The City's finance policy uses property taxes for programs of a general benefit. Examples of such programs would be Parks, Police, Fire, and Street Maintenance. These services are in the basic operations and capital projects areas of the budget. '. . Along with property taxes, these programs are financed with State Aids and Service fees, To fully fund the 1993 Annual Budget, on increase of 9,9% is recommended for property taxes. The change in State Aid already has been prescribed by the Legislature. It is anticipated that the hearings will be closed with no further input, due to Item #2, the resolution to rescind the Arden Place project, and approving the contractor, etc. '!his resolution will close any further action on the official project. '!he cost sharing agreement between the City, Dale Noyoo, Wally Bauer and Bongards has been signoo. Mr. Lis' easement is outstarxli.ng at this time. Either it will be signed or we will move the project slightly west and not use their land. '!he project is anticipated to start as soon as possible and could have already been started by the time. of the Council meeting. . 2. Consent Calendar items: Audit - '!he agreement f= 1993 incorporates a reduced cost for audit services from 1992. 'Ibis anpunt is reduced due to further activity by the City staff in preparation of materials. '!his aJOOUnt of activity has not been previously done. We expect that this participation by the city will continue to reduce costs for the audit services. 'Ibis also will involve and educate our staff in the process and in our record keeping. Resolution #93-63, '!his resolution relating to the investment policy adds paineWebber Inc. to use as a brokerage firm for short tenn government buildin:J ilnprovement fund and reflects the name change of Shearson Lehman Brothers, Inc. to Smith Barney Shearson. Resolution #93-64, '!his is a standard resolution to authorize staff to sul:rnit to the County Auditor an assessment role f= disn~<<ed tree . removal. Resolution #93-65, '!his is a standard resolution to authorize staff to sul:rnit to the County Auditor an assessment role f= delin:!uent utilities. Sale of City Vehicle - '!he City advertised this vehicle for sul:rnission of bids in the local papers. Having receivoo no bids from ads placed in the local papers, City staff was given an opportunity to bid by closed . bid. one bid was receivoo, that of JilII Perron for $100. Recommendation is for approval of the sale of this vehicle to Mr. Perron for $100.00. ." , . Codification - '!he League of Minnesota Cities has recently again provided their services for codification. '!his time it is headed by an attorney and has been more successful in its operation. '!he attorney's knowledge is ilIIpressive along with his knowledge of local Minnesota cities rather than what we experienced with a nationwide service. 'IWo other nationwide services have approached the City with both of their quotes being $15,000 or more, with one being approximately $20,000. '!his basic bid is $9,405 with additional ~ if we wish to recodify Shoreland, floodplain, etc. to a maximum of $15,000. '!he purpose of this action is to approve the contract prior to year en:i 1993 so that the 1993 budgeted item will carry into 1994 to be paid in 1994. We do not expect the actual work to begin 1.mtil late spring 1994. state of Minnesota contract - '!he contract with the state of Minnesota for building inspection services is straight forward and has been approved by the city attorney. '!he state will be billed for the inspector's costs for service. '!he contract is on file and available for review, let !):)rothy know if you would like to review contract. 3. General Infonnation: . Ms. Kim Gruetzmacher, 3312 Katie lane, has written a letter to the city regarding her 62.2% in=ease in taxes on the proposed 1994 tax schedule. In reviewing this situation, our a=1.mtant has identified that the unusual in=ease is due to an increase in her home's valuation, therefore her property value in=eased 26.1% by the County Assessor. Her home was increased in value from 125,719 in 1992 to 158,500 for taxes payable in 1994. A copy of her letter is attached. Water Board Hearing - Water rates public hearing is scheduled f= Tuesday, November 30 at 9:00 am in the Council Chaml::ers, third floor, st. Paul City Hall/Courthouse. As all pertinent inforIl'ation has not received and finalized, the stonn Water appeals will not be heard at the 11-29-93 Co1.mcil meeting. '!hese appeals are anticipated to be heard sometime in December. More information will follow regarding the up::late on the appeals. . DAP:rk - . CITY OF ARDEN HILLS RAMSEY COUNTY, MINNESOTA . RESOLUTION NO. 93-62 A RESOLUTION RESCINDING RESOLUTION #93-46 RELATING TO THE BID & CONTRACT IN THE MATTER OF THE 1993 ARDEN PLACE DRAINAGE IMPROVEMENT PROJECT WHEREAS, the city of Arden Hills had prepared and approved Plans and Specifications for the Arden Place Drainage Improvement of 1993; and WHEREAS, the city council took action on the award of the bid for the Arden Place Drainage Improvement project subject to review by the city Attorney; and WHEREAS, Public Hearings were held to receive public input on both the project and the proposed special assessments, and such hearings were continued; and WHEREAS, as a result of the continuance of the hearings and interim discussions between the City and the affected property owners, the principle property owners have been allowed to construct the improvement with some financial participation by the City; and . WHEREAS, the property owners of 3505 Ridgewood Road and 1553 Arden Place, contractor Wally Bauer and the City of Arden Hills have joined together in a private cost sharing agreement to address the drainage issue in a different manner than originally envisioned; WHEREAS, it is no longer necessary to pursue the construction of the Arden Place Drainage Improvement as a public improvement pursuant to Minnesota Statutes Chapter #429 N~, THEREFORE, BE IT RESOLVED that the city of Arden Hills rescinds Resolution #93-46. CITY OF ARDEN HILLS RAMSEY COUNTY, MINNESOTA RESOLUTION NO. 93-63 RESOLUTION DESIGNATING BROKERAGE FIRMS FOR INVESTMENT IN FINANCIAL INSTRUMENTS AUTHORIZED BY STATE STATUTE CONSISTENT WITH THE FORMAL CITY INVESTMENT POLICY WHEREAS, Resolution No. 93-03 designated general brokerage firms for the sole purpose of investing funds of the city of Arden Hills; and WHEREAS, it is desirable to add a brokerage firm (PaineWebber) to the approved list, and reflect the name change of a previously approved firm (Shearson Lehman Brothers, Inc.); NOW, THEREFORE, BE IT RESOLVED that effective this date, the following brokerage firms are designated for the sole purpose of investing city funds in Federal government instruments or in banks or savings and loan certificates of deposits, or other authorized investments allowed by state statutes and consistent with the formal investment policy of the City: Minnesota Municipal Money Market Fund (4M Fund) paineWebber Incorporated . CITY OF ARDEN HILLS ARDEN HILLS, MINNESOTA RESOLUTION NO. 93 - 64 RESOLUTION ADOPTING AND CONFIRMING SPECIAL ASSESSMENTS FOR DISEASED TREE REMOVAL WHEREAS, The amount to be specially assessed for DISEASED TREE REMOVAL has been duly calculated in accordance with the provisions of the City Code and Minnesota statutes, and WHEREAS, notices have been duly mailed as required by law, and WHEREAS, said proposed assessments have at all times since their filing been open for public inspections, and an opportunity has been given to all interested persons to present objections, if any to the proposed assessments, and WHEREAS, there were no oral or written objections received. 1. The amounts so calculated and set forth in said notices are hereby levied against the respective parcels of land described therein, and 2. The proposed assessments are hereby adopted and confirmed as . special assessments for each of said parcels of land and the assessments together with an additional penalty of eight percent (8%) of the original unpaid amount, inclusive of any previous delinquency penalty, shall be a lien concurrent with general taxes upon such parcel. NOW, THEREFORE, BE IT RESOLVED, that the City Administrator be authorized and directed to transmit to the County Auditor a certified duplicate of the assessment roll to be extended upon the proper tax lists of the County, and the County Auditor shall collect said special assessments with taxes levied in 1993 payable in 1994. CITY OF ARDEN HILLS ARDEN HILLS, MINNESOTA RESOLUTION NO. 93 - 65 RESOLUTION ADOPTING AND CONFIRMING SPECIAL ASSESSMENTS FOR DELINQUENT UTILITIES WHEREAS, The amount to be specially assessed for DELINOUENT UTILITIES has been duly calculated in accordance with the provisions of the city Code and Minnesota statutes, and WHEREAS, notices have been duly mailed as required by law, and WHEREAS, said proposed assessments have at all times since their filing been open for public inspections, and an opportunity has been given to all interested persons to present objections, if any to the proposed assessments., and WHEREAS, there were no oral or written objections received. L The amounts so calculated and set forth in said notices are hereby levied against the respective parcels of land described therein, and . 2. The proposed assessments are hereby adopted and confirmed as special assessments for each of said parcels of land and the assessments together with an additional penalty of eight percent (8%) of the original unpaid amount, inclusive of any previous delinquency penalty, shall be a lien concurrent with general taxes upon such parcel. NOW, THEREFORE, BE IT RESOLVED, that the city Administrator be authorized and directed to transmit to the county AUditor a certified duplicate of the assessment roll to be extended upon the proper tax lists of the County, and the County Auditor shall collect said special assessments with taxes levied in 1993 payable in 1994. Bl\CKGROOND 'Ihe sul:x:li vision was platted in 1957. In 1990, a minor subdivision was applied for and granted, Case #90-06. In reviewin:j this case, there is no evidence of an utility easement being present on the site. 'Ihe applicant, during the closing pr=ess, on his new harne, dis=vered a plat . from 1957 which reflected the utility easement running north and south across the new lot. Further investigation by the City staff and attorney found no re=rd of this easement other than on attachment "A". 'Ihe easement is shown to run a=oss each lot west of Rolling Hills Road. At the time the lot was split, the setback requirements of the City caused the harne to be placed at the current site location. 'Ihe easement discovered actually is shown running through the center of the applicants heme. FINDnG3 1. 'Ihere is no apparent need for a 20 foot wide utility easement in this area. 2. No recording d=ument for the easement can be found with Ramsey County. 3. As no recording c1=uroents can be located, a detennination of whom the easement was granted to is i.1npossible. 4. Northern states Power, US West and the School Oistrict have been , contacted and can find no record of an easement being located in this -- area. Upon a site visit, represeptatives from NSP also stated that they could see no reason to hold an easement in this area. 5. 'Ihe easement, on lot 7, runs right through the middle of the applicant I s house. No public purpose would be benefitted by refusing to vacate the easement on this lot. 6. As the easement runs the full len::jth of Rolling Hills Road, it also affects other property owners. In some cases, it appears to =, if not through, adjacent to many of the homes. . ~ CCMMISSICIN CCI!MENTS . 'Ihe Commission had minbnal questions on this caSe. staff found no evidence of the easement running North or South of the properties in question. staff also clarified discussions with several neighbors who were unaware of the easement. Background: 'Ibis subdivision was platted in 1957. Lot 7,Block 29, Rolling Hills No.6, is located at the intersection of Gramsie Rd. and Rolling Hills Rd. In 1990, the fanner owner, Jerry Mansergh, applied for a minor subdivision in order to split the lot. The city approved that application in caseil90-06. (see attachment B). One of the conditions was that the proposed residence be placed west of the point where the new lot was 95 feet wide. 'Ihe =rent plat does Nor show any utility ease.rnent. 'Ihe new lot was purchased by Jim Hanton and Carrie Hefte in March, 1992. Construction carrnenced in July,1992. Neither the builder,the surveyor, nor city staff discovered any utility easerrent relative to the site location of the new home. (see attachment C). At the time of closing the pemanent loan in December, 1992! the title cCIllpa11y discovered a plat drawing from 1957 which reflected a utility easement :running north and south across the new lot. City staff and the city attorney investigated and could find no record of this easerrent nor any cu=ent or future use for such an easement. 'Ihe tilee canpany issued title insurance upon the condition that this . possible title cloud be vacated. Justification: City staff have researched this easement and have established that there is no public need liar it. All properties have full public utilities available in the street. 'Ihis utility easarent creates a cloud upon our property which renders it unrrarketable. In addition, the only buildable site on the lot as allowed by the city was right in the middle of this easement. No public purpose would be benefitted by refusing to vacate this easement which now runs through our home. , -- . - , . . . 'Ihe proposed Alzheimer/derrentia units will I::e constxucted on the south side of the building, just north of the pond. 'Ihe surrounding land uses and zoning are as ~ follows: - North - Zoning is R-2, land uses included single family hares and lake Johanna to the northwest. South - Zoned R-2 and includes additional Presbyterian Hare stxuctures, East - Zoned R-1 and includes single family bares. West - Zoned R-2 and includes single family bares, . . Parkinq Areas: The site plan indicates that 269 parking spaces are available. The construction of the 34 unit addition will reduce the available parking by twelve to 257 stalls, 'Ihe ordinance requires one for every four residents plus one for each employee on major shift, plus one for each on-call medical professional, Between the McKnight Center and Lak:eview residence, there will be 398 residents. With the corrpletion of this project, it is planned to move 31 office staff to a central location off-site. The scheduling during the peak shift was stated to be 198. 'Ihis included enployees, volunteers, and residents. Under the Ordinance, 99 spaces would be required for the residents of the site. When canbined with the number of enployees on the peak shift, parking should be adequate. As stated before, the applicant is proposing to eliminate the north lot and extend the service drive. It also plans to accommodate fire and lift station access by including a 10-foot wide pathway on the north and east of building. 'Ihis drive will be constructed to supPort the weight of fire vehicles. Deliveries: It was noted that neighl::ors have expressed concerns in regards to the number and time of deliveries. Attached you will find a schedule of vendors. The applicant has contracts with the vendors and m:xlified the schedule to where deliveries will begin at 7:30 a.m. and Saturday deliveries, except trash, will be eliminated, . 'Ihe applicant is also attenpting to address concerns in the garbage <:lurrpsters. All refuse will no,; be kept in the building until rrorning, except for occasional items. Pistons and plastic covers will also be utilized to minimize the sound. Landscaoinq: At the O:::tober 3, 1993 Planning Carmission meeting, a number of issues of concern were noted, First, the carment was made that the applicant has not followed-up and corrpleted previous landscaping requirerrents. A letter dated September 18, 1984 fran Consultant Planner Miller to the City Council stated the following; all landscaping has been carpleted as proposed in the landscaping plans. 'Ihis letter was in response to a similar concern on perform3Ilce notes at that time" Thus it appears that the applicant is in conform3Ilce with all pre-existing landscaping requirements. Second, there was a concern in regards to the screening available along Sandeen R03.d. The applicant is proposing to construct a 3-4 foot high berm on the south side of the existing tree line, in that area of concern identified . by the neighl::ors. In the area of the berm and between the berm and driveway, approximately 80 Arrerican White Cedar will be planted. With the addition of -- the expanded drive, 2 major crab apple trees will be lost. The applicant is also proposing to plant 7 spruce on the south edge of the berm. The applicant discussed potentially rroving the driveway further east. Staff felt that this change would make the situation worse for two reasons; rerroval of a large section of existing screening/trees and the drive would be a=ss . fran a hane with inadequate screening. 'Ihe building additions will create two internal courtyards which will remain landscaped with trees and benches. Additional trees will be planted in the area of the 34 unit addition. . Develooment: 'Ihe development activity which is the prina:ry area of concem is the addition of the 34 units lakeside. This addition will be consistent with the existing structure in several areas. It will be one story, similar brick pattem/architecture and conform to the sarre general setback frc:m the lake as the rerrainder of building. The Alzheimer addition will also use similar brick pattem and architecture. Setbacks: The ordinance requires a 75' setback frc:m Lake Johanna, At its closest p::>int, the proposed building is 90 feet from the lake, The total area of the site is 985,694 square feet or 22.63 acres. The total building coverage including parking lots is 231,025 or 23. 4'lr The maximum lot coverage by structure in an R-2 district is 25%. If the parking lots are not included as part of the coverage, the total falls to 145,200 square feet or 14.7%. 'Ihe Planning Ccmnission should note that these figures are different than included in the original rep::>rt. uion verifying the applicants engineer's figures, a substantial mistake was found in building coverage. This is significantly higher than the 1.21 figure aI:ove, The development intensity of this site has been an issue in the past, Since the cacplex consists of a variety of dwelling types and support facilities, it is difficult to apply the density requirements of the 2'Dning Ordinance. Many of . the units within the institutional housing ccmplex do not, by definition and function, qualify as "dwelling units", Direct application of dwelling unit per acre requirerrents seem unrealistic. -- . Visual Impact: The proposed irrproverrents should have rniniIn3l irrpact on neighl:ors, Staff discussed the proposed project with several neighl:ors during the review process and no one voiced any concerns, The rerroval of the parking near the lake should irrprove the aesthetics of the site from the lake. The remainder of the irrprovements will have alrrost no visibility to neighl:ors. With the proposed landscape irrproverrents, the delivery area should be well screened. Liqhtinq: No changes are proposed for exterior lighting, Gradinq/Drainaqe: Rice Creek Watershed bad received the site plan for review, but carments had not been received prior to the reports preparation. 'Ihe City Engineer has reviewed the plans and stated that drainage from the proposed irrproverrents should decrease as the parking area will be replaced by building and lawn. Drainage flow patterns will not be altered under the proposal, Miscellaneous: 'Ihe project atterrpts to wake irrprovements which are to the benefit of the residents. The three season porch, canopy and dining area provide sane arrenities for residents not =ently existing. 'Ihe construction will also create several courtyards which residents can use for leisure. 'Ihe creation of the alzheimer unit allows the residents to be centrally located so they can better receive staff assistance. Person, city Administrator DATE: NOVember 23, 1993 SUBJECT: Army Reserve Retrocession The City has in years past discussed Retrocession with the Army Reserve. The issues previously raised have included reimbursement to the costs of City services. The Military Law section 2465 gives prohibition against the Army entering into contracts for fire fighting or security guard services (copy attached) . The Fort McCoy representative, Robert Wells, has agreed that billing for city services such as fire fighting or police response would be processed and normally paid in a similar fashion that their sewer and water utilities are paid. However, a formal contract is not possible. It is my understanding that this would resolve the final outstanding issue. . A question arose regarding the number of times the City has used the Reserve Center. The Recreation Department in 1993 is using it 184 hours. Costs charged elsewhere (schools) would equate savings to $1,472 per year plus savings for no charges for purchase or rental of equipment. The City anticipates also using the Center as a polling place in 1994. This year's cost of police protection is estimated at $55.00 per hour. Fire protection is estimated at $500. per fire response and $200 for non fire response (per Fire Department) . It is recommended that the Council agree to retrocession of the Army Reserve Center subject to the Reserves payment of use of any City services.
