MINUTES OF ADJOURNED MEETING OF THE COUNCIL OF TIlE
VILLAGE OF ARDEN lULLS. MINNESOTA
Held in the Town Hall. Friday. March 23rd. 1951.
Pursuant to action taken by the council at its previous first meet-
ing, this was a joint meeting of the village council with the Town Board of
Mounds View Township, called for the purpose of discussing a division of funds
in the town treasury, and other matters. The meeting ..as called to order by
Wesley Chandler, as chairman of the Town Board, and by Mayor CUIIllIlings as chair-
man of the village council. Other members of the Town Board present were
Clerk Irvine L. Bucher, Treasurer Dahl Metters, Supervisors Leonard /lhite and
Mr. Meyers, and Melvin Hurlbert, Building Inspector. ill members
of the village council were present, as was Treasurer Worth G. Read.
en the question of who has title to the Town Hall site, Trustee Mack
voiced the opinion based upon a study of the record of the deed, that the legal
title is vested in fee in the Township of MOunds View for the pgrpose expressed
therein, subject to reversion to the original grantors only if living in the
event of a violation of the terms of the deed, and that the heirs of the grantors
have no reversionary rights because not mentioned in the deed. Mr. Chandler
suggested that either the Township buyout any interest the village may have in
the real property (town hall) and thereafter allow it to use the hall on a
rental basis to be agreed upon, or that the village buy out the town I s interest
and then the town rent from the village. No decision was arrived at and the
question is to be considered further and decided at a later brneeting. The Cal-
census of opinion is that the town has title and should submit a proposal to
rent to the village.
The question of an equitable division of funds now in the town
treasury was then taken up. Mr. Chandler stated that as of March 1, 1951 the
balances subject to division were as follows:

Treasurer Metters of the Town Board mentioned that he was advised
by Mr. .:pears of the County Auditor's office that a fair average division of the
total amotU1t of the funds would be about 9-1/2% as the village' s share. This
is being based upon a rationof personal and real property valuations of village
and township. The village council fl!,vored a figure of 16%, based upon the 1950
real property assessed valuations of $274,502.00 for the village, and $1,452,237.00
for the township, tctal $1,726,739.00, as given in the County Auditor's letter
of March 14th to Clerk Doepner. The real property valuations were proposed as
a basis blcause of inability to arrive at any reliable personal p:'operty valua-
tions. The $14,700.00 personal property tax collectible in 1950 from the
Arms Plant was mentioned but nothing done about it. Mr. Chandler then proposed

that ''when the Attorney General has rendered an opJ.IlJ.on on a fair split of
funds the town will submit a proposal which will include the basis together
with a statement of a maximum advance payment which is riot to be regarded as
a precedent for the d etennination of the final split-up." Treasurer Read
then suggested that at this time a flat sum be agreed upon as an advance,
and thereupon the following action was agreed upon unanimously: "The Town
will authorize the payment of an even $1,000.00 minimum cash advance without
prejudice to the final settlement, robject to the approval of the town's
attorney." The check is to be mailed to Treasurer Read about Tuesday follow-
ing, and the clerk is to be furnished with a copy of the transmittal letter
for his file, andwe are also to be furnished with a copy of the ruling of the
Attorney General by the town. We are to furnish the town with a copy of
County Auditor's letter of March 14th.
It was agreed that another joint meeting is in order but no date ,
therefor set.
Mr. Chandler mentioned that Tom Schifsky (HlJ 2357) opened, cleaned
and heated the place at $3.00 per meeting.
He also mentioned the following data on licences:
State cigarette licenseswere issued to the Cafe on Hwy. 8 and
Carl's Cafe on Hwys. 1<:& 51, the fee is $1.00 per month, which Clerk Bucher
collected monthly and paid over to the County Treasurer.
Malt off-sale $5.00 fee; malt on-sale fee $10.00, to the town.
$35.00 per year for dance permits.
Town has no dog licensing.
The cp.estion of fire department contracts was then discussed. Mr.
Chandler stated that in 1950 the town paid Spring lake Park, Lake Johanna Vol-
unteer Fire Dept. and the New Canada Fire Dept. $1500.00 each, each receiVing
a third of the availalble annual fund. But at the 1951 annual meeting the
voters of the town approved a budget of $7,000.00 whi ch would be shared equally
by the said three departments. We will be expected to have contracts with at
least two departments in order to retain our Classification 9. We were advised
not to sign a per-run-and-hour basis contract, a s being too costly. Vice Court-
ney has a copy of the town's fire insurance contract. The Arms Plant depart-
ment will send out tankers only. No decision was reached on thi s subject.
At tris point the town board withdrew from the joint meeting and the
following was transacted by the vi.Ll.age council:
Worth G. Read was sworn in as Treasurer by Herman J. lhepner as
notary public.

Mack moved and Cwnmings seconded a motion approving the following
Public-Officials Bond #7jj 86616, in the amount of $500, of the
Fidelity and Casualty Company of New York, issued to Otto C. G!'affunder, as
justice of the peace for the term expriing on the 1st busin ess day of January,
1953.
Similar bond #2386619, issued to Frank AI. Schmitt as justice of the
peace for the term ending on the 1st business day of January, 1952.
Similar bond !f,2.3S6617, issued to Verne Keith Phiffer as constable
for the term expiring on the first business day of January, 1953.
