Boarding at Hillcrest saves $75 monthly ($900 annually). 1993 bJdget provides $3,400 for this service (previously provided by CSO) . The patrol costs if started 4-1-93 are $3,280 am 5-1 are $2,952. The first request is to set a date to hold a Public Hearing on April 26, 1993 to =eate the area (the current request f= '!be Cottages), as a Tax In=ement Financing District and secondly, to authorize staff to prepare a Tax Increment Financing Plan for the district with the School District and County notified. The procedure normally goes as follows: h creatino a TIF District 1. This process sets aside land which is not otherwise expected to develop. 2. The Council sets a date for the Public Hearing and describes the land. Legal: Parts of Lots 11, 12, 28, 29 and all of Lots 30 and 31, Rohleder's Harne and Garden a=es. 3. The hearing is held providing f= public comment, with the . Council approving or disapproving the district to be established. II. Tax In=ement Plan APProval 1. Tonight, the Council would authorize a Tax In=ement Plan preparation for the identified TIF District. lJegal: Parts of Lots 11, 12, 28, 29 and all of Lots 30 and 31, Rohleder's Harne and Garden a=es. 2. staff prepares the Tax In=ement Plan f= this District, including the use, size, answer the "But for" test, refers to other TIF Districts to provide continuity. 3. The Cottaqes Update 1. staff, in particular City Accountant Terry Post, have been continuing to work with this possible development and Tax Increment Financing for The Cottages project. 2. '!be development received Planning & Council concept approval in 1992. It is continuing to be discussed and reviewed f= . possible Tax In=ement funding. This review for Tax In=ement funding and any relevant, additional details, will be a part of the Developers Agreement to be prepared by staff and reviewed by Council on March 29, 1993. It is the intent f= this agreement to be finalized for the April 26, 1993 hearing and Council decision. .. . . MINUTES CITY OF ARDEN HILLS, MINNESOTA REGULAR CITY COUNCIL MEETING February 22, 1993 7:30 P.M. - City Hall CALL TO ORDER/ROLL CALL Pursuant to due call and notice thereof, Mayor Sather called to order the regular City Council meeting at 7:30 p.m. Present: Mayor Thomas Sather; Councilmembers Beverly Aplikowski, Paul Malone, Dennis Probst. Absent: Councilmember Hicks. Also present were: Parks Director, John Buckley; Clerk Administrator, Dorothy Person; City Accountant, Terry Post; and Recording Secretary, Shar Foster. ADOPT AGENDA Note was made that a revised agenda was printed on February 22, 1993. Administrator Person stated that Consent Calendar . item 4f should be "Approve List of Claims" rather than "Approve List of Claims/Payroll". MOTION: Probst moved, seconded by Malone, to adopt the revised February 22, 1993 agenda with one correction to Consent Calendar item 4f as noted above. Motion carried unanimously ( 4-0) . APPROVAL OF COUNCIL MINUTES Councilmember Malone referred to the sixth paragraph of page three of the February 8, 1993 Council meeting minutes. He said the concern he expressed during the discussion contained within that paragraph referred to "berming plans that are to be southeast of the townhouses" rather than "berming plans on the old lift station site". He asked that paragraph be revised accordingly. MOTION: Aplikowski moved, seconded by Probst, to approve the minutes of the February 8, 1993 Regular Council Meeting with the appropriate revision to the sixth paragraph of page three requested by Councilmember Malone. Motion carried unanimously (4-0) . CONSENT CALENDAR . MOTION: Malone moved, seconded by Aplikowski, to approve the Consent Calendar and authorize execution of all necessary documents contained therein. UNFINISHED AND NEW BUSINESS APPOINTMENT OF PLANNING COMMISSION CHAIRPERSON Mayor Sather commented that he has yet been unable to . contact the candidate chosen to fill the Planning Commission vacancy created by former Planning Commission member/chair Dennis Probst's being appointed to the City Council. He suggested that Planning Commission's vice chairperson, Jeanne Winiecki, be named as interim Planning Commission chairperson to conduct business at the Planning Commission meeting March 3, 1993. MOTION: Probst moved. seconded by Malone, to ratify the appointment of Jeanne Winiecki to the position of interim Planning Commission chairperson to conduct business at the March 3. 1993 Planning Commission meeting. Motion carried unanimously (4-0). PARKS & RECREATION DIRECTO~ FISHING CONTEST UPDATE Parks Director Buckley reported that the February 13 and 14 Winter Frolics festivities included an ice fishing contest, pancake breakfast, medallion hunt, family sleigh rides, ice skating, chili feed and bonfire/storytelling. He added that the weather was very pleasant and the festivities were met with very positive remarks from participants; the entire two-day event was a great success. . Buckley added that there were only two fish caught and those anglers received a girls and a boys bike. --------- . Arden Hills Council 3 February 22, 1993 Councilmember Aplikowski said that all the feedback she heard was positive and she hopes the event can take place again. Mayor sather thanked Buckley for his report. RESOLUTION NO. 93-13 REGARDING JOINT PUBLIC FACILITIES Administrator Person explained that proposed Resolution No. 93-13 has been drafted to represent Arden Hills' interest in sharing the Twin Cities Army Ammunition Plant (TCAAP) property as a joint public facility with Ramsey County, the State of Minnesota and other public agencies. She added that Ramsey County will be attending a National Association of Counties Meeting within the next few days which County officials are planning to present to Congressional District Representatives a packet of information regarding this matter, including resolutions of . support from interested parties. Mayor Sather stated he has been in contact with Ramsey County staff and learned that the information packet being compiled includes general information, resolutions of support, and collateral information which was discussed in joint meetings. He endorsed this effort and recommended adoption of Resolution 93-13. MOTION: Malone moved, seconded by Aplikowski, to adopt Resolution 93-13 Regarding Joint Public Facilities That Would Be Shared With the City of Arden Hills, Ramsey County, the State of Minnesota, and Other Public Agencies. Motion carried unanimously (4-0). Councilmember Probst asked if Resolution 93-13 makes reference to the description of the property. Administrator Person stated that property description is planned to be included in the information packet that Ramsey County will be presenting to the Congressional District Representatives. SECTION 125 PRE-TAX ~~DUCTIQN CORRECTION City Accountant Post reported that, during computer conversion, staff has discovered an erroneous payroll . process has been used since 1989 in the treatment of PRE- pre-tax dependent health deduction. He explained that since 1989, payroll has been treating some dependent health deductions as if an approved "cafeteria (Section 125) plan" was in place, when in fact, such a plan was not approved. ------------- -------- . Arden Hills Council 4 February 22, 1993 Post reported that, after being in contact with the IRS payroll tax compliance unit, the IRS would expect the employer and the employee to correct this mistake in the following manner: 1) The City would be responsible to pay the employer's share of back FICA taxes. The employee's share of back FICA taxes could either be paid by the affected employees or by the employer (the City) on behalf of the employees; and 2) For the affected employees to amend income tax returns for the affected years and pay the appropriate federal and state tax liability due. Post stated that if the City chooses to pay both the employee's share and the employer's share of FICA taxes, there is a formula which would be used (called "circular computation") in calculating the employee's share of back FICA. Post added that, since the error is considered by the IRS to . be an "honest error", no penalties or interest will be imposed on back FICA. He added that the "honest error" defense could be used by employees so penalties would not be imposed on the corrected federal and state tax liability, however, employees would be liable for interest. Councilmember Malone said ther~ is no question that the City is responsible to pay the employer's share of FICA, and th~ question is whether the City will accept responsibility to pay the employee's share also. He asked if there will be an impact on state taxes as well as Federal taxes as a result of this misreporting. Post answered yes. Councilmember Aplikowski stated that since this error was not the fault of the affected employees, she would prefer that the City accept both the employee's and the employer's share of back FICA. Post stated that the tax liability impact on each individual employee will be determined by their income level and their dependent health deductions in the years in which they are affected. Councilm~mb~r Probst asked if there is any way the City can . assist the affected employees in amending th~ir tax returns for the affected years. Person suggested that. for employee income privacy purposes. perhaps the City could offer a fixed allowance to each affected employee as reimbursement for tax preparation costs. . Arden Hills Council 5 February 22, 1993 Mayor Sather said he would support the City's taking responsibility for the entire FICA matter, furnishing the appropriate forms to the affected employees, and allowing a fixed amount for them to prepare amended returns. Post stated that the City's auditors estimate that it would cost about $50 per year for employees to amend their tax returns. He said affected employees could be reimbursed for tax preparation costs using the standard employee expense reimbursement process with a specific allowance determined by Council. Councilmember Aplikowski asked if there is any indication as to how affected employees will receive this news. Post stated that he was not part of City staff when the incorrect payroll process was implemented, and he believes the affected employees are faced with an inconvenience rather than financial harm. Councilmember Probst asked if the City has any exposure if affected employees don't file amended tax returns. Post . stated that the City's action of filing corrected W-2c forms will allow affected employees to file amended returns. Discussion took place as to what amount the City should allow for amended tax return preparation costs and how the matter should be administered. MOTION: Probst moved, seconded by Aplikowski, to take the following action as a means of correcting the identified past employment tax underreporting issue: 1) Authorize City staff to pay and properly report both the employee's and the employer's share of back FICA, and 2) Provide affected employees the forms they will need to amend their individual income tax returns for the affected years, and . . Arden Hills Council 6 February 22, 1993 3) Reimburse all affected employees in the amount of $50 per affected year for tax preparation costs. This reimbursement will be conditioned upon: A) Proof that amended tax returns are filed (regardless of who prepares the return), and B) Request for reimbursement being received by the City no later than July 1, 1993. Motion carried unanimously (4-0). COUNCIL COMMENTS COUNTY'S CIP FOR COUNTY ROAD I Councilmember Malone referred to Ramsey County's Capital Improvements Plan (CIP) wherein the County has allocated an amount for improvements to County Road I. He noted that the CIP indicates that Arden Hill's share for County Road I improvements is much more than the City has anticipated. Administrator Person said she would check into this matter. "COTTAGES" DEVELOPMENT . Councilmember Probst asked when John Arkell's "Cottages" development proposal is expected to come before the City. Staff answered that the proposal is expected very soon. SPEED LIMIT ON OLD SNELLING Councilmember Aplikowski reported that the issue of the speed limit on Old Snelling received a lively discussion at the last Public Safety/Works meeting. Mayor Sather recalled that a tentative date of March 29, 1993 has been set to discuss the old Snelling issue and since that meeting will have to be held at a location other than the City Hall in order to accommodate the expected number of attendees, he suggested the date be definitely established to assure the matter is dealt in a timely fashion. He added that a few locations have been suggested, but his first choice is the Mounds View High School. Staff was directed to make arrangements for the March 29, 1993 Council meeting to take place preferably at the Mounds View High School either at 7:30 p.m. or 6:30 p.m. (whichever is most convenient for the school), and to make every attempt to place as few other items on that agenda as . possible. . . RAMSEY COUNTY, MINNESOTA RESOLUTION NO. 93 - 14 A RESOLUTION ESTABLISHING THE 1993 SURFACE WATER MANAGEMENT UTILITY RATES WHEREAS, the City has added Sections 28 - 162 thru 28 - 171 to the Code of Ordinances, establishing a surface water management utility, and; WHEREAS, the revised code requires the City Council to establish by resolution, from time to time, the rates to be charged for the Surface Water Management Utility; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Arden Hills, Minnesota: 1. CITY OF ARDEN HILLS RAMSEY COUNTY, MINNESOTA RESOLUTION NO. 93 - 15 - A RESOLUTION ESTABUSHING CITY POLICY ON OPERA nON OF A SURFACE WATER MANAGEMENT UTILITY WHEREAS, the City Council has created a surface water management utility; and WHEREAS, the operation of said surface water management utility requires the establishment of criteria directing operations; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Arden Hills, Minnesota: 1) The following is hereby established as City Policy for the operation of the City of Arden Hills Surface Water Management Utility: . A. Policy Statement Except as herein after provided, all properties within the City of Arden Hills shall contribute to the Surface Water Management Utility in an amount proportional to the runoff contributed by each particular parcel. B. Exemptions 1) Street and Highway Right-of-Way - Street and highway right-of-way shall be exempt from all charges. 2) Lakes - Lakes by the Minnesota Department of Natural Resources as Natural Environment Waters, Recreational Development Waters or General Development Waters shall be exempt from charges. 3) Parks - Parks under the ownership of the City or Ramsey County shall be exempt from charges. This shall include all open space areas within the City. C. Computation of Surface Water Management Fees The following factors shall be considered in determining the surface water . management fees for each zoning classification. 1 of 3 -------- . , 1) Land Use - Land Use for determining surface water management fees . shall be the existing land use at the date of enactment of the Surface Water Management Ordinance. As land is developed, or redeveloped, the fees will be recomputed based on the revised land use. 2) Soils - Soil Conservation Service (SCS) - Type B soils shall be assumed for determining the curve number runoff index (CN) in the revenue equation. 3) Rainfall (P) - A 2" rainfall will be used on the revenue equation. 4) Runoff Indices (eN) - The runoff indices for the zoning classifications are as follow: Zoning Classifications Land Use .eN R-l Single-Family Residential (1\3 acre lots) 72 R-2 Single and Two-Family Residential (114 acre lots) 75 R-3 Townhouse and Low Density Multiple Dwellings 85 R-4 Multiple Dwelling 85 . I-I, 1-2 Limited and General Industrial 92 B-1, B-2 Limited and General Business 92 5) Revenue Equation - The revenue equation for computing the runoff volume (Q) shall be based on the runoff equation in the U.S. Department of Agriculture Soil Conservation Service (SCS) Engineering Handbook. The equation is as follows: Q = lP-O.2S)2 where S = (1000/CN) - 10 P + 0.8S and P = 2" 6) Undeveloped properties, without regard to zoning classification, shall be charged a quarterly fee per acre equal to one-half the fee charged to developed property zoned as R-1. D. Credits Surface water management utility fees may be adjusted under the conditions stated . below. It shall be the responsibility of the property owner to provide justification 2 of 3 - . for the fee adjustment. Credits must be applied for by October 31 of the year preceding the year in which the credit is to be considered, except that during the first months of operation, property owners shall have until March 15, 1993 to apply for credits, which shall be retroactive to the start date of Utility. E. Adjustment of Fees Surface water management fees will be adjusted under the following conditions: 1) Revision of Quarterly Surface Water Revenue - The estimated expenditures for the management of surface water shall be revised at a frequency specified in the ordinance. The fees will be adjusted accordingly and will follow established City procedures for this adjustment of utility (water and sewer) rates. 2) Changes in Developed Conditions of Parcels 3) Storm Water Retention - If it can be demonstrated that an individual parcel retains all or a portion of the rainfall that it receives, the surface water management fee will be reduced by a percentage equal to that percent of the parcel which produces no external runoff. Storm Water to Chapter 28 Utilities of the code of Ordinances Relating To The Establishment of a Surface Water Management Utility ARTICLE V SURFACE WATER DIVISION I. GENERALLY SECTION 28-162 GENERAL OPERATION: The Municipal Surface Storm Water Runoff system shall be operated as a public utility (hereinafter called the surface water management utility), pursuant to Minnesota Statute Section 444.075, from which revenues will be derived subject to the provisions of this Chapter and Minnesota Statutes. SECTION 28-163 DEFINITIONS: . A. Utility Factor. The utility factor is defmed as the ratio of runoff volume, in inches, for a particular land use, to the runoff volume, in inches, for a 1/3 acre residential lot, assuming a 2" rainfall and Soil Conservation Service (SCS) "Type B" soil conditions. B. Surface Water Manal!:ement Fee. The surface water management fee is defmed as the quarterly charge developed for each parcel of land pursuant to City regulations and zoning classifications and shall be established by City Council resolution. C. Ouarterly Surface Water Manal!:ement Utility Budget The quarterly surface water management budget is the estimated quarterly expenditures for planning and inventories, capital expenditures, personnel and equipment and operation of the surface water utility, in accordance with established City policy. This budget shall be established from time to time by City Council resolution. SECTION 28-164 ESTABLISHMENT OF FEES Surface water management fees shall be established by City Council resolution. The following steps are taken to determine the quarterly fee to be charged to each property: a) A calculation is made of the total area, in acres, of property zoned R-I, R-2, R-3, R-4, . I-1, 1-2, B-1, and B-2 within the City. 1 of 4 ~ . b) A determination is made whether each individual property within these zonin_ classifications is developed or undeveloped. c) The total number of developed acres of property within these zoning classifications is calculated. d) The total acreage of developed property zoned as R-l, single family residential, is divided by the total acreage calculated in step c. This yields the percentage of total developed property that is zoned R-I e) The City Council establishes, by resolution, the quarterly budget for the revenue to be generated. t) The portion of the quarterly budget to be charged against properties zone R-l is calculated by multiplying the percentage found in step d. by the budget amount in step e. g) The rate per acre for property zoned R-l is calculated by dividing the revenue for R-l properties in step f. by the total acreage of developed properties found in step c. This rate is the basis for all rates charged to any other zoned properties within the City. h) The volume of storm water runoff is calculated for all properties zoned R-l, R-2, R-3, R-4, I-I, 1-2, B-1, and B-2. The methods used for these calculations follow the U.S. Department of Agriculture Soil Conservation Service guidelines for soil types common. to Arden Hills. A curve number is chosen for each zoning classification, which is an approximate measure of the percentage of impervious surface on the property. The volume of runoff for each zoning classification is the calculated using the following equation. Q = (P-0.2S)2 P + 0.8S Where Q = runoff, cfs S = (l000fcn) - 10, dimensionless P = 2, inches i) The runoff value calculated in step h. for R-l properties is considered the base rate. The runoff value for each of the other zoning classifications is then divided by the base rate to yield a utility factor for each zoning classification. This utility factor is a measure of the additional runoff created from the property as compared to a single family lot. The utility factors for each zoning classification are listed ill the following section of this ordinance. j) The rate per acre for all zoning classifications, except R-l, are calculated by multiplying the utility factor found in step i. by the base rate determined in step g. . 2 of 4 . '\ SECTION 28-165 FACTORS FOR DETERMINING FEES FOR VARIOUS LAND USES: . The utility factors for various land uses used to determine the surface water management fees are assigned as follows: Zoninl! The City Council may adopt policies, by resolution, for adjustment of the surface water management fees. Information to justify a fee adjustment must be supplied by the property owner. The following land uses are exempt from the surface water management fee: (a) Public Right-of-Way (b) Lakes (c) Parks SECTION 28-169 MAILING STATEMENT OF CHARGES Statements for the preceding quarterly Surface Water Management service shall be mailed to each customer pursuant to the same procedures as listed under Section 28-57 of this code. SECTION 28-170 FEE APPEAL If a property owner or person responsible for paying the surface water management fee believes that a particular assigned fee is incorrect, such a person may request that the fee be recompute. Appeals will be heard by Council once a year in accordance with the schedule established for credit applications, in established City policy. SECTION 28-171 PENALTIES FOR DELINQUENT PAYMENTS OF FEES . A penalty equal to 10% of the amount due shall be added to accounts not paid in full on or before the 1st day of the second month following the filling periods and to each quarterly billing thereafter until the amount of the delinquent account plush accrued penalty is paid in full or otherwise certified to the Ramsey County Auditor as a delinquent account. SECTION 28-172 ANNUAL CERTIFICATION OF DELINQUENT ACCOUNTS Each year the City Administrator shall prepare a list of delinquent surface water management service charge accounts, including accrued penalties thereon, in the form of an assessment roll. This project consists of bituminous overlay and seal coat improvements on a number of streets within the City. These streets, as discussed at the December 21, 1992, Council worksession, were chosen based on updated pavement ratings of all City streets and Public Works staff recommendations. Additional streets have been added to the overlay portion of the project, as discussed at the February 16, 1993, City Council worksession. Items discussed in the study include the proposed improvements, estimated project costs, methods of financing the improvements, and a proposed project schedule. In accordance with the City's Assessment Manual, 50% of the bituminous overlay improvements project cost is proposed to be assessed to the abutting property owners. No assessments are proposed for properties abutting seal coat improvements, as outlined in the Assessment Manual. The estimated project cost for the 1993 Pavement Maintenance Improvements is $269,800. The estimated assessable cost is $122,850, leaving an estimated City cost of $146,950. The City budgeted amount for this project is $150,000. Any remaining budget could be used to fund improvements on Keithson Drive or other maintenance work as needed. Additional seal coating improvements could also be added without affecting public hearing requirements, since no assessments are levied. I I I I I I r I I ~ INTRODUCTION The Feasibility Study for the 1993 Pavement Maintenance Project, consisting of bituminous overlay and seal coat improvements, was authorized by Resolution 92-76, adopted by the City I Council at their December 28, 1992, meeting. The original Feasibility Study was received at the January 25, 1993, City Council meeting, but additional funds became available and I additional streets were added to the overlay portion of the project. I In Fall 1992, all streets within the City were reviewed and rated by Public Works staff and the City's computer pavement management data was updated. This computer program includes data I on each street's condition and prioritizes the need for maintenance. Based on these ratings and input from City staff, a list of streets requiring bituminous overlay and seal coating was I developed. I SCOPE The purpose of this study is to analyze the feasibility of bituminous overlay and seal coat . improvements on various streets within the City. This Feasibility Study will discuss existing conditions, proposed improvements, and estimated project costs. Financing methods will be I discussed, using the City's Assessment Manual as a guide. A proposed project schedule will also be presented. I EXISTING CONDffiONS I The City's pavement management system rates all streets based on the number and severity of cracks, areas of settlement, existing pavement thickness, and age of the street. The data is I collected in the field and entered into a computer program, which outputs a single numerical rating for each street on a scale of 1 to 100. A score of 100 would be calculated for a new I street, with scores decreasing as the street ages and deteriorates. Streets rated over 95 do not I require any work other than isolated crack filling. Streets rated between 90 and 95 require seal coating. Streets rated between 69 and 89 require bituminous overlay improvements. Streets I rated lower than 69 require reconstruction, as it would not be prudent to spend maintenance money on streets which are structurally failing. It is in this last category that recycling of the r pavement, as completed in 1992 on Round Lake Road and Dunlap Street, can be considered. I Pl!As-520.m9 -2- 52().lll9-IO I .. It is important to note, however, that a single numerical rating should not alone dictate the maintenance to be done. The ratings are a tool, but experience on repairing streets with similar I conditions and input from Public Works staff are also valuable in determining the most cost- I effective means of repairing a street. I It is vital that an ongoing program of maintenance projects be funded in future City budgets to keep streets from deteriorating to the extent that reconstruction is the only alternative. An I ambitious project in 1991 of $152,300 completed a number of seal coat and overlay improvements. Reconstruction of North Snelling Avenue, also accomplished in 1991, had a I construction cost of $230,200. In 1992, reconstruction of Tiller Lane and recycling improvements on Round Lake Road and Dunlap Street were completed, with a total construction I cost of approximately $280,500. Assessments were levied in both 1991 and 1992 to subsidize City funds. This ongoing program of maintenance and reconstruction projects would be severely I curtailed without assessments to abutting property owners. . PROPOSED IMPROVEMENTS The following streets are proposed to be improved in the 1993 Pavement Maintenance I Improvements Project. This project will consist of seal coating and overlay improvements. The rating for each street is provided. To provide anticipated cost savings in the bidding process, I streets have been grouped so the same maintenance activity takes place in a particular area of the City. This grouping, along with input from Public Works staff, accounts for the fact that - I some streets will have maintenance performed other than that indicated solely by their rating. Location maps showing the streets proposed for improvements are included as Exhibits 1 and I 2 in the appendix of this Feasibility Study. The budgeted amount for this project, as discussed in the I Financing portion of this study, is $150,000. A surplus budget has been provided to allow monies for repairs to Keithson Drive or other maintenance projects which may become apparent I later this Spring. It is not anticipated that streets will have to be deleted from the proposed improvements following receipt of bids. I ESTIMATED COSTS I The estimated project cost for the proposed improvements is as follows: I Estimated Bituminous Overlay Project Cost $245,700 Estimated Seal Coat Project Cost 24.100 I ESTIMATED TOTAL PROJECT COST $296.8QQ It The total estimated project cost includes 15 % overhead to cover engineering, field inspection, construction administration, and assessment roll preparation. I FINANCING I As outlined in the City's Assessment Manual, 50% of the total cost of a bituminous overlay, including all associated overhead costs, may be assessed to all properties with frontage abutting I a street to be overlaid. According to Ramsey County records, there are 304 abutting and benefitting properties with a total adjusted front footage of approximately 40,500 feet. The City's budget is $150,000 for this project. Should bids received be more favorable than I estimated, it would be possible to add other streets. As discussed in the previous section, streets I added to the seal coat portion of the project would not require additional public hearings. Ifbids received are higher than anticipated, it would be necessary to eliminate streets. I In 1991, the estimated assessment rate in the Feasibility Study was $3.44 per adjusted front foot. I Following the bidding process, however, the actual assessment rate was reduced to $2.64 per adjusted front foot. As was done in 1991, a resolution will be proposed for City Council review I to establish the 1993 residential equivalent assessment rate after bids are received. No commercial equivalent assessment rate is necessary for this project. I A detailed estimated assessment cost is provided in the appendix of this Feasibility Study for I each of the abutting and benefitting property owners on streets to receive bituminous overlay improvements. This preliminary assessment roll lists each property owner, the total adjusted . front footage for each property, and the estimated assessment cost for each property. I As detailed in the City's Assessment Manual, no assessments are proposed for seal coat improvements as this work is a maintenance procedure funded by the City. I Through the project specifications, the City shall retain the right to add or delete streets from I bituminous overlay or seal coat improvements to match the available budgeted funding. I CONCLUSION I The estimated project cost for the 1993 Pavement Maintenance Improvements Project is $269,800. The proposed improvements are feasible from an engineering standpoint and meet . all standards set forth by the City. Any surplus budget would allow for improvements on Keithson Drive or other necessary projects. Streets requiring seal coating could be added to this I project without affecting the necessary public hearings procedure. WHEREAS the Revised Feasibility Report recommends that the proposed improvement is feasible; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Arden Hills, Minnesota: 1. This agreement shall be effective as of J anuarv 1. 1993. and shall continue in effect until December 31. 1993. unless cancelled pursuant to Paragraph 15. 2. "ASCII! agL'ees to patrol the public streets of the "City" in a vehicle especiall,' designed for the transportation of small animals. in accordance with "Citv" ordinances and a schedule agreed upon by both parties. The vehicle shall have proper identification displayed on two sides. "ASCI" further agrees to insure. sen.ice. and maintain said equipment. 3. "ASCI" agrees that patrolling shall be done by competent personnel trained in the handling of animals.. Said employees shall perform their duties only while 1n proper uniform and shall wear identification as to indicate emplovee's name. title. and place of employment. . 4. The "City" shall authorize "ASCI" to apprehend and retain dogs. cats and/or issue citation tags for violations of the "City" Ordinances. However. "ASCI" will not invade the private property contrary to the wishes of the owner of said property nor forcibly take an animal from any person without the approval and assistance of a regular officer of the "City". 5. In addition to the regular hours of patrolling referred to. "ASCI" agrees to maintain one (1) vehicle for standby service to attend to cases outside regular' patrol hours at the specific request of the "Cityls" Police Department. "ASCI" shall respond immediately to any call involving a bite case or injured animal reported through the Police Department. 6. "ASCI" represents and agrees that all animals impounded shall be kept at Hillcrest Animal Hospital. 1320 E. County Road D. White Beat. Lake. MN 55110. "ASCI" agt.ees and warrants that all animals impounded shall be kept in a comfortable ancl humane manner for a period requi red by the "City" Ordinance. It is mutually agreed that "ASCI" may temporarily board at an emergency facilitr if access and/or treatment is not immediately available at the contract facili ty . 7. At the time that an animal impounded under this contract is reclaimed. ASCI" or its agent shall collect the impounding fee and boarding charges as provided by I1City" Ordinance. "Ascr" shall furnish monthly reports to the "City" as requit.ed as to the service 01' services rendered in connection with each animal impounded. All impounding fees and/ur any other penalty fees . collected by "ASCI" or its agent shall be remitted to the "City". ----~--~- 8. In the eveut an animal impounded and boarded by order of the llCity'1 Health Officer or placed under quarantine by ruling of the State Board of . Health. said animal shall be boarded as required by said order or ruling. At the end of such period. the "City" releases all of its interest. right and control over said animals which may then be disposed of at the discretion of "ASCI". In the event that any dogs. cats. or other impounded animals are unclaimed after five (5) days, they shall become the property of "ASCI" and may be disposed of or sold at their discretion. All proceeds from the disposition of such animals may be retained by "ASCI" including any proceeds received horn any animals disposed of in accordance to Minnesota Statutes 35.71. 9. The "City" shall furnish to "ASCI" any special fonns or receipts specified in the Ordinance and "ASCI" shall keep records of all animals impounded together with a description of the same. 10. "ASCI" shall assume liability for all harm to animals due to its negligence or that of its agents in nor properly caring for the s;qrne. and agrees to defend any lawsuits arising therefrom. "ASCI" shall defend. indemnify. and hold the "City" hannless including its officers, employees. or agents from any and all claims, suits, los ses , dmnages, or expenses on account of bodily injuries, sickness, disease. death, and property damage including injury to animals and the result of. or alleged to be the result of "ASCI's" animal control operations. Upon request, "Ascr" shall provide the City" proof of public liability insurance including comprehensive automobile liability in an amount of at least $500,000.00 per each claimant and $1,000.000.00 per occurrence. 11. The "City" agrees to pay "ASCI" for services in the performance of this . contract as follows: A) Price per hour - pel' vehicle for scheduled patrol based on ( I,) hours of patrol pel' week for actual time in service 1993 -- $20.50 B) Price per call - per vehicle for unscheduled service during r"egular working hours of 7 a.m, to 5 p.m. weekdays 1993 -- $40.00 C) Price per call - pel' vehicle for service during other than scheduled 01' regular w'orking hours 1993 -- $55.00 D) Price per animal - for each DAY or fraction thereof for boarding any species of animals impounded by direction of "City" officials or local ordinance 1993 -- $3.90 E) Price per animal - for disposal of a cat -.1993 -- $15.00 F) Price per animal - for disposal of a dog - 1993 -- $18.00 12. '!he =ent request involves 3 elements: 1. Tennis Court: '!he existin] . 4 courts located west of the school will be removed and replaced with 8 new courts. A small parking lot will be added between the school and the new courts. 2. The student Drop Off lane: CUrrently allows 13 stalls between the buildin] and County Road F. This will be reconfigured with a one-way traffic pattern that will allow parents to drop students off in a safe manner. A sidewalk and steps will be added f= access to the main school entrance. 3. The Parking and Service Area On the SW corner of the buildin] will be expanded slightly to allow trucks to turn around in a sort of cul-de-sac arrangement and provide an inproved drive to this rear area. Planner Bergly reviewed the considerations listed in his report. A variance will be required f= either the front yard setback = f= the height of the fence in the front yard. Rationale f= either type of variance is as follows: 1. '!he regulations are established to protect the character of a residential district. 2. The use a=oss the street is industrial in nature (MnOOI' radio tower and Ryder School Bus garages) although in a Residential District the inpact of the higher fence on property a=oss the street would be insignificant. 3. There are no residents within 800 feet alol'XJ County Road F. 4. The school site is fully utilized and alternative location of an expanded tennis facility is not possible. . 5. In an update of his review, Bergly presented the school's replantin] scheme that will save all of these trees and will soften the inpact of the new fence and wiOOscreen. '!he proposed student drop-off achieves the significant safety objective of removin] the hazardous practice of droppin] off students on the shoulder of County Road F and havin] them cross the traffic path to enter school. The new access is approxi1rately 50 feet west of the present access and is one-way entrance only. All cars leavin] this area of the site will leave through the student drop-off area, exitin] onto County Road F just east of the present parking area. Bergly commented that two negative fact=s result from the proposed access changes. First three 8" - 10" deciduous trees and three 6"-12" evergreens will be removed; second, the parked cars will be nearer to County Road F. Parked cars are now about 15 to 35 feet from the R/W while the proposed plan shows them between 5' and 20' from the R/W. The park:in;! setback requirement was intended to leave a 20' ban:i of . landscapin] along our streets. In this case, the parking lot will remain in the same location b.It the vehicles will be parked closer to the street. The drop-off configuration has been reviewed by the Ramsey County Transportation Department and was ar:proved in concept subject to makin] the west access an entrance only and the east drive an exit only. The ar:plicant will need a COUnty penni.t prior to construction. Bergly noted the safety gained from this proposal is an acceptable trade off f= the negative fact=s of parJdn;J setback and loss of mature trees . The trees should be replaced with additional landscaping in the front yard of the school. Trees and shrubs planted between the parking and County Road F would soften the inpact of cars parked closer to the County Road. He presented the landscaping plan suJ::xnitted by the school that shows 31 compact Amber rraple shrobs to be planted between the Co. Rd. F right-<:>f-way and the north edge of the parking lot. Bergly also advised that the proposed parJdn;J lot and drive modification on the south side of the school will add to the convenience of the many service vehicles using this area of the site and will contribute to the safety of the school by improvin] the capability of emergency vehicle access and turn-aroun::i. John ostlurrl, Assistant Director,Ccammmity Support Services, commented the School District needs 8 courts to provide competition events, as well as for instruction as a school =iculum. . Bergly commented that a nl.llllber of alternatives at the school have been investigated for plannin] the expan:ied tennis facility, but that the topography, nearly total usage of the site and the required north-south =ientation resulted in the location proposed. Rye questioned the definition of a "reasonable" height variance for the fence. Erickson requested a description of the fence materials. Mr. ostlund stated it would be a chain link fence with the green windscreen. McGraw offered rationale for a hardship based on the North & South =ientation required for the courts, and the land available not accomrnodatin] this orientation without a variance. Rye commented he preferred 2 rows of deciduous trees planted to help screen the visual effects of the windscreen. Erickson questioned the signage f= the proposed drop-off site. GRAINGER, 4444 WEST ROUND LAKE ROAD At the regular Planning Commission meeting held Wednesday, March 3, 1993, Commission members expressed concern relating to the exterior building materials which will be utilized for the "Future Additions" to the W.W. Grainger building. Commission took action to recommend approval of the proposed expansion, with the south wall to be constructed with the same exterior building materials, since that is not a temporary wall. There was substantial discussion relating to proposed . future expansion of the site and requiring the future additions to be constructed with exterior building materials as required by the new Gateway Business District guidelines. commission also discussed landscaping in the rear of the site to provide a buffer, if the U.S. Fish and wildlife Services installs a walking path around the lake and to lessen any visual impact from the residences across the lake. This was the rationale for requiring the applicant to submit a status report four years from the date of approval. The Planner, Building Inspector and I have discussed the action taken by Planning commission and to allow for easier implementation of the conditions imposed by Commission, we would recommend the Council consider the following condition to replace Item (a) listed on the Planning Action Request: a. That the north and east temporary walls of the structure are acceptable as painted concrete block walls and that plans for future expansion of the building show construction of the permanent north and east walls with uniform concrete panel material to maintain the continuity of the existing building materials, and which include enhancement of the structure by one of the following methods: 1) Utilizing building materials required by the Gateway Business District regulations; 2) The addition of an approved decorative . enhancement to the walls, which may be carried through to the existing structure; or, 3) Landscaping enhancement to the site on the north and east areas. . , . Staff concurs with commission concerns relating to preserving the ability to request site enhancement and is merely suggesting it would be easier to refer to the SUP for clear definition of what is acceptable for expansion, rather than attempt to recall that the applicant must report within four years. Staff is also planning to more clearly define the GB District regulations relating to acceptable exterior building materials, and to consider the addition of language relating to enhancement of the sites which contain existing buildings.
