MINUTES OF 'SPECIAL MEETING
COUNCIL OF THE VILIAGE OF ARDEN HILLS
Thursday, March 5, 1959
PUBLIC HEARING ON ADVISABILITY OF VACATING PORTION OF ALLEY LYING BETWEEN
LOTS 1'7 AND 18, block I, ARDEN HILlS.
The meeting was called to order at 8110 P.M. by Mayor Ashbach.
Roll Call. Present; AShbach, Winfrey, Crepeau, Kennedy, Stromquist.
Attorney Courtney and Engineer Carley also present.
. Absent; None
Mayor Ashbach informed residents that hearing is held for purpose of
consideration of entire Ridgewood Court matter, including advisability
of alley vacation, proposed #ootpath through plat, what to do about present
alley and turn around. Mayor Ashbach asked first to hear from petitioners
for vacation of alley. Mr. Gardener and Mr. Leonard, his Attorney stated
that they wished to urge that the petition for vacation of alley between
Lots 17 and 18, Block 1 Arden Hills be passed by Council.
Mr. Tom Conlin, Attorney representing Mr. & Mrs. Tissel, Kaehn, Martel,
Kelsey, Klass and leVander, objectors to petition. spoke in opposition to
the proposed vacation of alley. Mr. Conlin reviewed his prepared brief
(As attached). Mr. Conling stated he hoped Council could come up with a
satisfactory. solution for all residents conoered and stated that the
solutions presented by Council to date are unsatiffactory to objectors.
Mr. Conling then requested individual objectors to speak on the matter~
Mrs. Arthur Tissel stated that bank representatives had informed her that
if present alley extension is vacated, her property values in plat might
be devaluated 2% to 3%, but that her chief concern is the difficulty or
impossibility of emergency vehicles to get on and off the present alley
and turn around.
Mr. Paul Klass stated he had purchased his home after looking at approved
plat of Arden Hills and he felt , at time of purchase of home that alley
would eventually be built as shOWn on plat. He stated that bank appraisals
on his home indicated his property will depreciate if alley is vacated
between lo~t 17 and 18, Block 1, Arden Hills. Mr. Klass submitted a copy
of the Federal Underwriting Manual of the Federal Housing Administration
and requested that it be filed with village records. Mr. Klass objected
to proposed alley vaoation.
Mrs. Sohoonover objeoted to building a footpath or road straight thru plat.
Mr. Kerr stated that oul du saos are put in many well planned plats in the
suburbs.
... Mrs. Elane Shore objected to road or footpath being built straight thru
plat as it will make one more road to endanger children playing in the area
Mr. Kelsey stated he felt the turn around in plat should be built to
specifioations to allow emergenoy vehioles to turn around, or that Ridge-
wood Court should be extended to Siems Court, and that he preferred the
latter.

Fire Chief Ehlers of the Lake Johanna Vol. Fire Dept. stated that the
fire departmeny cannot operate on Ridgewood Court on the present turn-
around, and could not do so even if present easement was used to extend
RidgewoodCourt to Siems Court as the turn would be too shaPp for a road
that narrow. .
Mayor Ashbach then asked Village Engineer Carley to present new plans for
project. Mr. Ca rley presented three proposed plans, No. A, B. And C, as
attached, and explained each plan. Copies of plans were passed to Council
members and to residents. A.fter c onsidera ble discussion of the proposed
plans, Trustee Winfrey stated that he favored Plan A. Upon motion by
Winfrey, seconded by Kennedy, the attached resolution was made by Village
Council. Mr. Conlin objected to the turn around, as proposed, and stated
he felt Ridgewood Court should be extended to Siems Court between lots
16 and 17. Upon roll call vote by council, motion was passed unaminously.
The meeting was adjourned at 10130 P.M.
