FROM: Brian Fritsinger, City Administrato~ SUBJECT: Administrator Comments for September 21,1995, Council . Worksession . 1. Agenda Items a. Sheehy Tennis Court Attorney Filla will be in attendance to review the options available to the . City based on the request from the Homeowners Association. The Council has previously received information which detailed the request from the Association to lease the Sheehy Tennis Court property. . b. Lindv's Triangle .- The Council has previously raised questions on the City's ability to sell the park property in the Snelling A venuelRidgewood Road areas. Attorney Filla will be present to discuss this issue. . c. Pawn Shop Licensing I had previously made a recommendation to the Planning Commisson that . Arden Hills consider ordinances in the area of pawn shops and adult _. entertainment. Mr. Ringwald would like to discuss with the Council the process of a preemptive strike regarding pawnshops. Examples of . Ordinances from other City's will be available at the Meeting. d. City Water Sourcing . At the last Council Meeting, Staff was directed to place on an upcoming Agenda the exploration of the options for future municipal water sources. The Council will find some background on our current situation and . potential for utilizing TCAAP. I am anticipating this discussion to be very preliminary, with the outcome being a potential recommendation from the Council for Staff to explore all potential municipal water sources. . e. Phase 11 TCAAP Planninl!/Update Re\>ort . Phase I of the planning process with Camiros is nearing completion. The Council may wish to discuss the issues still before the City and how it will .- proceed into the future. . I I- f. Restril)ing of County Road E Several members of the Council had questioned the lack offoilow-up by I Ramsey County on the County Road E striping project. Mr: Stafford has been in contact with Ramsey County who apologized for the delay and requested some changes to the project, Staff would like the Council to I review these items before giving direction to the County. g. City Hall I Staff would like to briefly review with the Council any thoughts about proceeding with discussions on a new City Hail. I 2. Non-Agenda Items a. Cleveland Avenue Bridge I The Council may recail that the Cleveland Avenue Bridge near Stowe Avenue was severly damaged by arson several weeks ago. The County apparently has appropriated emergency funds to repair this bridge I sometime in 1995. b. Army Reserve Memorandum of Agreement I The Council received a draft copy of the MOA several weeks ago. The Agreement is the first step in completing the retrocession request process. I- I will be preparing a formal report for the September 25, 1995, Council Meeting. If the Council has any comments or thoughts on the Agreement, please let me know at the Worksession. I c. October 10. 1995. City Council Meeting The first Meeting in October was originally scheduled for October 9, 1995. As the Council is aware this date is a recognized Holiday, - I Colwnbus Day. The Meeting has been rescheduled for Tuesday, October 10, 1995. Because, New Brighton holds its Council Meeting on this date, I our Meeting will need to be held at a different location. Currently, space has been reserved at the Army Reserve Center. Due to the potential crowd on the Ogren application I am attempting to secure a larger facility. I d. Met CouncilffCAAP Tour Attached the Council wiil find the final Agenda for the tour scheduled for . Fri9;a.y, September 22, 1995. I will be attending these tours all day with Met Council and I expect Mayor Probst to be in attendance at TCAAP. Other members of the Council are invited to attend and can be picked up at . 8:30 A.M. at Gate 4 on TCAAP. Please let me know if you wish to attend. e. Sel)tember 20. 1995. RCLLG Meeting Agenda I The RCLLG is seeking additional members to its Legislative Committee. The Council may wish to briefly review the Council appointees to various .- government organizations on Thursday. I . .. .- f. September 7. 1995. Letter From Paul Kirkwold Mr. Kirkwold has prepared a letter to my attention detailing the concerns . of Ramsey County about the proposed location of the future joint public works facility. I have not yet responded to this letter. . <> August Mutual Aid Fire Run ReDort From Lake Johanna Volunteer ",. Fire DeDartment . h. County Road F Appeals City Attorney Filla and I met with the residents who have appealed . the assessments on County Road F. The meeting was attended by five of the six residents who have appealed. Mr. Filla was able to obtain some information from the residents which will help him in his efforts. He may . be present at the September 25, 1995, Meeting to review his findings with the Council. . 1. Se1;)tember 6. 1995. Letter From Greg Stonehouse The City Engineer has reviewed the infrastructure improvements associated with the McClung 4th Addition and recommended the project . be accepted by the City. I have had Mr. Stafford also inspect the work completed. His recommendation was the same. There is no formal action .- required of this acceptance as detailed in Section 3.8 of the Development Agreement. The City has received a one year warranty from the developer. . J. Arden Manor Resident/Sheriff On this past Saturday evening, the Ramsey County Sheriff was called to . respond to a resident who threatened several neighbors. When I talked to _ Ramsey County on Sunday they informed me that the resident threatened officers before holding himself in his residence. The County used a . number of methods to peacefully apprehend the individual and after a standoff which lasted several hours the resident was detained with no injuries to anyone. . k. Se1;)tember 18. 1995 Letter to Piper Jaffray In response to the disappointment with the formula used with the Piper . Jafftay settlement, the City will be severing its relationship with this firm. In a previous memo, 1 outlined a request by the Arden Hills #3 Homeowners Association to maintain and use the tennis court located on the former Sheehy property . The association is interested in entering into some type of agreement that would allow them to maintain the court and then have it be accessible only for association member use They are also interested in what the City would do with the property in the future and how that future . development would impact their improvements to the court. .. Possible Ootions The possibility of leasing the tennis court area to the Homeowners Association has been discussed with Attorney Filla. He confirmed that the City could be protected from potential liability by drafting us a lease to ensure that Arden Hills would not be responsible for maintenance or any . injuries that may occur within the court area. While staff is supportive of the leasing concept, I am concerned about turning a publicly owned - . area into a privately used facility. If the homeowners association maintains the court, they want exclusive use of it. . There will be representatives from the homeowners association present at the worksession to discuss possible options. Attorney Filla will also be present to answer any legal questions the . SUBJECT: Lindey's Trian!1;le Abstract of Title I City Attorney, Jerry Filla, has completed the preparation of the Abstract of Title for the parcel of I property presently called Lindey's Triangle. The City of Arden Hills condemned the right to use this parcel as a public park At Councilmember Hicks request, Attorney Filla has reviewed this parcel and determined that the actual fee title to this area was in the name of John 1. Kenna Jf. I Thus, the City of Arden Hills can use it for a public purpose, but they do not have the right to convey it for development purposes. This City can improve the area as a park, but it does nor appear that it can be sold. SUBJECT: Pawn Shop Ordinance The City Council and the City Administrator have placed several objectives on the work program . for the Community Development Department for 1995, one of these objectives was an ordinance regulating "pawn shops" within the City. . Typically, the purpose ofregulating second hand goods dealers (pawnbrokers, precious metal dealers, etc.) is that these uses provide an opportunity for the commission of crimes and their . concealment because these uses have the ability to receive and transfer stolen property easily and quickly. Therefore, to prevent these businesses from being used to facilitate the commission of crimes and to assure that they comply with basic consumer protection standards, thereby .- protecting the public health, safety, and general welfare of the citizens of the community these regulations are enacted. . Currently, the City Code does not specifically regulate these type of activities. However, the City Code (Section 13-24, Subpart gg) does require these uses to obtain a business licenses for retail sales. 1 am attaching to this report Chapter 13 of the City Code and the required permit . application, for your information. Staff is currently obtaining "pawn shop" ordinances from various Cities. Staff is including those . which it has received and hopefully will have others available at the worksession. In drafting this ordinance, the Staff will be working closely the City Attorney and the Ramsey County Sheriffs Department. I It is the intention of the council to regulate and license herein certain types of businesses not otherwise regulated or Ilcensed in the city, to the end that the public welfare shall thereby be protected and promoted. Differentiation in the I licensees charged herein is based upon the judgment of the council as to the probable expense involved in policing and inspecting various businesses. In SOme cases insurance .- coverage is required. where in the opinion of the council a business offers an unusual opportunity for loss or damage. It shall be unlawful for any person to engage in any business, occupation or activity for which a license fee is imposed by the provisions of this chapter without first . obtaining a license 50 to do. I Sec, 13-4. Applications generally. Applications for all licenses required by this Code shall be made in writing to the derk~admini5trator in the absence of . any specific provision to the contrary. Each application shall state the name of the applicant; the license desired; the location to be used, if any; the time covered; and the fee to . be paid; and each application shall contain such additional information as may be needed for the proper guidance of the city officials in the issuing of the license applied for. (b) In each case the liability lTISUrance policy or a certificate thereof shall be filed with the clerk-administrator . and shall be kept in full force and effect during the terms of any subject license. Upon the receipt of an application for a license, where provisIOns of this Code necessitate an inspection or . investigation before the issuance of such license, the clerk -administrator shall refer such application to the proper officer for making such investigation within forty. eight (48) hours of the time of such receipt. The officer . charged with the duty of making the investigation or inspection shall make a report thereon. favorable or .- otherwise, within ten (10) days after receiving the applica- tion or a copy thereof. The health officer shall make or cause to be made all inspections in connection with such licenses for the protection of health, the care and handling of food, the prevention of nuisances and of the spread of . disease. The building inspector shall make or cause to be made any 9uch inspections relative to the construction of buildings or othe r structures. Same-Duty of lieenBeeB, Whenever inspections of the premises used for or in . connection with the operation of a licensed business or occupation are provided for or required by provisions of this d.ivision~ article or chapter or are reasonably necessary to secure compliance with any such provision or to detect . Whenever an analysis of any . commodity or material is reasonably necessary to secure conformance with any such provision of this Code or to detect violations thereof, it shall be the duty of any licensee . whose business is governed by such provision to give to any authorized officer or employee of the municipality requesting the same sufficient samples of such material or commodity for such analysis upon request. I Sec. 13-10. Expiration, Unless otherwise provided by this Code, all annual I licenses or annual permit fees shall expire on the thirty-first day of December of each year. .- Sec. 13-11. Change of locations of premises. Except as otherwise specifically provided in this C"de, the location of any licensed business or occupation may be . changed, provided ten (10) days' notice thereof is given to the clerk-administrator in the absence of any provision to the contrary; provided, that the building, zoning and frontage consent requirements of this Code are complied . with. Sec. 13-12. Posting of licenses. . It shall be the duty of every person conducting a licensed business in the city to keep his license posted in a prominent place on the premises used for 5uch business at . all times_ (Ord. No. 92, ~ 8(2). 11-15-65) - Sec. 13-13. Suspension, revocation-Authorized. . The city council may suspend for a period not exceeding sixty (60) days, or revoke any license issued under this Code whenever the licensee, its owner, manager or employees or agents of the I .licensee have engaged in any of the following conduct: Supp. No.6 742 . .- . . .. . (11 Violation of any provision of this Code or any other feder- al. state or local law, rule or regulation; or . (g) Failure to comply with any of the provisions or conditions of the license, or the conditions of licensure) or engaging in conduct which would be grounds for denial of an initial application for licensure. I At the last regular City Council meeting, Councilmember Aplikowski suggested that a discussion regarding options of where the City of Arden Hills could obtain its municipal water source be scheduled for the next work session. I Background I The municipal water source supplier for the City has always been the S1. Paul Water Utility. The City, in turn, has a supplementary contract for water service with the City of Rose vi lie. This contract's last five year period from 9/27/92 until 9/27/97 still has to be formally ratified by the ~, Arden Hills City Council. The significance of the 9/27/97 date is that it is the termination date of the underlying thirty-five (35) year contract for water service between the St. Paul Board of Water Commissioners and the City of Rose vi lie. 1 Prior Investigations In 1993, the Citizen Finance Committee of the City of Arden Hills briefly evaluated the viability I of a city municipal well system and concluded that it would not be financially viable. TCAAP Supply I The facility has made offers to the City in the past about possibly using their supply of cleaned potable water. I believe a stumbling block has been a requirement of TCAAP to accept all of the treated water and not just on an as needed basis. Current City demand needs are approximately I 1,000,000 gallons per day. The treated supply has exceeded this demand requirement. Issues I As the TCAAP facility d~velops, there may be enough of an increased demand to warrant utilizing the facility well system water sourcing. I I I- I I .. , I. I SUBJECT: Restriping of County Road E - Highway 51 to Old Snelling Background I Council previously had an agreement with the County to make striping changes on this portion of County Road E and proposed striping is drawn out on the enclosed copies. The City had agreed to cover costs of moving loop detectors for semaphore. The County would pick up the remaining I costs. As of yet, nothing has been done. Current I I met with Dan Solar, and Vince Schaetz today after several letters requesting this work to proceed. Mr. Solar indicated several changes should be made to the approved plans and approval 1- of changes could start the new striping project next week. Chan~es Mr. Solar recommends: I 1. Abandoning the right turn from County Road E, Eastbound to Snelling, Southbound for now as the shoulder is not wide enough, but will be widened at a later date. I 2. Dropping four (4) lanes funneling into two (2) lanes from Old Snelling East on E and changing to a consistent two (2) lane, plus a turn lane all through the area. I , Adding striping to Lake Johanna Blvd., as shown, to align the lane with County Road E. ~. I Also, Mr. Solar would like the City to pay for removing the old stripes on the area to be changed, at a cost of approximately $2,000 or $.52 per linear foot. In exchange for this, the County would pay for the loop detector relocating, costing them between $2,000 to $3,000. I The reason for this change is budgeting. The County has a contract with an electric company to I provide this type of service and the County has no budgeted money for removing striping. Recommendation :- Accept changes made, send approval and go ahead with Mr. Solar's recommendations, with the understanding that the County will add the abondoned turn lane in the future. I I " , I. Over the last few years, the City of Arden Hills, the National Guard, and Ramsey County have been struggling with what seems to be a never ending project -- to secure .- approximately 100 acres of TCAi\P land north of County Road 96 and west of Hamline A venue. As you know, it has been quite diffiult to work things through the federal maze of rules and regulations to achieve our goal. Even though it has been an effort for the . three of us to work together for the benefit of the citizens we serve, I have felt throughout this entire time that we have been optimists about achieving our goal. . I am concerned, however, after our meeting early this week and the article I read in the Shoreview Bulletin, that the partnership may be faltering and, as a result, we may not achieve our goal. I am also concerned about good faith efforts on the part of the National . Guard and Ramsey County to provide infrastructure improvements for our future that may not be used. . Specifically, I am concerned about the $31,000 investment made by the County in sewer and water improvements needed to serve the future public works site that may only serve . a City need should your proposal for TCAAP development prevail. Prior to my recommendation to the County commissioners, I inquired as to the City's involvement and commitment to a public works site near the existing National Guard location. I was . assured the City was still committed and the investment by the County would be realized. My question today is: if the City proposal for TCAAP development excludes the . National Guard and the County from using their investment in sewer and water improvements, how does the City plan to compensate these agencies for that loss? .e .
