Donald Lund, Village Atty. Vincent P. Courtney, Treas. Worth G. head and Trustee Elect James Lang The minutes of the Regular Council Meeting of November 30, 1904, were afproved as submitted. .. REPORT OF ATTY. VINCENT P. COURTNEY Drive-In Ordinance Atty. Courtney diatributed to the Council copies of a rough draft of a proposed Ordinance titled IIAn Ordinance regulating and licensing the operation of drive-in restaurants or buainesses within the Village or Arden Hills and providing penalties for violation thereof." Mayor Kennedy stated that he understood that the intention of the Planning Commission is to prohibit drive-in establishments from the Village, whereas this proposed Ordinance provides for such establish- ments. Matter referred to Atty. Courtney to check into the possibility of an ordinance to ban drive-ins in Arden Hills. Perry Gibson Torrens Title Atty. Courtney informed the Council thnt the reason the Village is named as a defendant in the application for To!'rens Title for the Gibson property, 3240 Sandeen Road, is that we have an interest in the adjacent property. As recommended by Atty. Courtney no action was taken. However, Atty. Courtney informed the Council that we may hear further about this p!'operty ss a sewer assessment has been levied against this property, but no sewer is available. Perry Plat Atty. Courtney submitted a letter, dated December 14, 1964, which in- cluded COmments On the Perry Plat. He liB ted several ordinance !'equire- ments, which have not been satisfied to his knOWledge. Letter refe!'red to Trustee Nethercut to confer with Richard Jones. Heimbach Rezoninf AP~lication Atty. Courtney s ate that the ownership report as submitted by Atty. Daubney for A. J. Heimbach does show the owners of the prope!'ty within the required 250 ft. radius, but the application for the rezoning of this property should Come from the owner of the property, who is on record as being Carl A. Ingerson and Margaret Ingerson. He also in- formed the Council that the legal description sought to be rezoned in- cluded part of Lot 6~ Block 3, which is Village owned property and he .. believes that this property should be excepted. Mrs. Stephen Prager~ 3320 N. Dunlap St.# was present and requested the procedUre for registering complaints, and also requested a~ invitation to attend Planning Commiss1on tneetings. Atty. " 14. 1>;64 v. .-,. ...- Mayor Kennedy read a letter from Dr. i~. Blomberg. 3430 Glenarden Rd., opposing the rezoning of this property for apartments. A. M. Olen. 3270 Hamline Avenue. submitted a petition with many signers opposing apartments. Mayor Kennedy read the petition and referred it to Trustee Nethercut for the Planning Commission and then to be returned to the Village files. Matter of rezoning referred to the Planning Commission. Liquor License AfPlications Atty. Courtney 1 sted in his letter several discrepancies and/or omission in the liquor license applications and/or bonds. Referred to Clerk far proper completion. ~Trustee Crepeau moved. seconded by Trustee Nethercut. that the 1965 liquor licenses be granted. subject to the approval of the Attorney and the Police and Fire Departments. for the following establishments: McGuire's Supper Club, Inc. - on and off-sale liquor licenses Lewis W. Lindemer - on and off-sale liquor licenses Big Ten Supper Olub, Inc. .. on and off-sale liquor licenses Flaherty's Arden Bowl, Inc. - on-sale liquor license motion carried. Uniform BUilding Code Atty. vourtney reported that he still does not hRve the printed copy of the Uniform Building Code with amendments as passed by White Bear. Atty. Courtney recommended that the Uniform Building Code and the new Zoning Ordinance be accepted by the Village before the acceptance of the codification of the ordinances as many of our present ordinances are outdated and many others will be dropped. Mayor Kennedy suggested that the new books on ordinances be placed in a loose leaf type book to facilitate keeping the ordinances current. Butane Tank Matter Atty. Gourtney reported that Lester Wilsey, 1178 Tiller Lane. was found not guilty of a Village Ordinance violation by the location of a butane tank on his property closer to the property line that the Ordinance allows. JUdge Fleming, White Bear Court, determined that, according to our Ordinance, the butane tank does not constitute a structure. Atty. requested to send a copy of the Judge's determln~ ation to the Council and also to Carl Dale, Village Planner. Atty. Courtney informed the Council that this decision is not appeal- able. but the Village could start civil action u[jder the statutes, probably to the Ramsey County District Court. and if this court makes the same determination, our Ordinance should be re-written. Proposed Rezoning - County Rd. E & Snelling Ave. MayorKennedy read a memorandum from Carl Dale, Village Planner, with his reasons for recommending that the property on the northwest corner of County Road E and Snelling Avenue be rezoned from commercial to 4Itresidential. The Council and Atty. agreed that Mr. Dale's reasons were very good. ' Clerk Lorratne Stromquist informed the Council that a letter sent to Carl Moen, owner of the property, Was returned with a notation fram Mr. Moen that he sold the property on November 11. but he did not gi ve the name of the purchaser. Trustee Nethercut moved, seconded by Trustee Crepeau, that a public hearing for the rezoning of this property be held on January 2~. 1965, and that Atty. Clerk reported that 8 copy of this letter has been sent to John Rysgaard who'brought the matter to the attention of the Council. HEPORT OF TRUSTEE N~'THERCUT Warming House Employees . Trustee Nethercut moved, seconded by Trustee Crepeau, that Fred Nixon, Lyle JilcCalltUll. John Benedict and Larry Cameron be approved to work as attendants at the skating rink on Lake Johanna; the rate of pay to be $2.00 per hour; motion carried. Atty. Coul'tney informed the Council that all employees of the Village should be placed on the regular payroll. REPORT OF MAYOR KENNEDY . R.C.L.M. Meeting Mayor Kennedy info~ed the Council that the Ramsey County League of Municipalities meeting will be held Tuesday, December 15, at White Bear. ~iscussion WaS held as to which type of sanitary sewer district would be best for Arden Hills. Members of the Council recommended that the plan to be accepted should include St. ~aul. Mayor Kennedy requested the Clerk to prepare a breakdown of the. various s ewer char ges . REPORT OF CLERK LORRAINE STROMQU!ST BUdget Reports Clerk Lorraine Stromquist disttibuted copies of the budget report through November. 1904. Clerk Lorraine Stromquist informed the Council that she will have the data on Village employee benefits for the next Council meetIng.
