Council Agenda Consent Calendar Item No. No. 4b. regarding . solicitation request fram Greenpeace - Per City Ordinance, nonprofit organization is able to canvass pending receipt by the city of name, address, phone number, and Social Security of those who would be doing the canvassing . This has been received and will be forwarded to the Sheriff's office pending the approval by City Council. The Greenpeace organization will be canvassing fram October 1 through October 31 between the hours of 5:00 p.m. to 9:00 p.m., Monday through Friday, fram 11:00 a.m. to 3:00 p.m. on Saturdays, and 3:00 p.m. to 7:00 p.m. on SUndays. B. Council Agenda Consent Calendar Item No. 4c. regarding certification of reduced assessment roll - Agreement has been reached with for settlement on assessments on PIN #34-30-23-42-0053. The assessment roll to the County needs to be reduced in order to reflect this item being removed fram the assessment roll. C. Council Agenda Consent Calendar Item No. 4d. regarding Mr. Francis Podlasek - Conciliation Court has ordered the city to pay Mr. Podlasek $978. The city previously agreed to pay $850.00. D. Cotmcil Agenda Consent Calendar Item No. 4e. regarding approval of expenditure to purchase copier - The copier expense was not rodgeted for the 1992 rodget. However, during rodget discussions for 1993, the Cotmcil approved reviewing copiers returning and to submit a recommendation. staff has evaluated tllree different copiers and recamrnends the purchase of a reconditioned Minolta 4902 at a cost to the City $2,995 (including $1,000 trade-in). Recommendation is for purchase of this item and is on the Consent Agenda due to the previous general agreement from the City Council. E. Cotmcil Agenda Unfinished and New Business Item No. 7A regarding on site false alarm notices - Ramsey County Sheriff's Deparbnent tllrough the Policing Contract with the city of Arden Hills has offered the service. Alarm notices would be placed by the Officer on site at the time of response. 'Ihe City of North Oaks has the service in place and has seen this as a very positive service to its citizens. '!he benefit is that there is an . irmnediate notice to the homeowner placed by an Officer. The Sheriff's Dept. will respond immediately to the request by the city COilllcil if it is so approved to begin this service on any false alarm reports and at the time of checking the prerni~. staff recornrnendation is to approve this service as offered by the Sheriff's Deparbnent at no additional charge to the city. Council Agenda Public Hearing Item No. 6 regarding Arden Place storm Sewer Inlprovement - Enclosed infonnation includes Chronological History, explanation of project from City Engineer, proposed resolution and appraisal infonnation. You will note that the appraisal infonnation excludes several property owners as not benefitted from the project, with several property owners paying higher than notice was sent. A notice of hearing has also been received for the Rice Creek Watershed District to undertake a project entitled Rice Creek/wrrj lake Sedlinentation Project. The hearing is to be held on October 24, 1992, at 7:00 p.m. in the Council Chambers at Shoreview city Hall. The estimated cost of improvement is $80,000 funded by a district-wide Ad Valorem levy to be proportioned to each of the counties in the matter of all=ation of the adrninistrati ve fund of the District. MOTION: Malone moved, seconded by Hicks, to adopt the September 14, 1992 agenda as revised by staff. Motion carried unanimously (5-0). CONSENT CALENDAR Referring to consent calendar item "C"I the last page of the application for a Bingo Hall License from Arden Hills Pot O'Gold Bingo Hall, entitled "Bingo Hall Personnel Affidavit" , Councilmember Mahowald noted the caption on the top of that page reads "State of Minnesota, County of Hennepin". He asked staff to investigate whether the County designation is correct, and request the applicant change it if appropriate before executing the necessary documents. UNFINISHED AND NEW BUSINESS DISCUSSION OF PROPOSED REVISION OF ADMINISTRATOR JOB DESCRIPTION Attorney Filla advised t.hat proposed Resolution No. 92-65 was drart.ed, per t.ask rorce direction, to derine the duties . of t.he City's Clerk Administ.rat.or. Counci1member Mahowald commented that the newly added language will accomplish the intent or moving away rrom multiple reporting lines to a new style which gives the Administrator mOre vested authority. Filla stated that if Counci I so desires, a organizational fl ow chart could be incorporated into the resolution. Mahowald stated he did not consider that necessary. Counci1member Malone quest.ioned whether responsibility or hi ring and firing or staff would be delegated to the Administrator if the resolution were passed. Attorney Filla said those duties would be the responsibility or the Administrator. Malone caut.i0ned Council to be certain that the pr.oposed resolution conveys Council's int.ent. Clerk Administrator Person st.ated that her understanding is . that 1 ) The only change would be the lfnguage quoted by . Attorney Filla, 2) Council would stil have responsibility for overall planning and policy approval, and 3) The Administrator would have authori ty to execute and implement, yet be account.able t.o Counci I. * . Arden Hi 11 s Counci 1 3 September 14, 1992 Filla concurred, and added that Council would continue to have~ 311thori ty to determine the total amount. of staffing and the City's step/grade pay plan, however the Administrator would be responsible to take appropriate actions to implement those plans by determining numbers of staff members and deciding upon appropriate salary increases, etc. Councilmember Mahowald commented that he is comfortable with the arrangement outlined in the proposed resolution and is confident that the Administrator will be accountable to the Council and report regularly on relevant matters. MOTION: Mahowald moved, seconded by Malone, to adopt Resolution 92-65 Describing The Scope Of Authority And Responsibilities Of The Arden Hills City Administrator. Motion carried unanimously (5-0). CASE NO. 92-16; SITE PLAN REVIEW 1160 WEST COUNTY ROAD ,E - JOE COMMER~ Planner Bergly reported that the Planning Commission, at their regular September 2 meeting, reviewed a site plan, . submitted by building owner Joe Commers, to remodel the old Hoigaard property at 1160 West County Road E for use as a bank and video rental store. Bergly stated that at the Planning Commission's direction, a special meeting amongst the applicant, architect, construction manager, planner, and Planning Commission Cpair was held to further discuss items at issue, such as traffic patterns, access, parking, and landscaping. Berg1y advised that the development moratorium would need to be waived for this project, and the applicant is seeking a two phase approval - the site related elements to be approved in September to allow fall construction and site paving to occUr before potential frost, and the building plans to be approved in October 1992. He added that the Planning Commission has recommended waiving the moratorium, and approval of the applicant's building permit to undertake building demolition and site related work; but before the building permit is issued for the facade reconstruction, further ap9roval must be granted by the Planning Commission, Council and Building Inspector. Bergly illustrated via a sit~ plan map, the plans to remove the outer walls at the west end of the existing building and for the creation of a canopy for a multiple-lane drive through bank teller. He stated that the latest traffic plan . for the site is a one-way pattern arou~d the building, with appropriate signage, which was agreed fo at the special meeting. . l',rden Hi 11 s Counci 1 4 September 14, 1992 . Counci1member Malone asked how the assessed valuation of the building is expected to be affected by the removal of the existing walls. Construction Manager, Peter Hilger, stated that the valuation of the building , 0 primarily determined ~~ by the lease agreement for the building, that the proposed changes are expected to make the site more usable, so the assessed valuation is not expected to be negatively affected. Applicant Joe Comme::-s f commented that the expected end result is that the assessed valuation should remain the same. Counci1member Malone commented that he would be comfortable loTi th a two-phase approval process only if everyone involved understands that approval of phase one in no way assures approval of phase two. He added that it is not intended that construction be unreasonably delayed, but the applicant must understand the risk invol ved. Peter Hilger commented that the applicant lS aware of the risk involved but has requested the two-phase approval in order to begin demolition prior to t.he comlng of inclement weather. Deputy Clerk Iago reported that t.o date there has been no input received from the Fire Chief. Attorney Filla st.ated . that Fire Chief input is necessary at this time since the future access to t.he building is being determined. He added that it must also be understood that the development moratorium would be waived only for phase one at this time. Att.orney Fill a eXP1ai~ed the purpose of the development mo]~atorium is t.o assu^e that any projects undertaken during the time the zoning ordinance is being revised will be consistent with proposed zoning ordinance revisions. Bergly stated that the only aspect of the site plan which is still an issue is parking; the parking plan as submitted may not meet the existing or the proposed zoning ordinance. He added, however, that parking requirements are based upon the square footage and use of the buil ding, and the applicant has stated that a portion of the mezzanine of the building will not be used by either tenant, which would reduce the square footage factor. Bergly reported that employee parking is appropriately located on the southeast corner of the building. The question arose whether the need for any variances is anticipated. Bergly comment..d that he does not anticipate the need for any variances and,. in fact, aft er the reconstruction, the site lS expected to be more conforming than it is now. . Councilmember Mahowald commented that he does not anticipate problems with approval of phase two, but the City must maintain control over the approval process. He added that ------ . . Councilmember Mahowald stated that the one-way traffic pattern around the building appears to be the most workable plan, though not idea 1 . Planner Bergly ,stated t.hat. the Planning Commission is more comfort.ab1e wit.h the one-way design t.han any previous designs considered. Counci1member Mahowald asked for a reVl e'..;T of t.he parking and landscaping plans. Regarding parking, planner Bergly explained t.hat. t.he existing parking is quite close t.o Count.y Road E and is proposed t.o be moved furt.her from t.he street. He illust.rat.ed the addit.ional landscaping and lighting plans for t.he site and st.at.ed t.hey appear suit.able. Councilmember Mahowald asked if it. would be appropriat.e to request the applicant. att.empt to acquire an egress from the adjacent propert.y. Bergly report.ed that the applicant has approached the adjacent property molner in this regard, but the adjacent property owner is unwilling to provide the . egress, and condemnat.ion is not '",arranted. With regard to parking, Bergly added that the uses of the bank and the video store compliment each other in that peak bank traffic is expected at different hours than peak video store traffic; t.he only heavy traffic hours for both might be Friday evenings. Councilmember Hicks stated that it may be to the adjacent property owner's advantage to provide an egress as it may encourage bank traffic to use the adjacent shopping center. Attorney Filla stated that the City can go on record requiring the applicant to provide an improved exit if an egress can be acquired from the adjacent property owner. Arden Hills Counci 1 6 September 14, 1992 . Councilmember Malone reminded the applicant that during phase two approval, signage plans must be submitted in comformanoe with the sign ordinance. HOTION: Halone moved, seconded by Mahowald, wi th regard to Cas e 92-16 to: Waive the Development Moratorium for phase I , while reserving that option for phase II; - Authorize the applicant to proceed only with: - Site-related reconstruction and renovation as shown on the latest site plan, and - Building demolition with reconstruction only of the west wall columns and footings; This approval is given with the understanding that: - Building plans, elevations, materials, signage, landscaping and lighting details shall be presented for review at the October Planning Commission and Council Meetings; - No Certificates of Occupancy shall be issued for the bank until building, slgnage, 1 ighUng and landscaping plans are approved by the City; - No site work is to be completed prior to approval of the plan by the Fire Chief; . - The applicant is required to construct an improved egress to the property if and when the adjacent property owner agrees to provide the necessary easement~ - Approval of Phase I gives no assurance of future approval of Phase I I ; the applicant must apply for approval of Phase I I with the Planning Commission and Counci 1 . AUTHORIZATION TO EXTEND 90-DAY LEAVE FOR PUBLIC WORKS EMPLOYEE FRED REED Ccuncil reviewed a report from Public Works Superintendent Winkel which provided an update with regard to the condi Uon of Public Horks Employee Fred Reed. The J:eport pointed out that Reed's . c. Moti on carried unanimously (5-0). Councilmember Malone commented that from now on, personnel . matters such as this will be the responsibility of the City Administratoi:. . Arden Hills Council 7 September 14, 1992 DISCUSSION OF BOND REFERENDUM Attorney Filla stated that he has spoken with the people involved in the proposed city Hall project. and t.hey are comfortable wit.h a bond referendum. He added t.hat. t.he wording for t.he referendum can be changed up until t.he t.ime t.he ballot.s are print.ed, the proposed wording iC'. ~ . "Shall t.he Cit.y of Arden Hills be aut.horized to issue General Obligat.ion Bonds In an amount not. t.o exceed 2.8 million dollars for the const.ruction of a new Public Works/Maintenance Facilit.y?" Councilmember Mahowald comment.ed t.hat t.he proposed wording appears to be suit.able. He encouraged a concentrated effort. t.o communicate to t.he public why the facility is needed. Council reviewed a list. of possible key contact persons who may provide input. and/or assist in distributing information regarding the referendum. Clerk Administrator Person asked Council t.o provide addit.ions or changes as soon as possible. Councilmember Mahowald st.ated that a public information . meeting of all key cont.acts, City committees, department heads and Council needs to take place immediately to discuss effective means of communicating to the public the need for this facility. He said it would also be appropriate to develop a schedule of efforts toward accomplishing that aim. Mayor Sather announced that a press release has been prepared for release this week which illustrates the City's population growth and City Hall growth and provides sound justification for the facil ity. MOTION: Malone moved, seconded by Hicks, to authorize the Clerk Administrator to place the bond referendum, worded as outlined above, on the November ballot. Motion carried unanimously (5-0). Council directed Clerk Administrator Person to work with Planning Commission Chair Probst to assure appropriate pursuit of this matter. COUNCIL COMMENTS PODLASEK DRIVEWAY ISSUE Councilmember Malone commented that In light of District Court's recent judgment that the City pay Francis podlasek $978 for problems associated with his dri ve'Hay allegedly due to the improvement of North Snelling Avenue, perhaps it would be appropriate to reverse council's previous offer to pay podlasek $800 for this matter. Deputy Clerk Iago informed that the City has until September 29, 1992 to appeal the District Court judgment. Attorney Fill a recommended against appeal. Malone asked counsel if the assessment roll for the project . should be amended because of this judgment. Attorney Filla said this matter will appear on a Council agenda in the near future. ARDEN PLACE DRAINAGE ISSUE Councilmember Mahowald asked if the City will be prepared in two weeks to conduct an assessment hearing on t.he Arden Place drainage issue. Attorney Filla st.ated that, at a minimum} the Council can hear comment.s at the Sept. ember 28, 1992 hearing and then continue the hearing if necessary. To: Mayor and city Council From: Dorothy Person, City Administrator Date: August 28, 1992 , Re: False Alarm Appeal Process Recommendation The City has received a request for an appeal of a false alarm charge. The property owner has appealed this charge. The city ordinance provides for a charge ($50.00) following issuance of four notices of false alarm responses. At issue is the proper process to follow for review of the appeal. In order to obtain information re: the typical appeal process, the neighboring cities of New Brighton and Shoreview were contacted. Also contacted was the Ramsey County Sheriff's department re: their knowledge of others' processes. The typical process followed is an administrative appeal. In New Brighton, the Chief of Police hears the appeal, and in Shoreview, the Assistant Administrator hears the appeal. They report that the issues are usually addressed in this forum. . The most commonly given reasons for appeal are 1) situation beyond the control of the property owner, such as an electrical storm, heat inside the building for heat sensitivity. Documentation of such is requested and reviewed; or 2) owner error, which is usually a new alarm system. The cities look for documentation of the reasons given and showing of the owner taking preventative measures to ensure that these situations do not re-occur. The primary reason given if not one of the above for not wanting to pay the charge is that the amount is too high, in which case the owner is requested to write a letter to the city for ordinance change request. We are objecting to the amount of the assessment. It appears that the eight homes involved are to pay for 100% of the proposed $32,560 project (At one time the estimate . we heard was to be in the $17,000 to $22,000 range.) It has been well documented that it is a city drain, and we feel that, therefore, the city should bear some, if not most of the expense. It is evident that this drain has not worked properly for at least 13 years, during which time taxes have continued to be paid on all properties In another recent drainage project in Arden Hills (the Keithson Pond project), the proposed cost was $120,000 and the maximum homeowner assessment was $1,500. It appears that the 100% assessment is out of line, and that the city has tried to absolve itself of any financial responsibility for this drain We must strongly protest this proposal. This storm sewer will serve a small pond located behind 1553 Arden Place, which has been discussed at several Council . meetings over the last year. Please find attached the necessary easement documentation for your group's review. The first item is an Agreement to Convey Easement, along with an exhibit describing the easement on the property. This easement will allow the pipe to cross onto the property within a strip of land 20 feet wide by 40 feet long. The pipe will be centered within this easement and will disturb a smaller area. The specific alignment of the pipe will be established within the easement to minimize tree disruption. We would estimate 5 to 10 trees will need to be removed. The easement is necessary so that the pipe can be maintained by the City in future years as required. The easement also allows storm water to be conveyed from the small pond behind 1553 Arden Place to the group's property. Construction of the project cannot begin on the property until the Agreement to Convey Easement is executed by your group. It is anticipated that the construction of this project will occur in early October, so your prompt attention to this issue is greatly appreciated. The other form attached is a Grant of Permanent Easement. This form does not need to be executed as quickly as the other form, since construction can start without it. The City Attorney, as detailed in his attached letter, requests that the group provide an Abstract of Title or Owner's Duplicate Certificate of Title for the easement property. As of this writing, we have not secn this appraisal report, We were asked to provide an engineering opinion to the appraiser of what percentage eaeh of the eight lots contribute toward the total runoff. These pcrcentages are shown on the map along cach address. However, the appraisal report will define how these percentages can be used. An easement document has bccn prepared and forwarded to the Arden Hills Island Beach Club for their consideration in allowing the storm sewer pipe to convey runoff into their property. This casement would need to be granted prior to construction of the project. .. Attached for your consideration is a resolution awarding the contract to the low bidder, Ro-So Contracting, Jnc. We have also inspected the homes involved on a drive-by basis. Attached are phot~of the homes and drainage area, and listing information on each of.the properties. . It is our understanding drainage problems such as flooding and erosion haveocurred to 1553 Arden Place, 3487 Ridgewood Road and 3505 Ridgewood Road. As reported in the feasibility study the flooding and erosion has ocurred since the home at 1553 Arden Place was constructed in 1989. The existing storm sewer pipe was installed by the City in the mid 1960's and does not appear adequate to handle the runoff created by the surrounding properties along the ridge of the low area. The City has proposed storm sewer improvements to serve this drainage area. Per the feasibility study a catch basin will be installed in the rear lot of 1553 Arden Place to collect the storm water runoff. At this time it is unclear where the runoff will be directed. In consideration of possible "benefits" to the homes in the project area, we have made the assumption that the drainage problem can be cured through some type of reasonable storm sewer construction. Using figures provided by Mark Graham (Maier, Stewart and Associates Inc.) which show the contributing drainage area for each lot and their corresponding percentage of the total runoff, we have split the cost of the proposed project e.,. (estimated at $32,560.00) between the contributing properties. This is shown on the following pages. This cost does not necessarily relate directly to benefit. {,I 1 ; -< --...~ . Based on the information we have at this time, in our estimation only the three properties experiencing drainage problems will receive a direct benefit from the new storm sewer. In this case by "benefit", we mean allevation of the drainage problems. The remaining five properties which may be assessed for this project will not benefit since to the best of our knowledge, they have not experienced any problems from the existing drainage system. If the flooding and erosion is not corrected, then clearly those properties affected would experience a loss in value. The loss in value may be measured against the cost to cure the problem and repair any damage to the properties caused by the flooding and erosion that has already ocurred. It should be noted, this is not an appraisal, but an opinion as to possible benefits to the properties involved in the proposed drainage project. Shade Tree Disease Control - Council direction to staff was to inunediatelv in=ease pricincr by 50% for the removal of diseased trees from private prooortv. Anticipated inpact was to reduce amount of operating subsidy from the General FUnd in 1993. However, inpact of pricing change will be more evident for the 1994 Budget. This is because most of the 1993 trees are already marked and lower prices quoted. The 1992 J:udget deficit is funded by a 1993 General FUnd operating transfer expenditure. 5. Proaram FUnd - Council gave direction to the Program SUpervisor to manaqe the fund to a worst case $42 , 600 subsidy level while also evaluating revenue increases where . feasible and appropriate. 6. Park FUnd - state omitted a planned 1993 expenditure of $1,100 for Gateway Flower Gardens. The Park & Recreation Director also expressed an interest in redirecting some capital J:udget resources in 1993. UNFINISHED AND NEW BUSINESS DISCUSSION OF PROPOSED REVISION OF }iDMINISTRA,[,QR JOB DESCRIPTION Attorney Filla advised that proposed Resolution No. 92-65 was drafted, per task force direction, to define the duties . of the City's Clerk Administrator. He pointed out that the duties are consistent with what State law allows, and are prima;:;ly the same as before except that language has been added stating "The City Administrator shall supervise all Administrative staff end be directly accountable to the City Council." He said th Administrator position would be similar in fashion to a Chief Executive Officer, if the resolution is passed. Councilmember Mahowald commented that the newly added language will accomplish the intent of moving away from multiple reporting lines to a new style which gives the Administrator more vested authority. Filla stated that if Council so desires, a organizational flow chart could be incorporated into the resolution. Mahowald stated he did not consider that necessary. Councilmember Malone questioned whether responsibility of hiring and firing of staff would be delegated to the Administrator if the resolution were passed. Attorney Fill a said those duties would be the responsibility of the Administrator. Malone cautiGned Council to be certain that the proposed resolution conveys council's intent. Clerk Administrator Person stated that her understanding is . that 1) The only change would be the l,nguage quoted by Attorney Filla, 2) Council would stil have responsibility for overall planning and policy approval, and 3) The Administrator would have authority to execute and implement, yet be accountable to Council. . . Arden Hills Council 3 September 14, 1992 Filla concurred, and added that Council would continue to have authority to determine the total amount of staffing and the City's step/grade pay plan, however the Administrator would be responsible to take appropriate actions to implement those plans by determining numbers of staff members and deciding upon appropri ate salary increases/ etc. Councilmember Mahowald commented that he is comfortable with the arrangement outl ined in the proposed resolution and is confident that the Administrator will be accountable to the Council and report regul arl y on relevant matters, MOTION: Mahowald moved, seconded by Malone, to adopt Resolution 92-65 Describing The Scope Of Authority And Responsibilities Of The Arden Hills City Administrator. Motion carried unanimously (5-0). ~,ASE NO. 92-16; SITE PLAN REVIEW 116iL WEST COUNTY ROAD E - JOE COMMERS Planner Bergly reported that the Planning Commission, at their regular September 2 meeting, reviewed a site plan, . submitted by building owner Joe Commers, to remodel the old Hoigaard property at 1160 West County Road E for us e as a bank and video rental store. Bergly stated that at the Planning Commission's direction, a special meeting amongst the applicant, architect, construction manager, planner, and Planning Commission cfair was held to further discuss items at issue, such as tra fie patterns, access, parking, and landscaping. Bergly advised that the development moratorium would need to be waived for this project, and the applicant is seeking a two phase approval - the site related elements to be apprDved in September to allDw fall construction and site paving tD occur befDre potential frostl and the building plans tD be approved in october 1992. He added that the Planning CDmmissiDn has recommended waiving the moratorium, and apprDval of the applicant's building permit to undertake building demolition and site related work; but before the building permit is issued for the facade reconstruction, furth,.)/ approval must be granted by the Planning Commission, Council and Building Inspector. Bergly illustrated via a sit.@ plan map, the plans to remove the outer walls at the west end of the existing building and fDr t.he creation of a canopy for a multiple-lane drive through bank teller. He stated that the latest traffic plan . for the site is a one-way pattern arou~d the building, with appropriate signage, which was agreed 0 at the special meeting. ----- . Arden Hills Council 4 September 14, 1992 . Councilmember Malone asked how the assessed valuation of the building is expected to be affected by the removal of the existing walls. Construction Manager, Peter Hilger, stated that the valuation of the building is primarily determined by the lease agreement for the building, that the proposed changes are expected to make the site more usable, so the assessed valuation is not expected to be negatively affected, Applicant Joe Commersl commented that the expected end result is that the assessed valuation should remain the same. Councilmember Malone commented that he would be comfortable with a two-phase approval process only if everyone involved understands that approval of phase one in no way assures approval of phase two. He added that it is not intended that construction be unreasonably delayed, but the applicant must understand the risk involved. Peter Hilger commented that the applicant is aware of the risk involved but has requested the two-phase approval in order to begin demolit.ion prior to the coming of inclement weather. Deputy Clerk Iago reported tbat to date there has been no input received from the Fire Chief, Attorney Filla stated . that Fire Chief input is necessary at this time since the future access to the building is being determined. He added that it must also be understood that the development moratorium would be waived only for phase one at this time, Attorn,,,y Filla eXPlaiced the purpose of the development moratorium is to assu e that any projects undertaken during the time tbe zoning ordinance is being revised will be consistent with proposed z onl,ng ordinance revisions. Bergly stated that the only aspect of the site plan which is still an issue is parking; the parking plan as submitted may not meet the existing or the proposed zoning ordinance. He added, however, that parking requirements are based upon the square footage and use of the building, and the applicant has stated that a portion of the mezzanine of the buil ding will not be used by either tenant, which would reduce the square footage factor. Bergly reported that employee parking is appropriately located on the southeast corner of the building. The question arose whether the need for any variances is anticipated. Bergly comment~d that he does not anticipate the need for any variances and, In fact, after the reconstruction, the site is expected to be more conforming than it is now, . he does Councilmember Mahowald commented that not anti cipa te problems wi th approval of phase two, but the City must maintain control over the approval process. Councilmember Mahowald asked for a review of the parking and landscaping plans, Regarding parking, planner Bergly explained that the existing parking is quite close to County Road E and is proposed to be moved further from the street, He illustrated the additional landscaping and lighting plans for the site and stated they appear suitable. Councilmember Mahowald asked if it would be appropriate to request the applicant attempt to acquire an egress from the adjacent property. Bergly reported that the applicant has approached the adjacent property owner in this regard, but the adjacent property owner is unwilling to provide the . egressl and condemnation is not warranted, with regard to parking, Bergly added that the uses of the bank and the video store compliment each other in that peak bank traffic is expected at different hOUJ::s than peak video store traffic; the only heavy traffic hours for both might be Friday evenings. Councilmember Hicks stated that it may be to the adjacent property owner's advantage to provide an egress as it may encourage bank traffic to use the adjacent shopping center. Attorney Filla stated that the City can go on record requiring the applicant to provide an improved exit if an egress can be acquired from the adjacent property owner. Arden Hills Council 7 September 14, 1992 DISCUSSIQN OF BOND REFERENDUM Attorney Filla stated that he has spoken with the people involved In the proposed City Hall project and they are comfortable with a bond referendum. He added that the wording for the referendum can be changed up until the time the ballots are printed, the proposed wording is: "Shall the City of I\"rden Hi 1 J s be authorized to lssue General Obligation Bonds in an amount not to exceed 2.8 million dollars for the construction of a new Public Works/Maintenance Facility?" Councilmember Mahowald commented that the proposed wording appears to be suitable. He encouraged a concentrated effort to communicate to the public why the facility is needed, Counci 1 reviewed a list of possible key contact persons who may provide input and/or assist in distributing information regarding the referendum. Clerk Administrator Person asked Council to provide additions or changes as soon as possible. Councilmember Mahowald stated that a public information . meeting of all key contacts, City '" department caronn. L. This letter is intended as a brief summary of the issucs regarding assessments for this project. The estimated project cost, based on the low bid received on August 27, 1992, from Ro-So Contracting, Inc., is $32,560.00. 'XiS project cost includes construction cost as well as an overhead factor of25%. The three bds received have been accepted by the City, but award of the COntract has not been made. City staff was directed atthe August 31, 1992, City Council meeting to obtain an appraisal report from an independent professional to determine benefits to the eight properties north of Arden Place which we have determined provide runoff to the ponding area. These properties are shown on the attached exhibit. As of this writing, we have not seen this appraisal report. We were asked to provide an engineering opinion to the appraiser of what percentage each of the eight lots contribute toward the total runoff. These percentages arc shown on the map along each address. However, the appraisal report will define how these percentages call be used. An casement document has been prepared and forwarded to the Arden Hills Island Beach Club for their consideration in allowing the storm sewer pipe to convey runoff into their property. This easement would need to be granted prior to construction of the project. Attached for your consideration is a resolution awarding the contract to the low bidder, Ro-So .' Contracting, Inc. This would be needed should the City Council decide to move forward with the project. We have also inspected the homes involved on a drive-by basis. Attached are photos-of the homes and drainage area, and listing information on each of the properties. . It is our understanding drainage problems such as flooding and erosion have ocurred to 1553 Arden Place, 3487 Ridgewood Road and 3505 Ridgewood Road. As reported in the feasibility study the flooding and erosion has ocurred since the home at 1553 Arden Place was constructed in 1989. The existing storm sewer pipe was installed by the City in the mid 1960's and does not appear adequate to handle the runoff created by the surrounding properties along the ridge of the low area. The City has proposed storm sewer improvements to serve this drainage area. Per the feasibility study a catch basin will be installed in the rear lot of 1553 Arden Place to collect the storm water runoff. At this time it is unclear where the runoff will be directed. In consideration of possible "benefits" to the homes in the project area, we have made the assumption that the drainage problem can be cured through some type of reasonable storm sewer construction. Using figures provided by Mark Graham (Maier, Stewart and Associates Inc.) which show the contributing drainage area for each lot and their corresponding percentage of the total runoff, we have ,split the cost of the proposed project . (estimated at $32,560.00) between the contributing " properties. This is shown on the following pages. This cost does not necessarily relate directly to benefit. ,...li. ,;: --.:..~ i .!!; ,..:, l ;, . Based on the information we have at this time, in our estimation only the three properties experiencing drainage problems will receive a direct benefit from the new storm sewer. In this case by "benefit" , we mean allevation of the drainage problems. The remaining five properties which may be assessed for this project will not benefit since to the best of our knowledge, they have not experienced any problems from the existing drainage system. If the flooding and erosion is not corrected, then clearly those properties affected would experience a loss in value. The loss in value may be measured against the cost to cure the problem and repair any damage to the properties caused by the flooding and erosion that has already ocurred. It should be noted, this is not an appraisal, but an opinion as to possible benefits to the properties involved in the proposed drainage project. Re: False Alarm Appeal Process Recommendation The city has received a request for an appeal of a false alarm charge. The property owner has appealed this charge. The City ordinance provides for a charge ($50.00) following issuance of four notices of false alarm responses. At issue is the proper process to follow for review of the appeal. In order to obtain information re: the typical appeal process, the neighboring cities of New Brighton and Shoreview were contacted. Also contacted was the Ramsey County Sheriff's department re: their knowledge of others' processes. The typical process followed is an administrative appeal. In New Brighton, the Chief of Police hears the appeal, and in Shoreview, the Assistant Administrator hears the appeal. They report that the issues are usually addressed in this forum. . The most commonly given reasons for appeal are 1) situation beyond the control of the property owner, such as an electrical storm, heat inside the building for heat sensitivity. Documentation of such is requested and reviewed; or 2) owner error, which is usually a new alarm system, The cities look for documentation of the reasons given and showing of the owner taking preventative measures to ensure that these situations do not re-occur. The primary reason given if not one of the above for not wanting to pay the charge is that the amount is too high, in which case the owner is requested to write a letter to the city for ordinance change request. The proposed assessment is violative of Art 10, sec. 1 of the Minnesota State Constitution and Minn. Stat. sec. 429.051 in that other than the two parcels of land which sometimes experience water pooling, there is no "benefit" derived from the proposed improvements by the other properties which are being assessed. . All property in the city or neighborhood, except for the two properties noted above, will enjoy the same benefit, if any, from the improvement such that the properties assessed do not enjoy any special benefit . There is no increase in market value in the properties being assessed, other than the two noted above, such that there is no benefit to those properties. . Expert opinion Is that the market value of property assessed, other than the two noted above, will not be increased, . Control of water run-off is not a basis for benefit to an assessed property. "In regard to this issue, we note that the 'cost of any improvement ... may be . assessed upon property benefitted by the improvement, based upon the benefits received ...' Minn. Stat 9 429.051 (1988), This provision has been interpreted to mean: A municipality cannot levy a special assessment that exceeds the special benefit which the property, derives from the improvement. This storm sewer will serve a small pond located behind 1553 Arden Place, which has been discussed at several Council . meetings over the last year. Please find attached the necessary easement documentation for your group's review. The fust item is an Agreement to Convey Easement, along with an exhibit describing the easement on the property. This easement will allow the pipe to cross onto the property within a strip of land 20 feet wide by 40 feet long. The pipe will be centered within this easement and will disturb a smaller area. The specific alignment of the pipe will be established within the easement to minimize tree disruption. We would estimate 5 to 10 trees will need to be removed. The easement is necessary so that the pipe can be maintained by the City in future years as required. The easement also allows storm water to be conveyed from the small pond behind 1553 Arden Place to the group's property. Construction of the project cannot begin on the property until the Agreement to Convey Easement is executed by your group. It is anticipated that the construction of this project will occur in early October, so your prompt attention to this issue is greatly appreciated. The other form attached is a Grant of Permanent Easement. This form does not need to be executed as quickly as the other form, since construction can start without it. The plan was reviewed for its conformance with the management areas delegated to the local communities within the District. Specifically, policies in the area of runoff management, . individual sewage treatment systems I wetland management, floodplain management, construction erosion, and groundwater protection were examined. General Comments The RCWD has previously issued minor comments through correspondence and telephone conversations during July and August. The general review procedure the Watershed District has been employing with other municipalities in the District has been to review the management plan with the Board and issue comments. Following additional coordination with the City regarding revisions, the Board will again review the plan and grant an approval for those portions of the plan which meet the District's minimum requirements. Following District review and City approval of the ordinances implementing the general standards of the plan, the District will relinquish permitting duties (in the appropriate management areas) within the City. Runoff Management From the objectives, policies, and implementation portions of the plan, it appears the City of Arden Hills wishes to meet the runoff management standards for both quality and quantity and eventually become the permitting authority in this area. While it is noted that existing ordinances do not adequately cover these issues, the management plan does not provide sufficient performance standards from which to construct an ordinance. For example, it appears that developing areas need to provide for runoff detention but the standards to be met for flows could be either the undeveloped rate of runoff or a rate which can be handled by existing storm sewers. Standards for water quality state that treatment is required. It is not clear whether this involves skimmers, sedimentation ponds, or use of NURP standards for design. . BOARD OF MANAGERS A. Page 2 August 26, 1992 The City's intent to use regional detention areas whenever possible is commended. One potential use of the management plan would be to provide ponding parameters for regional ponds in the areas which remain undeveloped within the City. Of particular concern to the Watershed District is the commercial area adjacent to Round Lake. Such a planning effort would be similar to the historic plans prepared for the Gray Fox Road area west of Lexington Avenue and the Land 0' Lakes corporate area. As currently assembled, the plan qualitatively discusses results of the runoff modeling performed for the plan, We highly recommend inclusion of this data in the plan so that peak flow rates and approximate 100-year flood elevations are available. Conversations with Brian Miller noted that he had concerns regarding the accuracy of the TR-20 pond routing subroutines. We feel the information is still worthy of merit and could at least be included as a technical appendix with limited distribution. Many of the storm water plans prepared across the metropolitan area have been conducted using the TR-20 model and the use of this data in the management plan, we feel, does not pose a risk to the City. Policy 2,3 states that outlets will be provided for land-locked areas. Land-locked areas obviously provide maximized runoff control and treatment of water quality, While there are areas where existing development may be subject to flooding, many land-locked areas should be preserved or maximize the available storage if an outlet is provided. . District review of the TR-20 modeling results is still being performed and we will be forwarding additional correspondence when this review is completed. Individual Sewage Treatment Systems This portion of the management plan conforms with the District's plan with the exception that an inspection program for the few remaining ISTS is not documented. Wetland Management The plan indicates that the City is interested in developing wetland protection regulations. Our comments regarding this are similar to the Runoff Management section in that we feel that the management plan should have sufficient detail from which to construct an ordinance. The wetland portion of the District's plan has considerable detail regarding wetland alterations and additional requirements such as posting of wetland maps, etc. which could be transposed in the Arden Hills plan, The area of wetland regulation is in a state of flux until such time that the Board of Water and Soil Resources promulgates rules for implementing the Wetland Conservation Act of 1991. Until the interim period is included, the Watershed District has elected not to surrender wetland permitting authority in an effort to provide consistent wetland regulations across the District. The management plan does include a copy of the National Wetlands Inventory. A "key" which explains the NWI symbology would be beneficial. In addition, we have found it helpful to have a conversion chart which relates NWI symbols with the more familiar USF & WS Circular 39 classifications (Type 1 through 8), . -, Ms. Patricia Arlig, P.E. . Page 3 August 26, 1992 Shoreland Management It is our understanding that the City of Arden Hills has a state approved shore]and ordinance which fully meets the requirements of the Watershed District. Please notify us whether the City's ordinance has been upgraded recently to conform with the new state guidelines. Floodplain Management While the management plan has severa] policies relating to floodplain, it was noted that the City's Code of Ordinances, Chapter 9.5, met the Watershed District plan objectives, Please forward a copy of this chapter so that we may have it for our files and review it for conformance as well. Construction Erosion This portion of the management plan meets District requirements in that it references Ramsey County Erosion Control Handbook. Upon adoption of an ordinance for implementing this policy. The erosion control policy should address grading within shore]and areas if this area is not already covered under the Shore]and Management ordinance of the City. Please forward the name and telephone number for the contact person who will serve as erosion control inspector. . This information will help the Watershed District's inspector with his work as well. Groundwater Protection. There is an obscure reference in the back of the watershed plan which requires cities to forward an inventory of residential and commercia] properties appropriating water for heating and cooling purposes. The Watershed District will then use this information to require users to demonstrate discharges do not create drainage or water quality problems. This issue is not related to any jurisdictional matters with the City, but is merely for District information. Other Comments We will be sending under separate cover, some water quality information for the City lakes. We noted several errOrs for the data tabulated in the plan (Le., Johanna secchi depth of 11 meters...). . We will also forward a copy of the project list which the District completed as part of the Long Lake Chain of Lakes project in the late 1970s and early '80s. A number of sedimentation basins were constructed within the City of Arden Hills which remain the maintenance responsibility of the District, . The presence of chronic beaver problems at the Valentine Lake outlet perhaps should be addressed. From conversations with the DNR it appears they feel the property owner upon which the beaver dam is located is responsible for removal to prevent flooding, Perhaps a City inventory of common drainageway could be assembled which would be maintained by the City, The Watershed District will, of course, maintain any official public ditch systems, . . However, during b.1dget discussions for 1993, the Council approved reviewing copiers returning and to suJ::mit a recommendation. staff has evaluated three different =piers and recommends the purchase of a reconditioned Minolta 490Z at a cost to the City $2,995 (including $1,000 trade-in). Recommendation is for purchase of this item and is on the Consent Agenda due to the previous general agreement from the city Council. (A ~rJp.. E. Council Agenda Unfinished and New Business Item No. 7A regarding on site false alarm notices - Ramsey County Sheriff's Department through the Policing Contract with the City of Arden Hills has offered the service. Alarm notices would be placed by the Officer on site at the ti1ne of response. The city of North Oaks has the service in place and has seen this as a very positive service to its citizens. The benefit is that there is an i1mnediate notice to the homeowner placed by an Officer. The . Sheriff's Dept. will respond i1mnediately to the request by the City Council if it is so approved to begin this service on any false alarm reports and at the ti1ne of checking the premises. staff recommendation is to approve this service as offered by the Sheriff's Department at no additional charge to the City. 'Ihe hearing is to be held on october 24, 1992, at 7:00 p.m. in the Council Chambers at Shoreview City Hall. The estilnated cost of bnprovement is $80,000 funded by a district-wide Ad Valorem levy to be proportioned to each of the counties in the matter of allocation of the administrative fund of the District.
