Dear Arden Hills City Council,
I am writing to you concerning the road re-construction on North
Snelling Avenue. This re-construction has left me with a drive-
way which has a steep incline from the street which is unsatis-
factory and does not conform with its previous condition.
I am appealing to the City Council for financial reimbursement
to re-construct my driveway and yard to conform with the new,
lower elevation of the road.
As you mayor may not know, I attended all meetings pertaining
to the road re-construction. Never, at any of the meetings, was
it suggested that there would be any grade changes. I am of the
opinion that the cut in front of my driveway was made to provide
fill to facilitate the widening of the road in low areas. Mark
. Graham, of the engineering firm, claims it was a 6" cut. This,
is just not the case. I measured it with a laser device. From
the easement line to the back of the curb, which is a distance
of 13' 2" there is a two foot drop in elevation. This is the
,
elevation change from my existing driveway to the new road.
I have included pictures to show that previously, my driveway
abutted the road with no change in elevation. If the Council
wishes, I can also provide as many friends and neighbors as the
Council would like, to state that this is the true case.
Mark Graham takes the position that the Minnesota Dept. of
Transportation says that up to a 10% grade into a driveway is
acceptable. I feel that this is not a valid justification in
this case because the cut in front of my driveway was taken
purely for the economic benefit of Midwest Asphalt, in that
they did not have to truck in any material.
Drainage could not possibly be the reason, as it was, and still
is, a downhill slope. The two driveways 200' north (on top of
the hill) and Royal Hills Drive, 200' south of me, (at the bottom
of the hill) were met perfectly. I don't understand why so much
care was given to all other roads and driveways and not to mine,
nor Dorothy McClung's.
At one point, Mark Graham has suggested that they would come in
. approximately 40' into my drive to lower t~angle of the grade.
I rejected this because I do not want a two-pitched driveway.
Mark also refused to address the landscaping problem that this
and any re-construction of my driveway would entail.

At all of the meetings I attended, grade changes were never
suggested, only widening of the road. At these meetings, Terry
Maier stated that all work would be done within the easement.
I believe in the principle of Eminent Domain, but I don't feel
that it applies here. The lowered grade was simply an economic
expedient. I shouldn't have to suffer another substantial cost
because of the insensitivity of Mark Graham.
I don't want any council member to think I am looking for some-
thing for nothing. I am not seeking re-surfacing of my driveway.
I will cover that cost. I do feel, however, that the City,
Maier & Associates and/or Midwest Asphalt have an obligation
to provide the necessary funds to make the entrance to my home
(castle) at least similar to what I had before road re-
construction.
I have no solid estimate at this time, but I have talked to
some contractors. The dirt work and landscaping involved should
land somewhere between $2000 and $3000.

Dear Council Members:
This letter is intended as a reply to the June 21, 1992 letter from Mr. Francis
Podlasek regrading his driveway.
Mr. Podlasek's driveway prior to the project had a slope of 2.4% from the corner
of his garage slab to the roadway and a slope of 3.2% from a point 40 feet into
the driveway to the road. Our street reconstruction lowered the centerline of
. the street approximately 6 inches, and the establishment of a standard crown
lowered the edge of road approximately 10". This cut was made to provide a
uniform street grade torward Royal Hills Drive and to match topography on both
sides of the road. A straight prOfile on his driveway, therefore, would provide
a slope of 3.2% from the garage slab to the roadway and a slope of 5.7% from a
point 40 feet into the driveway to the road,
As a comparison, Department of Transportation and municipal engineering
gUidelines indicate that driveway grades of 10% are very reasonable for
residential driveways and are commonly used as design criteria.
Our first discussions with Mr. Podlasek occurred on Saturday, October 19, 1991.
when the concrete aprons were being placed. Mr. Podlasek was very concerned
that his existing driveway slope would not be exactly maintained and that we
should provide the same driveway slope even if it meant rebuilding his driveway
back to his eXisting concrete slab. At Mr. Podlasck's direction, we flattened
out the concrete apron as much as possible to provide positive drainage and
serve his driveway.
Further discussions were held on October 26 and October 29, 1991 between myself,
our inspector, Mr. Podlasek and the Contractor to discuss paving of his driveway
from the apron to the right-of-way. Mr. Podlasek indicated he was considering
replacement of his entire driveway, possibly with concrete, due to the condition
Of the existing pavement. We indicated that the intent of the plans was to
. match the existing driveway with bituminous surfacing, but we could extend the
bituminous patching Quantity in his driveway to improve the slope to his
satisfaction. This extension would have been to a point 40 feet from the road
and provided a 5.7% slope. This work was to be done in conjunction with Mr.
podlasek's plan to reconstruct his entire driveway. It was our understanding
over the winter that this was the plan for construction this Spring.

On April 7, 1992, I met with Mr. Pod1asek, at his request, to discuss the
driveway, Mr. Pod1asek indicated that it was now his intention to place
concrete for the entire length of his driveway and that placement of bituminous
surfacing WOUld be wasteful; as it wou1d cost him to remove it. He requested
that additional grading be done on his private property along his driveway to
match into his proposed driveway improvements. I indicated that I could not
authorize such additional work. I followed up this meeting with the attached
letter, dated May 6, 1992, to Mr. PodlaseK. This letter stated my understanding
of our meeting and that the Contractor would soan be in to complete all driveway
work.
Mr. Pod1asek did not contact me following this letter. He did, however, stop at
City Hall on May 8th and left specific direction with Ms. Cathy lago that we
should place blacktop surface back to the easement (right-of-way) line at a
slope not to exceed 10%. Mr. Podlasek was emphatic that we not cross the right-
Of-Way line "by as much as one foot." Ms. Iago phoned me with this information
and followed with the attached note. This work is exactly what was
. accomplished. The current driveway from the road to the right~of~way line is
approximately 7.9%. Had Mr, Podlasek allowed us to complete work to the spot 40
feet from the road, we would have been able to provide a slope of 5.7%. This
work would have been provided without additional cost to Mr. Podlasek as it was
a bid quantity. His present driv~way slope is well within all state and
municipal guidelines for driveway slopes.
Our offer to place bituminous surfacing to an agreed upon point beyond the
right-of-way was rejected by Mr. pod1asek. The specific directions he left with
City staff were carried out.
All construction work on this project has been completed and the final paperwork
is in process to close out the project, Neither myself or City staff have had
any contact with Mr. Podlasek since May 8th, until receipt of his letter. Every
effort has been made to treat Mr. Podlasek's concerns with honest and straight
forward answers.
I will be in attendance at the July 29th. 1992 City Council meeting, should you
have any Questions.

At the June 15 Council Worksession, I was directed by Council to review
the followin;1 subjects related to charitable gamblin;1:
. Analyze the impact of reducin;1 the current 50 percent trade
area spending requirement such that an organization would be
"revenue neutral" by carq;>lyin;1 with the current 10 percent
net profit contriJ::ution requirement.
. Discuss the above natter and the issue of irrposin;1 a
garnblin;1 tax with the City Attorney.
. TRADE ARE/\. SPENDING RrollIREMENr
A review of the supportin;1 documentation supplied by the organizations
thus far this year indicates that, as a group, carq;>lyin;1 with ooth the
10 percent net profit contriJ::ution and the 50 percent trade area
spending requirement of the present ordinance would be difficult for
most and irrpossible for same.
Specifically, organizations currently have approx.i1nately 15.6 percent of
gross profit available for discretionary spending purposes. Assuming
that all the organizations comply with the 10 percent net profit
contribltion calculation and calculate the 50 percent (effectively 40
percent) trade area spending requirement in a similar manner, then only
$30,000 (3.5 percent of gross profit) would be available for
discretionary spendin;1 purposes. It appears that this level of
discretionary spendin;1 would serve as a disincentive to the
organizations - especially in relation to gamblin;1 receipts of
$3,436,000 and gross profit (receipts less prizes) of $851,000.
'!he impact of taxes paid to the state of Minnesota by the organizations
for gross receipts, combined receipts, and pull tabs cannot be
minimized . The review indicates that same $169,000 (19.8 percent of
gross profit) of such taxes were paid durin;1 this ti1ne period. Simply
put, the organizations generally would not have the cash to satisfy the
50 percent trade area requirement if the najority of it were already
spent on tax payments.

An equitable solution may be to require the trade area spending
requirement to 30 percent (effectively 20 percent) of net profits from
the existing 50 percent level. Although not "revenue neutral" (14.3
percent of gross profit in discretionary spending v. 15.6 percent
today - 13.3 percent if a 1 percent gambling tax were inpose:l), this
approach still allows non-profit organizations an opportunity to raise
significant funds for charitable purposes.
DISCUSSION WITH CITY ATI'ORNEY:
On June 24, I discussed my June 22 memo (see attached) with Attorney
Filla. Mr. Filla generally agreed with suggestions and would be
prepared to discuss any questions Council may have about this
info:anation.
~ONS:
1. Council should mandate tlpQR 100 percent carrpliance with the
present 10 percent net profit contril:x1tion requirement retroactive
to the beginning of 1992.
2. In order to regulate 10 percent net profit contril:x1tion and trade
. area sperrling carrpliance, Council should consider imposing a 1
percent gambling tax.
3. In light of the significant aIroUnt organizations spend for various
State gambling taxes, Council should consider reducing the trade
area sperrling requirement to recognize the inpact of the State tax
l::urden to the organizations. A reduction from 50 percent to 30
percent seems appropriate.
4. Create a standardize:i reporting fonnat for licensed organizations.
The fom (see attache:i example) would require monthly reporting
(and payment) . The form would also collect trade area sperrling
info:anation.

At the Council's June 15, 1992, worksession, I presented a short report
on the rationale of in1posing a one percent gambling tax. While I
believe the majority of Council would be supportive of such a tax, two
other issues were raised. that warrant research and discussion.

'!he .issue here is when to begin aggressively pursuing underpayment
of past contrihItion payments. I recommend that our collection
efforts extend back to January 1, 1992.
2. Interplav between the trade area soendina requirement and the
. co=ect calculation of contrihItion oavrnents.
There was a feeling by some eouncil1nembers that by having the
organizations calculate co=ect contribution payments and pay a
one percent gambling tax, the licensees cash flCM would be
negatively iInpacte::l. It was suggested that the organizations
=.lId be made revenue neutral, if the trade area spending
requirement were reduced to some appropriate percentage from the
current 50 percent requirement.
While not raised at the worksession, I believe another ordinance
modification that would be beneficial would be changing the payment and
supporting documentation requirements from a quarterly to a monthly
basis. This change would be consistent with state reporting
requirements, irrprove the city's cashflCM, and be an early warning
indicator for non--cortq:)liance cases.

Could we get tcgether prior to the 6/29/92 Council meeting to discuss

Pursuant to due call and notice thereof, Mayor Sather called
to order the regular City Council meeting at 7:30 p.m.
Present: Mayor Thomas Sather; councilmembers JoAnn Growe,
Dale Hicks, Thomas Mahowald, Paul Malone. Also present
were: City Attorney, Jerry Filla; City Planner, John
Bergly; City Engineer, Mark Graham; Parks Director, John
Buckley; Public Works Superintendent, Dan Winkel; Acting

ADOPT AG~~DA
At Councilmember Malone's suggestion, Council agreed to move
"Public Comments" from before to after this evening's
. "Public Hearings" and to combine the Improvement Hearings
for Dunlap Street and West Round Lake Boulevard Improvements
since specifics for those projects are very similar.
MOTION: Malone moved, seconded by Hicks, to adopt the June 8,
1992 agenda changing the order of "Public Comments" and
combining hearings for Dunlap Street and West Round
Lake Boulevard. Motion carried unanimously (5-0).
APPROVAL OF. COUNCIL MINUTES
MOTION: Malone moved, seconded by Mahowald, to approve the
minutes of the May 26, 1992 Regular Council Meeting as
prepared. Motion carried unanimously (5-0) .
CONSENT CALENDAR
Councilmember Malone noted that Consent Calendar item "a"
regarding Pot-O-Gold Bingo Hall License Renewal should be
approved pending acceptable background investigation.
Malone asked to remove item "c" (Acknowledging Receipt of

KEITHSON POND.IMPROVEMENT
Mayor Sather opened the meeting at 7:36 p.m. for the purpose
of conducting a public hearing on Keithson Pond Assessments.
Acting Clerk Administrator Iago verified publication of the .
notice of hearing in the New Brighton Bulletin on Wednesday,
May 27 and Wednesday, June 3 and mailing to affected
property owners on May 26, 1992.
Written objections were received from:

City Engineer Graham presented a brief overview of the
Keithson Pond Improvement assessments, stating the
following:
- An independent appraiser has determined that
approximately $1,500 per lot is a justified assessment
for the improvement;
- Of the estimated project cost of $45,600, $18,000 is
proposed to be assessed to 12 properties at $1,500 .
each;
- The project has already been awarded to the low bidder
contingent upon acquisition of necessary easements.

The following comments, questions and responses were heard:
Resident Kurt Lawrence, 4516 Keithson Drive: Why is the
city involved in doing this project? Would the City be
liable in a flood situation? Why are Keithson Drive
residents the only people being assessed? Why are nearby
townhomes not assessed? I am angry about the assessment and
feel it is illegal because the City knew of the problem for
some time but allowed continued development to worsen the
situation.
City Attorney Filla: It ~s incumbent upon the City to
provide proper drainage. Assessments are proposed for
properties which contribute to the drainage problem.
Engineer Graham: The assessments proposed have been
determined justifiable by an independent appraiser.
Resident John Lawyer, 4539 Keithson Drive: There are
parcels on the west, south and east that also contribute to
the drainage problem. Why will they not be assessed? I
have submitted a letter of objection. Are objections being
. considered by the Council?
Attorney Filla: Objections are being considered.
Engineer Graham: Research of topography reveals that nearby
townhomes do not contribute to the dra;nage problem. when
the Reiling property is developed, an overall drainage plan
will be necessary as part of that development.
Resident Kurt Lawrence: I disagree with Graham regarding
drainage from the townhomes - the townhomes' drainage does
flow into the pond.
Property owner George Reiling, 661 Heinel Drive, Roseville:
Quit e a bit of the townhome property drains to the pond. I
have three photos taken at three different times that
indicate drainage problems existed a long time ago. Quite a
whil e ago, I offered my property to contain water, but the
City chose to pump water into the storm sewer instead. The
City Attorney has stated that the city can't look to the
developer to be responsible, yet that developer is still in
business and is not being pursued. Rice Creek Watershed
District (RCWD) should also be held responsible. Both RCWD
and the developer were negligent and should share costs.
. Resident Toni Tredal, 4521 Keithson Drive: I agree with Mr.
Reiling. This is not an "improvement" because residents
have the right to expect proper drainage. The City says
there is no recourse, but the City has not acted in a timely
manner in this situation.

Resident Nancy Horwath, 4510 Keithson Drive: How can we be
assessed for this project when we bought "improved" lots?
Attorney Filla: The majority of the cost in this project is
downstream. The City as a whole lS picking up the largest
share of the project costs.
Resident Kurt Lawrence: Years agol the developer, had
planned to do what is being done now but the City consultant
at the time told him it was not needed. The City has not
researched the background of this issue.
Attorney Filla: I disagree with the statements just made by
Mr. Lawrence; the City has researched the background
information available and has pursued the developer and
former engineers. To my knowledge, the developer never did
receive consent from Mr. Reiling to drain onto the Reiling
property.
Mayor Sather: The public needs to be reminded that it was
the residents of the Keithson area who asked the City for a
solution to the drainage problem. It is unfortunate that .
this situation ever happened, but we must deal with the
matter as it is. There is a problem and an available
solution, but someone needs to pay for it. The City as a
whole is paying the lion's share.
Resident Kurt Lawrence: This project does not qualify as
assessable under the definition of assessable special
assessment.
Property owner George Reiling: Have there been lawsuits
initiated against the developer or the former engineer? I
won't cooperate with the City in this matter until the City
ini tiates lawsuits.
Attorney Filla: There are ways of resolving these types of
issues without going to court. If Mr. Reiling would
cooperate regarding easement acquisition, project costs
would be substantially less. Past agreements indicate that
the properties involved in this matter are properly
assessable.
Resident Michael Giel, 4534 Keithson: It appears mistakes
were made by the City years ago and now the residents are
the "end of the line" when someone needs to pay. I will
fight this assessment and refuse to pay one dime. .
Resident Robert Stennes, 4540 Keithson Drive: I agree with
comments of my neighbors. I don't believe our property can
justifiably be assessed as its drainage does not contribute
and the property does not benefit whatsoever.

Resident Dick Foster, 4527 Keithson Drive: I'm confused
about the assessment policy. The City should have funds for
regular storm sewer drainage. How is a $1,500 per lot
assessment warranted? I have suffered tree loss on my
property already as a result of the drainage problem. I
feel an assessment in addition to the tree loss is unjust.
Attorney Filla: The appraiser's figures support the
assessment. The appraiser did state that each property may
require individual review, but $1,500 per lot is a
justifiable assessment amount.
Engineer Graham: The City does not have an overall City-
wide storm water utility plan at this time.
Resident George Crimmins, 4509 Keithson Drive: I agree with
my neighbors' comments. where did the City think the water
was going to go? Rather than being assessed, I should be
compensated for my loss of property caused by this
situation.
Attorney Filla: Regarding damages to properties, such
. cl aims are handled as a separate issue, not as a reduction
of assessment. I encourage residents to deal with such
claims through informal discussion with the City before
ini tiating lawsuits.
Resident Kurt Lawrence: We are told we can't be "double
assessed" for one benefit, but that is what is happening
here because the ori gina 1 lot prices paid by the residents
reflected "improved" lots.
Attorney Filla: I disagree with Mr. Lawrence's statement -
property owners have not already paid for the pond
improvement.
Resident Ron Horwath, 4510 Keithson Drive: If everything
was approved by the City before development began, why
wasn't drainage addressed then?
Attorney Filla: In review of the case, we have not found
documentation to support the logic behind what was done
during development, but it was known then that downstream
improvements would be needed. It ~s uncertain why the
anticipated downstream situation was not dealt with then.
Resident Kurt Lawrence: It bothers me that the City
. Attorney says problems were anticipated yet the City did not
deal with those issues then.
Resident Anne Hill, 4528 Keithson Drive: If this problem
was anticipated all along, shouldn't the City or someone

else have taken responsibility to notify residents?
Attorney Filla: We are unsure what the developer had in
mind, but it was known that Keithson Pond was not designed
as a permanent solution, that an outl et would eventually be
necessary.
Resident Jean Crimmins, 4509 Keithson Drive: RCWD and past
engineers are responsible. I was told by the previous owner
of my home that the City held money to deal with this
situation. I reca 11 the city Attorney saying to Counci 1 at
a past meeting that the City must take action to correct the
problem. Assessments are not warranted and this is not an
improvement.
Attorney Filla: I do recall saying the City is responsible
to find a solution to the problem, but don't recall saying
the City is responsible to pay or that assessments won't be
warranted.
The public hearing was closed at 8:29 p.m.
Councilmember Malone summarized the arguments heard this .
evening into two major categories: 1) Dispute over drainage
area, and 2 ) Dispute over benefit to properties. Council
agreed that these are the two items which need to be
formally addressed.
Attorney Filla stated that he believes every property owner
on the proposed assessment roll has filed an objection and
perhaps Council should formally respond with a ruling on
each objection. He added that since most of the objections
were just received this evening, it would be appropriate to
continue this meeting in order to allow time for proper
review and informed response.
MOTION: Malone moved, seconded by Growe, to continue this
hearing to the June 29, 1992 regular Council meeting at
8:30 p.m. in order to provide adequate time for
informed response to all objections received, Motion
carried unanimously (5-0) .

Attorney Filla advised all residents that the City must
receive all written objections by the end of today.

Mayor sather opened the meeting at 8:49 p.m. for the purpose
of conducting a public hearing on improvements for Dunlap
Street. Acting Clerk Administrator Iago verified
publication of the notice of hearing in the New Brighton
Bulletin on Wednesday, May 27 and Wednesday, June 3 and
mailing to affected property owners on May 26, 1992. Iago
reported that no written comments or objectives had been
received.
Engineer Graham briefly explained the street improvement
project plans and anticipated project schedule for Dunlap
Street from Grey Fox to Red Fox Roads. He reported that six
of the nine properties involved are owned by st. Paul
Properties. He compared the estimated costs of
reconstruction of the street (about $199,000) versus cold-
in-place recycling of the street (about $50,400 plus sub-
surface soils correction). He recommended the cold-in-place
recycling option and explained the financing policy for the
project whereby 50% of the total costs are absorbed by the
. City as a whole and 50% is assessed to benefiting
properties. He emphasized that actual assessments will be
determined and presented later at the assessment hearing,
but are estimated at about $14 - $15 per front foot.
,John Komula, representing Marquette Partners and st. Paul
Properties, expressed support for the project and acceptance
of estimated assessments.
There were no further comments from the public; the public
hearing was closed at 8:57 p.m.

Discussion took place regarding the anticipated combined
City's share for improvement projects to Tiller Lane, Dunlap
Street and West Round Lake Road and how these costs might be
handled. councilmember Malone suggested researching the
possibility of borrowing against the PIR fund. He noted
that some cost allocations between the general fund and PIR
fund should be investigated by City staff. He also stated
that the City Accountant may be required to make adjustments
to these fund balances.

Tom Balyk, representing Dennis Foster, applicant for Case

to report some confusion which has taken place with regard
to Mr. Foster's application and to request prompt Counci 1
action.
MI:'. Balyk stated that Mr. Foster's Case 90-9 for a site plan
review was considered some time ago by the City, but when
MI:'. Foster recently came to the City to complete the process
in order to meet upcoming closing and construction
deadlines, he was told by the City that he must begin the
entire procedure over because the site plan approval had
expired.
Mr. Balyk reviewed portions of December 1990 Council minutes
relating to Case 90- 9 and said the minutes do not indicate a
site plan expires in one year. He said the applicant was
confused by information received from the City, did not
anticipate any delay, and is now faced with a time
constraint in meeting upcoming commitments.
Mayor Sather asked if Council consideration at the next
regular meeting on June 29, 1992 would be early enough to
meet Mr. Foster's deadlines. Balyk said the closing is
. currently set for June 12, 1992 and Mr. Foster will suffer a
severe financial impact if the matter is not addressed
before cl osing. Balyk indicated that if Counci 1 would
consider taking action at their June 15 worksession meeting,
perhaps he could postpone the closing until then.
Councilmember Mahowald commented that this issue and the
next item on this evening's agenda (consideration of
development moratorium) are tied together. Councilmember
Malone commented that the fact that Mr. Foster allowed the
site plan to expire is the reason for the delay now.
Mr. Balyk stated that conflicting information was received
from City staff relative to the application procedure. City
Planner Bergly said he did inform the applicant of the
process and also advised the applicant when the site plan
was due to expire, but the request to extend the site plan
was received after expiration date of council approva 1 .
MI:'. Foster said that in discussion with Mr. Bergly before
the site plan expired, his understanding was that the site
plan would be in suspended status, could be revisited later,
but would not expire. He added that his application was
introduced and considered before the development moratorium
became an issue.
. Councilmember Mahowald and Mayor Sather suggested that it
may be appropriate for the Planning Commission to revisit
this issue. Attorney Filla stated that he was not aware
unti 1 this evening the deadlines that Mr. Foster is under,

and recommended consideration of this matter at the June 15,
1992 worksession rather than responding this evening.
Filla added that action on the development moratorium could
sti 11 be accomplished this evening and amended later if
necessary. Filla further explained to the applicant that no
suggestion is being made that this application will be
handled differently than any other application, that the
City needs to review the situation and determine how to
appropriately respond.
Mr. Balyk stated that if Council could at least begin
dialogue on this issue at their June 15 worksession, he
would wait for a decision on June 29, 1992.
MOTION: Mahowald moved, seconded by Malone, to place Case 90-9
on the June 15, 1992 Counci 1 worksession agenda and
direct the City Attorney to prepare an opinion on this
matter. Motion carried unanimously (5-0) .
A representative from Mr. Foster's real estate company
explained the timing elements involved from the standpoint .
of real estate and marketing.
Attorney Filla advised the applicant that all the conditions
attached to the previous site plan should be provided to the
City by the end of the day June 11, 1992.
UNFINISHED AND NEW BUSINESS
CONSIDERATION OF IMPOSING
DEVELOPMENT MORATORIUM
City planner Bergly commented that the Planning Commission
is in the process of reviewing and modifying the current
City zoning code and has discussed requesting Council to
implement a development moratorium over the last few months.
He noted the Planning Commission is now recommending Council
consider the imposition of the moratorium.
Attorney Filla explained the moratorium would cover the
entire City (with possible exclusions) for a period of one
year (with possible lS-month extension), the purpose of
which would be to allow time to consider redrafting of City
zoning regulations. He advised that the issue of a
development moratorium needs a public hearing at the
Planning Commission level with the usual public hearing .

CASE #92-06 SPECIAL USE PERMIT

Council had received written request from Theodore Brausen
to defer action on Case No. 92-06, (Special Use Permit for
Amoco Oil Co. at 1306 West County Road E) to the July 13,
1992 regular Council meeting.
MOTION: Malone moved, seconded by Hicks, to defer Case 92-06 to
July 13, 1992. Motion carried unanimously (5-0).
. CASE #92-11 SPECIAL USE PERMIT
TWIN CITY ~~T SUPPLY

City Planner Bergly advised that Twin City Pet Supply has
requested a special use permit to allow sale of pet
supplies, and allow club meetings, seminars, and dog
training at their store at 1212 Red Fox Road in the B-4
district.
Bergly reported that the Planning Commission conducted a
public hearing on this application at their June 3, 1992
meeting, where they recommended approval with the conditions
that 1) The City be allowed to review the operation in one
year, 2) The applicant provide a copy of the lease and
evidence of title, and 3) The applicant comply with any
stipulations of the Fire Marshall.
Councilmember Mahowald questioned whether it may be
appropriate to limit how long the special use permit would
be allowed. Attorney Filla advised that the nature of a
special use permit is that it runs with the land rather than
with the tenant, therefore, a new tenant could use the
property in the same way if conditions of the special use
permit were met.
. The applicant, Letty Afong, owner of Twin City Pet Supply,
was present and Attorney Filla advised that the proof of
ownership received with the application is not adequate;
that current proof of ownership would be required as a

be acceptable proof of ownership.
MOTION: Malone moved, seconded by Growe, to approve a special

CASE #92-07 VARIANCE
FRANK & MARY BETH RANALLO
1355 CUMMINGS LANE
Council had received written request from applicant Mary
Ranallo to table action on Case #92-07 (variance to allow a
la-foot solid wall at 1355 Cummings Lane) to allow time to .
review alternate plans with the Planning commission at their
July 1, 1992 meeting.
MOTION: Malone moved, seconded by Growe, to table action on
Case 92-07 until the regular July 13, 1992 Council
meeting. Motion carried unanimously (5-0).
CASE 92-08 VARIANCE
JAMES DLUGOSCH
1482 ARDEN VIEW DRIVE
City planner Bergly explained the applicant, James Dlugosch,
is proposing the erection of a six-foot solid wall along his
side property line which would provide privacy screening for
the pool proposed in the rear yard of the Dlugosch property.
He added this would require a variance from the ordinance
either as it relates to fences (which requires 30% open
area) or as it relates to walls (which restricts a wall to
42 inches in height).
Bergly further eXplained that immediately to the east of
1482 Arden View Drive is an easement for a trail which
serves as a buffer between single family properties and
higher density townhome properties to the east. He added
that the Planning Commission reviewed this case and .
recommended denial of a variance due to insufficient finding
of hardship.
Mr. Dlugosch stated that plans for the home at 1482 Arden
View Drive call for a pool in the rear yard, that pools are

required to be enclosed. Rather than a fence, he preferred
the enclosure be accomplished by a stucco wall, the finish
of which would match the exterior of the house and create a
more pleasant aesthetic architecture.
Mr. Dlugosch stated he understands the concerns of precedent
setting and the need for finding of hardship, having himself
served on the New Brighton Planning Commission, but thinks
the solid wall would function the same as a fence, and there
are no neighbors near enough to be impacted by the wall.
When asked to provide input, Planner Bergly opined that the
wall would not infringe substantially on the trail or have
negative impact on the public. He stated he would accept
the wall, but suggested perhaps staggering the height and
shortening the length of the wall to make it appear less
obtrusive.
Councilmember Malone commented that while he appreciates the
applicant's arguments, he shares the Planning Commission's
concern of closing off the view from the trail. He
suggested some creative fencing which would coordinate with
. the architecture of the home and pool.
Councilmember Mahowald stated that it appears the proposed
wall is not much different from a fence and perhaps the more
aesthetic option would be preferred.
Councilmember Hicks asked what is planned for the rear of
the pool area. Me Dlugosch said that is yet to be
determined, that there is a severe cliff behind the pool
which must be dealt with. Hicks asked if Dlugosch would
accept a wall of less length, perhaps not running all the
way to the front corner of the house. Mrs. Dlugosch said
that would be a possibility, but it would limit the use of
the property on the east side of the house as backyard.
MOTION: Malone moved, seconded by Mahowald, to deny a variance
for Case 92-08 on the grounds of lack of demonstrable
hardship. Motion carried (3-2; Growe & Mahowald voted
nay) .
CASE #92-10 SIDE YARD VARIANCE
EVIE DUNN, 3465 SIEMS COURT
City Planner Bergly explained that Case 92-10 involves a
request for a sideyard variance of three feet to allow
. expansion of an attached single car garage to a double car
garage at 3465 Siems Court. He added that there is no other
possible layout which would conform to ordinance without the
need for a setback variance. He reported that Planning
Commission recommended approval.
Arden Hills Council 14 June 8, 1992 .
MOTION: Hicks moved, seconded by Growe, to approve a variance
to sideyard setback of three feet for the expansion of
the garage at 3465 Siems Court (Case 92-10), with the
conditions that:
- The building plans and elevation for the addition
be reviewed and approved by the Planning
Commission;
- The applicant satisfactorily address the drainage
issue involving the proposed garage at 3465 Siems
Court and the neighboring garage.
Motion carried (4-0-1; Mahowald abstained).
SAC CHARGES FOR ARDEN MANOR
Attorney Filla reported that a meeting between the Arden
Manor Park owner and the Metropolitan Waste Control
Commission (MWCC) , the purpose of which is to determine how
sites should appropriately be charged SAC charges, was
originally set for June 6, but has been postponed to June
12. Filla stated that the City, as collection agency for
the MWCC, will administer collections based upon the outcome
of the June 12 meeting. Filla will follow up on this item.

DISCUSSION - MAY FINANCIAL REPORTS
Temporary City Accountant, Terry Post, provided Council with
May 1992 financial reports. Post stated that with regard to
year-to-date-receipts and disbursements, he would prefer to
report after necessary account variances are properly
posted. Council thanked Post for an excellent job in
reporting and keeping Council abreast of financial
conditions.
MEDICAL LEAVE OF ABSENCE FOR
PUBLIC WORKS EMPLOYEE FRED REED
Public Works Superintendent Winkel reported that the medical
progress of public works employee, Fred Reed, has slowed per
Mr. Reed's doctor. Winkel stated that he has discussed the
payroll situation with Reed who is aware of all the issues
and has requested a 90-day medical leave.
MOTION: Mahowald moved, seconded by Growe, to grant a 90-day
unpaid medical leave of absence, as requested by Fred
Reed, commencing June 10, 1992 to September 10, 1992.
Motion carried unanimously (5-0) .
RESIGNATION - MAUREEN WINKEL .
BUILDING MAINTENANCE EMPLOYEE
Public Works Superintendent Winkel reported that Maureen
Winke 1 has submitted her resignation from the position of

building maintenance, effective June 1, 1992. He added that
in discussing this with Ms. Winkel, she indicated she would
be willing to continue her position until September 1992 if
the matter of compensation (which has not been increased
over the past three years) could be reviewed.
MOTION: Malone moved, seconded by Hicks, to direct the Public
Works Superintendent to determine an appropriate market
rate for the building maintenance position, offer that
rate to Maureen Winkel, and look for a replacement
after September 1, 1992. Motion carried unanimously
(5-0).
COUNCIL COMMENTS
TOUR OF CITY HALLS
Acting Clerk Administrator Iago inquired and received a
count of Councilmembers planning on touring city halls on
June 10, 1992.

. COTTAGE LIFESTYLES ~ JOIUL ARKELL
Acting Clerk Administrator Iago asked if Council is
interested in meeting further with John Arkell regarding the
proposed senior housing project. Consensus of Council was
that Mr. Casserly could provide input On this matter, given
the fact that it would involve many elements inel uding tax
increment financing. Iago volunteered to compile
information from other cities to assist Council in this
matter.
INTERVIEWING - CLERK ADMINISTR~r~_~
Councilmember Hicks asked what arrangement the City has made
with the Jim Brimeyer Group. Councilmember Mahowald
explained the Jim Brimeyer Group has been asked to assist
the City in the process of filling the vacant Clerk
Administrator position, at a cost of approximately $3,000.
It was noted that interview with Brimeyer is scheduled for
the June 15 worksession.
KEITHSON POND
councilmember Hicks recalled the former City Engineering
consultant had discussed other corrective measures for
. Keithson Pond. Engineer Graham noted he had conversations
with the former engineer but the corrective measure did not
appear to be a viable solution. Hicks expressed
frustration with the Keithson Pond issue.

Councilmember Malone said it is important to note that most
comments received this evening regarding Keithson Pond were
simply accusations and misstatements of fact, but did not
deal with the assessment per se.
Councilmember Mahowald advised that in reviewing his
calendar, he realized he will not be in attendance at the
June 29 Counc il meeting, and asked if Counci 1 would consider
rescheduling the continuation of Keithson Pond assessment
hearing until July 13 so he could be in attendance.
Engineer Graham reminded Council that all the residents
present this evening were informed that the meeting would
continue on June 29; if Council reschedules, renotification
of all residents would be necessary.
MOTION: Mahowald moved, seconded by Hicks, to move the
continuation of Keithson Pond Assessment Hearing from
June 29, 1992 to 7:30 p.m. on July 13, 1992, and direct
staff to provide proper notice to residents. Motion
carried unanimously (5-0).
Mayor sather commented that although it was not brought up .
at this evening's hearing, at one time the City Engineer and
the Keithson developer were ready to reshape the pond and
residents of the area stopped that action. He reminded that
residents have not supported the City throughout the entire
issue. He stated he would prefer to take action soon to
bring this issue to a close rather than chasing the issue of
past responsibility which does not appear to be cost
effective.
BUDGET INFORMATION
(This item was moved from Consent Calendar for the purpose
of discussion.)
Councilmember Malone referred to the direction given at the
last Council meeting for the Public Works Superintendent and
Parks Director to analyze and report regarding 1991 budget
variances. Malone said he was satisfied with the
completeness of the report regarding the 1991 Park Program
Fund deficit provided by Mr. Buckley and Mr. Post, but was
not satisfied with the reporting of public works variances
provided by Mr. Winkel.
Councilmember Mahowald commented that he too had questions
after reviewing Winkel's analysis of Public Works variances.
REGIONAL TRANSIT BOARD .
Mayor Sather announced that the Regional Transit Board has
officially approved the new mass transit plan (with minor

plan will provide increased service to Arden Hills
residents.

Please [md enclosed three copies of Pay Estimate #1 for the 1992 Bike Trail Improvements. The
total project cost for the bike trail between Hamline Avenue and Cummings Park, as well as the
additional work approved b$' the City Council at Hazelnut Park, was $21,493.68. The total
original contract trice was 21,321.90 and the additional work was not to exceed $1,500, for a
total contract of 22,821.90. The actual quantities for the bike trail under ran the bid, so we were
. able to include the additional work and remain close to the original contract amount. John
Buckley has reiterated that this cost is entirely fundable through his park improvement budget.
We respectfully recommend that payment of $21,493.68 be made to Bituminous Consulting &
Contracting, Inc. with all but $500 released at this time. The $500 retainage could then be
administratively released when the proper fmal documentation, such as lien waivers, is received.
Please contact me if you have any questions. I will be in attendance at your June 29, 1992
Council meeting.

however, it is generally understood and accepted that with the additional responsibilities in
Arden Hills the starting salary would be more in the $45,000 to $50,000 range. The additional
responsibilities will include supervision of the Director of Public Works and the Parks and
Recreation Director plus general management responsibilities.

We anticipate receiving a great deal of assistance from the acting City
Administrator in developing information about the community, the organization,
and the position. It would be our intention to meet with the Council and staff
to more appropriately assess the acceptable management style and determine
some community priorities which will be the primary responsibility of the new
City Administrator.
Estimated hours: 8-12
Phase II Conduct direct recruiting of individuals who may be qualified and interested in
the position. We will screen the resumes of those wbo are interested and
conduct both personal and telephone recruiting of candidates. We will screen
the number of candidates to approximately 10-12 and then further reduce that
number to 5-7 to be presented to the City Council. We will provide a summary
of these preferred candidates in the form of a Progress Report, present that
report to the City Council and participate in the discussion and selection of
candidates for interviewing.

. Phase III
After reviewing the Progress Report with the Council and selecting the number
of candidates, we will conduct background and reference checks on the
candidates to be interviewed. We will provide the City Council with questions
to ask the candidates and an evaluation form associated with the questions and
the Position Profile.
Estimated hours: 6-8
The total estimate of hours for the above work should not exceed 40-45. Should the Council
ask us to participate in the interview process, coordinate the interviews, arrange meetings with
candidates, or other related activities, this would be at the direction of the City Council. In
addition, should the Council ask us to negotiate the compensation package with the preferred
candidate, this would require additional hours.
The rate is $110 per hour plus expenses. The Brimeyer Group charges for normal expenses
including mileage; meals; courier services; long distance telephone; conducting credit,
education, and criminal checks; copies and miscellaneous expenses. It is expected expenses for
this assignment will not exceed $100-$200.

RE: ARDEN PLACE DRAINAGE ISSUE
Dear Council Members:
A public hearing will be held at the June 29, 1992 City Council meeting for the above referenced
project.
Following is a summary of this project thus far. A feasibility study and plans and specifications
were prepared in September 1991 to replace the existing pipe that extends from the low area
. behind 1553 Arden Place to the south across Arden Place, and between 1540 and 1548 Arden
Place. Quotes were received for the project. The lowest construction cost estimate received was
for $16,675, which would yield a project cost, based on 25% overhead, of $20,800. I met with
all homeowners who would be affected by construction of this project as originally planned.
The existing pipe does not appear to be contained within an easement. If the City did in fact
o~ginally install the pipe, it may be legally possible to claim a prescriptive easement over the
pipe.
A public hearing was held on October 28, 1991 to discuss the project. There were 8 properties
notified for this hearing, which were those properties that topography maps indicate contribute
storm water runoff. No field topography work was accomplished. The City's Assessment Manual
contains a method of assessing storm sewer improvements by dividing the project cost equally
among the lots contributing runoff.
At the public hearing, a great deal of opposition was heard from many of the notified residents
outside of the two residents with standing water on their property. Comments received included
those who felt the house at 1553 Arden Place should not have been built, the lack of formal
easements over the existing pipe, the quality of the storm water to be directed to Lake Johanna and
the method of payment for the project.
The result of the public hearing was two-fold. We were directed to review th.e possibility of
draining runoff to the east, across Ridgewood Road, to property owned by the Lake Johanna
Beach Club. We also "gain contacted the Rice Creek Watershed District, who verified that runoff
from this small drainage area would have a negligible impact on water quality in Lake Johanna.
The major snowstorm at the end of October 1991 caused any further wok on this matter to be
. delayed until 1992.

In May 1992, we reviewed the site and determined that a possible construction alternative would
be to extend pipe within the north right-of-way of Arden Place and across Ridgewood Road into
property owned by the Lake Johanna Beach Club. Another option to extend the pipe between
3487 and 3505 Ridgewood Road was dismissed due to the depth of excavation and extensive tree
removal, We contacted both the former and current president of the Beach Club, who indicated
they would not oppose the project if the proper easements were obtained.
As presented at your May 18, 1992 Council meeting, the estimated construction cost to extend
storm sewer pipe to the Lake Johanna Beach Club property is $24,000. Using the same 25 %
overhead figure, the estimated project cost would be $30,000. This cost is higher than the option
discussed last fall due to an additional 140 feet of storm sewer pipe, an additional manhole and
driveway restoration work. The cost of obtaining any necessary easement from the Beach Club is
purely speculative, but we would hope it would be minimal.
The attached exhibit shows both the option presented last fall and the new option toward
Ridgewood Road. Should the City Council choose to move forward with the original proposal, it
would be necessary to approve the plans and specifications and order advertisement for bids.
. Should the City Council choose to move forward with the new proposal, it would be necessary to
order preparation of plans and specifications, which we would present at the next City Council
meeting for approval and advertisement for bids. The necessary resolutions have been prepared
for your consideration for either option.
A central question to either option for this project is the method of financing. Should assessments
be pursued, it will be necessary to hold an assessment hearing.
We will be prepared to make a brief presentation at the June 29, 1992 City Council meeting and

Dear Arden Hills City Council,
I am writing to you concerning the road re-construction on North
Snelling Avenu.e. This re-construction has left me with a drive-
way which has a steep incline from the street which is unsatis-
factory and does not conform with its previous condition.
I am appealing to the City Council for financial reimbursement
to re-construct my driveway and yard to conform with the new~
lower elevation of the road.
As you mayor may not know, I attended all meetings pertaining
to the road re-construction. Never, at any of the meetings, was
it suggested that there would be any grade changes. I am of the
opinion that the cut in front of my driveway was made to provide
fill to facilitate the widening of the road in low areas. Mark
Graham, of the engineering firm, claims it was a 6" cut. This,
tI is just not the case. I measured it with a laser device. From
the easement line to the back of the curb, which is a distance
of 13' 2" there is a two foot drop in elevation. This is the
,
elevation change from my existing driveway to the new road.
I have included pictures to show that previously, my driveway
abutted the road with no change in elevation. If the Council
wishes, I can also provide as many friends and neighbors as the
Council would like, to state that this is the true case.
Mark Graham takes the position that the Minnesota Dept. of
Transportation says that up to a 10% grade into a driveway is
acceptable. I feel that this is not a valid justification in
this case because the cut in front of my driveway was taken
purely for the economic benefit of Midwest Asphalt, in that
they did not have to truck in any material.
Drainage could not possibly be the reason, as it was, and still
is, a downhill slope. The two driveways 200' north (on top of
the hill) and Royal Hills Drive, 200' south of me, (at the bottom
of the hill) were met perfectly. I don't understand why so much
care was given to all other roads and driveways and not to mine,
nor Dorothy McClung's.
At one point, Mark Graham has suggested that they would come in
.-a. approximately 40' into my drive to lower t~angle of the grade.
I rejected this because I do not want a two-pitched driveway.
- Mark also refused to address the landscaping problem that this

and any re-construction of my driveway would entail.

At all of the meetings I attended, grade changes were never
suggested, only widening of the road. At these meetings, Terry
Maier stated that all work would be done within the easement.
I believe in the principle of Eminent Domain, but I don't feel
that it applies here. The lowered grade was simply an economic
expedient. I shouldn't have to suffer another substantial cost
because of the insensitivity of Mark Graham.
I don't want any council member to think I am looking for some-
thing for nothing. I am not seeking re-surfacing of my driveway.
I will cover that cost. I do feel, however, that the City,
Maier & Associates and/or Midwest Asphalt have an obligation
to provide the necessary funds to make the entrance to my home
(castle) at least similar to what I had before road re-
construction.
I have no solid estimate at this time, but I have talked to
some contractors. The dirt work and landscaping involved should
land somewhere between $2000 and $3000.

This letter 1s intended as a reply to the June 21, 1992 letter from Mr. Francis
Podlasek regrading his driveway.
Mr. Podlasek's driveway prior to the project had a slope of 2.4% from the corner
Of his garage slab to the roadway and a slope of 3.2% from a point 40 feet into
the driveway to the road. Our street reconstruction lowered the centerline of
# the street approximately 6 inches, and the establishment of a standard crown
lowered the edge of road approximately 10". This cut was made to provide a
uniform street grade torward Royal Hills Drive and to match topography on both
sides of the road. A straight prOfile on his driveway, therefore, would prOVide
a slope of 3.2% from the garage slab to the roadway and a slope of 5.7% from a
point 40 feet into the driveway to the road.
As a comparison, Department of Transportation and municipal engineering
gUidelines indicate that driveway grades of 10% are very reasonable for
residential driveways and are commonly used as design criteria.
Our first discussions with Mr, Podlasek occurred on Saturday, October 19. 1991.
when the concrete aprons were being placed. Mr. Podlasek was very concerned
that his existing driveway slope would not be exactly maintained and that we
should provide the same driveway slope even if it meant rebuilding his driveway
back to his existing concrete slab. At Mr. Podlasek's direction, we flattened
out the concrete apron as much as possible to provide positive drainage and
serve his driveway,
Further discussions were held on October 26 and October 29, 1991 between myself,
our inspector, Mr. Podlasek and the Contractor to discuss paving of his driveway
from the apron to the right-Of-way. Mr. Podlasek indicated he was considering
replacement of his entire driveway, possibly with concrete, due to the condition
of the existing pavement. We indicated that the intent of the plans was to
match the existing driveway with bituminous surfacing, but we could extend the
- - bituminous patching Quantity in his driveway to improve the slope to his
- satisfaction. This extension would have been to a point 40 feet from the road
- and prOVided a 5.7% slope. This work was to be done in conjunction with Mr.
Podlasek's plan to reconstruct his entire driveway. It was our understanding
over the winter that this was the plan for construction this Spring.

On April 7, 1992. I met with Mr. podlasek. at his request, to discuss the
driveway. Mr. Podlasek indicated that it was now his intention to place
concrete for the entire length of his driveway and that placement of bituminous
surfacing would be wasteful" as it would cost him to remove it. He requested
that additional grading be done on his private property along his driveway to
match into his proposed driveway improvements. I indicated that I could not
authorize such additional work. I followed up this meeting with the attached
letter, dated May 6, 1992. to Mr. PodlaseK. This letter stated my understanding
of our meeting and that the Contractor would soon be in to complete all driveway
work.
Mr. Podlasek did not contact me following this letter. He did, however. stop at
City Hall on May 8th and left specific direction with Ms. Cathy Iago that we
should place blacktop surface back to the easement (right-of-wayl line at a
Slope not to exceed 10%. Mr. Podlasek was emphatic that we not cross the right-
Of-Way line "by as much as one foot." Ms. Iago phoned me with this information
and followed with the attached note. This work is exactly what was
# accomplished. The current driveway from the road to the right-of-way line is
approximately 7.9%. Had Mr. POdlasek allowed us to complete work to the spot 40
feet from the road. we would have been able to provide a slope of 5.7%. This
work would have been provided without additional cost to Mr. Podlasek as it was
a bid Quantity. His present driveway slope is well within all state and
municipal guidelines for driveway slopes.
Our offer to place bituminous surfacing to an agreed upon point beyond the
right-of-way was rejected by Mr. Podlasek. The specific directions he left with
City staff were carried out.
All construction work on this project has been completed and the final paperwork
is in process to close out the project. Neither myself or City staff have had
any contact with Mr. Podlasek since May 8th, until receipt of his letter. Every
effort has been made to treat Mr. podlasek's concerns with honest and straight
forward answers.
I will be in attendance at the July 29th. 1992 City Council meeting, should you
have any questions.

At th,,, June 15 Council Worksession, I was directed by COlmcil to review
the following subjects related to charitable gambling:
, Analyze the inpact of reducing the current 50 percent trade
area spending requirement such that an organization would be
"revenue neutral" by complying with the current 10 percent
net profit contr:iJ::ution requirement.
. Discuss the above matter and the issue of inqx>sing a
gambling tax with the city Attorney.
. TRADE AREA SPENDING REOUIREMENT
A review of the supporting doctnnel1tation supplied by the organizations
thus far this year indicates that, as a group, complying with both the
10 percent net profit contr:iJ::ution and the 50 percent trade area
spending requirement of the present ordinance would be difficult for
most mn impossible for some.
Specifically, organizations currently have approximately 15.6 percent of
gross profit available for dis=etionary spending purposes. Assuming
that all the organizations comply with the 10 percent net profit
contritution calculation and calculate the 50 percent (effectively 40
percent) trade area spending requirement in a similar manner, then only
$30,000 (3.5 percent of gross profit) would be available for
discretionary spending purposes. It appears that this level of
discretionary spending would serve as a disincentive to the
organizations - especially in relation to gambling receipts of
$3,436,000 and gross profit (receipts less prizes) of $851,000.
'The :iJnpact of taxes paid to the state of Minnesota by the organizations
for gross receipts, combined receipts, and pull tabs cannot be
min:iJnized. 'The review indicates that some $169,000 (19.8 percent of
gross profit) of such taxes were paid during this time period. Simply
put, the organizations generally would not have the cash to satisfy the
50 percent trade area requirement if the majority of it were already
spent on tax payments.

An equitable solution may be to require the trade area spending
requireJ:lient to 30 percent (effectively 20 percent) of net profits from
the existing 50 percent level. Although not "revenue neutral" (14.3
percent of gross profit in discretionary spending v. 15.6 percent
today - 13.3 percent if a 1 percent gambling tax were imposed), this
approach still allows non-profit organizations an opportunity to raise
significant funds for charitable purposes.
DIsaJSSION WI'lH CITY ATIORNEY:
On June 24, I discussed my June 22 memo (see attached) with Attorney
Filla. Mr. Filla generally agreed with suggestions and would be
prepared to discuss any questions Council may have about this
information.
~TIONS:
1- Council should mandate upon 100 percent conpliance with the
present 10 percent net profit contribution requirement retroactive
to the beginning of 1992.
2. In order to regulate 10 percent net profit contribution and trade
, area spending conpliance, Council should consider ilrposing a 1
percent gambling tax.
3. In light of the significant al1lOUTIt organizations spend f= various
State gambling taxes, Council should consider reducing the trade
area spending requirement to recognize the impact of the State tax
b..lrden to the organizations. A reduction from 50 percent to 30
percent seems appropriate.
4. create a standardized reporting format for licensed organizations.

At its meeting last evening, the Mounds View School Board voted to change the
District 621 School Board election date from May to November, effective 1993.
. The motive for doing so is to encourage greater voter participation.
While we believe the change will help eliminate voter confusion about
inconsistencies in where and when to vote, we also recognize the change will
raise some concern among election administrators as we deal with the details
of altering the system. Addressing this issue, one suggestion put forth in
Board discussion was to seek legislation that would permit four year terms,
with elections in even numbered years.
This action by the School Board has generated questions for me as it will for
you. Your guidance will be welcome. I will be in contact with you as the
process evolves.

. I spoke with John Arkell on Tuesday, June 16, 1992. I explained
to Mr. Arkell that the City was comfortable with the proposed
land use for this site, but the Council was concerned about the
amount of tax increment that had to be invested. I told John we
needed to have some room to negotiate on the level of tax
increment and at this time we did not anticipate providing 100%
of it, John Arkell understands our position and will work with
us to minimize the tax increment investment. Until we are
farther along on the project, I have no idea what level of tax
increment is necessary to make the project work.
In any event, John Arkell will proceed with the planning of this
project, In about six weeks he will be approaching the City
regarding the public finance provisions. If anything further
needs to be done, please let us know.

and ObjectiveS for the 90's". These revisions encompass all State, Federal, and City policy

relate to topics which revolve around intergovernmental concerns for which the City of
Arden Hills and the City of New Brighton can cooperate and communicate.

cooperation as well as a way to assist us in revising this plan in our upcoming goalsetting
process.
We believe that this document will clearly illustrate the direction of the City in the coming

The city of Arden Hills has begun planning for the design and
construction of the new city Hall and Public Works facilities.
In the process of identifying candidate sites for these facilities, our
City Hall study Connnittee identified the Sunfish Lake area of the TWin
cities Ordinance Plant.
This is 'an opportunity for Arden Hills to improve both the quality and
. image of our facilities as well as an opportunity to begin a new
partnership with you as one of the significant members of our community.
We are proposing that Arden Hills acquire the southeast =rner of the
Ordinance Facility with the area effectively bounded by the extension of
HaInline Avenue on the west, Highway 96 on the south, Lexington Avenue on
the east and a line approxbnately 400 feet north of the north boundary
of the new National Guard Training Facility on the north - exclusive of
the property which incorporates the new National Guard Facility (sketch
attached) .
We would like to arrange a meeting with the appropriate officials to
discuss this matter and to further explore what we believe can be a
mutually beneficial opportunity.

CUMMINGS TRAIL
Bituminous Construction Company has completed the trail from Curmnings
Park to HaInline Avenue.
Mark Graham will be requesting final payment f= this project at the
June 29 Council meeting. '!he CUrmnings Trail and the additional work at
Hazelnut was completed for $100 over the original bid of $21,321.90.
'Ibe Park =ew is presently seeding and mulching the edges. 'Ibis task
will be completed next week.
. 'Ibis new trail is extensively used by the neighborhood and employees of
Cardiac Pacemakers and Control Data, during the noon hour.
BALLFIEID IMPROVEMENTS
'Ibe installation of overhangs have J:een campleted at Floral, Royal
Hills, Hazelnut, Perry 1 and Perry 4 backstops.
Player safety fences have been placed at Perry 1 and Perry 4, Floral and
CUrmnings fields.
ARSENAL STATUS REPORT'
I called Colm1ander Schulte this week to find out the status of our
request for arsenal property for the Athletic Complex. Colm1ander
Schulte stated the follCl'i/ing:
-the arsenal buildings are being down-graded and naintenance-
reduced to save l1\Oney.
- the homes along I35W will be vacated by september this year to
reduce naintenance cost.
- there is no l1\Ovement toward releasing the 25 a=es for an
Athletic Complex.
There has been a change in Mr. Schulte's Carnrnanding Officer, so I will
send another letter to rejuvenate the process.

As directed by Council at the June 8, 1992, Council meeting, I have reviewed
the treatment of costs related to the 1991 Pavement Management Program and
offer the following analysis for your review.
ISSUE:
Council was of the understanding that fifty percent (50%) of the estimated
costs related to the bituminous overlay of streets portion of the 1991
Pavement Management Program would not be funded out of the General Fund. It
appears that one hundred percent (100%) of these costs were funded by the
General Fund in 1991.
. BACKGROUND:
The year 1991 narked a policy change for the city in that, for the first t:i1ne,
the City assessed fifty percent (50%) of estimated costs for bituminous
overlay of streets to abutting property owners. Previously, this type of work
had been treated like sealcoating costs and funded in the streets Department
of the General Fund.
The city went through a public hearing procedure in early 1991 and levied

getting the February and March reports to you; I thought I had already
gotten them out earlier. A number of projects have kept me extremely
busy in both my regular business and Department activities.
Also included are the mutual aid reports for the same time period
showing our calls.

SUBJECT: Public works weekly Report
The jetter truck was utilized every day this week and the annual sewer
Ilaintenance seems to be going very well this sununer. There continues to be a
few easement problems, due to trees and bushes being planted on utility
easements . I have attempted to deal with the encroachments on an individual
basis.
Several hours were spent on Tiller lake this week; on Tuesday, a possible
watennain leak occurred at the corner of Dunlap and Tiller. The ground was
very saturated and the water appeared to be under pressure. The =ew dug up
the watennain in the area and allowed the Ilain to be exposed overnight. No
leaks were found and no water ran into the hole. The hole was then
backfilled, since it appeared this could be caused by a natural spring in the
area. The Contractor also experienced some difficulty with the project; the
. entire section of street fram Carlton to Hamline should be subcut and refilled
with sand/gravel by the end of this week.
On Wednesday staff and Council representatives met with BRW Architects. These
meetings are scheduled fram every other Wednesday at 7:30 a.m. The next
meeting will be on Wednesday, July 8, at 7:30 a.m. at City Hall.
The Public W=ks =ew also had some hydrant repair this week. While using a
hydrant on Arden Oaks Drive, a r=k got caught in the seat of the hydrant and
, the =ew was unable to shut it off. The =ew shut off the gate valve in front
of the hydrant to stop the water flow, dismantled the hydrant and repaired
daJrage to the "seat".
The =ew also spent one-half day checking and preparing a punch list of
repairs on the North Snelling Avenue project; the reconstruction job is near
completion, with the exception of a small amount of cleanup items to be
addressed.

overview of the differences between financing a municipal project on a
general obligation b:md versus a lease-purchase agreement basis.
The key financial difference in the analysis appears to be the fact that
homestead properties would pay approximately 80% Irore under a general
obligation bond scenario than with a lease financing alternative.

Bayport, Minnesota
The City of Bayport recently put to voter referendum the question of a $700,000 General
Obligation Bond for a public works building. While the City Council realized the building was
necessary for present and future purposes it was their decision to let the residents determine
whether or not the project should proceed. According to Council Member Larry Hering, the
decision to pursue a voted general obligation bond over the lease-purchase option was purely
political in that the Council "did not want to face the music of circumventing an election." The
majority voting were in favor of the project, albeit slim
With this $700,000 General Obligation Bond, the City of Bayport is right at their Net Debt
Limit which could pose problems should the need arise in the near future for capital equipment
acquisition (also under the net debt purview). Moreover, had the City chosen to proceed with a
lease-purchase agreement as opposed to a voted bond, a larger proportion of the annual debt
service payments would have been shifted to commercial/industrial properties in the community
and less to residential homesteads as will be explained further in a moment.
Apple Valley, Minnesota
The City of Apple Valley also needed to construct a public works building to handle
development the City is experiencing. Instead of issuing general obligation bonds, the City chose
. to finance the $2,560,000 project through a municipal lease-purchase agreement. The rational for
this decision was two-fold:
1. The issuance of general obligation bonds would have put the City too rlo,e to its
Net Debt Limit, ~nd in light of future equipment needs, the ,City wished to
"preserve" its gt,hcral obligation allowanceJor this purpose.
2. While the City of Apple Valley respects citizen opinion, a voter referendum was
feared to fail. In the minds of the City Council and Staff, this vote might appear to
be in the residents best short-term interest, however, not to the community's
long-term benefit. Therefore, the lease option allowed the City to proceed in a sure
and expedient manner.
Finally, I have enclosed a cash flow a-nalysis for each a general obligation issue and a lease-
pnrchase agreement. As you will note, each of the issues are structured for a 20-year term with a
par amount of $2,120,000 which nets out approximately $2,000,000 for applicable project costs,
For the most part, the two issues are structured similar to one another with three noticeable
exceptions, First, the interest rates on the lease altemative are slightly higher than that of the
general obligation issue due to the greater risk factor associated with the lease, Our projections of
the present bond market indicate that an average coupon rate difference of 6.232% to 6.334%
would exist between the general obligation and the lease alternatives, respectively. Second, Juran
& Moody would recommend that a public sale be pursued if the general obligation method is
selected and a negotiated sale if a lease is preferred, Third and most important deals with the tax
impact of the two financing methods. Please note columns K through R on the analyses. The
Minnesota Legislature recently enacted into law a bill requiring voted debt to be spread across the
. community on a market value basis as opposed to the tax capacity value. In short, this legislation
will put a $100,000 market value homestead on the same tax impact base as a $100,000 market
value commercial/industrial operation. Under the previous law, the annual tax levy would have

been spread against the tax capacity value of community where commercial and industrial
properties would pay a larger share of the annual debt service payments due to their higher
classification rates. While this is the case for general obligation bonds, the same is not nue for
lease-purchase agreements. Since leases are not considered debt, the lease payments are allocated
from the general fund which is spread across the tax capacity value of the community. As a result,
columns M through R illustrate significantly lower tax increases under the lease scenario for all
homestead properties.
