April 26, 1993

CALL TO ORDER/ROLL CALL
Pursuant to due call and notice thereof, Mayor Sather called
to order the regular City Council meeting at 7:30 p.m.
Present: Mayor Thomas Sather; Councilmembers Beverly
Aplikowski, Paul Malone, Dennis Probst. Absent: Dale
Hicks. Also present were: Clerk Administrator, Dorothy
Person; City Accountant, Terry Post; Recording Secretary,
Shar Foster.
ADOPT AGENDA
MOTION: Aplikowski moved, seconded by Probst, to adopt the
April 26, 1993 agenda as presented. Motion carried
unanimously (4-0).
RECOGNITION OF EAGLE SCOUT
. SCOTT MCLEAN FERGUSON
Mayor Sather read aloud Resolution No. 93-28 honoring Scott
McLean Ferguson for his attaining Eagle Scout status based
on earning 21 merit badges, and planning and directing a
service project relating to installation and construction of
benches, trail markers, waste receptacles and signage along
the trail system in Arden Hills.
Mayor presented Scott with a certificate and City of Arden
Hills pin; all in attendance applauded.
MOTION: Probst moved, seconded by Malone, to adopt Resolution
No. 93-28 Honoring Eagle Scout Scott McLean Ferguson.
Motion carried unanimously (4-0).
PUBLIC HEARINGS
PROGRAM MODIFICATION OF DEVELOPMENT
DISTRICT #l & APPROVAL OF TIF
PLAN FOR TIF DISTRICT #3
Mayor Sather opened the meeting at 7:32 p.m. for the purpose
of conducting a public hearing on Program Modification of
Development District #1 and Ap?roval of Tax Increment
. Financing Plan for Tax Increment Financing District #3.
Administrator Person verified publication of the notice of
hearing in the New Brighton Bulletin on Wednesday, Apri 1 14
and 21, 1993.

Arden Hill s Counci 1 2 Apri 1 26, 1993
Administrator Person reported that the City has received
correspondence from Ramsey County advising of their general
concerns regarding the creation of tax increment financing
districts in Ramsey County.
Mayor Sather stated that Carolyn Drude, Executive Vice
President/Director of Ehlers and Associates (consultants to
the City) would make a presentation, followed by input and
questions from the Council and the pub li c .
Ms. Drude explained that the creation of TIF District No. 3
is being considered in order to provide financial assistance
to Developer John Arkell to complete a proposed senior
housing project called Cottage Lifestyles, which would
inc1 ude a 60 -unit, two-story apartment building located on
four parcels west of Cleveland Avenue, south of County Road
E2 and north of Thom Drive in the City of Arden Hills.
Drude added that the project would not be possible without
tax increment financing, and the developer plans to finance .
the project and be reimbursed through TIF per a developer's
agreement. She added that the City is not proposing any
bonds for this project.
The Counci 1 , having discussed this matter at length on
previous occasions, had no questions. When invited, there
were no questions from the public. The public hearing was
closed at 7:37 p.m. Action was taken under "Unfinished and
New Business".
APPROVAL OF COUNCIL MINUTES
MOTION: Malone moved, seconded by Aplikowski, to approve the
minutes of the Apri 1 12, 1993 Regular Council Meeting
as prepared. Motion carried unanimously (4-0).
CONSENT CALENDAR
MOTION: Malone moved. seconded by Probst to approve the Consent
Calendar and authorize execution of all necessary
documents contained therein. Motion carried
unanimously (4-0) .
a. Approve Agreement with MWCC & 550 Association
(Arden Manor Trailer Park owners) for payment of
SAC charges. .
b. Approve 1993 Contract for Tree/Stump Removal.

PUBLIC COMMENTS
Lucia Miklas, 1696 Chatham Avenue, voiced her concern about
the recent utility bill increases, which raised her bill by
25%. She stated that she had received the notice of the
impending increase, but did not believe it would affect her.
Miklas asked what constitutes the increase, and if the City
is looking at the financial management of the fund.
Councilmember Malone responded saying that, as liaison to
the Finance Committee, he is aware that the fund is being
watched closely.
Malone explained that the City pays the MWCC for sewer
service on a per gallon basis, and that amount has raised
from $385,000 in 1990, to $449,000 in 1991, to $518,000 in
1992, and is expected to be $546,000 in 1993. He added that
such an increase is substantial and must be passed on to the
customer.
. Malone reported that the City's sewer fund has been "in the
red" for two years because the City has been charging 1 ess
than what is needed to balance the fund. He said the fund's
cash balance has been providing subsidy, but now that cash
balance has dropped to a point where it can no longer
provide that subsidy.
Miklas asked why the MWCC has such significant increases.
Malone said he can't speak to that matter directly, but
knows that there are substantial pollution control measures
the MWCC must undertake. City Accountant Post added that
the MWCC has also expanded their plant and operations and
opened new interceptors, and those capital costs are being
spread amongst the user base.
Miklas asked why the City does not charge a per gallon rate.
Malone said that matt,;,r has been discussed, but such action
would require a means of measuring/metering sewer use and it
would be difficult to administer. He said contribution to
sewer outflow oftentimes is in direct correlation with water
use, but that is not so in instances where a large volume of
water is used for lawn sprinkling or pools, etc. He stated
that large commercial users are charged on the basis of
volume and content of sewage.
. Miklas said her main objection is that, as a single person
in her household. she is charged the same as a large family
would be charged. She added that she has experienced
mismanagement and waste in government, and is concerned that

things such as utilities and taxes are getting so high while
citizen's incomes are not keeping up.
UNFINISHED AND NEW BUSINESS
MODIFICATION OF ORIGINAL BERM
EDGEWATER ESTATES - PAUL KELEHER
Administrator Person drew attention to a map! dated March
24, 1993, of Edgewater Estates at the corner of Brueberry
Lane and Parkshore Drive which incorporates previous Council
and Planning Commission discussions.
Person noted that the map calls for drainage in front of
unit 1672, and lowering of the berm in front of unit 1676 to
accommodate a resident who is in a wheelchair and has
requested improved visibility.
Person reported that the Planning Commission has approved
the modifications to the berm if the issues of height and .
accessibility to sanitary sewer easement are resolved
between the affected homeowners and the City Engineer and
the Public Works Superintendent.
Person advised that those issues have been resolved to the
satisfaction of the Engineer and Public Works Superintendent
by an agreement by the Townhome Association to in(:orporate
into their by-laws the understanding that the Townhome
Association will be responsible for maintaining or ' -
rep.l.aClng
landscaping in drainage and utility easements if the City ~s
required to perform utility maintenance work within the
easements.
Councilmember Probst stated that this matter has been before
the Planning Commission for quite some ,- originally
"lme,
prompt.ed by the fact that the berm was not built according
to the original plan. He stated that the action proposed
would now take care of the issues of drainage and
responsibility for landscaping in the event of ut.ility
maintenance work ~n the easement.
Councilmember Malone asked if the culvert noted on the March
24, 1993 map will remain in place. Person replied that the
culvert is planned to remain for additional drainage
purposes.
Councilmember Aplikowski expressed concern that perhaps the .
City needs to make an even better effort to follow up on
developments to assure that what has been promised is
actually accomplished.

MOTION: Probst moved, seconded by Malone, to approve berm
modifications for Edgewater Estates, as outlined on the
map dated March 24, 1993, subject to written evidence
that the Townhome Association agrees to be responsible
for maintenance and replacement of landscaping in the
drainage and utility easements in the event the City is
required to perform utility maintenance work within the
easement. Motion carried unanimously (4-0).
RESOLUTION NO. 93-29 - PROGRAM
MODIFICATION OF DEVELOPMENT DISTRICT #1 &
APPROVAL OF TIF PLAN FOR TIF DISTRICT #3
A public hearing regarding this matter was conducted earlier
during this evening's meeting.
MOTION: Malone moved, seconded by Sather, to adopt Resolution
93-29 Relating To Development District No. 1, Tax
Increment Financing District No. 3; Adopting An
. Amendment To The Development Program And Approving A
Tax Increment Financing Plan Therefor And The Execution
And Delivery Of Certain Documents In Connection
Therewith. Motion carried unanimously (4-0).
COUNCIL COMMENTS
TRAILERS AT NCR~H HEIGH7S CHURCH
Councilmember Malone said he has observed that trailers,
which have been parked on the southerly part of the North
Heights Church property, have recently been moved to another
location on the property. He suggested staff check into
whether the trailers should be there.
UTILITY RATES
Councilmember Malone reported that st. Paul Water Utility,
from which the City purchases water, is in the process of
establishing a 13% increase for summer water rates and an 8%
increase for winter water rates. He added that there is a
strong recommendation that the City follow suit by
implementing rates with a differential rate structure.
Administrator Person reported that several residents have
contacted the City in this regard and are interested in
. attending the May 10, 1993 Council meeting.

PUBLIC WORKS/SAFETY UPDATE
Councilmember Aplikowski reported that the Public Works and
Safety Committee has discussed whether an additional City
committee should be established, and have concluded that
such action is not necessary. she added that the Committee
discussed areas of conservation, recycling, crime watch.
etc. , and noted that there is not much being done in the
area of ci vi 1 defense. She reported that Bill Gillies has
volunteered to head civil defense efforts,
HUMAN RIGHTS COMMITTEE UPDATE
Councilmember ~robst reported that he attended his first
meeting with the Human Rights Committee and found them to be
a clearly dedicated group or people, however, because of
changes at the state level, the focus and direction of the
group has changed, and the Committee and Council may wish to
reconsider their mission statement. He suggested that the
matter of their mission statement, focus and direction be
placed on the next Council worksession agenda. .
HARSTAD PROPERTY
Mayor Sather recognized and introduced Marty Harstad in the
audience. Sather reported that it has come to the
attention of the City that Mr. Harstad has a "small window
of opportunity" to develop a 64-unit townhome racility at
the current City Hall si te if the City is interested in a
land swap.
Council and Harstad discussed the possible land swap which
would entail trading the current City Hall 7-acre property
plus additional cash (the figure to be negotiated) in
exchange for Harstad's 9.9 acre parcel at the southwest
corner of Round Lake.
Harstad explained that hp is under a deadline to make a
decision as to whether he will develop the current City Hall
property as his next project. He said he would be willing
to facilitate the vacation of the City Hall property ~n a
staged timeline to allow the City time to get the Harstad
pronertv ready for City us,"?, He showed a concept plan for

the d~velo!?me?1t of t.he ~nrrent City Hall property, and a map
of the Harstad property.
Council and Harstad discussed what amount of additional cash .
would be an agreeable amount to make the land swap. During
the brier discussion, the parties were unable to come to an.
mutually agreeable range.

Councilmembers Malone and Probst questioned whether the
appraisal figures are an accurate reflection of the
properties and the potential uses of the properties. Probst
reminded Council that the City's first choice of property
for a new City Hall is still under consideration but there
lS no commitment yet.
Council briefly discussed the hurdles which would need to be
addressed relating to price negotiation, new appraisals,
property rezoning, access issues, availability of tax
increment financing, vacation of the current City Hall
property, etc.
Sather commented that he would be interested in further
negotiations to see if the price issue could be negotiated
to a mutually agreeable amount.

RESOLUTION NO. 93-30
A RESOLUTION RELATING TO THE DISPOSITION OP REAL PROPERTY
WHEREAS, the City is considering the final sale of
the following described property which has been used as the
site for a sanitary sewer system lift station;
Unplatted Land in Section 21 Township 30 Range 23,
the North 150 ft. of the South 597.5 ft. of the
East 100 ft. West of the Westerly line of the
Anoka cutoff of the Northeast ~ of the Southeast ~
of Section 21 Township 30 Range 23.
(PIN: 21-30-23-41-0003).
WHEREAS, the City's Director of Public Works has
indicated that the operation of a sanitary sewer system lift
station on this site is no longer necessary for utilization
of the City's Sanitary Sewer System.
WHEREAS, the City Council has reviewed the City's
. Comprehensive Plan in regard to the utilization of this
property.
NOW, THEREFORE, be it resolved that the Arden
Hills City Council hereby determines that the proposed sale
of the lift station site has no relationship to the City's
Comprehensive Municipal Plan; that this matter need not be
referred to the City's planning commission for review; and
that the lift station site may be sold as the Council
determines in the City's best interests.

RE: Review of Comprehensive Plan Relating to Sale of
City Property - Highway 10 and Brueberry Lane,
Lift station #10, 4255 Old Highway 10
As per your request of 11-3-92, I have reviewed the Comprehensive
Plan to identify development guidelines for the above mentioned
property, as outlined in the plan adopted by Council June 14, 1982.
The following items are noted for your information:
1- Map #2 is shown on page 8 of the Plan and identifies this site
as "site C". Under the "Development Potential" title on Page
13, it states; "A graduation of residential densities,
increasing from north to south is considered reasonable
because of the (site) relationship to 1-694."
Since the adoption of this plan, a portion of the 48-acre site,
identified has developed under a POD known as Edgewater Estates.
. The POD contains a gradation of residential densities from north to
south, beginning with R-1 single Family site on Wedgewood Circle,
an R-3 Townhouse Development on Brueberry Lane and an R-3 Multi-
tenant Complex on Parkshore Drive.
2. Under the section identified as "The Plan", page 20, section
1- RESIDENTIAL. (b) Medium Density, paragraph 2 recognizes
this area as one of three areas designated for medium density
residential use; Item (2) " the parcel adjacent to 1-694 and
Old Highway 10."
It appears this reference was to the entire 48-acre undeveloped
site, which has been partially developed since the plan was
adopted. It should also be noted that Council had previously
approved a PUD for continental Development company, for a 64-unit
apartment complex, on the parcel located south of parkshore Drive
and north of 1-694.
In review of the Comprehensive Plan, noting the above two
references, it appears that the sale of this property for a
Townhouse development would have no negative impact on this area
and in fact would be consistent with the adopted plan.
The New Brighton Sewer Interceptor utility installation was
accomplished in 1988-89, at which time Lift station #10 was
abandoned. Public Works Superintendent Dan Winkel may be able to
. provide further input on the sanitary sewer connection and
abandonment of the lift station.

A RESOLUTION ADOPTING FINAL ASSESSMENT ROLL
IN TIm MATTER OF TIm 1993 PAVEMENT
MAINTENANCE IMPROVEMENT
WHEREAS, upon due notice property made as requited by law, the Arden Hills City Council has met
and heard and passed upon all objections to the proposed assessment for the 1993
Pavement Maintenance Improvement and has detennined the amount to be assessed
against each individual property as the Council deems just;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Arden Hills, Minnesota:
1. Final assessment roll, a copy of which is attached hereto and incorporated herein by this
reference, is hereby accepted and adopted and shall constitute the special assessment against the
lands therein named. Each such tract of land in the assessment roll is hereby found to be
benefitted by the improvement in an amount not less than the amount of the assessment levied
against it.
2. Such assessment shall be payable in equal annual installments, including both principal and
. interest, amortized in such amount annually as is required to pay the principal with interest as
8 % over a period of three years for assessments less than $500 and five years for
assessments equal to or greater than $500.
3. The owner of any property so assessed. may, at any time prior to certification to the County
Auditor of the assessment or the first installment thereof, pay to the City Treasurer the whole
of the assessment on such property. with interest accrued to the date of payment; except that no
interest shall be charged if the entire assessment is paid within 30 days after the adoption of this
Resolution. Prepayment may also be made after the certification of the assessment or first
installment thereof by paying to the City Treasurer I Auditor the entire amount of the assessment
remaining unpaid with interest. In the case of a payment made before November 15, interest
will be calculated through December 31 of the next succeeding year.
4. The City Administrator shall transmit to the County Auditor a certified duplicate of the attached
assessment roll to be extended on the property tax lists of the County. Such assessment shall
be collected and paid over in the same manner as other municipal taxes.

RE: ASSESSMENT HEARING
1993 PAVEMENT MAINTENANCE IMPROVEMENTS
Dear Ms. Person:
The assessment hearing for the 1993 Pavement Maintenance Improvements is scheduled for the
. May 10, 1993, City Council meeting at City Hall. A revised assessment roll, based on $2.98
per assessable front foot, has been provided to City staff. Customarily, the City Council has
not requested individual copies of this assessment roll, but you may wish to see if they want
their own copy. If so, copies could be made from the roll you have. Each individual property
owner has received a mailed notice stating their assessable front footage and proposed
assessment.
As we've discussed, approximately 20 calls have been received from homeowners of the 612
properties proposed to be assessed. The calls primarily question the method of calculating
assessable front footage for odd-shaped lots, lots on cul-de-sacs or comer lots. The calculation
methods are clearly defined in the City Assessment Manual adopted in November 1990. All
footage calculations have been documented and will be available for individual discussion at the
assessment hearing. We would expect, based on previous assessment hearings for similar
projects, that several property owners will ask that the City Council reduce their assessments.
The City Council has the ability to reduce any assessment and/or vary from the Assessment
Manual for individual properties. Reduction in any property's assessment would not alter the
assessment rate of $2.98 per foot or $1lI.78 per townhouse unit. Two residents on the corner
of Dellview Avenue and Gramsie Road, Mr. Paul Crosby and Mr. Rodney Palmer, have called
and correct! y identified that their properties were assessed within the last five years for similar

residents questions am concerns about the 1993 Pavement Management
~"':IL<tIIl. Mark Graham am myself investigated all concerns that were
brought up at the April 12 Public Hearing. We also surveyed all of the
,.t....eets to be overlayed to check for any other issues not rli.....,~~'ed at
the hearing.
I have sent responses back to the following people regarding their
c:oncerns . '!he first four letters were written to residents who either
called or were at the hearing, am stated that by adding llz inch of
blacktop could cause a drainage problem or that their cars would l:ottan
out at the end of the driveways. It was explained that the '-A'Ut....c1ctor
will be milling an area in front of the driveways so that the new
blacktop would then match the existing grade or =b. 'lhese letters
were sent to:

Also appearing at the hearing was Mr. Ken Hanzalik of 1768 Venus who
stated that he am his neighbor, Mr. Walt Harmer from 1776 Venus, had
c:oncerns about the drainage in front of their homes. I wrote letters to
both gentlemen explaining that we will be replacing the existing catch
basin castings am grates with a larger size. '!he small castings
currently on site do not appear to be able to hanile the heavier rains.
It is anticipated that replacing the castings am grates will solve the
drainage issue.
Mr. Dennis Prchal of 1553 Briarknoll Dr. noted a drainage issue in front
of his house am also a=oss the street fran him. I sent letters to Mr.
Prchal am his neighbor Mr. Lee of 1552 Briarknoll Dr explaining that we
will lower the catch basins on both sides of the street, am also
replace sections of curb on both sides of the catch basins.
Mr. Cluck M::Cann of 1839 Venus has a problem with water running down his
driveway am into his garage. I explained to Mr. M::Cann that we will be
milling in front of his home am flattening the =own of the road in an
atte!rpt to alter the current water drainage. Mr. M::Cann' s driveway is
. currently lower than the street causing water to collect in the
driveway. We will also be rel:W.lding ani raising the catch basin in
front of his property. '!he =ent catch basin is small in size, am is
also about 3 inches low.

Mark Graham and myself met with Mr. Jill! Tali:lot of 1840 Gramsie Road to
. rli=1SS his potential drainage problem. He was told that the contractor
will be millin:J an area in front of the driveway so that the new
paVElme.ht will match the existin:J oonc::tete driveway. A small swale will
be placed in the blacktop to ensure that excess water will not run in
the driveway. Sane blacktop curb will also be replaced in front of his
house. '!he curb was removed while plCMing snow.
Mr. Gordon Fay of 1841 Gramsie Road wanted to know if he could pay to
have ooncrete curb placed in front of his hoose. I explained that the
overlay maintenance ~'-Y'-aw does not include concret:e curb. Concrete
curb will only be installed durin:J a recoJ....L..<lCti.on project and that we
ltIOUld not be putting curb in front of his hoose.
Ms. Karen Whitehurst fran 1575 Briarknoll called with concerns about
curb that has settled in front of her driveway. In the letter to her I
stated that we will be replacin:J at least two sections of curb that have
settled. '!he curb appears to have settled over the area where the sewer
and water services were installed for the hoose.
Mark Graham drafted two letters to residents who irxticated that they
were assessed two years ago for one side of the lot and should not have
a full ",;,<;"~sment durin:J this project. Mark ooncurred that an error was
made and that the new aSE:9S'~l'lt rates are considerably less than what
was estimated. '!he corrections were made for Paul & Mny Crosby at 3953
Dellview, and Rod and SUsan Palmer at 1717 Gramsie Rd.
. We =ntinue to receive phone calls from residents who have questions.
After reviewin:J the =ncern or situation, i will write back with any
results .
Other issues brought to our attention durin:J the public hearin:J may
again be addressed at the assessment hearin:J. '!he question was asked
how often do we re-rate the streets? It is our policy that all of the
streets are rated every three years. We may have to evaluate in;ti vidual
streets that deteriorate faster than anticipated. Recent exaITples would
be Dunlap Avenue and West Rot1rxi Lake Road. 'lhe City needs to keep open
the option that scheduled street maintenance work may have to be dlanged
because of an unforeseen circumstance.
~ions were also asked how the footage is calculated for the
assessment rate. Fach individual property is evaluated, and the formula
established in the Arden Hills assessment policy is used to determine
the exact assessment rate. '!he asS9l1""""l'lt policy addresses the many
different shapes and configurations that irxtividual properties can have.
'!he rates are not neces~~"'ily established by actual front footage, the
entire property configuration is taken into consideration.
Some residents called ~in:J which contractor was awarded the
project. 'lhey are looking to get their private driveways blacktopped.
We do supply the name of the contractor, however, we do not make
r.........,....ndations to the resident if they should use the same contractor.
. Usually the prices that the contractor quotes are very CCII1pE!titive
because they are already on the job. We have not had an issue with
residents usin:J the same contractor, as lon;J as the driveway work does
not delay the City streets fran gettin:J paved.

OOIlOel:uS centered on the fact that there doesn't appear to be large pot-
holes, therefore possibly the ",L..eets ca.tld be left alone for awhile.
It was explained that althoogh these ..4....ts did not rate at the very
tc:p of the list for an overlay, they are in between the overlay ani seal
coat ratiJ'gs. If the residents show' erDJgh objection to the overlay.
then at the very least the ",L..eets in this area shQI.1ld be seal coated
this year. MarX an::l I Ix:Jt:h feel that these ..l.1.....ts will probably
. require an overlay within the next two to four years. We do not want to
reduce the integrity of existing conditions. To wait until large pot-
holes develop may mean to do a IIIJCh mere expellsive reoonstructi.on

April 7, 1993, Planning Minutes as submitted. All
voted in favor. (5-0) .
CASE #93-07 SXTE PLAN REVXEW FOR OUTSXDE FOOD AND BEVERAGE
AREA AT THE RAMADA HOTEL, 1201 W. COUNTY ROAD E.
. The Proposal is to allow an outdoor food and beverage
serving area (patio) and to approve the site plan. The area
in which the serving area is proposed is a roofed nine (9)
foot indentation at the west end of the south facade of the
Motel. At present, the area is surfaced with crushed rock
which will be replaced by a concrete slab as suggested by
the State Health Department for outside food serving areas.
It will have a three (3) foot high wrought iron fence on the
south side next to the drive and is proposed to accommodate
60 patrons.
John Bergly noted the following:
L The Zoning Ordinance does not specifically refer to
this type of use. The proposed use presumably could be
considered as an extension of the allowed'principal use
(motel, restaurant, bar) or it could be considered as a
seasonal accessory use. In either case, the outward
appearance and operation of the facility will be
changed only slightly. A site Plan Review is an
appropriate course of action.
2. The patio will be 15 feet wide and 54 ft. long and will
be surrounded on the west, north and east sides by
existing walls of the building. The south side will be
. open except for a 3 foot high wrought iron railing. A
door will provide access between the existing
bar/eating area and the patio.
. 3. The applicant prefers that entry or exit from the
patio be through the bar, however, since the door from
the bar is an "outside" door it should provide
unobstructed egress in case of an emergency. A gate
should be provided in the railing to allow emergency
egress from the patio.
4. The Public Works Director has indicated that the
proposed 14 foot (includes a 3 foot walkway area that
will be painted on the bituminous adjacent to the
concrete patio), one-way fire access lane, will be
acceptable as an interim condition, but that the drive
should be widened in the future. The 3 foot wide
walkway is also considered temporary and should be
replaced by a real sidewalk when the roadway is
widened.
5. The hotel manager proposes that the facility be allowed
to function for a year to determine the project's
viability. If successful, changes in the walk, roadway
and landscaping would likely be made. The bar and
restaurant are currently undergoing major renovation
with emphasis on the food service (lunch crowd is
considered a main target).
6. The Building Inspector's review indicates that a gate
. in the fence will be required, in addition to some
miscellaneous building material/fire protection
concerns.
7. The city Engineer felt that there were no impacts on
City streets or utilities and hard surface cover is not
being increased.
8. The attorney's concerns are:
a. The liquor license should be tied to the site
Plan/Building Plan because the area for serving
liquor is defined by the Plans. Any change
requires an amendment to the liquor license.
b. Access control is needed because I.D. 's need to be
checked and no liquor is allowed to be carried out
of the serving area.
9. As a result of the previous application in 1991, 14
parking s~alls were added in the wide drive area west
of the building. These were recommended to address the
parking requirements resulting from the increased food
service area. Due to the generally law usage of the
hotel by overnight guests during the lunch (and even
the evening) period, the proximity of parking is the
. primary concern - not the number of spaces.

. 10. The proposal shows a 3 foot bench around the patio.
Now, because of insurance reasons they want to make it
higher, probably 42 inches. A higher fence should
increase security.
Planner Bergly recommended approval of Case #93-07, with the
following conditions:
l. That the drive be appropriately signed and marked as a
one-way drive and let staff authorize.
2. That a 3-foot walkway be stripped between the drive and
the patio.
3. That the operation be evaluated after the 1993 use
season. If the owner determines that the operation was
successful, changes will be made prior to the 1994
season as follows:
a. The drive along the souths ide of the patio will be
widened by 8 feet.
b. A permanent 4 foot sidewalk be provided in place
of the stripe on the drive.
c. Landscape enhancement will be made between County
. Road E and the outdoor eating area to lessen the
traffic impact on diners.
Such plans will be approved by Staff unless the City
has received complaints or has observed problems in
which case a review by Planning Commission and Council
will occur.
4. That a host/hostess station be provided at the gate if
patrons are allowed to either enter or exit the patio
directly without going through the restaurant/bar area.
5. That appropriate adjustments be made in any food and
liquor licenses and that the site/building plan
approved in this application be attached to the liquor
license.
6. Recommend that a gate be installed in the fence outside
the patio area (opposite the door into the bar) so in
case of an emergency people would have access to the
street.

. Chair Winiecki asked if the applicant had any comments.
Ron Lemke, General Manager of the Ramada, commented on the
following:
Both insurance and Liquor Control Board have been
contacted to comply with the wishes of the City.
Liquor Control Board requires that at time of renewal
they will add the patio area. The license is given to
the address and therefore, everything on the property
is covered. Also, they will advise their corporate
insurance company to show the expanded area.
In 1994 they will be resurfacing the entire parking lot
area and at that time they will meet the needs of
widening the driveway. Restaurant renovation is
underway and in order to comply with ADA requirements,
they are installing an additional exit which will be
wheelchair accessible.
Ray McGraw had a concern that when he went to the
Ramada this evening at 6:30, a manager was not
available to speak with him. McGraw's concern was the
noise level within the bar itself which is very loud
and asked what Mr. Lemke's plan was to control the
noise level outside. Mr. Lemke stated that the plan is
. to make the patio area a more relaxed, quiet
environment and that noise control is a priority.
A question regarding the height of the fence was raised
by Scott Petersen. Mr. Lemke stated that according to
the Liquor Control Board and other establishments in
the area with a similar situation suggest a height of
about 42". The main concern is controlling the illegal
entrance of minors and to enable restaurant staff to
control legal serving of alcoholic beverages. Mr.
Lemke said that upon his investigation, there is not a
"code" for this kind of fence and that 42" seems to be
the standard. Planner Bergly stated that if the fence
were any higher, there should be a review of the
design. Mr. Lemke said he does not want to have it
too high and get the "fish bowl" feeling and that his
main concern is control of illegal entrance. Also,
Mr. Lemke's goal is to improve curb appeal and
contribute to downtown Arden Hills.
Piotrowski asked the general question regarding long
term plans regarding the valet overhang. It is the
desire of Mr. Lemke to remove the overhang and open up
the front of the building and make it more attractive,
but at this time the expense is not justified.
Renovation in the dining and lounge area is priority.

. Mr. Lemke will evaluate the landscaping issue with Planner
Bergly.
Scott Petersen moved and McGraw seconded to approve case
#93-07 with the recommendations outlined by Planner Bergly
with the addition of recommending a safety gate to be
installed in the fence for emergency exiting, and that the
landscaping plan be reviewed by city staff during the 1993
season and in 1994 a more specific and formal landscape plan
be submitted to the Planning commission for approval.
Motion passed unanimously. (5-0)
PILGRIM HOUSE DISCUSSION
Allen Carstens and Carolyn Tucker were present to discuss
the issue of expansion. Before getting involved with
architects, they wanted to discuss the general proposal with
the Planning Commission to examine concerns that the City
may have. In 1973 a Permanent Special Use Permit was
granted and expansion of the building or changes in the site
Plan require an amendment to the SUP.
Allen Carstens presented overheads showing the existing
situation and possible plans for the future. The Pilgrim
House has been in existence for 25 years and at this time
. has grown to approximately a 50-family membership. The
parking lot is a major problem and renovation and expansion
of the building is needed. They want to stay at this
location but need to know if they even have the opportunity
to expand or should they start looking for a new location.
Wienicki explained to Carstens what they could expect from
the Planning Commission. If they would come before the
Commission with an application, it would require a Public
Hearing and at that time they would be sure to find out what
the neighbors were thinking. The impact on the neighbors is
significant. Therefore, getting the neighbor's feedback
would be the first step for them to take at this time.
Marty Rye stated it might be hard to prove hardship when
there is the possibility of the church going to 1, 2 or 3
services, which would solve some of the problem of growth,
but Mr. Carstens stated they would rather move.
COUNCIL REPORT
Councilmember Hicks reported on items of interest to the
Commission.

. OTHER ISSUES
City Administrator, Dorothy Person, reviewed the interim
disbursement of Community Planning duties with the
Commission. She presented a handout which itemized the
assignment of the various duties.
Marty Rye had several handouts relating to economic issues
and is willing to work with staff to draft appropriate forms
and guidelines to have available to the residents.

Twin Cities Anny Ammunition Plant to Selectively
Bum Prairie Grass for Restoration of Native Species
In the mon~h of May, approximately BO aores of upland prairie will be
burned at TCAAP. This joint conservation effort between the Minnesota
Department of Natural Resources (DNR) and the U.S. Army is a land
management technique used to disoourage non-native and non-prairie
. species. These fires mimic the control methods used by Mother Nature
to maintain open spaces which support native prairie species.
Conservation groups have recoqnl2:ed 'I'CAAP'S upland prairie and
prairie-pothole ecosystem as a unique natural resource in the densely
populated Twin cities metropolitan area. over the years the beautiful
prairie habitat has been encroached upon by alien species of trees,
shrubs, and weeds. This prairie restoration project is part of an
overall plan to manage natural resources at TCAAP in coordination and
cooperation with state-wide conservation efforts.
TCAAP'S strategy of partnerShip with conservation groups has been
recently recognized by the Secretary of Defense, Mr. Les Aspin, who
cited 'I'CAAP for meritorious achievement and awarded TCAAP the 1992
Department of Defense Natural Resources Conservation Award.

City of Roseville and neighboring municipal:ities. I would like to have
cable TV service but my experience with Cable TV North Central has been
much too unpleasallt~ Possibly I am merely ssrlsitive to their smLlg and
lucrative attitude. I expect better representation than to permit and
support this kind of behavior.
Specifically~ a cable was laid ir\ my yard last autumn along witll various
flags associated with its intendod burial. Cable TV North Central did
rlot bury the cable despite stating that such would be done on mere thah
(Jns occassiQn. This situation continlJed into the sprirlg~ Th2 first
time the serVlce was to be installed, two younger persons arrived and
seemed more conce~ned with ttle fact that the weekend was about to start
than with doing a decent job -- I refused this installation and the rlEx.t
time was much bette~. Also~ I was charged a $4.50 late fee bEcause I
forgot to mail the bill the prior month. This seemed an extlPeme nleasure
glven the monopoly (US West and NSP do not bet12ve .this waY'1 and that
Cable l'V North Cerltral does not bury cables on schedule. And on anothE~
occaSSlon, after discovering tt,e premium channel signals were distor-ted,

Let this letter serve as a written objection to the assessment
against my property at 1273 Nursery Hill Lane or Lot 25 Karth
Lake Addition. I attended the Public Hearing on April 12, 1993
and was one of those that spoke on the bituminous overlay and
seal coat improvements. One of the specific questions I asked
was if the $2.98 per front foot was a firm price. I was told
that it was and that the City of Arden Hills would pay the rest
of the total contract out of other funds. I have front footage
of 54.84 feet which would give me an assessment, based on your
firm price of $2.98, of $163.42 rather than my notified price
of $299.55. If this was another improvement such as curb and
gutter, sewer or water I would think that the only benefit I derive
from the improvement would be whatever benefits me in the front
of my house at the property line. As an example if my curb and
. gutter was all broken up and needed to be replaced, only 54.84 feet
would need to be installed. If this was an area assessment for
storm sewer then I could understand the need for a calculation
based on square footage of lot size. Life is full of surprises
but hard to accept when told one thing and surprised with another.
My other concern is the installation of a II inch bituminous over-
lay when the existing blacktop is already even and in some cases
slightly higher than the existing curb and gutter. Let me again
express my fear that if the contractor only feathers the overlay
to match the curb and gutter, than it will not stay in place.

. In unplatted areas, the City Council shall establish on a
case-by-case basis, a formula for determining the assessable
front footage for each improvement project separately.
Typically, this will be accomplished by dividing the property
into equivalent lot units. The total parcel front footage
shall then be determined by summing the front footage for
each equivalent lot unit.
2. Odd-Shaped Lots
For odd-shaped lots, (i .e. lots on cul-de-sacs or lots where
the difference between the length of the front property line
and back property line is greater than five feet), the front
footage is computed by dividing the area of the lot by the
average depth of the lot. If the odd-shaped lot is deeper
. than 200 feet, the front footage shall be computed by
determining the area assuming a 200 foot depth, then dividing
that area by 200 feet. The Appendix contains an example of
calculating assessable front footage for odd-shaped lots.
3. Approximately Rectangular Lots
For a lot which is approximately rectangular, the front
footage is computed by averaging the front and back side of
the 1 at. If the lot is deeper than 200 feet, the front
footage shall be computed by averaging the length of the
front property line and width of the lot at the point 200
feet deep into the lot. This method is used only where the
divergence between front and rear lot lines is five feet or
. 1 ess.

. 4. Shallow Lots
For rectangular lots under 130 feet in depth, or irregular
lots averaging less than 130 feet in depth, the front footage
is determined by the actual lot area divided by 130 feet.
5. Corner Lots
In the case of a street improvement project which abuts both
sides of a corner lot. the assessable front footage shall be
the dimension of the shorter side plus one-third (1/3) of the
dimension of the long side. or the long side. whichever is
greater. This same formula will apply where the streets
abutting a corner lot are improved within five years of each
other. The maximum amount that a corner lot can be assessed
. for street improvements is equal to the dimension of the
shorter side plus one-third of the longer side. or the longer
side. whichever is greater, within a 5 year period.
Where the proposed improvement project is only along one side
of a corner lot. the front footage dimension along that same
side shall be used.
6. Double Frontage Lots
For lots which front on streets being improved on both the
front and back property lines. the property will only be
assessed on the bas i s of the average of the two frontages. .

that the City has received effective January 1, 1993. '!he City of

24% and Nov-Apr - 14%). '!he city of Arden Hills was notified in March
of this unanticipated and unOOdgeted in=ease (4.99% lulgeted) .

June and mailed by July 20) will reflect the in=ease of a two tiered
billing reflectin;J the 24% increase of May-oct and 14% fram Nov-April.
'!he system is able to ac:x::amnodate the volume based only system and
recoup the same costs received fran the base and standby rates, if the
Council so desires.

Schifsky & Sons, Inc. Work will include bituminous
overlay and seal coat improvements.
. Based on low bid, the total project cost. including
overhead, is $257,568.20. Of this amount. $136,878.20
will be funded by the City and $120,690.00 will be
assessed to the abutting/benefitting property owners.
. . Assessment rate for residential homes is $2.98 per adjusted
front foot and $63.78 per unit for townhomes in the Arden
View Drive/Court area.
. Calculation for adjusted front footage for all abutting
properties is based on the City's Assessment Manual.

. In unplatted areas, the City Council shall establish on a
case-by-case basis. a formula for determining the assessable
fronI footage for each improvement project separately.
Typically, this will be accomplished by dividing the property
into equivalent lot units. The total parcel front footage
shall then be determined by summing the front footage for
each equivalent lot unit.
2. Odd-Shaped Lots
For odd-shaped lots, (i.e. lots on cul-de-sacs or lots where
the difference between the length of the front property line
and back property line is greater than five feet), the front
footage is computed by dividing the area of the lot by the
average depth of the lot. If the odd-shaped lot is deeper
. than 200 feet, the front footage shall be computed by
determining the area assuming a 200 foot depth, then dividing
that area by 200 feet. The Appendix contains an example of
calculaIing assessable front footage for odd-shaped lots.
3. Approximately Rectangular Lots
For a 10I which is approximately rectangular, the front
footage is computed by averaging the front and back side of
the lot. If the lot is deeper than 200 feet, the front
footage shall be computed by averaging the length of the
front property line and width of the lot at the point 200
feet deep into the lot. This method is used only where the
divergence between front and rear lot lines is five feet or
. 1 ess.

. 4. Shallow Lots
For rectangular lots under 130 feet in depth, or irregular
lots averaging less than 130 feet in depth. the front footage
is determined by the actual lot area divided by 130 feet.
5. Corner Lots
In the case of a street improvement project which abuts both
sides of a corner lot. the assessable front footage shall be
the dimension of the shorter side plus one-third (1/3) of the
dimension of the long side, or the long side, whichever is
greater. This same formula will apply where the streets
abutting a corner lot are improved within five years of each
other. The maximum amount that a corner lot can be assessed
. for street improvements is equal to the dimension of the
shorter side plus one-third of the longer side. or the longer
side, whichever is greater, within a 5 year period.
Where the proposed improvement project is only along one side
of a corner lot. the front footage dimension along that same
side shall be used.
6. Double Frontage Lots
For lots which front on streets being improved on both the
front and back property lines, the property will only be
assessed on the basis of the average of the two frontages.
