means the porch is only 3.5 feet from a City
watermain.
- Building within a utility easement is prohibited.
- Clayton Larson cannot obtain title insurance or clear
title to the property given the screen porch location.
Therefore, he has requested either a variance to allow
the porch to remain as is within the utility easement,
or an easement vacation.
- Staff and Planning Commission have reviewed the case
concluding that granting a variance or vacating the .
easement is inappropriate; there are two options:
1) The City and Mr. Larson enter into an agreement
that allows the porch to remain but indemnifies
the City in order to protect the City from costs

resulting from damage to the porch should
maintenance work need to be done on the watermain,
or
2 ) The porch be removed.
- Planning Commission has recommended denial of a
variance.
Councilmember Hicks asked if the porch must be removed if
the applicant does not agree to indemnify or the City grant
a variance. Bergly said that is his and the City Attorney's
opinion.
Clayton Larson stated that he applied for the variance to
obtain clear title because the porch is a nice feature of
the house which he would like to keep. He explained that if
he agreed to indemnify, he would simply be faced with the
possibility of having to remove or repair the porch at some
later time without advanced notice. He added that an
indemnification agreement would not allow him to obtain
clear title, therefore, he is unwilling to agree to
indemnify.
. Larson explained that he felt this situation is unique, it
was not caused intentionally, it is in no way an aggressive
encroachment upon the easement, and there is no other
location on the property to construct a porch. He stated
that it was probably the original builder's fault that the
deck was built encroaching upon the easement, and now as the
new owner, he is suffering the consequences.
Councilmember Hicks asked Larson if clear title can only be
obtained by the removal of the porch or the granting of a
variance. Larson answered yes and clarified that an
indemnification agreement would not suffice to obtain clear
title but would subject him to future costs to remove the
porch. Larson stated that as a building inspector himself,
he understands this type of issue very well, but is of the
opinion that a variance would be appropriate in this case
given the unique situation.
Councilmember Malone stated that while he sympathizes with
Larson and understands the situation was not created
maliciously, he agrees with the Planning Commission's
recommendation because the City must have ability to access
the watermain immediately should a maintenance problem
arise.

Arden Hills Council 4 May 11, 1992 .
MOTION: Malone moved, seconded by Hicks, to deny a variance to
allow a structure in the utility easement on the
property at 1173 Karth Lake Drive. Motion carried
unanimously (4-0).
APPROVE INSTALLATION OF
BANNERS ALONG COUNTY ROAD E
Parks Director Buckley reported that County Road E
representatives, the Park and Recreation Committee, and
Planning Commission have reviewed and provided input on the
plans for the installation of banners along County Road E
and options for banner design.
Buckley stated that it is being recommended that
1) The City purchase the daisy design street banners and
brackets from Banner Creations for $2,271.25,
2 ) The City continue to use the design service of Duane
Carlton at a cost not to exceed $400, and
3) Charitable Gambling contributions be solicited to help
cover the cost of the banners.
Councilmember Hicks asked which type of material is more .
durable, poly/cotton or nylon. Buckley said the
recommendation is to purchase a poly/cotton material which
is more durable.
Councilmember Malone commented that the public should be
aware that these banners are being installed for the purpose
of drawing attention to the city's business district and
they be under close control by the City. He stated that he
does not expect the City would allow banners for businesses
as it would be violate the sign ordinance.
MOTION: Hicks moved, seconded by Growe, to approve the
installation of daisy design banners and brackets
purchased from Banner Creations at a price of $2,271.25
along County Road E. Motion carried unanimously (4-0) .
KEITHSON POND IMPROVEMENT
- ORDER ASSESSMENT HEARING
City Attorney Filla advised that he expects a cost of about
$17,500 for acquisition of the Reiling site needed for the
proposed Keithson Pond Improvement. Filla added that the
City appraiser has opined that it would be difficult to levy
any assessment to the Reiling property improvement, but .
other affected lots could be assessed at approximately
$1,000 - $1, 500 per lot.

City Engineer Graham reminded Council that the Keithson Pond
Improvement project has been awarded to a contractor
contingent upon resolution of the Reiling acquisition
matter. With regard to the Crimmons acquisition matter,
Graham reported he expects resolution of that matter without
any problem or delay.
City Attorney Filla reported that condemnation procedures on
the Reiling property are in process in case there are any
unforeseen problems with resolving the matter in a timely
manner.
City Engineer Graham suggested the City hold an assessment
hearing before starting the project; the earliest possible
date for the hearing would be June 8, 1992.
MOTION: Malone moved, seconded by Hicks, to order an assessment
hearing, to be held at 7:30 p.m. June 8, 1992, on the
matter of Keithson Pond Improvement, and authorize the
City Engineer to prepare the assessment roll using the
figures provided by the City Appraiser. Motion carried
unanimously (4-0).
. Councilmember Hicks suggested that it may be appropriate to
meet with the City's former engineer, Barry Peters of SEH,
to try to reconstruct the background involving the Keithson
Pond drainage problem, and see if there is any possible
assignment of responsibility. Malone supported such a
meeting and recalled that while serving on the Planning
Commission, the matter was reviewed and drainage was found
to be adequate. However, in reviewing the file, he has been
unable to reconstruct the events in this case.
Mayor sather suggested that Councilmember Hicks and perhaps
another Councilmember meet with SEH. Councilmember Hicks
volunteered to arrange the meeting; Councilmember Malone
expressed interest in attending also.
DISCUSSION OF DRAFT
WATER MANAGEMENT PLAN
Based upon the recommendation of City Engineer Graham,
Council agreed to discuss the Draft Water Management Plan at
their May 18, 1992 worksession.

RECEIVE FEASIBILITY REPORT,
ORDER PUBLIC HEARING AND
PLANS AND SPECIFICATIONS -
DUNLAP STREET IMPROVEMENTS
City Engineer Graham reported that the feasibility report
for Dunlap street was prepared using two options for road
improvement. One option would be cold-in-place recycling
(CIR) project which involves rejuvenating the existing
surface and overlaying with a 2" layer on top, at an
estimated cost of about $50,400. The second option would be
complete reconstruction of the road at an estimated cost of
$198,900.
Graham explained that CIR would not address poor soil
conditions identified in the Dunlap area, but he would still
recommend CIR in light of the fact that the property owners
in the area have expressed a need for a short-term solution
at a lower cost. Graham recommended a public hearing on the
1992 Dunlap improvement be held on June 8, 1992.
Councilmember Hicks asked if CIR would result in a road
adequate to handle the heavy vehicles which use the road.
Graham said that although he could not assure the tonnage .
limits of a CIR project, he would expect a 12 - IS-year life
from CIR. He said a complete reconstruction would provide
about a 20-year 1 ife, but at nearly four times the cost of
CIR.
Council had been given an opportunity to review the
feasibility report prior to the Council meeting. Graham
noted that page 9 of the report should have included
indication that CIR does not include soil corrections.
Council briefly discussed a potential assessment rate.
MOTION: Malone moved, seconded by Hicks, to adopt Resolution
92-32 Receiving the Feasibility Report and Ordering a
Public Hearing, to be held at 8:30 p.m. June 8, 1992,
on the Matter of 1992 Dunlap Street Improvements.
Motion carried unanimously (4-0).
MOTION: Malone moved, seconded by Growe, to adopt Resolution
92-33 Ordering Preparation of Plans and Specifications,
for Cold-In-Place Recycling, in the Matter of the 1992
Dunlap street Improvement. Motion carried unanimously
(4-0).
ORDER PUBLIC HEARING - ROUND
LAKE ROAD WEST IMPROVEMENT .
City Engineer Graham reminded Council that action was taken
on Apri 1 13, 1992 to accept the feasibility report and order

plans and specifications for a CIR improvement project for
West Round Lake Road. He suggested that Council order a
public hearing in this matter for June 8, 1992. Council
agreed that 9:00 p.m. would be an appropriate time to
schedule the public hearing since two other public hearings
are already scheduled for that meeting.
MOTION: Malone moved. seconded by Hicks, to adopt Resolution
92-34 Ordering a Public Hearing, to be held at 9:00
p.m. June 8, 1992 , on the Matter of 1992 Round Lake
Road West Improvements. Motion carried unanimously
(4-0).
ACCEPT IMPROVEMENT & AUTHORIZE
FINAL PAYMENT - CLEVELAND AVENUE
LIFT STATION IMPROVEMENT
Included in packets for Council review were:
- A letter from contractor Lametti and Son requesting
final payment for the Cleveland Avenue Lift Station
Improvement,
- A letter dated october 9, 1990 from former City
Engineer Barry Peters of SEH stating that four items
. must be corrected before final payment is made to the
contractor,
- A memorandum, dated May 5, 1992, from Acting Clerk Iago
indicating that former Engineer Peters has recommended
Council accept the improvement and make final payment
since the contractor has corrected the four items at
issue,
- An agreement by the contractor not to charge the City
accrued interest for this project.
Councilmember Malone stated that it would be appropriate to
convey to Lametti and Sons the City's appreciation for their
reasonable attitude in resolving this matter.
MOTION: Malone moved, seconded by Hicks, to adopt Resolution
92-35 Accepting Improvement and Approving Final Payment
For Cleveland Avenue Lift station Improvement NO. SS-W-
89-1. Motion carried unanimously (4-0).
Council was also asked to consider final payment to former
City Engineer SEH for involvement in the Cleveland Avenue
Lift Station Improvement project.
MOTION: Hicks moved, seconded by Malone, to authorize final
payment to SEH in the amount of $5,972.05 to cover the
. project percentage fees ($5,442.93) and inspections on
"punch list" items ($549.12). Motion carried
unanimously (4-0).

Arden Hills Council 8 May 11, 1992 .
Council discussed the electrical connection for the lift
station which has not yet been accomplished. Engineer
Graham explained what the connection would entail and the
estimated costs involved to complete the connection. Public
Works Director Winkel stated that the City has used a
generator in the past to perform tests of the lift station
and could continue to do so, but he stated it may be wise to
make the connection at this time to allow for proper
maintenance of the lift station.
MOTION: Hicks moved, seconded by Malone, to direct the Public
Works Director to arrange for the necessary electrical
connections for the Cleveland Avenue Lift Station.
Motion carried unanimously (4-0).
REQUEST FROM CABLE COMMISSION
TO ADOPT RESOLUTION OF SUPPORT
Councilmember Malone expressed appreciation to staff for
compiling additional information with regard to the request
from North Suburban Cable Commission to adopt a resolution
urging the Minnesota Congressional Delegation to support
cable legislation. He indicated that he did not wish to
sway other Councilmembers, but he would tend to oppose this .
type of legislation.
MOTION: Hicks moved, seconded by Growe, to adopt Resolution 92-
28 Urging The Minnesota Congressional Delegation to Co-
Sponsor and Support Cable Legislation Which Would
Provide Consumer Protection For Cable Television
Subscribers, Preserve Community Television Channels And
Funding Support, And Protect The City's Authority To
control And Manage Its Public Rights-of-Way. Moti on

COUNCIL COMMENTS
FINANCIAL INFORMATION
For informational purposes, Terry Post, Temporary City
Accountant had provided the Council with the following
financial information:
1) Investment Portfolio analysis for period of 12/31/91 -
4/30/92,
2 ) 1992 Investment Portfolio Transaction Log,
3) Budget Recap Sheets from 1/92 - 4/92,
4) Financial Summary through April 1992
Council was advised that the City Auditors will be .
presenting the 1991 audited financial statements and letter
of recommendation at the May 26, 1992 Council meeting.

Councilmember Malone commented that since Council just
received the financial information this evening, he would
need time to review the material. Mayor Sather suggested
that Council review the information and provide input to Mr.
Post.
CITY HALL SOFTWARE
Councilmember Hicks reported that he had researched prices
for computer software for the City offices and provided
price comparison information.
ST PAUL TURNERS CHARITABLE GAMBLING
Councilmember Hicks asked for an update on the st. Paul
Turners Gymnastics Charitable Gambling License issue.
Attorney Filla reported that he has had no contact with the
organization since Council took action to revoke approval of
the gambling license based upon the organization's
noncompliance with lawful purpose regulations. He stated
that he believed the matter of noncompliance has been turned
over to the Attorney General's office.
. Temporary City Accountant, Terry Post, reported that st.
Paul Turners made their January and February 1992 10%
contribution payment, but nothing more has been received.
RECYCLING ORDINANCE
Councilmember Malone referred to an April 29, 1992
memorandum from Temporary City Accountant, Terry Post,
regarding recycling service fees for multiple family
structures and manufactured home parks. Malone suggested
the City Attorney draft an appropriate ordinance to address
this issue.
Council provided the City Attorney with guidance as to their
preferred approach to recycling service fees and directed
him to draft an ordinance addressing the issue for their
consideration.
ST. MARY'S ROMANIAN ORTHODOX
CHARITABLE GAMBLING
Councilmember Growe asked if st. Mary's Romanian Orthodox
Church Charitable Gambling payments, which had fallen
behind, have been brought up to date. Temporary City
. Accountant Post reported that st. Mary's is now current in
those payments.

A RFSOLUTION ACCEPTING BID AND AUTHORIZING
EXECUTION OF CONTRACT IN THE MATTER OF THE
1992 KEITHSON AREA STORM SEWER IMPROVEMENTS
WHEREAS, pursuant to City Council Resolution, competitive bids were solicited and received
for the 1992 Keithson Area Storm Sewer improvement as set forth in the bid
tabulation attached hereto and incorporated herein by this reference; and
WHEREAS, the City Council has considered the amount of the bids and the responsibility of the
bidders and determined that Machtemes Construction, Inc. is the lowest responsible
bidder;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Arden Hills,
Minnesota:
1. The Mayor and the Acting Clerk-Administrator are authorized and directed to execute, on
. behalf of the City, such contract with Machtemes Construction, Inc. as is approved by the
City Attorney for the completion of the 1992 Keithson Area Storm Sewer improvement
according to the approved plans and specifications.
2. The Acting Clerk-Administrator is authorized and directed to forthwith return to all bidders
the deposits made with their bids upon execution of the contract above specified.

I am enclosing two Ordinances which would add regulations to
the City Code regarding the scavenging of recyclable materials and
the imposition of a residential recycling service fee.
Initially, I had a concern about the exclusivity of the City's
current service contract with E- Z Recycling Inc. and the City
. Council's request to allow an exemption in the regulation for
certain residential occupants who contracted independently for a
recycling service. In my discussions with E-Z Recycling Inc., it
was agreed that they do not have an exclusive contract with the
City.
In addition, E-Z Recycling indicated that anti-scavenging
regulations are helpful because there are economies of scale
inVOlved in this type of business. Therefore, I took the liberty
to prepare an appropriate anti-scavenging regulation for Council
review.
Three affirmative votes of the City Council are required in
order to pass the proposed legislation. A public hearing is not
legally required. If you have any questions, please contact me.

ORDINANCE NO. 286
AN ORDINANCE RELATING TO THE SCAVENGING OF iI.ECYCLABLE
MATERIALS.
The Arden Hills City Council hereby ordains that Article III,
Sections 11-22 to 11-25 and their subdivisions are hereby added to
the Arden Hills City Code to read as follows:
III. Unauthorized Collection of Recyclable Materials.
11-22. Purpose. The City of Arden Hills has contracted with a
service provider for the collection of recyclable materials and has
otherwise implemented a recycling program within the City. The
City's ability to maintain favorable contracts depends, in part,
upon the volume of recyclable materials which are placed on
curbside by Arden Hills residents. The unauthorized collection or
II scavengingll of recyclable materials will reduce the volume
available for collection as part of the designated recycling
program. Scavenging also causes confusion among participating
. residents and thereby disrupts the publicity and educational
processes of an authorized program. The purpose of this article is
to ensure that a designated recycling program will be implemented
in an orderly fashion to avoid adverse affects on the public
health, welfare, safety and environment.
11-23. Definitions.
(a) "Authorized or Designated Recycling programlr shall mean a
program for the collection and recycling of the recyclable
materials which is instituted, sponsored and/or approved by
the City of Arden Hills.
(b) "Recyclable Materials" shall mean items of refuse which are
part of an authorized recycling program of which are intended
for transportation, processing, .and manufacturing or re-use,
including but not limited to, paper, glass, aluminum, and
other metal cans and containers.
(c) t1Scavenging" shall mean the unauthorized collection of
recyclable materials that have been set out by residents of
the City specifically for collection as part of an authorized
or designated recycling program.
11-24. OwnerShip. Ownership of recyclable materials set out for
. the purpose of participating in a curbside recycling program shall
remain in the person or household from which the materials
originated until collected by an authorized collector. Upon

. removal by the City or its designated agent or contractor from a
designated collection point, ownership of properly prepared and
stored recyclable materials intended for a City authorized
collection program shall be vested in the authorized collector.
Materials not prepared, cleaned, or stored according to City
specifications shall remain the responsibility and property of the
individuals or households from which the materials originated.
Nothing in this Article shall abridge the right of any individual
to give or sell their recyclable materials to any approved
recyclable materials program.
11-25. Unauthorized Collection. It shall be unlawful for any
person who is not authorized by the City to take or collect
recyclable materials set out for an authorized or designated
recycling program within the City.
Effective Date. This ordinance shall become effective on

AN ORDINANCE IMPOSING A RESIDENTIAL RECYCLING FEE.
The Arden Hills City Council hereby ordains that Article IV,
Sections 11-30 to 11-35 are hereby added to Chapter 11 of the Arden
Hills City Code to read as follows:
IV. Residential Recycling Service Fee.
11-30. Purpose and Intent. Consistent with the policies expressed
in the Minnesota Waste Management Act (MS 115A), the City of Arden
Hills has implemented a curbside recycling program for all
residential dwelling units within the City. Although other sources
of funding will be used when available, the City Council has
determined that the economic viability of the City's residential
. curbside recycling program and the ultimate benefits resulting
therefrom require the imposition of a residential recycling service
fee.
11-31. Imposition of Fee. Except as herein provided, a
. residential recycling service fee is hereby imposed on the owners
of all residentially occupied property within the City. The owners
of multiple family dwellings and the owner of the manufactured home
park may be exempt from such fee upon furnishing proof, in a manner
satisfactory to the City Administrator, that such owners have
contracted for a collection of recyclable materials by a collector
other than the City designated collector. Proof of such alternate
service shall be submitted no later than July 15, 1992, and shall
indicate that a contract has been entered into for the succeeding
calendar year. The total number of residential dwelling units less
the total number of exempt residential dwelling units, shall
hereinafter be referred to as the total number of assessable
residential dwelling units.
11-32. Computation of Fee. Before August 31, 1992, the City
Administrator shall determine the succeeding years estimated budget
for the collection of recyclable materials for residential
dwellings and the total number of assessable residential dwelling
units within the City. The proposed residential recycling service
fee for each assessable residential dwelling unit shall not exceed
an amount equal to the unfunded portion of the estimated recycling
budget divided by the total number of assessable residential
dwelling units within the City. Unless otherwise exempted, owners
of multiple family dwellings shall be charged a recycling fee for
each dwelling unit within a multiple family structure. Unless
otherwise exempted, the owner of the manufactured home park shall
. be charged a recycling fee for each lot within the manufactured
home park.

. 11-33. Annual Review. The residential recycling service fee shall
be reviewed and approved annually by the City Council.
11-34. Collection of Fee. The City may facilitate the collection
of the residential recycling service fee by agreement with Ramsey
County to include such fee on the real estate tax statement for
individual or multiple family dwelling units. In the alternative,
residential recycling service fee statements shall be mailed to
property owners on or before April 15th, and shall be payable no
later than July 15th of each year. A penalty equal to 10% of the
amount due shall be added to delinquent accounts.
11-35. Certification of Delinquent Accounts. Each year, the City
Administrator shall prepare a list of delinquent residential
recycling service fee accounts, including accrued penalties
thereon, in the form of an assessment roll. On or before October
1st of each year, the City Council shall review the delinquent
residential recycling fee assessment roll and adopt an appropriate
resolution certifying the delinquent accounts to the County Auditor
as a lien against the real property served and further directing
that the County Auditor collect the assessment as part of the
ensuing year's tax levy. All delinquent residential recycling
service fee assessments shall bear interest, at a rate determined
by Council resolution, from the date on which the resolution is
adopted until December 31 of the following year.

Effective Date. This ordinance shall become effective on

RE: ARDEN PLACE DRAINAGE ISSUES
Dear Council Members:
As you recall, a drainage concern behind the home at 1553 Arden Place, built by Wally Bauer, .
was discussed at a public hearing on October 28, 1991. This drainage problem ponds water on the
backyards of both 1553 Arden Place, owned by Mr. Warren McGuire and 3505 Ridgewood Road,
owned by Mr. Dale Noyed. With the early winter, further discussion regarding this issue was
delayed until this spring.
. Plans presented at the public hearing were to extend a 12" pipe from the rear of 1553 Arden Place
to the south toward Lake Johanna, in the same manner as an existing storm sewer pipe.
Discussion at the public hearing from residents on the south side of Arden Place opposed the
project as disruption to their property and the fact that very little water currentll drains in the
existing pipe. Also, several residents raised concerns about discharge of fUnof containing
herbicides or other lawn chemicals toward Lake Johanna. Discussion was also heard regarding the
possibility of draining runoff to the east of Ridgewood Road to an existing ponding area owned by
the Lake Johanna Island Beach Club. We have reviewed this possibility and offer the following
comments.
We have field reviewed the possible routes to install storm sewer from the low area behind 1553
Arden place to the east. These routes include going directly from the low area to the east,
between 3487 and 3505 Ridgewood Road, or extending pipe to the south to Arden Place, then
easterly within the north right-of-way of Arden Place across Ridgewood Road. Option 1 would
require extensive removal (or trimming) of existing trees and would present construction
difficulties due to the existing ground elevations and depth of pipe. Option 1, however, is the
most direct route. Easements to contain the pipe would also have to be obtained. Option 2 is
more favorable from a construction standpoint, since the work would be within City owned right-
of-way. Disruption to existing trees would also be minimized, but it would be necessary to cross
the driveway at 3487 Ridgewood Road.
It is our opinion that if storm sewer were to be extended to the east, Option 2 would be the
preferred option. The estimated construction cost for this option is $24,000. This estimated costs
exceeds the cost of $17,000 for the direct route to the south across Arden Place due to an
additional 140 feet of storm sewer pipe, one additional manhole and driveway restoration work.

We have contacted the Lake Johanna Island Beach Club to further inquire about the likelihood that
they would allow runoff to be directed onto their property. Mr. Steve Erickson, the group's
president, did not think it would be a problem as long as the necessary easements were obtained.
However, he plans to discuss this issue with the other members.
I have received two phone calls from Mr. McGuire regarding the status of this issue. It would be
appropriate for the City Council to further consider this issue and order another public hearing to
discuss the matter with residents who contribute runoff to the problem area. Discussions
regarding financing of the project would also be necessary.
I will be in attendance at your May 26, 1992 City Council meeting to further discuss this matter.

When I first began my accounting assigrnnent at the City, one of the
first areas of investigation was charitable gambling receipts. '!he
initial scope of my work was to detennine if licensees were cu=ent in
their ten percent contrib.1tion payments to the city am if receipts-to-
date were tracking against b.Jdgeted revenues. I satisfied myself that
there does not appear to be a collection problem am estimted annual
revenue expected to marginally exceed b.Jdgeted revenue ($85,000).
. However, as I broadened my scope to detennine if licensees were
calculatiIlCl their contrib.1tion payments to the City as pres=ilied by
local Ordinance, I identified another set of issues that ultimtely will
require your consideration for resolution.
ORDINANCE FORMUIA VS. FORMUIA USED:
City Ordinance clearly defines the formula f= calculating net profit as
being gross profit less allowable expense. In actual practice, most
organizations have also been deducting "lawful expenses" (Le.; federal
state, am local taxes) fram gross profit. My interpretation of our
Ordinance, as seconded by City Attorney Filla, is that most of the
licenses organizations are not in corrpliance with our Ordinance (see
attachment) . I conservatively estimte the dollar inpact to the city of
nOl1CCRllpliance to be approximately 50 to 70 percent of contrib.1tion
payments made, or about $60,000 to $70,000 annually.
It should also be noted that I could find nothing issued by the City,
aside from the Ordinance itself, that encourages corrpliance such as a
calculation worksheet that clearly defines the basis of calculation am
serves as an audit trail.
I believe the options available regarding this issue are as follavs:
1- Aggressively pursue collection of underrep:>rted contrib.1tions
. since date of initial licensing. 'lhis approach would constitute
enforcement on a retroactive basis.

2. Consider chan:J"ing the ordinance definition of net profit to
include subtractions f= taxes paid.
3. Work with the Licensees to explain the current Ordinance
carrpliance situation, develop a payment document to calculate
future contriWtions beginning with second quarter 1992, and
commit staff resources to regulate carrpliance. nus approach is
very proactive in nature and cornrmmicates a reconciliation theme.
Before discussing these or other alternatives you may have, I believe
the Council should also consider a revenue opporbmity that would work
in concert with the 10 percent profit contriWtion.
state law pennits the imposition of up to a three percent gambling tax
of the gross profit on licensed organizations. 'Ihis tax must only raise
such revenues as are necessary to cover the costs the City incurs in
regulating lawful gambling. The City must make an annual report to the
state Galnbling Board shcMing the amount of revenue raised by the tax and
the use of the tax proceeds.
One possibility for the current level of noncarrpliance may be that city
. staff has not been diligent in regulating the gambling activities
because of resource limitations. 'Ihe imposition of a gambling tax could
fund the I'''''''''''''''?ry resource requirements.
Another benefit to having dedicated resources available would be to
monitor the organization's carrpliance with the "spending in the local
trade area" requirement of the ordinance on a more regular basis.
The seven licensed organizations are currently generating some $2.0 to
$2.5 million in annual gambling gross profits within the City. 'lhe
imposition of a one, two or three percent gambling tax would generate
approxiInately $20,000, $40,000, and $60,000 per year to regulate
gambling activities.

Whatever enforcement option is chosen, I believe all of the licensed
organizations should be monitored on a regular and consistent basis.

This week I met with Fred Reed and it does not appear that Fred will be
able to return to work prior to the end of June.
In order for Fred to receive full wage re:iJnJxlrsement to the end of June,
it would require utilization of his remaining vacation, sick leave and
Council granting approxilnatel y 54 additional hours of sick leave to
cover this ti1ne period. This employee was previously granted 29 hours of
extended sick leave.
Another option would be granting approxilnately 16 additional hours of
. sick leave for this employee, which would carry only through the next
pay period, 6/12/92, and require utilization of his a=ued vacation and
sick leave.
REC::CMlliNDATION :
Council may wish to consider extension of sick leave only to the end of
the next pay period, 6/12/92, and require a physical examination by his
doctor and a doctor chosen by the city, to determine when this employee
may return to work and perform all duties as required.
After June 12, the following options may be considered:
. Extend sick leave on a pay period basis and continue requiring
. physical examinations for the employee.
Grant no further extensions of sick leave.
. Grant a medical leave of absence without pay. (Several cities
surveyed grant employees an unpaid Jredical leave of absence for a
period of 60 days)
I am atterrpting to obtain price quotes for a physical examination to
determine if this individual is capable of returning to work and perform
all duties required. I hope to have a verbal report for Council at the
May 26 meeting.

SUBJEX:T: Purchase of Used Case Tractor fran Perron Sewer & water
Due to the untimely death of Ray Perron, Perron Sewer and Water
Construction is now selling a used 1988 Case 580-K Tractor/Backhoe. 'Ihe
backhoe is in excellent condition, with only 3,100 hours of use, and
appears to have been well maintained on a routine basis. The tractor
was operated by both Jim Perron, a current city employee, and Phil
Perron, who will be working as a terrporary employee this summer.
The price quoted is $25,000.00 and after contacting local dealers that
handle this type of equipment, I determined the amount quoted price
would be an excellent purchase. 'Ihe average selling price for this
machine is approximately $30,000, based on the age and low hours of use.
. The purchase price for a new machine of this type in 1988 was
approximately $42,000, and the price tag would be over $50,000 if this
same tractor/backhoe were purchased new in 1992.
There are no funds budgeted in 1992 for purchase of a backhoe, however,
we do have $25, 000 budgeted to purchase a Bobcat tractor. I would
prefer to utilize the budgeted funds for purchase of the Case Tractor
from Mr'S. Perron. My intent would be to still purchase a Bobcat during
this year, if p::>ssible, using any funds saved from capital expenditures
scheduled for purchase this year.
For your information, I plan to negotiate the sale = trade-in of the
Massey Ferguson tractor that is =ently used by Public Works. The
Massey tractor has been very troublesome since it was purchased in 1987.
The value of this tractor was $32,500 when purchased, and I am hoping to
realize at least $15,000 to $20,000 from the sale or trade-in of this
tractor. It appears that there may be some I1\Onies saved on the capital
equipment purchases schedule for this year. If it is not possible to
regain the $25,000 that was eannarked for the Bobcat tractor, I would
recammend that purchase of Bobcat tractor be delayed one year.
The Case 580-K Tractor/Backhoe would be put to use immediately upon
purchase for repairing manholes, gate-valves, hydrants, catch basins,
and several other projects that formerly required rental of this type of
equipment. The backhoe would also be a valuable asset during street
repairs, watermain repairs, and also maintenance of storm water ditches.

It should be note::! that when the new stonnWater Management Plan is
irnplemente::!, the city will be obligate::! to maintain most of the stonn
water areas wi thin the city.
since January 1, 1990, the City has spent approx:iJnately $3,600 with
Perron Sewer and Water, and $3,900 with C.W. Houle, Inc., for rental of
backhoes and operators to a=nplish these various activities. It is my
opinion that purchase of the Case Tractor would provide a savings of
approx:iJnately 50 percent of rental costs for this type of equipment; it
may still be necessary to contact C.W. Houle, Inc. when the repair work
exceeds the capabilities of the Case Tractor.
I will be present at the meeting to answer any questions.
ACI'ION REDUIRED:
If Council concurs with the above recormnendation, they should pass a
motion authorizing the purchase of the 1988 Case Tractor from Perron
Sewer and Water, Inc., in the amount of $25,000.00.

OVer 60 children and adults participated in the Fl= Fewer celebration on
Saturday, May 15. Ramada Inn Sj:X)nsored the annual Pancake Breakfast for the
volunteers this year. After breakfast, the volunteers went to assigned garden
sites to plant. Seven (7) J:usinesses on County Road E have gardens this year:
Ramada Inn, the former Hoigaards building, Norwest Bank, MSI, st. Paul Book &
stationery, Arden HillsjShoreview Animal Hospital, and Arden Hills Amoco.
Nine (9) gateway gardens were also planted: city Hall, Lexington & Highway
96, Lexington and County Road E (north and south side), County Road E and Old
Highway 10, County Road E-2 and Old Highway 10, County Road F and Old Highway
10, County Road D and Johanna Blvd., and Cleveland and Glen Paul.
. There was a real wann feeling among the volunteers. They expressed a lot of
fun, excitement and pride while planting.
CUMMINGS TRAIL CDNSTRUcrION:
Mark Graham and I will be meeting with the contractor on Tuesday, May 27 to
walk the trail in preparation for starting construction. I will continue to
keep in contact with the residents to answer any questions regarding trail
construction.
ELEMENrARY SCHOOL TRACK PROGRAM:
The. four Park Departments have been Sj:X)ns=ing the School District #621
Elementary Track Program since the School District dropped the program due to
bKlget cuts. The program had the final all-district meet on Wednesday, May 20
at Mounds View High School. This is always an exciting event for the
children, with over 500 children participating in the track and field events.
SPECIAL OLYMPICS:
The special education students had their Regional Track meet on Friday, May 15
at 'Ibtino Grace High School in Fridley. OVer 400 athletes from the metro area
participated in this event. This is a very worthwhile program. The athletes
~ience a lot of pride and achievement while participating.

Contract=s at Old Snelling Avenue, south of Highway 96, were on the job
. this week building the retaining wall on the south end and also
completing final dirt work behind the =00. 'Ihe final lift of blacktop
is scheduled'to be completed within the next couple of weeks.
'Ihe Tiller Lane Re=nstruction Project is scheduled to start the week of
May 25 or possibly June 1.

projects.
\ The first. Round Lake RoadWest. is slated for
recycling Ihis summer at a cost or $98,000.
The second; Dunlap Street between Red Fox

Assessments to property owners are expected
