In theory, the Comprehensive Plan is treated as a ~ policy statement which can and should be periodically amended by the City Council. The policies of the Comprehensive Plan are reflected in the official controls adopted by the City Council in order to implement the Comprehensive Plan. The lIlOst common official controls are the City's zoning and subdivision regulations. The C~ty's Transportation Plan is part of its Comprehensive Plan and is another example of an official control adopted by the City. The Transportation Plan illustrates existing and proposed road systems that the City has determined will be necessary in order to guide development in the future. If a proposed street is shown on the Transportation Plan, a private property owner cannot build on the proposed roadway without first giving the City a chance to purchase the right-of-way and thereby preserve the integrity of its Transportation Plan. Obviously. it is more cost effective to acquire roadways before buildings have been constructed in their path than to remove the buildings or to re- route traffic systems around buildings. The change to the Transportation Plan which is being discussed would simply illustrate that, at some point in the future, the City has determined it would be beneficial to extend Shoreline Lane. The public hearing should be preceded by ten days published notico (M.S. 462.359, Subd. 2). Amendments to this part of the Comprehensive Plan are accomplished by the adoption of an appropriate ordinanoe. Four affirmatiVE! Council votes are required to adopt the ordinance (M.S. 462.355, Subd.3). If the City wishes to proceed on the Comprehensive Plan Amendment, the Council should request staff to prepare necessary ordinances for Council review. PUBLIC IMPROVEMENT PROJECT In order to preserve the city's authority to specially assess all or a portion of the cost of a public improvement, the Ci ty should follow the public hearing procedures outlined in M.S. 429. A publiC hearing is held before the City Council. The public hearing is preceded by published notice in the City's official newspaper. The notice should appear in two publications at least one week apart and the last publication should be at least three days before the public hearing. Mailed notice should also be sent, at least ten days before the publio hearing, to the owners of each ~ parcel within the area to be assessed for the improvement (M.S. 429.031. ) At the conClusion of the public hearing. the City can choose to order or scrap the proposed project. In the case of Shoreline Lane, the City has not received a petition from the owners of at least 35% of the frontage in the proposed project. Therefore, four affirmative Council votes will be necessary in order to approve the improvement. If the City chooses to proceed in this particular matter, the Council should direct staff to prepare the appropriate resolutions and should direct the City Engineer to prepare plans and specifications for Council review. CONCLUSION In conclusion, the City may amend its Comprehensive Plan in order to preserve its right to acquire a future right-Of-way in a cost effective manner 0 The City can also order a sanitary sewer and/or street improvement for the Shoreline Lane portion of the City. CALL TO ORDER/ROLL CALL Pursuant to due call and notice thereof, Mayor Sather called to order the regular City Council meeting at 7:30 p.m. Present: Mayor Thomas Sather; Councilmembers Beverly Aplikowski, Dale Hicks, Paul Malone, Dennis Probst. Also present were: City Attorney, Jerry Filla; City Planner, John Bergly; Clerk Administrator, Dorothy Person; City Accountant, Terry Post; Recording Secretary, Shar Foster. . ADOPT AGENDA Note was made that the agenda had been revised to clarify Consent Calendar items. MOTION: Malone moved, seconded by Aplikowski, to adopt the June 28, 1993 agenda as revised. Motion carried unanimously ~ (5-0). APPROVAL OF COUNCIL MINUTES MOTION: Aplikowski moved, seconded by Probst, to approve the minutes of the June 14, 1993 Regular Council Meeting as prepared. Motion carried unanimously (5-0). CONSENT CALENDAR MOTION: Malone moved, seconded by Hicks. to approve the Consent Calendar and authorize execution of all necessary documents contained therein, Motion carried unanimously (5-0), a. Approve 1993 Pay Plan at a 3\ increase effective 1/1/9; and City employee insurance contribution at $270 per month. b. PUBLIC COMMENTS There were no public comments, UNFINISHED AND NEW BUSINESS CASE #93-09 CONSIDERATION OF SEWER EASEMENT VACATION & SEWER RECONNECT ION/ EXTENSION - 3280 SANDEEN ROAD City planner Bergly explained that Steve Nelson has requested vacation of a sanitary sewer easement on his property located at 3280 Sandeen Road and relocation and reconnection of sanitary sewer in a different configuration ~ (at the expense of the applicant) in order to achieve increased buildable area on the applicant's property. Bergly outlined the existing sewer easement on the Nelson property pointing out that it greatly inhibits construction on the property, He added that the Planning Commission considered this case at their June 2, 1993 meeting, received public input. and recommended vacating the easement pending resolution of a specific sewer alignment. With regard to the matter of a new sewer alignment, Bergly reported that a number of alignment options have been considered and the neighbors adjacent to the applicant (the Klawiters) object to any alignment that would affect their property or assist in enlarging the buildable area of the Nelson property. Bergly further reported that at the suggestion of the Planning Commission, in consideration of the KlawLters' objections, a special meeting was held on June 7 to attempt to arrive at an agreeable solution, He noted that the June 7 meeting was attended by the City's Engineer, Planner, Administrator, Building Official, and Public Works Director as well as the applicant, neighbors McCloskey and Klawiter, and engineer White. He explained that the options considered included the City's preferred alignment (a ~ straight line hookup which would require the neighbors' consent) and other less desirable options which would not require neighbors' consent. ~ Arden Hills Council 3 June 28, 1993 Bergly noted that the outcome of the June 7 meeting was that a recommendation was made to Council to approve an alignment, referred to as Option #2, which would allow Nelson's hookup to existing manholes and would include sharp angles in the sewer line, but would not affect the existing Klawiter sewer hookup, therefore, not require their consent. He emphasized that Option #2 is certainly not the preferred option from an engineering standpoint, but it would be workable without disturbing the Klawiter property, and the applicant would agree to it. Councilmember Probst asked how Option #2 would affect existing trees. Bergly stated that the Option #2 alignment would likely disturb a large oak which has already been damaged in that its top is broken out, and Nelson's proposed construction would likely also disturb a large maple on the Nelson property. Councilmember Hicks noted that the only reason the City ~ would even consider Option #2 is to satisfy the Klawiter's objections. that Option 12 is not a desirable alignment. Councilmember Malone commented that the ideal sanitary sewer situation would be for the Nelson property (and eventually the McCloskey and Klawiter properties and perhaps others on either side of the Nelson property) to be serviced by sanitary sewer from the street side of the properties rather than from the lakeside of the properties. He added that regardless of who pays for a realigned sewer line, the new creation would be the responsibility of the City, so the City should require a well-engineered alignment which is the most appropriate from the City's standpoint. He commented that sanitary sewer was made available from the lakeside of these properties many years ago, but since service from the street side would be far desirable, perhaps the City should consider correcting the entire situation rather than exacerbating the existing situation by approving Option #2. Mayor Sather commented that the City could vacate the existing easement and require Nelson to hook up to the sanitary sewer service on the street side of his property, and over a period of time, require Nelson's neighbors to also hook up to service on the street side, Nelson advised that he has considered hooking up on the street side, and ~ would agree to do so even though the cost would be considerably more than hooking up to the lakeside service. ~ Arden Hills Council 4 June 28, 1993 Mayor Sather expressed concern regarding sewer lines in close proximity to lakes, and suggested this entire matter be returned to staff in the hopes of arriving at a solution that accommodates everyone involved in a positive manner, without polarizing the neighbors involved or jeopardizing the City. Councilmember Malone concurred with Mayor sather's remarks and added that it would be nice if everyone involved would cooperate, but that does not appear to be occurring, and the City must protects its interest with regard to the sewer alignment matter yet still allow the applicant reasonable use of his property by vacating the very restrictive easement. Councilmember Probst echoed the comments of Sather and Malone and added that the City may want to take this opportunity to consider realignment of sanitary sewer lines servicing the entire immediate neighborhood, ~ Steve Nelson commented that he has presented several options in an attempt to be flexible and cooperative, but even after the lengthy June 7 meeting, the Klawiters have maintained their objections, MOTION: Malone moved, seconded by Hicks, to direct Case #93-09 back to staff and request that they report their final recommendations to Council prior to the July 26, 1993 regular Council meeting, In arriving at their recommendation, staff is to consider 1) The best solution from an engineering standpoint to protect the City's interest, 2) Minimizing the impact on the properties involved, and 3) The existing sanitary sewer situation of the immediate neighborhood. Motion carried unanimously (5-0). CASE #93-08 VARIANCE REOUEST FOR GARAGE - 1419 ARDEN PLACE City Planner Bergly reported that Bernie Ortt, the applicant in Case #93-08 has requested that action with regard to his variance request be tabled until either the July 12 or July 26, 1993 regular meeting of Council. MOTION: Aplikowski moved, seconded by Probst, at the ~ applicant's request, to table consideration of Case #93-08 until July 26, 1993. Motion carried unanimously (5-0). .. Arden Hills Council 5 June 28, 1993 CASE #93-10 FRONT YARD SETBACK FOR AREA IDENTIFICATION SIGN FOR CPI City Planner Bergly explained that the City currently has on file an approved PUD for CPI, and CPI is proposing 1) A deviation from the front yard setback requirement for an area identification sign at the corner of County Road F and Hamline Avenue, whereby an area identification sign and granite wall would be allowed to be placed just inside the property line rather than observing the standard 20-foot setback requirement, and 2) To update and replace the business sign at the west entrance and the directional sign at the south entrance to the CPI property. Bergly stated that the PUD allows the City to grant this type of change if it is in keeping with the spirit of the PUD. He added that the Planning Commission considered this case at their June 2, 1993 meeting and recommended approval, ~ MOTION: Hicks moved, seconded by Aplikowski, relative to Case 1193-10, to establish a front yard setback for an area identification sign which would allow such sign to be erected just inside the property line. and approve the updating and replacement of the business sign at the west entrance and the directional sign at the south entrance of the CPI property. Motion carried unanimously (5-0). BINGO LICENSE APPLICATION - DENNIS CAVANAUGH City Attorney Filla stated that Dennis Cavanaugh, representing C GRein, is applying for a bingo hall license, and although the location of the site is acceptable per the City's zoning regulations, the bingo hall would not be allowed under the City's current gambling regulations, Filla explained that the City's current gambling regulations state that all Class A gambling activities (bingo) are allowed at only one site in the City at any given time (presently the Pot-O-Gold Bingo Hall), and no more than nine gambling licenses of all classes may be outstanding at any given time. He added that the Pot-O-Gold site is licensed by the State Gambling Control Board, with the City's ~ support, and he believes that license is valid until September 1994. ~ Arden Hills Council 6 June 28, 1993 Mayor Sather asked if the City could change City gamblinq regulations in order to grant a bingo hall license to Cavanaugh. Filla stated that the City has the power to allow more than one site for Class A gambling if the Council so chooses and takes appropriate action to revise the City's gambling regulations, however, current City regulations allow only one site (presently the Pot-O-Gold site),- Council discussed possible scenarios if a second bingo hall site were allowed for a specific period of time with a specific "sunset" date. Council acknowledged that, from a business standpoint, if two bingo halls were allowed for a limited period of time, competition between the sites would occur and the marketplace would determine which hall were more successful; however, many elements (such as lease terms, time scheduling, etc.) would affect the interim period and it may be complicated, difficult or impossible to return to only one bingo hall at the sunset date. Dennis Cavanaugh said the idea of a bingo hall at the vacant ~ former supermarket space at Arden Plaza was conceived several months ago when a charitable gambling organization (currently licensed and operating at the Pot-O-Gold bingo hall) approached C G Rein expressing interest in the Arden Plaza space because they were dissatisfied with the food service, lighting, signage, accessibility, etco of the Pot- O-Gold site. He added that he believes that three of the organizations presently operating at the Pot-O-Gold site would transfer to the Arden Plaza site when their leases with Pot-O-Gold expire this year. Councilmember Probst expressed his opposition to the proliferation of bingo halls in the City, but said he would support moving those activities to a new location if a sound process to do so could be devised. Councilmember Malone commented that he favors only one bingo hall in the City, but would support two sites for a specific time period in order to foster competition and allow the marketplace to dictate which site should continueo Councilmember Aplikowski asked how other tenants in the Arden Plaza center would be affected by the proposed bingo hall at that location. Cavanaugh stated that many attempts have been made to no avail to attract a supermarket anchor ~ tenant to the Arden Plaza center, and although the existing tenants in the center realize that a bingo hall is less preferred than a supermarket, it would be acceptable. ~ Arden Hills Council 7 June 28, 1993 Administrator Person offered, and Council directed staff to compile additional information as to pros/cons/options surrounding this application for Council's further consideration at the July 12, 1993 regular Council meeting. COUNCIL COMMENTS ARDEN PLACE DRAINAGE Councilmember Hicks commented that he visited the Arden Place neighborhood recently and is aware that the drainage problems experienced in that neighborhood continue to be a problem and eventually that issue will likely surface again. Councilmember Malone reminded Council that the City offered that neighborhood a solution to their drainage problems but there was no support for any solution which included assessments, TCAAP PROPERTY . Councilmember Probst reported that he and Administrator Person plan to attend a meeting regarding the Twin Cities Army Ammunitions Property (TCAAP) scheduled for July 13. FIRE BOARD Councilmember Malone reported that the Fire Department has expressed interest in a reconstituted Fire Board, and the Fire Chief is expected to communicate with the City in this regard. Council briefly reviewed the history of the Fire Board. Councilmembers Malone and Probst and Administrator Person offered to serve as members or alternates on the Fire Board. RESPONSE TO CITIZENS' CORRESPONDENCE Councilmember Probst commended staff for their recent prompt and positive response to a letter from a citizen regarding water rate increases. 0 ITINERANT VENDORS Administrator Person reported that there seems to be confusion regarding an itinerant vendor selling wares at the . corner of Lexington and County Road E at the Ramada Hotel siteo She stated that the vendor has permission from the Ramada to operate at this site and she granted permission for the vendor to operate from within the Ramada Inn for a limited period of time at that site, She noted that the -------------- ~ Arden Hills Council 8 June 28, 1993 vendor appears to be operating in the County right-of-way and disturbing City flowerbeds in the area; she asked for Counci I review per ordinance 13.93. Mayor Sather suggested that the vendor be contacted and notified that he could continue to operate at that site this week, but would need Council approval to continue to operate thereafter. Councilmember Malone commented that open air sales are specifically prohibited in certain zones within the City, and he believes it is unfair to allow open air vendors to compete with taxpaying businesses. He questioned whether the Ramada Hotel has the power to grant permission for any type of retail sales on their property, He added that he does not believe the City has accepted outdoor vendors in the past even though they have operated from time to time and been overlooked. MOTION: Malone moved, seconded by Hicks, to direct staff to ~ advise the itinerant vendor operating at the corner of Lexington Avenue and County Road E that as of Saturday, July 3, 1993 at 12:01 a.m. the permission granted by staff will be null and void. Motion carried unanimously (5-0). Council briefly discussed the acceptability of a hotel operation allowing special retail sales events within its premises, Mayor Sather commented that it has become commonplace for signs advertising such special events to be displayed at the Ramada Hotel on a regular basis although this may not be within the definition of a hotel. Note was made that the sign ordinance includes a process restricting sign permits for such events. However. a bingo hall could probably be inCluded in the general category of "commercial recreation" which is a ~ permitted use in the B-2 Zone. Both the current bingo hall site and the proposed bingo hall site are located in 8-2 Zones. The City's current gambling regulations do not directly limit the number of bingo hall licenses but indirectly limits the number by requiring all organizations who wish to conduct bingo to do so in one location. Generally, in order to conduct bingo, an organization needs a Class A license. The City allows a maximum of nine gambling licenses and, of that amount, only seven can be Class A licenses. There are currently four Class A licenses and four Class a licenses outstanding. One additional license could be issued. You have inquired regarding the pros and cons of allowing another bingo hall in the City. The following items occur to me: 1. Pro a. A second bingo hall might help maintain real estate values in Arden Plaza and thereby secure the City'S tax base. Owners of vacant property tend to request real estate tax reductions. b. A secono. bingo hall might encourage competition between bingo hall sites. If the City does not increase the number of allowable Class A licenses, the group of organizations allowed to conduct bingo would remain constant and may not be able to support both sites. In this event, the City may see one vacant building replace a current vacant building. The current bingo hall site does not generate abnormal law enforcement requirements and I would not expect that a second site would become a law enforcement problem. We are in receipt of that certain Notice dated June 28, 1993 regarding the matter, and we have a!Sl) briefly reviewed certain ftles of the City of Arden Hills last Friday. It appears to us what has precipitated this matter is the request of Warren Hanson dated June 7, 1993 to install sanitary sewer to Lot 1, Block 2; and Lots 1 and 2, Block 1 of the Hanson Subdivision. However, it also appears that the City of Arden Hills has undertaken on its own initiative a desire to amend the Transportation Plan showing the extension of Shoreline Lane, as well as installing sanitary sewer improvements on my clients' property that would faci11tate the Warren Hanson hook-up. For the following reasons, my clients are adamandy opposed to the amendment of the Transportation Plan and adamandy opposed to the installation of additional sanitary sewer improvements. Their reasons include, but are not limited to, the following: 1. My cHenls do not oppose Warren Hanson hooking up to existing sanitary . sewer improvements on Warren Hanson's own property, but oppose any new sanitary sewer improvements. To the extent that Mr. Hanson wants to run a sanitary sewer line along the southerly portion of the Hanson orooertv to connett to existing sanitary sewer improvements located on .Ilia property, my clients do not object, We understand that the Hanson property has already been subdivided and platted, and presumably the subdivision approval was given with full knOWledge by the City and Mr, Hanson that he would have to make the sanitary sewer hookups on his own property. To the extent that Mr, Hanson would like this hook-up to occur in the near future so that he can sell his lots, it is imperative that he do it on his own property. To the extent that the hook-up is altered to cross-over the Bachman! Andersen property, such hook-ups will be contested and will delay if not eliminate any proposed improvements on the Bachman property . 2. There is no need for the City to incur additional sewer improvements. ~ The simple fact of the matter is that the Hanson property. the Bachman property, and the Andersen property all have adequate sanitary sewer improvements to halldIe their existing lots And even potential or existing subdIvisions thereof. There is no need for the City to incur additional costs al its expense, or the expense of neighbors. for unneeded and unwanted improvements. 3. An)' proposed condemnation for a S81litar)' sewer easement will be opposed by my clients. My clients will not agree to a negotiated sale of any easements to the City for the needless purposes of the proposed sanitary sewer improvements. The acquisition of any such easementS would, therefore. have to take place by condemnation, and my clients intend to contest any such proceeding and argue that the improvements fail to have any "public pUlpose" . 4. The sanitary sewer improvements could end up costing the City of Arden Hills tens of thousands "of dollars. Although we have not yet obtained a copy of the feasibility study. we reviewed it quickly last Friday. Our reading of that feasibility study indicates that the total cost of improvements could well be in excess of $50,000. not merely the $8,000 as set forth in the . Notice. Page 3 Any attempt to assess all or pan of this upon the Bachman or Andersen property will be adamantly opposed. There is a serious question as to whether either of those properties would be benefited from the improvements in view of the fact that they already have sanitary sewer and water on their propenies. If the assessment process is unsuccessful, the City of Arden Hills could be stuck with the cost of paying tens of thousands of dollars out of its own general funds for an improvement that Mr. Warren Hanson could make on his own property. 5. My clients and the neighbors oppose the suggestion of further extending Shoreline Lane. My clients do not intend to subdivide their property at this time and instead want assurances of privacy and solitude in their neighborhood. We are told that other neighbors in the vicinity. likewise oppose the complete extension of Shoreline Lane as it would simply add traffic to the neighborhood, Because the City has insufficient information on the real impact whiCh the extension could have on the neighborhood. and in view of the fact that the neighborhood does not want it, the City should not amend the Transportation Plan showing the total connection of Shoreline Lane. ~ In conclusion, if Me. Hanson desires to hook up sanitary sewer in the near future, he should do so on his own propertyo The City should not undertake the legal exposure or the fmancial expense of making the proceeding more than it needs to be, and should simply allow Mr. Hanson to hook: up the sanitary sewer on his own property without condemning other peoples' property or making Transportation Plan adjustments that go far beyond the scope of Mr. Hanson's simple request. . Thomas Sather, Mayor Beverly Aplikowski Dale Hicks Paul Malone Dennis Probst, Councilmembers PROPOSED SECOND BINGO HALL IN ARDEN HILLS We take this ODDortunity to register a strong objection to the granting of a second bingo license in the city limits of Arden Hills. The benefits to the city are minimal at best and the four sponsoring organizations of the existing facility are not even local--nor are the majority of the bingo .' players who use the location to gamble. Of much more concern though is the major ramification, namely the loss of an opportunity for a grocery store within the city. Presently there is no grocery outlet, save t hose which dispense milk and bread along with gaso- line in Arden Hills. This situation has existed since the Hauser IOA store in Arden Plaza closed, The residents of this city urgently need a grocery store to provide for their baSic needs and to protect property values. Bingo parlors do not serve residential needs nor are they in harmony with the vision and goals this community and its citizens consider worthwhile. It is pUrported that the principal reason that another grocery purveyor . has not established itself in the Arden Plaza location is because, to be successful, the space needs to be between 30,000 and 50,000 square feet. The present grocery space is approximately 24,000 square feet. The ability to expand is possible to the east, toward Lexington Avenue. However, the voiced objection to this is that a city ordinance required a given number of parking spaces for a given area of floor space, putting a limit on the size of the structure. However, since this is a city ordinance, the city council, in the interest of civic enhancement, can easily grant a variance tc accommodate and encourage this expansion. Parking space for retail establishments provides short-term, frequent change space for customers. Be reminded that USe of the Arden Plaza space for bingo playing will intensify the USe of parking space for concentrated periods (several hours) at a time, often when the retail establishments in the center will also be open for business. This could provide additional problems for these fine businesses and their customers. Therefore it is requested that the Arden Hills City Council 1. Reject the request for the issuance of a second bingo permit. 2. Take the action necessary to grant a one-time variance in the parking space to floor space ratio to facilitate expansion of the Arden Plaza Shopoing Center to acconunodate a grocery outlet. 3.
