HomeMy WebLinkAbout2024-026CITY OF ARDEN HILLS COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION NO. 2024-026 RESOLUTION DECLARING COSTS TO BE ASSESSED AND ORDERING PREPARATION OF PROPOSED ASSESSMENTS AND CALLING FOR HEARING ON THE PROPOSED ASSESSMENTS WHEREAS, the construction bids have been received for the proposed 2024 PMP Street and Utility Improvements Project, the improvement of: • Keithson Drive from County State Aid Highway (CSAH) 96 West to 800 feet south of CSAH 96 West; • Royal Hills Drive from Snelling Avenue North to Arden View Drive; • Colleen Avenue from McClung Drive to Hamline Avenue North; • Norma Avenue from Dawn Circle to Briarknoll Drive; • Norma Avenue from Briarknoll Drive to Colleen Avenue; • James Avenue from Indian Oaks Trail to Colleen Avenue; • Briarknoll Circle; • Briarknoll Drive from Snelling Avenue North to Norma Avenue; • Royal Lane from Norma Avenue to Floral Drive West; • McClung Drive from Snelling Avenue North to Colleen Avenue; • Colleen Circle; • Arden Vista Court; (collectively, the "Improvement"), and the contract bid price for such Improvement is $2,238,418.15, and the expenses incurred or to be incurred in the making of such Improvement amount to $604,372.90 so that the total cost of the Improvement will be $2,842,791.05; and WHEREAS, the City Clerk has prepared a proposed assessment of the cost of the Improvement; and WHEREAS, the property owner of the property located at 1370 Colleen Avenue timely appeared in front of the City Council and filed an objection to a proposed assessment for that property (PID: 223023310064); and WHEREAS, the City Council held a hearing on the objection on May 13, 2024, and determined that the assessment for property located at 1370 Colleen Avenue would be set at $6,045.00 at the time of the final adoption of the assessment roll applicable to this property (the "Assessment"); and WHEREAS, the City Council further determined that a separate assessment of $6,045.00 for this property would be deferred for a period of twenty (20) years, or until the property located at 1370 Colleen Avenue is legally subdivided or sold by the current owner, or the owner's heirs (the "Deferred Assessment"); and Page 1 of 3 To view the final document, access adopted Resolutions via Arden Hills Public Laserfiche Weblink by visiting cityofardenhills.org and clicking on Archived Documents under Helpful Links on our main webpage. WHEREAS, at the hearing on May 13, 2024, the City Council ordered a hearing on the Assessment and the Deferred Assessment, which shall occur on Tuesday, May 28, 2024, at 7:00 p.m., or as soon thereafter as is possible; and WHEREAS, at the hearing ordered to occur on May 28, 2024, the City Council may adopt the final assessment roll for the Assessment and the Deferred Assessment, and determine the interest rate applicable to the Deferred Assessment; and WHEREAS, the City Clerk has notified the City Council that such proposed assessment for the Improvement has been completed and filed at City Hall for public inspection. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ARDEN HILLS: 1. The portion of the cost of the Improvement to be paid by the City is hereby declared to be $2,124,615.05 The portion of the cost to be assessed against benefited property owners is declared to be $718,176. 2. All assessments for the Improvement shall be payable in equal annual installments extending over a period of 10 years, the first of the installments to be payable with property taxes for the year 2024, and shall bear an interest rate to be determined from date of the adoption of the assessment resolution. The City Clerk, with the assistance of the City Engineer shall forthwith calculate the proper amount to be specially assessed for the Improvement against the property located at 1370 Colleen Avenue, without regard to cash valuation, as provided by law, and shall file a copy of such proposed assessment in her office for public inspection; and BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF ARDEN HILLS, MINNESOTA: 1. A hearing shall be held on May 28, 2024, in the Council Chambers at 7:00 p.m. or as soon thereafter as is possible, to pass upon such proposed assessment and at such time and place all persons owning property affected by the Improvement will be given an opportunity to be heard with reference to such assessment, including the Assessment and the Deferred Assessment for 1370 Colleen Avenue. 2. Publication by the City Clerk is hereby directed to cause notice of the hearing on the proposed Assessment and Deferred Assessment once in the official newspaper at least two weeks prior to the hearing, stating in the notice the total cost of the Improvement is hereby approved. Notice shall be mailed to the owner of 1370 Colleen Avenue not less than two weeks prior to the hearings is also approved. The owner of 1370 Colleen Avenue may, at any time prior to certification of the assessment to the County Auditor, pay the whole of the Assessment on such property, with interest accrued to the date of payment, to the City, except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of the assessment. The owner may at any time thereafter, pay to the City the entire amount of the Assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment must be made before November 15 or interest will be charged through December 31 of the succeeding year.
