RE: SURFACE WATER MANAGEMENT UTILITY
Dear Ms. Person:
Please find attached a revised code of ordinances on the creation of the Surface Water
Management Utility. This item was placed on the February 16, 1993, City Council
worksession agenda at the January 25, 1993 council meeting.
. As you know, the Council has discussed quarterly rates of $4.95 per residential unit and
$49.50 per acre for commercial and industrial properties. These rates are comparable with
rates in surrounding communities. Based on these rates and infonnation provided by City
Planner Bergly, a annual revenue of approximately $160,000 would be generated.
Following discussions with City staff, however, we recommend that an ordinance which
further refines quarterly rates for residential properties be considered. This ordinance would
more equitably charge properties in various zoning classifications to compute quarterly rates.
We have discussed the attached ordinance proposal with City Attorney Filla, who is of the
opinion that this ordinance is a fairer and more defendable ordinance is meeting State
requirements than charging a flat rate to all residential properties.
Based on engineering principles of stonn water runoff, each type of zoning classification
contributes a different amount of runoff to the City's collection system. We have calculated
an average expected runoff for each zoning district, utilizing accepted engineering standards,
and determined a fee per acre for all developed properties.
The following table lists the comparative amount of runoff for each zoning district. A base
rate is assumed for R-1 properties and all other properties contribute a proportionlltely greater
amount. This proportion is shown as a utility factor.

For example, a property wned R-4, based on its density of units, contributes 2.72 times as
much runoff as a property in a R-l district. Similarly, business or industrial properties
contribute 4.25 times as much runoff as a R-l property.
Given these utility factors and the data from City Planner Bergly, the quarterly rates for each
wning classification can be determined. It is at this point that the City Council would decide
how much revenue is necessary for storm sewer infrastructure and maintenance.
. Based on collecting $40,000 per quarter, as has been previously discussed, the following rates
would be necessary:
R-l $ 10. 32/Acre - $3.44/Unit Based on 3 Units/Acre
R-2 $ 13. 52/Acre = $3.38/Unit Based on 4 Units/Acre
R-3 $28.07/Acre
R-4 $28.07/Acre
Industrial $43. 86/Acre
Business $43. 86/Acre
This new rate structure has reduced the proposed quarterly rate for single family units from
$4.95/unit to $3.44/unit, and proportionately raises the rate for residential properties. Should
the council choose to establish $4.95/unit as a quarterly rate for an R-l property, this rate
structure would generate approximately $56.200 per quarter, including a rate of $63.11 per
acre for industrial and commercial properties. As evidenced by the Keithson Pond and Arden
Place projects, and maintenance and equipment needs, the needs for revenue will exceed the
amount collected.
Another issue to consider is the possibility of collecting revenue from land that is presently
undeveloped. Communities that surround Arden Hills, including Shoreview and Roseville,
do not charge undeveloped property. However, undeveloped properties do contribute storm
. water runoff and, therefore, share in the burden of maintenance of the storm sewer
infrastructure. There are currently 110.1 acres of undeveloped residentially-wned property,

110.6 acres of undeveloped industrially-zoned property, and 7.7 acres of undeveloped
business-zoned property. Establishing rates for these properties, based on one-half of the
developed rates, would generate an additional $3,160 of revenue per quarter.
At the February 16, 1993 Council worksession, we recommend that the Council consider the
following questions:
A. Is the City Council comfortable with the method of determining rates for various
zoning categories?
B. How much revenue does the Council wish to generate on an annual or quarterly
basis?
C. Does the Council wish to collect revenue from undeveloped land.
D. When does the Council want to hold a public infonnational hearing?

Following this worksession, we can prepare a brief article for the City's newsletter that
discusses a surface water management utility and publicizes the infonnational hearing.
City Attorney Filla is reviewing the attached ordinance to insure that it meets State guidelines,
so minor corrections may be necessary. Please contact me if you have any questions.

Addition of Article V. Storm Water to Chapter 28 Utilities of the code
of Ordinances Relating To The Establishment of a Surface Storm Water
Runoff Management Utility
ARTICLE V SURFACE WATER
DIVISION I. GENERALLY
SECTION 28-162 GENERAL OPERATION:
. The Municipal Surface Storm Water Runoff system shall be operated as a public utility
(hereinafter called the surface water management utility), pursuant to Minnesota Statute Section
444.075, from which revenues will be derived subject to the provisions of this Chapter and
Minnesota Statutes.
SECTION 28-163 DEFINITIONS:
A. Utility Factor. The utility factor is defined as the ratio of runoff volume, in inches, for
a particular land use, to the runoff volume, in inches, for a 113 acre residential lot,
assuming a 2" rainfall and Soil Conservation Service (SCS) "Type B" soil conditions.
B. Surface Water Mana&ement Fee. The surface water management fee is defined as the
quarterly charge developed for each parcel of land and shall be established by City
Council resolution.
C. Ouarterly Surface Water Management Revenue. The quarterly surface water
management revenue is the estimated quarterly expenditures for planning and inventories,
capital expenditures, personnel and equipment and operation of the surface water utility,
in accordance with established City policy.

. SECTION 28-164 FACTORS FOR DETERMINING FEES FOR VARIOUS LANE USES:
The utility factors for various land uses used to determine the surface water management fees are
assigned as follows:

SECTION 28-165 ESTABLISHMENT OF FEES
. Surface water management fees shall be established by City Council resolution. The Surface Water
Management Fee per land use zoning per quarter shall be determined by first determining the percentage
of total runoff in the City which is attributed to Single-Family Residential property. The fee-per-acre
for Single-Family Residential is computed by equating the runoff percentage to an equal percentage of
the Quarterly Surface Water Management Revenue, divided by the estimated total acres of Single-
Family Residential land use in the City. The per-acre fee for all individual parcels shall be defined as
the product of the Single-Family Residential Fee, the appropriate utility factor and the total acreage of
the parcel. Parcels in the R-l and R-2 zoning districts shall be assessed on a per-lot basis using the
acreage as determined by established City policy.
SECTION 28-166 ADJUSTMENT OF FEES
The City Council may adopt policies, by resolution, for adjustment of the surface water management
fees. Information to justify a fee adjustment must be supplied by the property owner. Such adjustments
of fees shall not be retroactive, unless provided within said resolution. Credits will be reviewed
annually by a staff committee.
SECTION 28-167 UNDEVELOPED LAND
. Undeveloped properties shall be assessed at one-half the developed rate, based on their zoning
classification.

.' SECTION 28-168 EXEMPTIONS
The following land uses are exempt from the surface water management fee:
(a) Public Right-of-Way
(b) Lakes
SECTION 28-169 MAILING STATEMENT OF CHARGES
Statements for the preceding quarterly Surface Water Management service shall be mailed to each
customer pursuant to the same procedures as listed under Section 28-57 of this code.
SECTION 28-170 FEE APPEAL
If a property owner or person responsible for paying the surface water management fee believes that
a particular assigned fee is incorrect, such a person may request that the fee be recompute. Appeals
will be heard by Council once a year in accordance with the schedule established for credit applications,
in established City policy.
. SECTION 28-171 PENALTIES FOR DELINQUENT PAYMENTS OF FEES
A penalty equal to 10% of the amount due shall be added to accounts not paid in full on or before the
1st day of the second month following the filling periods and to each quarterly billing thereafter until
the amount of the delinquent account plush accrued penalty is paid in full or otherwise certified to the
Ramsey County Auditor as a delinquent account.
SECTION 28-172 ANNUAL CERTIFICATION OF DELINQUENT ACCOUNTS
Each year the City Administrator shall prepare a list of delinquent surface water management service
charge accounts, including accrued penalties thereon, in the form of an assessment roIL On or before
October 1 of each year, the City Council shall review the delinquent surface water management service
charge assessment roll and adopt an appropriate resolution directing that the assessment roll be certified
to the Ramsey County Auditor as a lien against the premises served and directing the Ramsey County
Auditor collect the assessment a part of the ensuing year's tax levy. all delinquent surface water
management service charge assessments shall bear interest, at a rate determined by the City Council,
from the date on which the delinquent surface water management service charge assessment resolution
is adopted until December 31 of the following year.

Re: Development Proposal for Property Located within the
Gateway Business District, Arden Hills, Minnesota
Friends:
. I am writing to outline, with greater specificity, our proposal
with respect to the planning, marketing, acquisition and
development of property within the Arden Hills Gateway Business
District. In general terms, we would propose that the city and
Everest enter into a Development Agreement which would provide
for our cooperation, and our joint effort and participation in
development and redevelopment of the property within the GB
District. The essential elements of the agreement, and the
respective obligations of the parties, would be as follows:
1. Plannin2
Everest, with the input, participation and approval of the
City, will undertake and complete preliminary planning for
the development of the property. The goal of this
preliminary planning will be to achieve a comprehensive
plan encompassing the entire site, which satisfies the
objectives of the City while at the same time meeting the
demands of the marketplace. In this connection, and as
previously discussed, we feel that certain changes will be
required with respect to the permitted uses and
architectural standards applicable to development. To
that end, I am enclosing herewith, as Exhibit A, our
proposed modifications to the current standards
established in the GB District. In our view, these
. modifications will be necessary to permit us to
effectively pursue development of property within the
District.

2. Marketing
Everest will actively and aggressively market the property
to suitable users, including both prospects that seek to
lease and prospects that seek to own. When appropriate,
and where the mutual goals of Everest and the City can be
achieved, Everest will proceed with acquisi tion of
necessary land and development thereof, all consistent
with the agreed preliminary plan.
3. Tax Increment Financing
The City, utilizing the redevelopment district already
established, will make tax increment financing assistance
available for proposed development. We would propose a
flexible TIF program which would permit either "up front"
or "pay as you go" assistance for development. The
approach utilized will largely depend on the circumstances
surrounding the transaction, with the intent that II up
front" TIF would be utilized only in situations where the
"pay as you go approach" would not effectively secure the
. development opportunity. In either easel TIF proceeds
would be applied to the following items, in the noted
priority:
a. To defray the expense of public improvements
associated with and necessary to support the
development contemplated in the GB District;
b. To reimburse Everest for qualifying development costs
including land write down;
c. Any excess funds remaining following payment of the
foregoing expenses, would be distributed to the City
for application and distribution in such manner as
the city would deem appropriate.
The level of the assistance available will be controlled
and determined by the level of development which occurs.
Obviously, funds available for assistance will increase as
the incremental value of development increases.
4. Development Rights
In exchange for the undertakings by Everest, as set forth
above, the City will grant Everest the exclusive TIF
. supported development rights with respect to the GB

District property for a period of five (5) years.
Depending upon achievement of certain reasonable
performance levels, Everest would have an option to extend
the term of agreement for an additional five (5) years.
Essentially, our proposal would be that Everest have the
right to develop all or any portion of the property within
the GB District, subject and pursuant to the following
terms and conditions:
a. In the event Everest successfully markets a site for
development within the GB District, the city will
cooperate with land acquisition, will permit
development consistent with the uses and
architectural standards as outlined in subsection 1
above, and will provide TIF support as outlined in in
subsection 2 above.
b. In the event the City is contacted regarding or
otherwise becomes aware of development opportunities
. or prospects that may be appropriate for the GB
District, the City shall immediately notify Everest
thereof and shall refer any prospects or inquiring
parties to Everest.
c. The foregoing is not intended to limit independent
land owners from developing their properties, but
rather is intended to restrict availability of city
assistance for such development, unless Everest is
involved as the developer. This consideration is
sought in exchange for the significant investment
Everest will be making in the GB District by reason
of its efforts as outlined in sections 1 and 2 above.
The above outline represents a more specific description of the
proposal we are making with respect to development within the
GB District. In the event these key elements of agreement are
acceptable to the city, we would suggest that further
discussions occur between Everest and city staff, to the end
that a Development Agreement can be prepared and submitted to
the Council for consideration.

We would propose to operate within the parameters of the
existing Gateway Business District zoning, wi th the following
modifications and additions.
1. Amend section H(4), as follows:
(4) Allowable Uses.
The following uses will be permitted in the GB
District:
(a) Office usesf-") includinq without limitation,
administrative. executive. corporate.
orofessional, personal, research and sales.
(b) Manufacturing, production, fabrication,
assembly, processing, and related repair,
servicing, testing, packaging, warehousing and
distribution of goods or products, provided that
the use is contained wholly within the building
... and meets or maintains all environmental
standards set by the MPCA and other public
agencies having jurisdiction.
(c) Research and testing laboratories, provided that
the use is contained wholly within the building
and meets or maintains all environmental
standards set by the MPCA and other public
agencies having jurisdiction.
(d) Printing, provided that the use is contained
wholly within the building and meets or
maintains all environmental standards set by the
MPCA and other public agencies having
jurisdiction.
(e) Municipal and other public agency,
administrative and service facilities and
activities.
(f) Wholesaling and warehousing, provided that the
use is contained wholly within the building and
meets or maintains all environmental standards
set by the MPCA and other public agencies having
jurisdiction.

. (g) Retail or service businesses offering goods,
merchandise or personal services primarily to
those employed in the GB District. c."

incidental to any of the above permitted uses,
provided that such outside storage is

2. Amend Section R(S), as follows:
(5) Prohibited Uses.
Some land uses are not compatible with the stated
purpose of the GB District. The following uses are
therefore prohibited.
(a) Single-family or two-family residences.
(b) Open sales, rental or storage lots, including
but not limited to cars, buses, trucks,
motorcycles, bicycles, recreational vehicles,
trailers, boats, mobile homes, machinery,
lumber, building materials, landscape materials
. and similar items.
(c) Vehicular sales, lease, rental or repair,
including but not limited to the items listed in
(b) above.
(d) Truck terminals or freight terminals.~~
(e) Building supply stores and yards.
(f) Outside storage, excent as allowed nursuant t:n
subsection RI41 Ii) above.
(g) Ministorage facilities.
(h) Bulk (.~ terminals, including
storage yards and but
not limi ted to forest, metal, concrete,
agricultural and petroleum products, chemicals
'-:1 and similar products.
(i) Manufacturing or processing that generates
hazardous waste without a valid hazardous waste
generator's license from the Ramsey County
Public Health Department.

. 3. Amend section H(6) (a)-(e), as follows:
(6) Development Standards.
(a) Minimum Project and Lot Size:
1. Except as otherwise specifically set forth
in this section, a mixed use project within
the GB District shall contain a minimum of
five (5) contiguous acres. The proposed
land uses in such a project and their mix,
intensity and relationship may require
varying lot sizes within said project, none
of which lots shall be less than five (5)
acres in size except as otherwise permitted
herein.
2. Lots of less than five (5) acres within a
mixed-use project may be permitted only
when the applicant has demonstrated
satisfactorily that:
a. The lot will be site of a use that
will be compatible with and will
complement and enhance existing and
planned business.
. b. The primary business of the proposed
complementary use will serve business
activities within the GB District.
3. Single-use projects shall contain a minimum
area of two and one-half (2-1/2) contiguous
acres.
4. Interior lot lines within a mixed use or
single-use project may be located to allow
individual ownership of specific buildings.
To allow maximum development creativity and
flexibility, regulations, such as side and
rear yard building and parking setbacks,
FAR, number of parking spaces, percent of
landscape area, etc. , may be modified for
individual parcels and interior lot lines.
However, the regulations for these same
items must be met for the total mixed-use
or single-use project area and exterior
project lot lines.

. (b) Minimum Building Size:
To accomplish the scale of development
consistent with the defined purpose of the GB
District, the minimum ground floor area of a
building other than for residential uses shall
be twenty thousand (20,000) square feet except
as otherwise regulated herein. This limitation
shall not apply to the described .

The total FAR of a mixed-use project shall not
exceed 0.5. In order to achieve the open space

(d) Building Height and Setback:
To accomplish the intensity and scale of
development consistent with the defined purpose
of the GB District, multistory buildings will be
permitted:

it affects the safety of occupants,
compatability with other uses and buildings
and other city and district requirements.

. 2. Minimum building setback requirements are
fifty (50) feet from all streets and
exterior project property lines and twenty
(20) feet from all interior property lines
except that interior lot line setback
requirements may be modified by the city in
the project review process if specific
conditions of the project plan justify
modification.
(e) Landscaping:
Appropriate and unified landscaping is essential
to effectively meet the defined purpose of the
GB District:
1. A landscape plan shall be submitted in the
general plan stage required in subsection
VIIG(3) .
2. The landscape plan shall include species,
size and location of all plant material.
3. In the concept-plan stage, natural existing
vegetation, earth forms, wetlands and steep
slopes shall be carefully evaluated and
. protected as appropriate.
4. Landscape berms and buffers will be used to
screen and visually separate: business
sites from residential uses, business sites
from public streets; and one site from
another.
5. Minimum planted tree sizes shall be three-
inch caliper for overstory deciduous trees,
two-inch caliper for ornamental trees and
eight-foot height for coniferous trees.
The required height of evergreens used for
required screening may be increased by the
City.
6. Special landscape enhancement for views of
1-694 and I-35W will be required.
7. A minimum of twenty (20) percent of the
total area of a mixed-use or single-use
district shall be landscaped.

. 8. Minimum landscaping requirements shall
relate to the gross square footage of all
floors of a building and the building
height and shall be expressed as the
minimum number of total caliper inches
required per building site.

dividing the coniferous tree height in

4. Amend section H(6) (f), as follows:
(6) Development Standards.
(f) Building Exteriors:
The appearance of buildings is an important
visual component in accomplishing the stated
purpose of the GB District. Accordingly, the
following standards shall apply to any building
or structure to be constructed within the GB
District:
1. All exterior wall finishes on any principle
or accessory building shall be one of, or a
combination of, the following:
a. Face brick.
. b. Natural or cut stone.
. c. Specially designed pre-cast concrete
units, architectural block, or
architecturally treated block.
d. Glass, prefinished metal, fiberglass
or similar materials or cor-ten steel
(other than unpainted galvanized metal
or corrugated materials).
e. stucco and other cemetation coating
applied in a manner so as to create a
harmonious design in conjunction with
the materials.
f. Factory fabricated and finished metal
framed panel construction if the panel
materials are any of those noted
above, or similar as determined by the
city.
g. The City may approve other new
materials which are equal to or better
than the materials listed herein.
2. All subsequent additions, exterior
alterations, and accessory buildings,
. constructed after the erection of an
original building or buildings shall be of
the same materials as those used in the
original building and shall be designed in
a manner conforming to the original
architectural concept and general
appearance. These provisions shall not
prevent the upgrading of the quality of
materials used in a remodeling or expansion
program.
3 . Garages, accessory structures, screen
walls, and exposed areas of retaining walls
shall be of a similar type, quality and
appearance of the principle structure.
These provisions shall not prevent the
upgrading of the quality of materials used
(.::1 in a remodeling or expansion program.
5. Amend section H(6) (g)-(h), as follows:
(6) Development Standards.

. (g) Parking:
Parking requirements contained in subsection
VIE(l) shall apply. However, these requirements
may be adjusted by the city in the project
review process if the changes will more
effectively accomplish the stated purpose of the
GB District and subject to the following:
l. Parking structures shall maintain the
setbacks required for principal structures.
2. The exterior finish of parking structures
shall be compatible with the principal
building served by the parking structure.
3. Surface parking shall maintain a twenty
~ foot landscaped setback from all
pu ic streets and a five (5) foot
landscaped area from exterior project
property lines except for access drives
(.) that may cross the setback area.
4. The required number of parking spaces may
be adjusted by the City if the developer
submits adequate proof that the standard
. requirements exceed the actual demand.
Proof that the required number of spaces
could be increased to the number required
must be shown to provide for changes in use
or intensity of use.
5. Combined or joint surface or structure
parking facilities will be permitted for
one (1) or more buildings and uses if the
purposes of the district will be more
effectively accomplished. If the total
number of spaces in a project does not meet
the required number of spaces, the
applicant shall show to the City's
satisfaction that the peak parking load
will not exceed the number provided. Such
reduction in parking may limit the type of
future occupants or may require expansion
of parking if the parking need increases.
Combined or joint parking shall be
reasonably related to the destination of
the user.

. (h) Traffic Impact study:
The City has determined that the traffic
capacity of the interchange at I-35W and state
Highway 96 will impose limitations on traffic
generated within the GB District. In order to
maintain the functional capacity of the area
road system, both internal and external traffic
and parking plans and traffic generation studies
prepared by registered traffic engineers will be
required for all projects within the GB
District.
During the project and site plan review process,
the city will review a project plan or site plan
and determine the allowable development
intensity based on the following guidelines:
1. Improvements to the I-35W ramp
intersections with Highway 96 and the
realignment and intersection improvements
of Round Lake Road West as it intersects
with Highway 96 will allow development in
the GB District that will produce a maximum
total of one thousand five hundred (1,500)
outbound peak p.m. traffic-hour trips.
. 2. A roadway along the southerly border of the
GB District that would connect Round Lake
Road West with old Highway 10 would allow
additional development that would produce
up to fifty (50) additional outbound peak
p.m. traffic-hour trips.
3. A bridge across I-35W at approximately 14th
street that would connect Round Lake Road
West with C.S.A.H. 77 in New Brighton would
allow additional development that would
produce up to two hundred fifty (250)
additional peak p.m. traffic-hour trips.
4. Development producing additional peak p.m.
traffic-hour trips would be allowed if
travel-demand management strategies are
implemented by developers and businesses in
the GB District.
5. Developers in the GB District and the city
may be required to include transportation
infrastructure improvements in connection
with proposed development. Tax-increment
. financing will be utilized as available in
providing such financial assistance.

I am writing in response to the recent solic1tation for membership
on the Planning commission. My interest stems from the awareness
of the Dotential impacts of land use on the natural resources of
our community. I have briefly summarized some of my qualifications
for your consideration.
*) I have a BS in Agricultural Engineering - Soil and Water
Emphasis and a BS in civil Engineering - Water Resources
Emphasis from the University of Minnesota Institute of
Technology.
*) I am presently employed as a Hydrologist for the
Department of Natural Resources. My job responsibilities
include assisting local communities with Shoreland and
. Floodplain Ordinance adoption and administration, wetland
delineation and regulation, and other water resource and
zoning issues. I am very familiar with plat review and
the issues facing communities and developers.
*) I work closely with the Rice Creek Watershed District and
I am familiar with the Wetland Conservation Act of 1991.
