REGULAR CITY COUNCIL MEETING
January 11, 1993
7:30 P.M. - City Hall
CALL TO ORDER/ROLL CALL
Pursuant to due call and notice thereof, Mayor Sather called
to order the regular City Council meeting at 7:30 p.m,
Present: Mayor Thomas Sather; Councilmembers Beverly
Aplikowski, Paul Malone. Councilmember Hicks was absent.
Also present were: City Attorney, Jerry Filla; City
Planner, John Bergly; Clerk Administrator, Dorothy Person;
Deputy Clerk/Zoning Administrator, Catherine Iago; Recording
Secretary, Shar Foster.
ADOPT AGENDA
Administrator Person asked that agenda item "Presentation of
Plaques/Recognition of Service" be moved from early in the
meeting to late in the meeting because recipients will be
. joining the meeting later. Council agreed to make this
adjustment to the agenda,
MOTION: Malone moved, seconded by Aplikowski, to adopt the
January 11, 1993 agenda with rearrangement of order as
noted above. Motion carried unanimously (3-0).
APPROVAL OF COUNCIL MINUTES
Administrator Person noted that under "Committee
Appointments for 1993" on page four of the January 4, 1993
Council meeting minutes, there are chairpersons and vice-
chairpersons designations for committees; she recommended
chair/vice chair designations be removed allowing those
positions to be determined administratively. Councilmember
Malone recalled that Council has appointed chairpersons in
the past, per ordinance.
MOTION: Aplikowski moved, seconded by Malone, to approve th,e
minutes of the December 28, 1992 Regular Council
Meeting and the January 4, 1993 Special Council
Meeting. Motion carried unanimously (3-0) ,
CONSENT CALENDAR
MOTION: Malone moved, seconded by Aplikowski, to approve the
. Consent Calendar and authorize execution of all
necessary documents contained therein. Motion carried
unanimously (3-0).

There were no public comments.
UNFINISHED AND NEW BUSINESS
CASE #92-18 - SITE PLAN AMENDMENT;
INTERNATIONAL PAPER. 1300 RED FOX ROAD
City Planner Bergly explained that recently the City
reviewed and approved a site plan relating to a fuel oil
tank for International Paper, and now that applicant is .
requesting a site plan amendment to allow the construction
of an accessory building to enclose the fuel oil tank.
Bergly reported the accessory building is proposed to be 16'
X 55' in size which will be large enough to shelter the tank
and provide adequate room to walk around the tank. He added
that the Planning Commission has reviewed this application
and recommended approval subject to review and approval of
the exterior finish of the building by the City Planner.
Planner Bergly stated that in reviewing this case, he found
that the proposed enclosure meets all ordinance requirements
and the structure is situated in a location that is least
obtrusive to views from public streets and neighborhing
property.
MOTION: Malone moved, seconded by Aplikowski, to approve the
site plan amendment for International Paper, Case #92-
18, based upon the findings of the City Planner noted
above, allowing construction of an accessory structure
to enclose the above-ground fuel tank. subject to
review and approval of the exterior finish materials by
the City Planner. Motion carried unanimously (3-0) .
CASE #92-22 - SITE PLAN AMENDMENT;
SCHERER BROTHERS LUMBER COMPANY .
4797 HIGHWAY 10
Planner Bergly reported that in 1987, the City approved
major improvements to the Scherer Brothers Lumber site and
. Arden Hills Council 3 January 11, 1993
now Scherer Brothers Lumber is proposing the addition of a
millshopfwarehouse building to be attached to their main
office and sales area.
Bergly noted that although Scherer Brothers Lumber does not
anticipate the need for additional employees by adding the
millshopfwarehouse, they are proposing 16 - 17 additional
parking stalls.
Bergly stated that Planning Commission has recommended
approval of the revised site plan subject to the following
conditions:
l. The Engineer's approval of site utilities and site
drainage plans,
2 . The Council's determination that the proposed number of
parking spaces is adequate for the proposed use,
3. The lighting fixtures be adjusted so as not to direct
the lighting glare onto Highway 10 or to the mobile
homes to the south, and
4. The Planner's review of the minimal landscape plan.
. Councilmember Aplikowski asked if the additional proposed
parking spaces are adequate. Bergly said the site currently
meets parking requirements and he anticipates the additional
proposed 16 - 17 parking spaces will be quite adequate.
Councilmember Malone commented that this applicant has been
very cooperative in the past. He added that some time ago,
it was noted that Scherer Lumber trucks displayed a New
Brighton address rather than Arden Hills, and they
immediately corrected that after it was brought to their
attention.
MOTION: Malone moved, seconded by Aplikowski, to approve the
revised site plan for Case #92-22, Scherer Brothers
Lumber, subject to the following conditions:
l. The Engineer's approval of site utilities and site

With regard to the matter of parking spaces, Council has

CASE #92-23 - MINOR SUBDIVISION &
LOT COMBINATION; ASHBACH PROPERTY
1585 LAKE JOHANNA BOULEVARD
planner Bergly explained the configuration of the existing
lots involved in this action and the applicant's plans to
subdivide and consolidate. In surrunary, the applicant was
proposing the creation of Tracts A and B from one existing
parcel, then the combination of Tract A with the lot
directly to the south containing Marjorie Ashbach's home.
Bergly noted that if this total proposal is approved, there
is a need for an access easement to utilize the present
driveway to Oak Avenue as access to the Ashbach home. He
added that such an agreement exists.
Bergly illustrated that the newly created Tract B will have
an extremely deep slope, therefore, it may require review
and perhaps a variance prior to allowing future building.
Bergly stated the Planning Commission recommended approval
of the lot division subject to the following conditions:
l. That the action include recognition that access to .
Tract B is across the existing roadway easement to
Johanna Boulevard,
2, That a document combining Tract A with the lot
immediately to the south and an easement document
providing access on the present driveway to Oak Avenue
across the large parcel to the east be approved by the
City Attorney and the lot division, lot combination and
access easement documents are filed concurrently with
the County,
3 . That any setback variances required on Tract B must be
applied for when and if they are needed and that such
variances are not included in this action,
4. That prior to any future divisions of any of the four
parcels involved in this application, a subdivision or
development sketch be prepared showing how such a
proposed division will fit into the long-range plans
for the total property.
Bergly added that, in addition to the four conditions listed
above, he recommends additional conditions, as follows:
5. A covenant be attached to Tract B limiting potential
future development of that Tract to only one single-
family residence, .
6, The city Engineer review and approve this case,

Bergly commented that the applicant has agreed to all six
conditions.
Councilmember Malone commented that typically an arrangement
such as this, with no access to an improved street would not
be allowed, however, this is a unique situation, and the
access issue appears to be addressed within the conditions.
MOTION: Malone moved, seconded by Aplikowski, to approve Case
#92-23, Minor subdivision/Lot Consolidation at 1585
Johanna Boulevard, with the following conditions:
l. That the action include recognition that access to

CASE #92-24 - LOT COMBINATION;
DAN ASHBACH. 1567 OAK AVENUE
Planner Bergly reported that Case #92-24 involves a simple
combination of two parcels, He explained that there is an
existing home located about one to two feet from the lot
line separating the two parcels, and there has been a
covenant attached in previous variance action requiring that
prior to selling the residence the lots are to be combined,
as is now proposed.
. Bergly reported that the Planning Commission recommended
approval of this lot consolidation subject to City
Attorney's approval of all documents prior to filing with
the County,

MOTION: Malone moved, seconded by Aplikowski, to approve Case
#92-24, Lot Consolidation, 1567 Oak Avenue, subject to
the City Attorney's review and approval of all
documents prior to filing with the County. Motion
carried unanimously (3-0).
ADDITIONAL PLANNING INFORMATION
Planner Bergly advised Council of upcoming Planning
Commission meeting dates and items on those agendas.
Councilmember Malone, prompted by one of the conditions of
Case #92-22, commented that there are instances throughout
the City where there is "trespass" 1 i ght from one property
to another. He cited examples and asked how conditions
prohibiting "trespass" light can be enforced, Bergly said
it is difficult to manage the matter, but ability to enforce
may be improved under the new zoning ordinance.
REVIEW OF LAW ENFORCEMENT SERVICES/
APPROVAL OF 1993 PATROL/POLICE CONTRACT
Commander Bergeron of the Ramsey County Sheriff's Department
gave a presentation and provided reports comparing 1992 to .
1991 calls for service and investigative services. He
explained that in 1992 "enhanced patrolling services"
handles many types of minor investigation tasks, however,
"investigation services" handled the following number of
incidents under each category:

Councilmember Malone commented that the City is consideri~g
establishing a Fire Marshall position; he asked if the
Sheriff's Office could handle fire investigations rather
than a Fire Marshall. Bergeron explained that the Sheriff's
Office responds to all fires and investigates anything of a
potentially criminal nature, while a Fire Marshall would
investigate matters of a non-criminal nature related to the
fire, therefore, his department's investigation is not a .
duplication of a Fire Marshall's investigation.

Councilmember Malone commended Bergeron on the reporting
format presented for Counci 1 review and asked specific
questions as to what each category incl udes .
Councilmember Malone asked if deputies have been reassigned
due to recent deputy retirements. Bergeron reported
reassignments have been made; he listed those assignments.
Administrator Person noted that a law enforcement contract
with Ramsey County Sheriff's Department has been in place
for several years, and the proposed changes for 1993 are:
1} Standardized formal agreement with all municipal i ties
contracting with the Sheriff's Department for service,
2} Provision for the contract to be self-renewing,
3) Definition of the Contract City Group and a dispute
resolution process,
4) Extension of the number of days either party may
terminate the agreement from 90 days to 180 days, and
5) 'Elimination of the cancellation clause which allowed
the County to terminate the agreement in case of
insurance cancellation of the municipality.
. Councilmember Malone advised Bergeron that should there be a
shifting of costs (relating specifically to communications
consolidation) in the future, the City must work within
budget constraints. Bergeron stated that he does not
anticipate additional costs related to potential
communications consolidation, but if that occurs, it is
understood that there are budgets constraints and time lines
of several agencies which would need to be considered.
Mayor Sather thanked Commander Bergeron for his visit and
presentation.
MOTION: Malone moved, seconded by Aplikowski, to approve the
Law Enforcement Services Agreement for 1993 incl uding
the five areas of change from previous years. Motion
carried unanimously (3-0) ,
COUNCIL COMMENTS
PLANNING ACTIVITIES REPORT
Administrator Person drew Council's attention to and briefly
highlighted Planning Commission's Activities Report,

RESCHEDULING WORKSESSION
Person advised Council that the February 15 worksession
meeting should be rescheduled, perhaps to February 16,
because February 15 is President's Day.
MOTION: Malone moved, seconded by Sather, to reschedule
Council's February worksession from February 15 to
February 16, 1993. Motion carried unanimously (3-0).
CANDIDATES - VARIOUS BOARDS
Administrator Person reported that the Association of
Metropolitan Municipalities has advised that they are
seeking candidates for the Regional Transit Board, the
Metropolitan Waste Control Commission, and the Metropolitan
Parks and Open Space Board.
LJVFD PENSION FUND
Councilmember Malone stated that the Lake Johanna Volunteer
Fire Department Pension Board recently held its annual .
meeting, He highlighted the financial report and summarized
that the LJVFD Pension Fund is in good financial shape
handling 70 active participants and having increased their
benefits over the last year.
MCGUIRES BANKRUPTCY
Councilmember Malone commented that recent information
indicates the City received the equivalent of $36 on its
c1 aim of $7,472.66 for utilities and Gateway Flowers charge
submitted to court on the McGuires Inn bankruptcy case, He
asked if McGuires paid their liquor licenses to the City.
Deputy Clerk Iago reported that McGuires paid their liquor
license, but they did not pay their taxes, and she would
check with the County to see if the bankruptcy judgment
ordered payment of taxes.
PRESENTATION OF PLAQUES/
RECOGNITION OF SERVICES
Mayor Sather read aloud Resolutions 93-05 and 93-06
Commending JoAnn Growe and Thomas Mahowald for their Years
of Service to the City of Arden Hills, He presented plaques
to both Growe and Mahowald; those in attendance applauded.

RE: 1993 Liquor License Renewal for Great Lakes Restaurant

The City was advised on 12/2/92 that the Great Lakes Restaurant
was delinquent in filing tax returns and no liquor license may be
issued by the City or state until the Minnesota Department of
Revenue issued a Tax Clearance Certificate.
The Minnesota Department of Revenue has issued the Tax Clearance
certificate for payment of delinquent taxes for this applicant
and authorized the City and state to proceed with processing the
liquor license for Charlie Chung, Inc.
The applicant has submitted appropriate documentation and payment
of the first quarter license fees for 1993. The Ramsey County
. Sheriff's Department has completed the background investigation
for the applicant. The Fire Marshal inspection of the premises
and city Attorney review of the documentation is pending.
ACTION REQUIRED:
Council should pass a motion under Consent Calendar to approve
the 1993 Liquor License Renewal for Charlie Chung, Inc,
d/b/a/Great Lakes Restaurant, for On Sale Liquor and Sunday On
Sale Liquor Licenses, pending review and approval by the city
Attorney and Fire Marshal.

A RESOLUTION RECEIVING THE FEASIBILITY REPORT
AND ORDERING A PUBLIC HEARING ON THE
IMPROVEMENT IN THE MA TIER OF THE
1993 PAVEMENT MAINTENANCE IMPROVEMENTS
WHEREAS the Feasibility Report ordered by the Council in Resolution 92-76 has been
prepared with reference to the 1993 Pavement Maintenance Improvement
and was received by the City on January 25, 1993; and
WHEREAS the Feasibility Report recommends that the proposed improvement is
feasible;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Arden Hills,
Minnesota:
1. The City Council will consider the 1993 Pavement Maintenance Improvement as
. described in the Feasibility Report and the assessment of the properties abutting this
proposed improvement for all or a portion of the cost of the improvement pursuant to
Minnesota Statutes, Section 429 at an estimated total cost for the improvement of
$123,700.
2. A public hearing shall be held before the City Council on the proposed improvement on
the 8th day of March, 1993, at 7:30 o'clock p.m. at Arden Hills City Hall.
3, The City Administrator shall provide ten days mailed notice and two weeks published
notice on the hearing as required by law.

FEASIBILITY STUDY
I Dear Council Members:
. Please find attached the Feasibility Study for the proposed 1993 Pavement Maintenance
Improvements Project. This project consists of bituminous overlay and seal coat
improvements on a number of streets within the City. These streets, as discussed at the
I December 21, 1992, Council worksession, were chosen based Dn updated pavement ratings
of all City streets and Public Works staff recDmmendations. Items discussed in the study
include the proposed improvements, estimated project costs, methods of financing the
I improvements, and a proposed project schedule.
In accordance with the City's Assessment Manual, 50% of the bituminous overlay
I improvements project cost is proposed to be assessed to the abutting property owners. No
assessments are proposed for properties abutting seal coat improvements, as outlined in the
Assessment Manual.
I The estimated project cost for the 1993 Pavement Maintenance Improvements is $123,700.
The estimated assessable cost is $49,800, leaving an estimated City cost of $73,900. The City
I budgeted amount for this project is $110,000, providing a surplus budget of $36,100. The
remaining budget could be used to fund improvements on Keithson Drive or other maintenance
work as needed. Additional seal coating improvements could also be added without affecting
I public hearing requirements, since no assessments are levied. The surplus budget has been
built in to this feasibility study to provide flexibility on additional maintenance improvements
I which may be necessary after the spring freeze/thaw cycle occurs.

.. INTRODUCTION
The Feasibility Study for the 1993 Pavement Maintenance Project, consisting of bituminous
I overlay and seal coat improvements, was authorized by Resolution 92-76, adopted by the City
I Council at their December 28, 1992, meeting.
I In Fall 1992, all streets within the City were reviewed and rated by Public Works staff and the
City's computer pavement management data was updated. This computer program includes data
I on each street's condition and prioritizes the need for maintenance. Based on these ratings and
input from City staff, a list of streets requiring bituminous overlay and seal coating was
I developed.
I SCOPE
The purpose of this study is to analyze the feasibility of bituminous overlay and seal coat
I improvements on various streets within the City. This Feasibility Study will discuss existing
conditions, proposed improvements, and estimated project costs. Financing methods will be
. discussed, using the City's Assessment Manual as a guide. A proposed project schedule will
also be presented.
I
EXISTING CONDITIONS
I The City's pavement management system rates all streets based on the number and severity of
cracks, areas of settlement, existing pavement thickness, and age of the street. The data is
I collected in the field and entered into a computer program, which outputs a single numerical
rating for each street on a scale of 1 to 100. A score of 100 would be calculated for a new
I street, with scores decreasing as the street ages and deteriorates. Streets rated over 95 do not
require any work other than isolated crack filling. Streets rated between 90 and 95 require seal
I coating. Streets rated between 69 and 89 require bituminous overlay improvements. Streets
.' rated lower than 69 require reconstruction, as it would not be prudent to spend maintenance
money on streets which are structurally failing. It is in this last category that recycling of the
pavement, as completed in 1992 on Round Lake Road and Dunlap Street, can be considered.
It is important to note, however, that a single numerical rating should not alone dictate the

.. maintenance to be done. The ratings are a tool, but experience on repairing streets with similar
conditions and input from Public Works staff are also valuable in determining the most cost-
I effective means of repairing a street.
I It is vital that an ongoing program of maintenance projects be funded in future City budgets to
I keep streets from deteriorating to the extent that reconstruction is the only alternative, An
ambitious project in 1991 of $152,300 completed a number of seal coat and overlay
I improvements. Reconstruction of North Snelling Avenue, also accomplished in 1991, had a
construction cost of $230,200. In 1992, reconstruction of Tiller Lane and recycling
I improvements on Round Lake Road and Dunlap Street were completed, with a total construction
cost of approximately $280,500. Assessments were levied in both 1991 and 1992 to subsidize
I City funds. This ongoing program of maintenance and recDnstruction projects would be severely
curtailed without assessments to abutting property owners.
I PROPOSED IMPROVEMENTS
. The following streets are proposed to be improved in the 1993 Pavement Maintenance
Improvements Project. This project will consist of seal coating and overlay improvements. The
I rating for each street is provided. To provide anticipated cost savings in the bidding process,
streets have been grouped so the same maintenance activity takes place in a particular area of
I the City. This grouping, along with input from Public Works staff, accounts for the fact that
some streets will have maintenance performed other than that indicated solely by their rating.

2 in the appendix of this Feasibility Study.

I All streets listed for proposed overlay and seal coat improvements will be included in the
solicitation of bids. It may be necessary, however, to eliminate streets after bids are received
I to match the budget for this project. The budgeted amount for this project, as discussed in the
Financing portion of this study, is $110,000. A surplus budget has been provided to allow
I monies for repairs to Keithson Drive or other maintenance projects which may become apparent
later this Spring. It is not anticipated that streets will have to be deleted from the proposed
I improvements following receipt of bids.

The estimated project cost for the proposed improvements is as follows:

I The total estimated project cost includes 15 % overhead to cover engineering, field inspection,
construction administration, and assessment roll preparation.
I FINANCING
I As outlined in the City's Assessment Manual, 50% of the total cost of a bituminous overlay,
including all associated overhead costs, may be assessed to all properties with frontage abutting
I a street to be overlaid, According to Ramsey County records, there are 136 abutting and
benefitting properties with a total adjusted front footage of approximately 15,000 feet. The
. residential equivalent assessment rate is therefore calculated as follows:
I Estimated Bituminous Overlay Cost $99,600
Estimated Amount Assessed (50%) $49,800
I Total Front Footage 15,500 ft
Estimated Assessment Rate $3.22/foot

Based on this assessment rate, the City share of the estimated total project cost is $73,900.
I The City's budget is $110,000 for this project. The remaining balance of $36,100 would allow
I for improvements to Keithson Drive or other maintenance improvements. Should bids received
be more favorable than estimated, it would be possible to add other streets. As discussed in the
I previous section, streets added to the seal coat portion of the project would not require additional
public hearings. If bids received are higher than anticipated, it would be necessary to eliminate
I streets.
, In 1991, the estimated assessment rate in the Feasibility Study was $3.44 per adjusted front foot.

.. Following the bidding process, however, the actual assessment rate was reduced to $2.64 per
adjusted front foot. As was done in 1991, a resolution will be proposed for City Council review
I to establish the 1993 residential equivalent assessment rate after bids are received. No
I commercial equivalent assessment rate is necessary for this project.
I A detailed estimated assessment cost is provided in the appendix of this Feasibility Study for
each of the abutting and benefitting property owners on streets to receive bituminous overlay
I improvements. This preliminary assessment roll lists each property owner, the total adjusted
front footage for each property, and the estimated assessment cost for each property.
I As detailed in the City's Assessment Manual, no assessments are proposed for seal coat
I improvements as this work is a maintenance procedure funded by the City.
I Through the project specifications, the City shall retain the right to add or delete streets from
bituminous overlay or seal coat improvements to match the available budgeted funding.

same date. Should there be any appeals fIled at the Assessment Hearing, the City may want to
I wait the 30-day appeal period prior to awarding the contract.
I CONCLUSION
I The estimated project cost for the 1993 Pavement Maintenance Improvements Project is
$123,700. The proposed improvements are feasible from an engineering standpoint and meet
I all standards set forth by the City. A surplus budget of approximately $36,100 has been
provided to allow for improvements on Keithson Drive or other necessary projects. Streets
I requiring seal coating could be added to this project without affecting the necessary public
hearings procedure.

A RESOLUTION
ORDERING PREPARATION OF
PLANS AND SPECIFICATIONS IN THE MA TIER OF
THE 1993 PAVEMENT MAINTENANCE IMPROVEMENTS
WHEREAS, the City Council has duly considered the Feasibility Report presented at
the January 25, 1993, City Council meeting, and;
WHEREAS, a public hearing has been scheduled for March 8, 1993, to solicit public
input;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Arden Hills,
Minnesota:

RE: STORM WATER UTILITY ORDINANCE
Dear Ms. Person:
Please find attached a preliminary ordinance and the necessary resolutions to initiate a storm
water utility ordinance, This information is provided for discussion at the January 25, 1993,
City Council meeting. As discussed at the December 21, 1992, City Council worksession,
. the City Council should set a date for a public informational meeting in early March 1993 to
solicit public input. Should you desire, we can provide you an informational article suitable
for publication in the next City newsletter.
It is our understanding that the Council has discussed quarterly rates of $4.95 per residential
unit and $49,50 per acre for commercial or industrial properties, Based on information
provided by City Planner Bergly, these rates could be expected to generate $43,300 per
quarter. A summary of various land uses is also attached.
1 will be in attendance at your January 25, 1993, City Council meeting to further discuss this
matter.

of Ordinances Relating To The Establishment of a Surface Storm Water
Runoff Management Utility
ARTICLE V STORM WATER
DIVISION 1. GENERALLY
SECTION 28-162 GENERAL OPERATION:
The Municipal Surface Storm Water Runoff system shall be operated as a public utility
(hereinafter called the surface water management utility), pursuant to Minnesota Statute Section
. 444.075, from which revenues will be derived subject to the provisions of this Chapter and
Minnesota Statutes.
SECTION 28-163 DEFINITIONS:
A. Utility Factor. The utility factor is defined as the ratio of runoff volume, in inches, for
a particular land use, to the runoff volume, in inches, for a 1/3 acre residential lot,
assuming a 2" rainfall and Soil Conservation Service (SCS) "Type B" soil conditions.
B. Surface Water Management Fee. The surface water management fee is defined as the
quarterly charge developed for each parcel of land.
C. Ouarterly Surface Water Manae:ement Revenue. The q uarterl y surface water
management revenue is the estimated quarterly expenditures for planning and inventories,
capital expenditures, personnel and equipment and operation of the surface water utility,
in accordance with established City policy, The quarterly surface water management
revenue and resulting surface water management fees shall be established for a period
of time as set by City Council resolution.

. SECTION 28-164 FACTORS FOR DETERMINING FEES FOR VARIOUS LANE USES:
The utility factors for various land uses used to detennine the surface water management fees are
assigned as follows:

SECTION 28-165 ESTABLISHMENT OF FEES
Surface water management fees shall be established for a period of time as set by City Council
resolution. The Surface Water Management Fee shall be determined by first detennining the percentage
of total runoff in the City which is attributed to Single-Family Residential property. The fee-per-acre
for Single-Family Residential is computed by equating the runoff percentage to an equal percentage of
the Quarterly Surface Water Management Revenue, divided by the estimated total acres of Single-
Family Residential land use in the City. The per-acre fee for all individual parcels shall be defined as
the product of the Single-Family Residential Fee, the appropriate utility factor and the total acreage of
the parcel. Single-Family Residential and Rural Residential parcels shall be assessed on a per-lot basis
using the acreage as determined by established City policy.
SECTION 28-166 ADJUSTMENT OF FEES
The City Council may adopt policies, by resolution, for adjustment of the surface water management
fees, Information to justify a fee adjustment must be supplied by the property owner. Such adjustments
of fees shall not be retroactive, unless provided within said resolution, Credits will be reviewed
. annually by a staff committee.
. SECTION 28-167 EXEMPTIONS
The following land uses are exempt from the surface water management fee:
(a) Public Right-of-Way
(b) Lakes
(c) Undeveloped Parcels
SECTION 28-168 MAILING STATEMENT OF CHARGES
Statements for the preceding quarterly Surface Water Management service shall be mailed to each
customer pursuant to the same procedures as listed under Section 28-57 of this code.
SECTION 28-169 FEE APPEAL
If a property owner or person responsible for paying the surface water management fee believes that
a particular assigned fee is incorrect, such a person may request that the fee be recompute, Appeals
will be heard by Council once a year in accordance with the schedule established for credit applications,
in established City policy.
. SECTION 28-170 PENALTIES FOR DELINQUENT PAYMENTS OF FEES
A penalty equal to 10% of the amount due shall be added to accounts not paid in full on or before the
1st day of the second month following the fIlling periods and to each quarterly billing thereafter until
the amount of the delinquent account plush accrued penalty is paid in full or otherwise certified to the
Ramsey County Auditor as a delinquent account.
SECTION 28-171 ANNUAL CERTIFICATION OF DELINQUENT ACCOUNTS
Each year the City Administrator shall prepare a list of delinquent surface water management service
charge accounts, including accrued penalties thereon, in the form of an assessment roll. On or before
October 1 of each year, the City Council shall review the delinquent surface water management service
charge assessment roll and adopt an appropriate resolution directing that the assessment roll be certified
to the Ramsey County Auditor as a lien against the premises served and directing the Ramsey County
Auditor collect the assessment a part of the ensuing year's tax levy. all delinquent surface water
management service charge assessments shall bear interest, at a rate determined by the City Council,
from the date on which the delinquent surface water management service charge assessment resolution
is adopted until December 31 of the following year.

OPERATION OF A STORM WATER RUNOFF MANAGEMENT UTILITY
WHEREAS, the City Council has created a surface water management utility; and
WHEREAS, the operation of said surface water management utility requires the establishment
of criteria directing operations;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Arden Hills,
Minnesota:
I) The following is hereby established as City Policy for the operation of the City of Arden
Hills Stonn Water Runoff Management Utility:
. A, Policy Statement
All properties within the City of Arden Hills shall contribute to the Surface Water
Management Utility in an amount proportional to the runoff contributed by each
particular parcel.
B. Exemptions
1) Undeveloped Lands - Undeveloped lands, or land in a natural, undisturbed
condition, shall be exempt from all charges,
2) Street and Highway Right-of-Way - Street and highway right-of-way shall
be exempt from all charges.
3) Lakes - Lakes by the Minnesota Department of Natural Resources as
Natural Environment Waters, Recreational Development Waters or
General Development Waters shall be exempt from charges.
4) Parks - Parks under the ownership of the City or Ramsey County shall be
exempt from charges. This shall include all open space areas within the
City.

. C. Fee Basis
1) Land Use - Land Use for determining surface water management fees
shall be the existing land use at the date of enactment of the Surface
Water Management Ordinance. As land is developed, or redeveloped, the
fees will be recomputed based on the revised land use.
2) Soils - Soil Conservation Service (SCS) - Type B soils shall be assumed
for determining the curve number runoff index (CN) in the revenue
equation.
3) Rainfall (P) - A 2" rainfall will be used on the revenue equation.
4) Runoff Indices (CN) - The runoff indices for the property classificatiDns
are as follow:

. D. Credits
Surface water management fees may be adjusted under the conditions stated
below. It shall be the responsibility of the property owner to provide justification
for the fee adjustment. Credits must be applied for by October 31 of the year
preceding the year in which the credit is to be considered, except that during the
first months of operation, property owners shall have until March 15, 1993 to
apply for credits, which shall be retroactive to the start date of Utility.
1) Storm Water Retention - If it can be demonstrated that an individual parcel
retains all or a portion of the rainfall that it receives, the surface water
management fee will be reduced by a percentage equal to that percent of
the parcel which produces no external runoff. A fee reduction of 20
percent or greater must be demonstrated.
E. Adjustment of Fees
Surface water management fees will be adjusted under the following conditions:
1) Revision of Quarterly Surface Water Revenue - The estimated
expenditures for the management of surface water shall be revised at a
frequency specified in the ordinance. The fees will be adjusted
. accordingly and will follow established City procedures for this adjustment
of utility (water and sewer) rates.

THE WORKPLACE PER THE AWAIR BILL
WHEREAS, the city of Arden Hills realizes that it has the
responsibility to provide a safe workplace for its employees and
safe environments for its citizens. Each employee must pursue
the highest standards in his or her assigned activities and all
City employees must recognize that the well-being of persons
involved, and the protection of our physical resources are as
important as the activity and work being performed.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ARDEN HILLS AS FOLLOWS:
The City of Arden Hills is establishing a Loss Control
Management Program to be implemented in stages over the next
year. The City expects its management and employees to
respond to all planned safety efforts and to perform their
assigned jobs in the safest manner possible.
As the first portion of the City of Arden Hills program, the
. Safety Coordinator will be assigned the responsibility of
organizing the overall Loss Control Management Program.
In addition, a Loss Control Committee is to be created to
establish a loss control policy, investigate major losses
and loss trends. This committee should be made up of
employees, managers, and/or supervisors from each department
with the City.
Each City Department Head will be responsible for the safety
and well-being of the workers in his or her department as
well as the repair and maintenance of facilities and
equipment in his or her area of responsibility.
Each City employee will be responsible for his or her
personal safety and for the safe completion of assigned
tasks.
I, NOW, THEREFORE, establish the Office of Safety Coordinator for
the City by this notification. The Safety Coordinator will be
the representative and will be responsible for staff direction
and administration of our safety program. He or she will submit
a report to the Administrator by departments, of the progress of
the safety program.

Committees, Job Safety Training, minimum job safety requirements,

be expected to follow safe practices, to obey safety rules, and
to help generally in the program of the Safety Coordinator. We

Subdivision 8 <WORKPLACE PROGRAMS>. An employer covered by
this section must establish a written

program that promotes safe and healthful

stated goals and objectives for meeting those
goals. The program must describe:

Mayor and Members of the City Council:
This Letter of Agreement is given by John Arkell as partner of Cottage Villas of Arden
Hills a limited partnership organized under the laws of the State of Minnesota (the
"Applicant") in connection with the review and consideraticn of Tax Increment Financing
for the Cottage Villas of Arden Hills (the "Project"). In consideration, the Applicant hereby
covenants and agrees as foilows:
1. Consultinq Services. Tile City shall have the right to employ legal counsel, bond
counsel, accounting, real estate, financial, engineering, architectural and other
consultants to review the profjosed Project and all proposed financing therefor in
accordance with the Poiicy Statement (the "Policy Staiement") attached to this letter.
. ~ Other Costs and Expenses. The City shall also have the right to allocate and

postage and other similar items rendered or incurred with respect thereto.
3. Payment of Costs. The Applicant shall pay all costs, expenses and consulting

thereof, wittlOut any liability of the City, its officers, employees and agents.

. Applicant hereby releases the City, its officers, employees and agents, from any
claims or causes of action which it may have against them or any of them for any
costs, expenses, losses, damages or liabilities which it may incur in connection with
the City's consideration of the Project; the failure of the City, in its discretion, to issue
Tax Increment Obligations for Applicant's Project' the issuance and sale of the Tax
Increment Obligations; the construction of the Project; or any other matter or thing of
any type or nature whatsoever which may arise in connection with any of the
foregoing.
5. Indemnification. Applicant agrees to indemnify and hold the City, its officers,
employees and agents harmless from and against any and all losses, claims
damages, expenses or liabilities, including attorneys' fees incurred in their defense, to
which the City', its officers, employaes and agents Oi any 01 them may become
subject in connection with the City's consideration, issuance or sale of the Tax
Increment Obligations for Applicant's Project and the carrying out of the transactions
contemplated by this Agreement and any resolutions adopted or Agreements
executed by the City in connection with the issuance of Tax Increment Obligations for
Applicant's Project.
6. Assicmment. The applicant shall have no right to assign any claimed rights it may
acquire by reason of any action taken with respect to Applicant's Project and the
issuance of Tax Increment Obligations therefor by the City or its officers, employees
or agents.
. 7. Effective Date. The effective date of this Agreement is December 22, 1992.
