Garrett Lysiak is appearing before the Council to request consideration for appointment to the Cable 'IV Commission. He will be providing background infonnation relating to his expertise in the area of cable technology. He will be ccmnnenting on areas of concern regarding service and technology issues of Cable 'IV. 2. Review of Ramsey County Road Turnbacks - Teny Maurer will present to the Council the preliminary proposal of the proposed road turnbacks (see attached report) to the City of Arden Hills. It is iInportant that the Council direct staff as to what their concerns are in proceeding with these road tumback issues. 3. ZOning EnfOl:oenel1t - '!he staff will be informing Council of future zoning enforcement plans and a concern that consistency be awlied in . all cases. Council may wish to identify additional needs of which the staff has not been aware, or concerns regarding full or consistent enforcement. 4. Everest Group - Everest Group has reconsidered their concept development plan for the Round lake Business District. 'lhey are now retunring to Council with a revised concept plan YJhich they have iIxlicated is Jrore in line with the City planned development objective of a "corporate headquarters" type b.Jilding, based in the area along with other mixed use b.Jilclings. May 12, 1993 File: 520-043-70 , Ms. Dorothy Person City Administrator City of Arden Hills 1450 West Highway 96 Arden Hills, MN 55112 RE: RAMSEY COUNTY TURNBACK ISSUES Dear Ms. Person: Discussions have been ongoing with Ramsey County regarding a possible turnback of roads currently designated as County State Aid Highways in exchange for roads currently designated as Municipal State Aid Streets. The roads under discussion, as shown on the attached map, are: New Municioal State Aid Streets - Snelling Avenue from TH 51 to County Road E 0.86 mi Lake Johanna Boulevard from County Road D to County Road E 0.83 mi 1.69 rni New County State Aid Highways County Road F from 1-694 to Lexington Avenue 0.51 mi Hamline Avenue from 1-694 to TH 96 1.00 mi 1.$1 mi The City currently has 0.61 miles of undesignated roadways on the Municipal State Aid Streets System, so it would be necessary to use 0.18 mile of the balance should this proposal be accepted. We have reviewed the projected needs for the new Municipal State Aid (MSA) streets. As allowed by the State Aid Office, every $1,000 of needs (current cost of reconstruction) for a roadway generates $29.50 of apportionments. Based on this rate, it is anticipated that Snelling venue would generate $29,130 and Lake Johanna Boulevard would generate $30,240 of needs pportionments, for a total of $59,370. At present, County Road F and Hamline Avenue enerate very minimal needs apportionments because they have been recently reconstructed. fter 20 years, they will again generate full needs. - 1959 SLOAN PLACE, SUITE 200, ST, PAUL. Equal Opportunity Employer , . , . . - Ms. Dorothy Person May 12, 1993 Page Two Ramsey County also proposes to perform crack seal and seal coat work on Snelling Avenue, prior to turning it back, to bring it to a condition level 90. The estimated cost for this work is $22,260. It is the County's pinion that the bridge located just north of Trunk Highway 51 on Snelling Avenue is sufficient to accommodate any roadway urban improvements the City may choose to construct. Ramsey County rated Lake Johanna Boulevard at a condition level 100 in 1991, so no improvements are proposed prior to the turnback. Turnback procedures are ideally intended to benefit both parties. In this case, Ramsey County benefits by obtaining County Road P, which will be partially upgraded to match improvements on the east side of Lexington Avenue. Acquiring HaInline Avenue also allows the County to have control of the intersection at County Road P, which has been discussed as a future location for traffic signals. It also benefits the County that Hamline Avenue was recently reconstructed. The benefits of the City are that 1.69 miles of MSA roadway designation will immediately begin to draw apportionment and maintenance needs. The roadways turned back will not create immediate maintenance projects for the City. - There are also negative aspects to this turnback from a City standpoint. The uncertainty of the bridge integrity on Snelling Avenue would require the City to have it inspected, and possibly improved, prior to any future projects. The issue of right-of-way width and possibly vacating portions of it is also a complicated and political decision within the neighborhood. Also, the present layout of Lake Johanna Boulevard maximizes the useful space between properties on both sides of the road. It is therefore doubtful that State Aid design criteria could be met if Lake Johanna Boulevard were to be reconstructed. It is my understanding that this issue will be discussed at the next City Council worksession, set for May 18, 1993. We would hope to discuss the various issues at that meeting and receive direction from the City Council on how to continue discussions with Ramsey County. I will be in attendance at that meeting. I expect that changes in the purpose of Snelling Avenue from TH 51 to County Road E will reduce this street classification from a Minor Arterial to a Collector classification. It is not only reasonable for Arden Hills to receive Snelling A venue as a City street but it also can be a great benefit to - the City. Approximately 50 properties abut Snelling Avenue along this 0.86 mile of street. As a part of the trade action with the County it is important for the City to receive a right-of-way of a reasonable width consistent with the 1982 City Comprehensive Plan (page 58) which calls for "80 foot + as required". The 1980 County Comprehensive Plan (figure 6.5) showed "Desirable Right-of-Way, Total Width of 66 foot". There does not appear to be any public need for the City to receive the full 200 foot width to accommodate traffic. A public road existed along the present Snelling Avenue alignment in the 1930's or 1940's when the State of Minnesota made additional acquisition to produce the 200 foot right-of-way that exists today. As was common practice for the State to simply acquire the right to real estate for trunk highway purposes from the adjacent land owners. The state did not acquire fee title. In a change of State plans a new alignment was selected and basically a 230 foot right-of-way was acquired to the East and TH 51 was constructed at its present alignment in about 1950. After many years the State of Minnesota, by Quit Claim Deed filed May 9,1977, conveyed its interest to Ramsey County. I expect that the County will Quit Claim all of its interest in this highway including any conditions or restrictions or covenants that run with the land to the City of Arden Hills for highway purposes. Based on the width that the Council adopted in the Comprehensive Plan it is reasonable for the City to follow at this time with a single action to describe the north/south limits of vacation, - reduce a 60 foot width from each side of the right-of-way and allow the basic needed 80 foot width to remain. Attached is a suggested Vacation of Excess R/W, Snelling Avenue map to serve as a point of beginning for City consideration. In this regard: \ - Mayor, City Council City of Arden Hills May 17, 1993 Page 2 of 3 l. The easterly segment of the right-of-way from County Road E southerly to Arden Place would not be reduced by vacation. The easterly leg of Snelling Avenue serves about seven (7) properties and the area between the streets serve the City public purpose as a recreation area. 2. The southern 400 foot or so on both sides of Snelling A venue at TH5l would not be reduced by vacation at this time. This area may be required for reconstruction of the Johanna-Josephine Bridge. The City could declare some excess right-of- way and vacate at a later date. 3. Two (2) segments of 20 to 30 foot width adjacent to about seven (7) properties must be retained in easement to accommodate the City sanitary sewer system. The actual extent of right-of-way and easement necessary to serve the City need is, of course, - a City Engineering and Planning determination. A few development implications of the suggested vacation are as follows: l. About 12 adjacent residential properties are in non-conformance as to setback from Snelling Avenue. Based on District Requirements of the City Zoning Code. All of these would become conforming with vacation. 2. A slight upward adjustment in property Assessed Values would benefit the City with a small increase of real estate tax income. The County will furnish these numbers. 3. The 8.5 acres of land vacated to adjacent properties would reduce the City cost and responsibility of managing the generally wild wooded area. 4. The City Park located on the West side of Snelling Avenue about 200 foot south of County Road E would be increased in area by about 12,000 square feet. This parcel would then be large enough for the City to sell the site for a single family residence with increased tax benefit to the City. 5. One lot, my residence, would be increased in area and size to accommodate a"Lot Division" . Sale of the second lot and its development can be accommodated completely consistent with the District Requirements of the Zoning Ordinance. - I have a Lot Division application under Sec. 22-12 Variances and Exceptions on file with the City for processing when vacation takes place. , - Mayor, City Council City of Arden Hills May 17, 1993 Page 3 of 3 I do not know of other properties that could have a simple lot split. Others may combine properties to subdivide with a plat which would follow the usual publication, hearing process recommendation and Council action. The 200 foot right-of-way was acquired for highway purposes. The highway requiring that width was constructed elsewhere over 40 years ago. Ramsey County received the full right-of-way for highway purposes over 15 years ago and continued to retain that width after adaption of the Comprehensive Plan showing 66' as the planned width I3 years ago. It is my understanding (MS4l2.851) that the City by its own motion can vacate the excess right- of-way. A two week published notice is required prior to public hearing in this regard. The City would then complete the proceedings, enter in the transfer record and file with the County recorder. - I urge the Council to proceed with the turnback of Snelling Avenue from the County and vacate excess property to the adjacent property owners in the interest of orderly Planning and Development of Arden Hills.
