CITY OF ARDEN HILLS, MINNESOTA REGULAR CITY COUNCIL MEETING AUGUST 8, 1994 7:30 P.M. - City Hall CALL TO ORDER/ROLL CALL Pursuant to due call and notice thereof, Mayor Probst called to order the regular City Council meeting at 7:30 p.m. Present: Mayor Probst; Councilmembers Beverly Aplikowski and Dale Hicks. Councilmember Malone was absent. Also present were: City Administrator, Dorothy Person; Community Planning Coordinator, Brian Fritsinger; Public Works Superintendent, Dan Winkel; City Accountant, Terry Post; Recording Secretary, Deanne Gueblaoui. ADOPT AGENDA . The date on item No. 3 was corrected on the minutes of the June 27, 1994 Council Worksession. MOTION: Hicks moved and Aplikowski seconded a motion to adopt the agenda for the August 8, 1994 City Council meeting as revised. The motion carried unanimously (3-0). APPROVAL OF COUNCIL MINUTES The following corrections were made to the regular Council meeting minutes of July 25, 1994: Page I: Mayor Probst listed as present, not Mayor Sather. Page 14: First paragraph, second line, should read ten years. Page 15: Fifth paragraph, fIrst line, should read ...County is also anxious to move the turnback forward in 1995... Page 15: Seventh paragraph, last line, should read, If reconstruction is done... Page 16: Next to last paragraph, first line, should read ...which would give that person two months to get up to speed... and in second line, ... in the election would be seated immediately to fIll the vacancy. . Page 18: Mayor's initial is Dennis P. Probst. , ARDEN HILLS CITY COUNCIL - AUGUST 8,1994 2 . Hicks stated that he was not present at the Council Worksession of June 27, 1994. MOTION: Hicks moved and Aplikowski seconded a motion to approve the minutes of the June 27, 1994 Council Worksession and the July 25, 1994 regular Council meeting as amended. The motion carried unanimously (3-0). CONSENT CALENDAR MOTION: Hicks moved and Aplikowski seconded a motion to approve the Consent Calendar and authorize execution of all necessary documents contained therein. The motion carried unanimously (3-0). PUBLIC COMMENTS Mayor Probst opened the meeting to public comments. Mr. Don Myers reported that children are not cared for by parents at the Arden Manor swimming pool. He requested that the pool be closed or certified. . Mayor Probst stated that this issue will be addressed later in the agenda. There were no further comments. UNFINISHED AND NEW BUSINESS NORTHWEST YOUTH & FAMILY SERVICES - BUDGET REOUEST FOR BUILDING AND SERVICES Mr. Paul Ciemia, Chair of the Board of Directors, Northwest Youth & Family Services (NYFS), introduced Kay Andrews, Executive Director and Dean Masehka, Chair, Capital Campaign. NYFS is a private, non-profit agency committed to supporting the developmental needs of youth and family within their community environment. NYFS was started 20 years ago, and there are 10 supporting cities participating in the program. Arden Hills was served in 1993 with over 400 hours of services. Ms. Andrews described the types of programs that are offered by NYFS: Counseling Center: This center serves ages 3 to senior citizens. A key emphasis of this program is on children and families. A new component, not reflected in 1993 statistics, is working with families, who, for whatever reason are unable to come to the center and need more intensive services through team visits. . ARDEN HILLS CITY COUNCIL - AUGUST 8, 1994 3 . Young Fathers: This program is for young men who are co-parenting with teen moInS. There is a strong commitment to help these young men meet the responsibilities of fatherhood emotionally as well as economic support. Community Restitution/Awareness Seminars/Delinquency Assessments: In all cases of these three services, the person is referred by the police for delinquency acts of vandalism, drinking, chemicals, theft. After an initial meeting, the delinquent person appears before a panel of adults and older adolescents to talk about what happened and why. The panel decides the consequences, Le., community service hours, awareness seminar, etc. If the person does not reflect an attitude of having learned from this experience, then the center will refer him/her back to the court. Employment Services: This service serves as a link with community restitution and senior citizens. Young people do odd jobs and chores for older people, usually in their neighborhood. This program has built some wonderful relationships of surrogate parenting grandparents. Many seniors say they would not be able to stay in their homes without the services of these young people. This program is partially subsidized with federal funds. Services can be offered to seniors at a reduced rate, and youth can earn money for their services. Teen Health Center: This center provides medical services to young people without . access to health services on their own because of no insurance. The program began in 1990, and has been growing steadily. Youth Service Learning: This is a specialized program in conjunction with Moundsview Public Schools. NYFS is contracted by the Community Education Department in Moundsview to provide volunteer opportunities for youth in the community that will earn extra credit or other benefits in classes. This program serves elementary ages through senior high school. Ms. Andrews stated that when possible, fees are charged for services. A sliding fee scale is used, but no one is ever turned down because of an inability to pay. Regardless of income, everyone receives the same level and quality of service. The three major sources of funding are: 24% from individual donations; 40% from grants; 29% from counseling fees. The participating cities provide approximately 20% of the operating income for NYFS. The budget is very efficient with approximately $.90 of every $1.00 is spent on some type of program. Mr. Ciernia stated that Arden Hills has contributed approximately $10,000 each year. The return for the City is clearly preventing hundreds of youth from developing patterns of delinquency and ending up in court. This program is able to catch problems when they are small and minor before they are major, traumatic and very difficult. NYFS has made it possible for many low and moderate income families to work out issues related to abuse and . cbemical addiction. NYFS has a strong orientation to promote health and well being, which ARDEN HILLS CITY COUNCIL - AUGUST 8,1994 4 . is the foundation of how to build a community. It is a very powerful fundraising tool to be able to tell other groups that year after year 10 cities continue to support the program. He respectfully requested that Arden Hills continue its support in the coming year. Ms. Andrews stated that the Business and Professional Women's Group has agreed to contribute $5,000. At this time, there is no commitment for the other half of the contribution. Hicks stated that the City has been able to support this program indirectly but has not had to budget it because of the charitable gambling groups who have contributed on the part of the City from their profits. He urged the Council to make this a budget item if another group is not found to contribute the balance of the donation. Aplikowski asked who made the contribution last year. Ms. Andrews answered, Concordia Singers, who no longer have a gambling license. Other groups have indicated preference for their own charities. Person noted that gambling profits have decreased, and this item is coming mid-year when many groups have already set their budgets for 1994. Ms. Andrews stated that NYFS is approaching the Board of Government Innovation and . Cooperation, which is a state funding source to try to obtain funding for the new expansion. NYFS may need to call upon member City Administrators to sign the grant application. Councilmembers agreed there would be no problem with that request. Mayor Probst thanked Mr. Ciemia, Ms. Andrews and Mr. Maschka for their presentation. This funding request will certainly be added to the City's budget considerations. ARDEN MANOR ALTERNATIVE PLAN PRR'i:ENTATION AND REVIEW FOR SPECIAL USE PERMIT Fritsinger referred Councilmembers to a letter from the mobile home park owner and manager proposing to reopen the swimming pool. Repairs have been made, and there is water in the pool as of today. The owner is waiting for Ramsey County health officials to inspect it before opening. If the swimming pool opens, Arden Manor will be in compliance with this portion of the special use permit. Hicks expressed regret that no one from management was present at the meeting and that there seems to be a communication problem with the Council. Operation of the swimming pool was a condition of the special use permit that was not imposed by this Council. Mr. Don Myers, stated that he has lived in Arden Manor for 17 years. He is a member of . APAC, a go-between organization between residents and management. Many of the children ARDEN HILLS CITY COUNCIL - AUGUST 8, 1994 5 . who use the pool are latchkey children. Parents are not responsible. The pool was built in the 1970's and there are not other parks in New Brighton with a swimming pool. Someone should be supervising these children. Before someone gets killed, he would like to see the pool closed. Aplikowski stated that as an owner of a mobile home park, she can appreciate the comments on responsible parenting. The question, however, is not closing the pool for safety. Building the pool was part of the agreement for building the second half of the park. In order to close the pool, there must be an alternative plan offered to residents which has not happened in a timely manner. Mr. Husnick's chose to repair the pool rather than come up with an alternative plan. The City must prohibit closing the pool because that is the condition of the special use permit. She expressed concern about APAC stirring up residents against management. The Council does not want to participate in such action. She would have liked to see management explore more options. Mr. Myers stated that he would like to see the pool closed before someone gets hurt. Teenagers are rough, and there is nobody there to guide them. Little children, four- and five-year-olds, are not supervised. Mrs. Sherry Holmquist stated that she is the manager's wife and is present on behalf of Mr. Tom Holmquist and Mr. Husnick. They plan to go forward with the opening of the pool . because the City's demands for amenities were absurd. He was afraid the City would pull his license to operate the park. Contrary to the Council's statements, there was not enough time to communicate with the residents or do a survey. Therefore, they proceeded to repair the pool. The owner certainly wishes to keep peace. Many residents, including Mr. Myers, came and stated to them that they were glad to see the pool close for the safety of the children. She believes having the pool open will cause more problems in the park than solving them. Mayor Probst stated that the matter before the Council is approval of a special use permit. The pool was made a condition of the special use permit to allow a denser development than otherwise would have been allowed if a park dedication had been required according to the ordinance. The Council and staff in no way demanded that the pool be repaired. M part of compliance with the special use permit, there has been a pool since the park opened. Management seems to feel no obligation whatsoever to comply with the special use permit conditions . Mrs. Holmquist asked if there is any proof of signature on the special use permit requiring the pool to stay open, even if residents no longer want that amenity. Mayor Probst stated that the Council gave management the opportunity to come forward with an alternate plan. There is no alternate plan and no other way to solve this problem, except to keep the pool open. . ARDEN HILLS CITY COUNCIL - AUGUST 8,1994 6 . Mrs. Holmquist stated that the Council suggested a survey, but there was not enough time to do it. With the demand of removing the license, Mr. Holmquist decided to open the pool. That is why the letter was written, to express their views and try to communicate the needs of the park. Aplikowski stated that at the first planning meeting, she offered to meet with Mr. and Mrs. Holmquist to work out the problems because she is an officer in the association for the industry. No one eVer called her or staff for help. which is always an option. She stated that she feels badly because the last thing she wants to see is a mobile home park closed. The City Council is not close to considering that action. The Council is properly reviewing the special use permit because it is not in compliance. Mrs. Holmquist stated that times have changed. Arden Manor needs to be reviewed and compared with other parks in other cities. As taxpayers, the needs of residents should be considered. Aplikowski stated that ordinances and requirements in Arden Hills are different from other cities, and that argument does not work. Arden Hills is special to itself with firmer and higher standards in some areas. To request that the process be changed to review this park does not work. If a survey had been taken or a public meeting held with Council members invited, then the owners would have been working within the process. . Hicks stated that if the management of Arden Manor has opened the pool, they are in compliance. Also, it should be made clear to management that the Council is wi1ling to 1isten to any kind of proposal for changing the conditions of the special use permit. The Council wanted to take into consideration the concerns of the residents and offer some alternative. The Council is willing to listen to any kind of plan that management would wish to present. Mrs. Holmquist stated that the mobil home park did offer an alternative that was rejected by the Council. Hicks stated that Mr. Husnick indicated no one had been asked to estimate the cost of repairing the pool. The Council wanted to look at reasonable alternatives, and Mr. Husnick failed to present them. There is no matter for decision. If the pool is in operational condition and open, the owner is in compliance. He directed staff to monitor the situation. If the owner wishes to pursue alternatives, that is an option open to him. Mrs. Holmquist stated that at the first two meetings nothing was said or sigued to indicate that they must continue to offer the pool facility. She requested a copy of the document. Pritsinger stated that the discussion was in reference to the park dedication easement document and agreed to send her a copy. . - ----------- ARDEN HILLS CITY COUNCIL - AUGUST 8, 1994 7 . MCCLUNG DEVELOPMENT UPDATE Fritsinger stated that the developer's agreement is in regard to a single family lot subdivision. The key items are identified in the report. General grading has been completed and pre- construction meetings have been scheduled for later in the week. Everything is on track. MOTION: Hicks moved and Aplikowsi seconded a motion for the City to enter into an agreement with Mr. McClung for the McOung Development Fourth Addition. The motion was unanimously approved (3-0). MOTION: Hicks moved and Aplikowski seconded a motion for the City to accept the 18,037 square foot area identified in the plat as the park dedication of the McClung Development. The motion was unanimously approved (3-0). RESCHEDULR AUGUST WORKSESSION MOTION: Hicks moved and Aplikowski seconded a motion to reschedule the August Council worksession from August 18, 1994, to August 31, 1994, at 4:30 p.m., to be held at the TCAAP property. . Person referred Councilmembers to a letter on the Stowe A venue reconstruction that will be discussed at the Council Worksession on August 31, 1994. Aplikowski asked if the City is participating in the Minnesota Cities' Week. Person answered that no plans have been made, but staff would be open to whatever the Council deems appropriate. Aplikowski requested that this item be included in the budget for next year with a notice in the newspaper indicating that Arden Hills is a sponsor and participant in .Cities' Week.. She added that she would like to see the Council and City officials reach out more into the community. She has had three conversations with residents who do not know how to access City Hall, and there are residents who do not know where it is located. She emphasized the need for public relations measures and requested that a worksession agenda include a discussion of publishing a newsletter. Aplikowski questioned publishing information regarding assessments. She stated that she has received telephone calls and would like to pursue a better system for informing residents of the procedure and timeline of appealing assessments. Person stated that special information on assessments was distributed this year, but staff will draft a full procedure with time deadlines. . '. ARDEN HILLS CITY COUNCIL - AUGUST 8, 1994 8 Mayor Probst announced a meeting scheduled for August 30, 1994, at TCAAP at 7:00 p.m. to discuss the beginning of a formal reutilization process. The meeting will be convened by Congressman Vento. The City has been invited to participate, and he urged all Councilmembers to attend and express the City's support. Mayor Probst reported that crime statistics from Ramsey County show generally good news for the City. However, a trend that is not limited to Arden Hills is the increase of incidents of domestic assaults and juvenile offenses. This is further encouragement for a contribution to NYFS. Hicks stated that juvenile offenses is a major issue and emphasized his interest in supporting NYFS as a budget item because it is an organization that is directly speaking to that need. MEMORANDUM DATE: August 18, 1994 TO: Mayor and City Councilmembers ~ FROM: Dorothy A. Person, City Administrator SUBJECT: Sheriff Contract - Insurance Coverage The Contract Cities group has been reviewing alternatives to our current insurance coverages (currently through Ramsey County Risk Management) in order to decrease costs, We currently have Workers' Compensation through State Fund Mutual ($111,135.00) ; auto liability through National Indemnity ($24,388.00) ; Professional liability through Illinois ($22,886.68 with $8,500 deductible) . Since our group is a unique employment situation where we as cities subcontract to County employees, insurance is also seen as a unique situation. The best alternative identified is through the Minnesota Counties Insurance Trust, a non-profit self . insurance pool of County functions which also covers related groups through Joint Powers Agreements. The administrative agency is Meadowbrook Insurance. Meadowbrook also provides inspection, training and other service programs. The quote provided gives a savings of $45,400, with Workers' Compensation cost at $75,291.00; Auto $9,152 (including physical damage to vehicles with $100 deductible for comprehensive and $250 deductible for collision) and Professional liability $24,461.00 ($2,500 deductible). If agreeable, Ramsey County requires a Joint Powers Agreement with MCIT. In the event that unexpected losses jeopardize the pool's reserves, the pool could be affected. In fact, however, the MCIT has provided dividends to its members in 1991 ($2.1 million) and in 1992 ($2.8 million) . The Contract Cities group must commit to a 3 year membership which requires an amendment to the Police service Agreement, accepting responsibility for its share of any surcharges made by MCIT. A concern was identified re: an inconsistency with a joint and several liability in the three year commitment with MCIT. City Attorney Filla also noted that there was no similar time commitment in the Law Enforcement Contract. His attached letter adds language to the proposed amendment which should address this issue. The City would agree to reimburse the County for its pro . rata share of any contingent liability during the term of the Law Enforcement Contract. If there is any termination of the Law .~ . Sheriff Contract - Insurance Coverages 2 . August 18, 1994 Enforcement Contract, the County will advise the group of any pending liability as part of the budgeting process. Under the current carrier, if we choose to convert, there is a 10% conversion fee for auto and professional liability but not Workers' Compensation. Recommendations include: 1. The pool concept of the self insurance group as related to our contract group is sensible in that the employees are County employees who would be grouped into similar positions and employment situations. 2. Savings are also seen since there are no additional costs of broker fees. 3 . An amendment to the Contract Cities contract for law enforcement services will address the issue of joint and several liability in respect to the length of the contract. 4. Savings of $45,400 is quoted. . 5 . The 10% conversion fee for auto and professional liability is included. My experience in working with MCIT and Meadowbrook has been excellent. The investment required. a terrp:>rary up to three year deviation fran the City Investment Policy because the total investment in the mutual fund portfolio catego:r:y w::JUld exceed the policy goal. Council granted this temporary policy deviation. The rationale for investing in this type of investment was the need to stay liquid for future facility financing requirerrents and generate . additional interest incare relative to alternative llDney rrarket yields. The original assumptions were that if the $500, 000 were left a rroney rrarket catego:r:y, approxiwately $42,000 in interest inccrne w::JUld be generated (assuming a 2.75% rate) . It was estimated that the yield in this mutual fund w::JUld generate an additional 175 basis points (1.75%) llDre in interest incare ($28,000) at nominal risk. O=..nt Status However, actual perfonnance of the fund for the first eight llDIlths has been extrerrely disappointing. The value has rem3.ined strang during a :rocky bond market with net asset value off 2% (purchase price NAV $10.00 vs. 8\10\94 NAVof $9.82), but dividend yields have consistently fallen short of expectations. For the first eight tronths, the fund distributed $n,347.50 in dividends on an average investment of $504,498 for an average armual yield of 3.37%. This conpares to average rroney market yields in the satre period of 3.25%. . . . Clearly, the fund is not perfonning as w=ll as was anticipated. . Conversations with the brokerage have not given me any assurance that fund performance will relxJund to expected levels anytime in the near future. Additionally, paineWebber has recently rrade management changes with the Fund Advisor because of perfonnance issues with other funds managed by the Fund Advisor. Actions Taken Because of these perfonnance problems, I have today directed PaineWebber Investment Executive, John Hnastchenko, to redeem all of the City's Class D Short term US GoveI11ll'eIlt for Credit Unions shares at the end of the business clay. This action will result in net settlement proceeds of approximately $503,275 (est. 51,250 shares x $9. 82\ share) . Net interest incorre during the holding pericx:l of this investment will co=espondingly be reduced to approximately $3,275. I intend to reinvest the proceeds as follows: a.) $300,000 for three year 6.50% coupon Treaswy note rraturing 8\15\97. b.) $200,000 f= two year 6.125% coupon Treasury notes rraturing in 7\31\96. Three actions will result in an interest incane stream of $13,900 in . 1994; $31,900 in 1995; $27,767 in 1996 and $13,000 in 1997. Final grading and curb w:Jrk should begin within the next couple of weeks. Ashbach Construction is arrrentl y w:Jrking an Amble Drive. Approxirrately half of the sub-cut w:Jrk is ccrnplete. The sand and . gravel is in place on the ccrnpleted half. If the weather oolds, I would anticipate that the sub-cut w:Jrk on Amble Drive w:JUld be carpleted by the middle of next week. Keithson Drive has not had \\'Ork done an it as of yet. All of the cum to be replaced has been marked for renoval. Dear Hayor We are approaching the time of the year in which you and your city council are faced with budget decisi<lns - sometimes very difficult decisions. As a former Mayor I have some understanding of the scope of the problem. Resolving conflicts and disputes through the adversarial court system appears to be escalating. The escalation arises because of (1 ) higher court awards and (2 ) frivolous and nuisance suits gaining access to "deep pockets. " There are alternatives. The mediation process is a cooperative process which, of course, is vastly different from the court process. Unfortunately, we have a huge task of educating the public and city administrative staffs. We have had opportunity to discuss the process with some administrative staffs and we find that the re is a lack of understanding between. "mediation and arbitration." We are finding, for example, that the term "mediation" is being used erroneously to describe negotiation. . The Supreme Court has taken what I believe is a significant step in attempting to bring some changes in the process by which we handle disputes and conflict. It is now mandatory in Minnesota (State Courts) that all civil disputes be first submitted to one of several possible alternatives prior to 11 tigation. One of those is mediation as a cooperative process. It is the only genuine alternative-the rest are in realty an extension and/or modification of the adversarial system. I'm sure it will take some time before attorneys and Judges will feel comfortable with the new rule but it is an excellent start. ~ . , . . . The court has appointed a number of private individuals and organizations as approved ~neutrals. " Our office had been named to that list. One of the potential problems. of course, is a lack of experienced mediators to handle the potential number of cases. I trust you will carefully select your professional mediators and be pai&nt as we together try and make some progress to implement the new rule.
