Several questions have been raised requiring a report by me at
the Council meeting toni~ht. The questions and my opinions on them are
surnnarized ir. this letter'_
,1) A questicn v~s raised regarding an apparent conflict bet~reen
par8gr2ph /.!,-6 and pagagraph h-l7 of our Building Cede 1:!ith reference to the
inst.al1~::t:~on of piping for ~n incinerator. Paragraph 4-6 does not specifically
n.ention Bn incinerator but imposes 8 .CO fee for any machine or appliance
:reC{ui ring t.he use of 93S, pLus 3D additional .00 fee for gas piping if it is
required in the installation of the appliance. I 8SSllile that piping is neceS-
sary in connection -~lit.h the installation of an incinerator. Paragraph 4-17
provides a fee cf .00 for the instal18ticn of 8ach domestic portnble incinerator.
In !:J.y opinion the provision in h-l? c?v~rs an~: type. of. ir:.ciner-~t~l',

(2) The matter of t.he tUlfinishcd building on Tiller L2De has been
with us for 8 considerable period of time. Lz.st Saturday I examined the house
from the outside and t~ere is no qU2stion that it is an eye sore in that neigh-
borhood. ?C1.ragr~Jphs 1-33 to 1-43 of our Building Code cover this situation and,
in effect, authorize the buildiDg inspector, after 8 hearing before the CounciJ,
and notice to the oBner, to do such things to the structure 8S, in his opinion,
!lrr~ay be necess3ry for the protecticD of life or adjoining property.1I
The problem of handling a building ltlich may be 8 nuisance is not
U.I-'1USU8l but it is generally true th8t a municipBlity may only act to the extent
that is necessary to correct a public nuisance. A public nuisance, as opposed
to 8 private nuisance, is one Hhich adversely affects 8 substantial number of
pEople, r8t~er than o~J.ly a feu. Also, and I consider this quit~ im.portant in
this Dituation, asswning that a buildir.g does constitute 8 publi~ nuisance,

tt18n the Counci 1, after giving the o,mer an opportunity to be heard, can take
such steps l.rdth reference to the building as are reasonably necessary to Ehate
or correct the dangerous condition. In the event, for example, that the building
is torn dO~J1l, Bnd the Ot,mer can later convince a Court. that the danger could have
been corrected ,;:ithout tearing the :building d01m, the building inspector or
CouJlcil nembers may be held personal1.y responsible for the excessive loss to the
Ol..,lner, The decision by the Counci 1 that destruction cf U,e building is necessary
is ~?~ conclusive or in any -,-Jt1y binding upon the Court if the O1<mt2r brings 3n
action against the Council me~~ers or the inspector.
It is FlY 'understanding thzt the Council is of the opinion that the
house on Tiller Lane is dangerous. I should like to point out that the fact
that the unfinished house is unsightly and nay result in depreciotion of
property values in the neighborhood does not constitute sufficient reason or
basis for the Council to take any action tOl~rd its destruction.
If the Council is satisfied that the existence of the building in its
1~~iinished condition is dangerous and constitutes a plli~lic nuisance then I recom-
mend thDt lile obtain a 1rJTitten report from the building inspector and notify the
ovmer, Joseph Surin8, that there 14ill be c\ hearing before the Council. on this
;rcatter at the Council meeting cn October 27. T-re could then proceed in t:3ccord-
c;ncs 1.Jith tl1e sections of the Building Code l"lhich I have referred to above.
I might also point out that, if the building constitutes a public
nui sanee, action eouic be t31ten against the ObJDer under the st8te statutes
regu12ting this nuisance.
(~ ) Nr. "}infrey asked me to check into the question raised by I.Ir.

Hoelzel regarding the lot at 3370 New Brighton Road. I am enclosing original
and one copy of a letter addressed to the Counci I. covering this point.
(Ii) Hr. ;Jinfrey also advised that he had a complaint regarding an
old bus Hhich has been placed on some property in the Vill age, apparently for
the purpose cf converting it into a hunting shack. Secticn 5-15 of the Building
Code prohibits the placing of street cars, buses, etc. on any property in the
Vill.age. Accordingly this constitutes a violation of the Code.
(5) You advised me that certain residents of the Village "ish to
vacate Olenarden Road to the extent that it runs through the p18)'gro~~d at County
Hoad 0; and Eamline J\venue. Vacation of a street by Village acticn is govermd
by Section h12.8:;1 of the Einnesota St8,tutes. The Ection must be cornIlcnced by a
petition of a majority of owners of land abutting on the street, and there must
be a hearing by the Counci 1. preceded by tlrfO \"eeks published and posted notice.
(6) At the Council meeting in August a question Has referred to me
regarding the application of Horthwestern Bell Telephone Company to place a
buried telephone cable under Glenarden Road. I do not believe we have any

plant engineer Hha signed the application. He 2c1vises me that the Telephone
Comp2ny Hou.1d take such action as lllight be necessary to protect the cable
in tho future in the event a SSHer is installed or it is necessary to perform
some other ohTork in the street. At my request he is M:'iting a letter to the

Attorney Courtney reported. that there have been a rash of apoeals lately
from Justice Court and advised that Council channel requests for Village
attorney's appee.re.nce at """lese cases through the Public Safety Director
or Council and that Vlllage authorize Courtney to use his Junior Associate
Mr. fevette for some of these cases as he would be used at less cost to
the Village. Upon motion by':finfrey, seconded by DeLange, Hr. Courtney
. was Quthorized to use Mr. Devitte for court appeal cases and requests for
an attorney for such cases be channeled. through the Director of Public
Satety and the Council. Motion passed.
PUBLI C HORKS: DeLange reported there are still some street names in the
Village "Ihich should posSibly be changed and will chec]~ further into the
matter. He stated he is working with Village engineer in completion of
the Grant. Road project.
PUBLIC SAFETY CO~1IT~EE: Crepeau reported a complaint of a barb wire
fence 1'" inches high Dut up at 1956 ;,lound. Clerk reported a complaint
from l~s. Rossler, 196~ Mound on the Same fence. Mrs. Rossler felt it a
hazard to her small chilc'ren. Attorney stated he kne"1 of no 18.'-1 under
which the Village could take action when the fence is on the owner's prop-
erty.
MAYOR'S REPORT: Ashbach renorted a regional meeting of the LeaK~e of
MinneSota Municipalities to'be held at Stillwater October 2. DeLange
will try to attend. A book showing nel'l high"ay Dlans through Village
was presented to Council. Highway officials will be invited in the near
future to explain the layout to Village residents at a public hearing,
pOSSibly October 20, at the Village Hall.
Northern States POloler Com~any submi tted a proposed plan for ind.ustrial
zoning for the VillD.ge. he plans "Iere referred to Public ':!elfare Com-
mittee. Northern States desires to explain at some future date as set by
Council why they made the survey and plan.
PUBLIC 'JELFAtiE REPORT: Mr. Winfrey reDorted th2.t the Jehovah Hi tnesses
have purchased the extra lot required and now have received permiSSion to
obtain a building permit for their proposed new church at Mound Avenue
anC', Highway #3.
A request from Dick Schreyer for a commerical building on tl,e Zilliox
plat waS referred to the Public Welfare Committee.
