HomeMy WebLinkAboutCC 09-28-1959 . MINUTES OF REGULAR MEETING COUNCIL OF VILLAGE_OF ARDEN HILLS MONDAY, SEPTEMBER 28, 1959 The meeting was called to order at 8:00 p.m. by Mayor AShbach. Roll call: Present; Ashbach. Crepeau, Delange, Kennedy . Absent; Stromquist Deputy Clerk Margaret Steinkraus was present to record the minutes of the meeting. The minutes of the September 11. September l4 and September 22. 1959 meetings were read and approved. A public hearing on rezoning from residential to commercial property owned by John Grudnoske located near the Southwest corner of Hamline and High~ay 90 was held. The legal description of this property is: The North 351 feet of the East 833 feet of the NWt, Section 22, Township 30, Range 23, subject to Cou~ty Road G (T.H.90) and Hamline Avenue, all in Ramsey County, Minnesota. . Rezoning of property owned by John Neske had also been deferred until this time so that the Council could consider the matters together. Mr. Kennedy reported that the Public Welfare Committee had a meeting to discuss rezoning in general and this particular rezoning. It was the unanimous opinion of the committee that Arden Hills did not have too much land zoned commercial and are not in agreement with Mr. Jones. Village Planner, on this point. The committee also felt that the Nesky and Grudnoske rezoning should be approved and if any other land owners between these two pieces of property brought in petitions relative to rezoning their land from residential to commercial. the matter should be considered favorably. The Public Welfare Committee recommended that no other changes be made in the zoning ordinance unless a specific. highly desirable type of business such as large department stores or insurance companies wanted a particular piece of land that was not zoned properly for their activities . Mr. Kennedy moved that the rules be suspended and this be considered as the second, third and final reading of the ordinance amending the zoning ordinance to re~one to commercial the portion of the NEt of the NEt of Section 2l, Township 30, range 23 and that the ordinance be adopted upon publication in the Rose Tribune. Motion seconded by Crepeau. Motion carried. . Mr. Grudnoske stated that he really was only asking to have an area 300 feet and 833 feet along Highway 96 rezoned to commercial. } Minutes of Regular Council Meeting. September 28. 1959 2 . Mr. Kennedy moved that this be considered the first reading of an ordin- ance to rezone this Grudnoske property from residential to commercial. that amount not to exceed amount requested in petition. The exact amount to be determined before ordinance is drafted. Mr. Crepeau seconded motion. Motion passed. Mr. Kennedy suggested that the Council should insist that a survey of land- to be rezoned be furnished with petition requesting rezoning so that ~ the exact parcel in question can be easily determined. Mr. S. J. Kranak appeared before the CounCil, at Council request. The Council req~ested Mr. Kranak to surface Gramsie Road to Rolling Hills Road. Mr. Kranak stated that he will have it done before cold weather sets in. Dr. Edward Walsh, 1401 Forest Lane, asked the Council if they had re- ceived a report from their attorney on the legality of building a swim- ming pool on Forest Lane. The proposed pool is to be built by not more than 10 familias on a lot not yet purchased by the families. Attorney Courtney stated that he had found nothing in our building code or ordinance specifically referring to swimming pools. If a pool is to be an accessory building to a home, it would require a permit and any problems concerning it would be referred to the Board of Appeals. If the proposed pool construction is not a private pool, the Council has the . power to pass an ordinance permitting construotion and regulation. He recommended that the Council amend the zoning ordinance to ~efine swimming pools or else pass a separate ordinance dealing with pools, describing prooedure and specifioations. Dr. C. E. Watz. 1415 Skiles Lane and P. B. Hale. l40l Skiles Lane. adjacent property owners to the proposed pool brought up several points they would like the Council to consider before they passed such an ordin- anoe. They did not feel that it would be possible for the Counoil to enact an ordinance that would make this project nuisance-free to the adjacent property owners. Mr. Kennedy stated that the Public Welfare Committee had also considered this matter at their committee meeting. The committee did not oppose the idea of pools but could see many proplems , arising with them. If an ordinance was passed onabling this pool to be built, they felt ,that all surrounding property owners should have acoess to the pool. The committee also felt that a chain-link fence of sufficient height would be neoessary ~ to keep small children out of the pool area at unsupervised times. The mayor reoommended that the SWimming pool matter be laid over until the next regular Council meeting. The Council ooncarred and felt that the matter will need to be considered carefully and there will probably have to be an amendment to the zoning ordinance before the pool can be built. . Engineer Carley was allil:ed when the 12 Village street maps requested by the Council would be ready. He stated that he expected to have them the next day. Minutes of Regular Council Meeting. September 28+ 1959 3 ~ Attorney&s Report: Mr. Courtney stated that he had spent considerable time with Mrs. Patterson in regard to the Patterson matter. as she feels the turnaround easement will unduly penali~e her property. He sugges tad that Mr. Carley have a talk with her and try to come to some sort of equitable agreement with her concerning the easement as condemnation proceedings are possible but expensive and necessarily involved. Mr. Carley to check with her. ~ Mr. Courtney stated that on the Kranak bond there are no specifications attached to the bond and no time of completion has ever been set for finishing the roads in Shorewood Hills #6. Mayor stated that we ao have in the official minutes of the Village a request that he furnish us with a bond and complete the roads upon Council request and that the specifica- tions are in the ordinance. No action was taken on matter. Attorney courtney presented the Clerk's office with a letter regarding the purohase of the Village Hall from the Village of Mounds View, dated Sept. 25, 1959. The Hall now belongs to Arden Hills with all papers in order. Mr. Courtney said that the Joseph Besch matter poses a serious questiopas to who has responsibility for covering him as he was an uncompensated Eivil Defense worker. It could be Ramsey County, Ramsey County Civil Defense or the Village of Arden Hills. The attorney advised that the Village handle the matter under the provisions of Seotion 176.191 of the MinD.eota Statutes. He felt that the Village should not acoept responsi- ~ bility as if we do. our workmen's oompensation premiums will go up beoause the rate will reflect all Arden Hills Civil Defense volunteers. He feels that the Village should let the Industrial Commission decide responsibility. He suggested that the village deny the claim and let our insuranoe oompany undertake the defense. The Industrial Commission is willing to handle Besoh's defense in order to avoid a charge to anyone for attorney's fees. The Council felt that compensation benefits should be made available to Mr. Besch as soon as possible. The Council recommended that Village attorney notify our insurance oompany and Ramsey County of their position on the matter according to attorney reoommendations. Mr. Weber Jleported that Mrs. Besch has been in need of ready oash and two Civil Defense members have advanced her $300.00. The Arden Hills Police Department and Civil De#ense Unit are sponsoring a drawing on a TV set whioh they hope will raise $1.000.00, the proceeds to be turned over to her. Dr. Watz suggested that if the Village is to cover their Civil Defense ~ Unit under their own insurance policy that a specific distriot or area be set up where this unit will be covered. Mr. Co~tney presented an ordinance accepting the provisions, terms and conditions contained in Ordinance No. l0725 of the City of st. Paul. as amended. and Ordinance No. ~~3 of the Village of Roseville. whioh ordinance was passed September 22, 19 . all relating to the conneotion by the Village ~ of Arden Hills to the publio sanitary sewer system of the Village of RB.e- ville. Roseville has requested that a copy of Arden Hills ordinance aocepting their ordinance, duly authorized and oertified. be on file in the office of Clerk before Ootober 6 so that they may accept the st. Mr. Crepeau recommended that the Council waiwe the rules. consider/the lst, 2nd, and third reading of the ordinance and moved that the Council pass the ordinance. seconded by DeLange. Motion carried. Publication can be delayed until October 8 as Roseville does not require that it be published before October 6. The sewer contract documents between Lametti & Sons. Inc. and the Village . of Arden Hills for Project Nos. 1 & 2. of Sanitary Swwer Improvement No.1. found to be in order by attorney, were presented to Council, approved by Council and properly signed by the ~yor and Deputy Clerk. The attorney presented the Village Council with a contract letter from Banister Engineering Company. dated September 14, 1959. Up to this time, there has been no formal agreement between them and the Council. Letter referred to Finance Committee. Counoil noted that staking and field inspections were not included except at an extra fee. Before a contract is entered into with Banister Eng. Co., the Council felt that the matter should be investigated thoroughly. The attorney stated that the property damage provision in the insurance seotion of the building oode definitely referred to $25.000.00 for eaoh aooident and recommended that the Clerk's office rejeot all certifioates of insuranoe that do not oomply with this provision. . PUBLIC WELFARE: Kennedy reported that he had attended a Rural Munioipal- ities meeting on county planning. He felt that the purpose of the group was to get a degree of planning for all of Ramsey County. The group would like a representative from each village to attend meetings and help make up an overall map of existing zoning and bring back suggestions to loeal village. It is aotually reaetiv~ting the Ramsey County Planning Commission that held its last meeting in 1952. DeLange moved that the mayor appoint a representative to attend these meetings. Mr. Crepeau seconded motion. Motion carried. The incinerator proposition was also revived at this meeting. Warren Brennan would like a representative from each village to attend a meeting to keep in touoh and gather facts. Mae Couna'l suggested that the group determine whether there is a problem before trying to solve it. Mr. Kennedy was appointed to attend these meetings. The Clerk is to inform Mr. Brannan. . Mr. Ashbach was unable to attend the Governor1s Conference on Water Pollu- tion but sent two representatives. Dr. Sekhon. Health Officer. and a representative from Banister E~gineering. The repor t wa s made. Dr. Sekhon felt that water pollution was no problem in the Village area. The Counoil reoommended that there be spot eheoking by individuals if they had a problem. PUBLIC SAFETY: Crepeau attended a meeting called by the Ramsey County sheriff for villages interested in buying police protection from the county. The Council suggested that someone from the Sheriff's office be inv~ted to come to a council meeting to discuss the maJter with the Counoil. Crepeau also attended a Ramsey County Officials meeting. They are attempt- ing to adopt a uniform ordinance on burning and fire control throughout the county. They are recommending seven specific ohanges in the fire ordinaace. ~ Matter referred to the Fire Chief and then to the Village Attorney for recommendation. The New Brighton Fire Department stated that they would like to be paid $75.00 for each oall they answer in the Village of Arden Hills. It was recommended that the Ramsey County Sheriff's Office dispatcher be enoouraged to send the proper fire department to the proper village. . Ootober 12 there will be a hearing on the Village Budget for 1960. Mayor's Report: A letter received from the Walter Butler Company intereste~ in preparing-complete plans and specifications for awarding sewer contracts was put on file with the Clerk. Ashbach reported that he and Mr. Stanslasky, New Brighton mayor, disoussed the possibility of asking the county to take over Stowe Avenue. The Council referred the matter to the mayor who is to write a letter to the County Commissioners requesting them to take over and maintain this street. Mr. . Ed Salverda was present at the Council meeting and the Counoil requested his help in the matter. PUBLIC ROADS: Mr. DeLange reported that he had received a oom,plaint from Mrs. Riohard Carlson.. 1159 Carlton Drive, concerning a drainage problem on Tiller Lane. Apparently, a house is being built on a lot by a Mr. Anderson which is the natural drainage for that area. The lot has been tiled and wright green water is coming out of the pipe most of the time. She feels that it is a health hazard to children playing in the area. Mr. DeLange suggested to her that the area could be fenoed or boarded over the top. The matter was referred to Mr. Ashbach and Rr. DeLange for further aotion. Mr. DeLange has recently inspeoted all village streets and he is recommend- ing that some of them be oiled. Mr. Kennedy moved that the proposed budget for 1960 8S presented b~ acoepted by the Council for the public hearing, Ootober l2. Motion seconded by Crepeau. Motion oarried. It was observed by the Council ~ that the mill rate will stay approz1mately the same for the coming year if the proposed budget is adopted. A letter from Banister Engineering Company concerning the Preliminary Report on Sanitary Sewer Improvement for the southwest portion of the Village, dated August 10..1959 be placed on file with the clerk. . A letter. dated September 23. from the Village insurance agent, Wm. H. Hite. was placed on file with the Clerk, recommending that the Village Hall be appraised by McGregor-Deyo Appraisal Company to determine the correct amount of insurance that should be carried on the building. cost of apprais@ not to exceed $25.00. There is a binder oovering $l5.000.00 of fire. extended coverage and vandalism insurance on the hall at the present time. Minutes of Regular Council Meeting, September 28, 1959 6 . Mr. Kennedy moved that the Council request Village Clerk to order the Village Hall appraised through Wm. Hite, insuranoe agent, cost not to exceed $25.00. Seoonded by DeLange. motion carried. A letter from the Minnesota Water Pollution Control Commission approving the plans submitted for sewerage facilities in the Village was read. They requested that the enolosed form be mailed to their office when the project is completed. Letter referred to Clerk. . An invitation from North St. Paul inviting the Council to attend the Fall Regional meeting of the League of Minnesota Municipalities in the Village on October 7 was read. Three Council members, Ashbach, Crepeau and Kennedy. indicated that they planned to attend. A letter from Thomas. Bradford, King & Collatz, attorneys for the Village of Shoreview was read in which they stated that some of their residents were disturbed by an asphalt plant operating in the north end of the villag at the Twin City Ordinance Plant. The matter was referred to the mayor. Robert W. Nixon's application for a rubbish and garbage hauling license was again submitted for Council approval. He included a complete schedule of rates with application. Mr. Kennedy moved that the Council grant him a license subject to the Health Officer's approval. Motion seconded by DeLange. Motion carried. . Claims #1900 through #1926 were presented for payment. Mr. Crepeau moved vhat these claims be paid. DeLange seconded motion. Motion carried. Mr. Ashbach moved that a 11 meetings held in the Village Hall be scheduled through the Clerk1s Office so as to avoid conflicts. Motion seoonded by Kennedy. Motion passed. The Mayor brought up the matter of publishing Village Council meeting minutes in the legal newspaper. The matter was referred to the Clerk to check cost of this and the number of people living in Arden Hills that actually take the Rose Tribunel Clay Kelley, Building Inspector, stated that he has had a request for a permit to attaCh a basement garage to a basement house at 4235 North Raw- line Ave nue . He felt that this would actually be upgrading the property as the basement house was built before Arden Hills incorporated and new owner plans to build on the entire area next year. The Council agreed to leave the matter to the judgment of Kennedy and Kelley as to whether or not . to grant this permit. The meeting was adjourned at 11110 p.m. . ~ ~. ~..t:.
