HomeMy WebLinkAbout2024-005 �ENHILL, ORDINANCE NO. 2024-005 CITY OF ARDEN HILLS RAMSEY COUNTY, MINNESOTA AN ORDINANCE AMENDING CHAPTER 9—BUILDING REGULATIONS,BY AMENDING SECTION 900—ADOPTION OF THE MINNESOTA BUILDING CODE, AMENDING SECTION 910—SWIMMING POOLS,AND ADDING A NEW SECTION 920—ZONING PERMIT REGULATIONS THE CITY COUNCIL OF THE CITY OF ARDEN HILLS, MINNESOTA, ORDAINS: SECTION 1. Section 900 — Adoption of the Minnesota Building Code is hereby amended by deleting the [str-iek ] language and adding the underlined language as follows: Section 900— [ ] Building Regulations 900.01 Adoption of Minnesota Building Code The Minnesota State Building Code, as adopted by the Commissioner of Labor and Industry pursuant to Minnesota Statutes, Chapter 326B, including all of the amendments, rules, and regulations established, adopted, and published from time to time by the Minnesota Commissioner of Labor and Indusryy, through the Building Codes and Standards Unit, is hereby adopted by reference,with the exception of the optional chapters,unless specifically adopted in this ordinance. The Minnesota State Building Code, which includes the International Fire Code, including Appendix Chapter H and the Minnesota State Fire Code, is herebyincorporated in this ordinance as if fully set out herein. 900.0[4-]2 Application, Administration and Enforcement. Subd. 1 The application, administration., and enforcement of the code shall be in accordance with the Minnesota [rule PaA 1300 2100, and as modified by Chapter- i 305] State Building Code. The Minnesota State Building Code, [established „ „t *^ >\ ime et., Statutes 16B 59 to 16B.75] Minnesota Rules Part 1300.0060 allows the City of Arden Hills to adopt by reference and enforce certain optional chapters of the most current edition of the Minnesota State Building Code. The following optional provisions [ehapters] identified in the most[r-eee t additi ] current edition of the Minnesota State Building Code are hereby adopted and incorporated as part of the Arden Hills building code [for-the r;t y of Arden 144 -.'- Minnesota Rules Part 1306.0020, Subp. 1. Requirement. The City hereby adopts the sprinkler system requirements of Subpart 2 without amendment. Minnesota Rules Part 1306.0020, Subp. [fit] 2_ Existing and new Buildings. Automatic sprinkler systems for new buildings,buildings with increased floor area(including the existing building) or buildings in which the occupancy classification has changed, must be installed and maintained in operational condition within the structure. The requirements of this subpart apply to structures that fall within the occupancy classifications established in Part 1306.0030, Items A-[l✓]D. Subd. 1 All plumbing on private property within the city must comply with the provisions of the Minnesota State Building Code and this Section. Subd. 2 Plans and specifications. Prior to the installation of a system of plumbing other than for a single-family dwelling complete plans and specifications, together with any additional information that the building official may require,must be submitted in duplicate and approved by the building official. Construction cannot proceed except in accordance with approved plans and specifications. Any alteration extension, or repair of an existing system is subject to these same requirements unless waived by the building official in accordance with Minnesota Rules Part 1300.0215. The plumbing plan review agreement between the City of Arden Hills and Minnesota Department of Labor and Industry Plumbing Plan Review shall be on file with the approved plumbing plan reviewer(s). Subd 3. Exceptions. Pursuant to Minnesota Statutes 326B.43, Subd. 2(n),plumbing plans and specifications for the following projects must be submitted to the Minnesota Department of Labor and Industry for a full plan review: A. State-licensed facilities as defined in Minnesota Statutes & 326B.103, Subd. 13; B. Public buildings as defined in Minnesota Statutes § 326B.103, Subd. 11; and C. Projects of a special nature for which department review is requested by either the City or the State. Subd. 4 Inspections. New plumbing systems or parts of existing plumbing systems that have been altered extended or repaired shall be inspected,tested, and approved by the building official in 1 accordance with Minnesota Rules Part 1300.0215,before the plumbing system is put into use. The building official shall perform the final inspection and witness the test. The building official shall approve the plumbing system if the system complies with the requirements of this code, any permit requirements and the requirements of any approved plans and specification. Plumbing system tests shall comply with Minnesota Rules, Chapter 4714. Subd. 5 Covering of work. No building drainage or plumbing system or part thereof shall be covered until it has been inspected, tested, and approved as herein prescribed. Section 910 — Swimming Pools is hereby amended by deleting the [stfiekei3] language and adding the underlined language as follows: 910.06 Building Code Applicable. A swimming pool shall be deemed to be a structure under the zoning ordinance of the City and all work shall be done in accordance with the provisions of this Section, other applicable sections of the City Code, and the Minnesota State [b]Building [e]Code. 910.07 Building Permit Required. Subd. 1 A building permit shall be required for any swimming pool with a capacity of over one thousand(1,000) gallons or one and one-half feet of water depth. Subd. 2 Enlargement or Alteration. A building permit shall be required for any enlargement or other major alteration of a swimming pool coming within this section or one that will come within this section because of the enlargement or alteration. Subd. 3 Accessory Structures.A separate building permit unless included in the swimming pool permit, shall be required for any pump house, filter house, enclosure for the pool or any other structure erected in conjunction with a swimming pool. The structures shall conform to all provisions of the city code or applicable building code. 910.08 [Speed] Conditional Use Permit. A [speeW] conditional use permit pursuant to the zoning ordinance shall be required for the construction of any structure designed to cover a swimming pool or for the construction of any accessory structure such as a bathhouse, or other structure large enough to enclose persons and The [brae ete str-i ke ] language is deleted; the underlined language is inserted 5 designed for the accommodation of persons. Other auxiliary structures, such as those defined in [ ] this Section, shall require [on4y] a building permit. 910.10 Fee. The normal building permit fee per the adopted City fee schedule shall be charged for applications made pursuant to this section. SECTION 3. Chapter 900 is hereby amended by adding the underlined language as follows: Section 920—Zoning Permit Regulations 920.01 Application, Administration, and Enforcement. Subd. 1 The application, administration, and enforcement of the zoning code shall be in accordance with Arden Hills Code of Ordinances. The code shall be enforced within the limits permitted by Sections 120 and 1370 of the Arden Hills Cites Subd.2 The code enforcement agency of this municipality is called the Arden Hills Community Development Department. Subd. 3 This code shall be enforced by the Zoning Administrator designated by the City f Arden Hills to administer the code in accordance with Arden Hills Code of Ordinances. 920.02 Permits and Fees. Subd. 1 The issuance of zoning permits and the collection of fees shall be as authorized in the Arden Hills Code of Ordinances. Subd. 2 Permit fees for zoning permits shall be established by Ordinance adopted by the City Council and shall be assessed for work governed by this code in accordance with the fee schedule annually adopted by the Council. 920.03 Types of Zoning Permits Subd. 1 Fences under seven feet in height; Subd. 2 Driveway new construction or expansion; Subd. 3 Accessory Structures 120 square feet up to 200 square feet; Subd. 4 Retaining walls less than four feet or less in height; The [brae ete st-fiek „] language is deleted; the underlined language is inserted 6 Subd. 5 Decks not attached or adjacent to buildings and 30 inches or less above rgrade; Subd. 6 Chicken Coops; and Subd. 7 Temporary Structures.
