EN HILLS ORDINANCE NO.2024-007 CITY OF ARDEN HILLS RAMSEY COUNTY, MINNESOTA AN ORDINANCE AMENDING CHAPTER 13, OF THE ARDEN HILLS CITY CODE CONCERNING AN EVENT CENTER USE IN THE B-2 GENERAL BUSINESS DISTRICT THE CITY COUNCIL OF THE CITY OF ARDEN HILLS, MINNESOTA, ORDAINS: SECTION 1. Chapter 13 — Zoning Code, Section 1305 — Rules, Scope, Interpretation, & Definitions, Subsection 1305.04, is hereby amended by adding the underlined language as follows: Event Center. An establishment which is rented by individuals or groups to host scheduled private events including but not limited to weddings, cultural celebrations, corporate functions, and banquets. Such use ma,, or not include 1) kitchen facilities for the preparation or catering of food; 2) the sale of alcoholic beverages for on -premises consumption only during scheduled events and not open to the general public; and 3) outdoor gardens, patios or outdoor ate hexing areas. SECTION 2. Chapter 13 — Zoning Code, Section 1320 — District Provisions, Subsection 1320.05 — Land Use Chart, is hereby amended by replacing the chart in its entirety as follows: 1320.05 Land Use Chart. See attached Attachment "A" for the Land Use Chart with the addition of "Event Center" as a Conditional Use in the B-2 Zoning District. SECTION 3. Chapter 13 — Zoning Code, Section 1320 — District Provisions, Subsection 1320.085 — Special Requirements for the B-2 General Business District, is hereby amended by adding a Subdivision 6 as follows: Subd. 6 Event Center Additional Conditional Use Permit Criteria. A. In addition to meetingthe he requirements of Section 1325 and 1355.04 Subd 4, event centers shall conform to the following: 1. The occupancy of the building must never exceed the occupancy load posted based on the Fire Marshal's determination. Pagel of 3 2. The serving of alcohol shall be subject to Minnesota State Statute and Chapter 5 - Alcoholic Beverages of the Arden Hills City Code requirements and is permitted only in conjunction with a private event that is not open to the public. 3. Licensing information from the Ramsey Sheriff s Office may be requested by City. City could at its discretion request licensing information from the County Sheriff s Office. 4. A security plan shall be submitted and approved by the Cites 5. A noise mitigation strategy shall be submitted and approved by the City. B. In addition to meetine the reauirements of Section 1325 and 1355.04 Subd 4, the City mav: 1. Prohibit access from a predominantly residential street; 2. Restrict the hours of operation for loadingdocks; ocks; 3. Require greater than minimum setbacks for structures and driveways; 4. Require opaque screening to eliminate headlight glare; 5. Impose any other restriction it deems to be in the public interest. SECTION 4. Chapter 13 — Zoning Code, Section 1325 — General Regulations, Subsection 1325.06 — Requirements for Parking, Loading and Circulation, is hereby amended by adding the underlined language as follows: J. Off Street Parking Spaces Required: Event Center 1 for every 4 seats (based on design capacity) SECTION 5. Pursuant to Minn. Stat. §412.191, in the case of a lengthy ordinance, a summary may be published. While a copy of the entire ordinance is available without cost at the office of the City Clerk, the following summary is approved by the City Council and shall be published in lieu of publishing the entire ordinance: • Section 1320.04 is amended by adding language to define an Event Center; • Section 1320.05 updates and replaces the Land Use Chart by adding Event Center as a Conditional use in B-2 Zoning District; • Section 1320.085 is amended by adding a new Subdivision 6, Event Center Additional Conditional Use Permit Criteria. This subdivision specifies requirements to allow for an event center in the B-2 General Business District as a conditional use; • Section 1325.06 is amended by the addition of language about required off-street parking spaces for an event center. A printed copy of the whole ordinance is available for inspection by any person during the City's regular office hours at the City of Arden Hills, 1245 West Highway 96, Arden Hills, MN 55112. This Ordinance shall become effective immediately upon its passage and publication according to law.
