Roll Call: Present ~ Mayor Kennedy, Trustees Crepeau and Nethercut, Clerk Lorraine Stromquist Absent .. Trustee Olmen Also Present.. Village Atty. Vincent P. Courtney and BUilding Inspector Clay Kelley '. The minutes of the Regular Qouncil Meeting of October 26, 1964, were approved as amended. ----. ~~, ~- . Gregorich Sewer Matter John Gregorich, 1609 Lake Johanna Blvd., had received a letter from Don Lund, Banister Engineering Co., which contained recommendations for connection of his property to the Arden Hills sanitary sewer ~- system. Copies of this letter were also sent to the. !,embers' of the Council. Mayor Kennedy suggested that Mr. Gregorich install a private line with Banister ~ngineering Co. determining a connector of sufficient size to accomodate the Miske property; he suggested that Mr. Gregorich confer with Mr. Miske and consider installing a olt pipe line ins tead of the required 4" line to accomoda te the Miske property at a future date with Mr. Miske paying the difference in the cost of the pipe. Matter referred to Atty. Courtney to determine if the easement in~ volved is a private or public eQsement. Mayor Kennedy moved that Banister Engineering Co. be instructed to proceed with the plans and specifications for the installation of the stub; seconded by Trustee Crepeau; motion carried. GreRorich Building Permit Mr. Gregorich informed the Council that it is possible that the Building Permit he has for an addition to his house will not be completed in the required one year time limitation. Building Insp 0 Clay Kelley suggested that an e:tension of time be requested by Mr. Gre gorich when this becOl..es evident. TexaCO Screening Mr. Leroy Hetnlck, 2030 Glenpaul hoad, appeared'and informed the Council that adequate screening has not been provided by the Texaco Station on ~leveland and County hoad II as required by Village Ordinance. , Mr. Hetrick informed the Council that he had talked with a represent- ative from the Texaco Co. and had reached an agreement that a redwood fence type of screening would be supplied by Texaco with Mr. Hetrick volu teering to supply the labor, but a decision had not been reached as to on whose property the fence would be constructed. Trustee Nethercut stated that this plan has evidently been dropped '. as Texaco now intends to have the Elling Nursery plant about forty Poplar trees for screening. The Council agreed with Mr. Hetrick that this would not be satisfactory for year rourd screening. Mayor Kennedy read the Ordinance concerning screening on Commercial property. Matter referred to Trustee Nethercut to again confer with Texaco. County Road D (Lakeview Avenue) Floyd Snyker, hamsey Co~; Entineer's office, presented a copy of the proposed expansion of tHe County Park at Lake Josephine, stating that the County propose& to acquire the property north of the present park and bounded by Lex~ngton Avenue, County hoad D (Lakeview Ave.) and the beach as an add~ti8n to their park. Pag'/j Two Regular Council Meeting Nov. 9. 1904 Council consider asking hamsey County to also acquil'e County Road D (Lakeview Avenue), since half of the existing road will be included in the acquisition and it would be feasible for the County to have contro~ of the entire road for policing and maintenance purposes. In reply to an inquiry from Mrs. narmon, Mr. bnyker stated that the widening of County Road D would be from the south side. Matter referred to the Clerk to send a letter to the involved property owners and/or residents informing them of the proposal and also to place the matter on the agenda for the next Council meeting. . Mr. Snyker stated that both he and t~. Walter Bremer will be available to answer any inquiries concerning this matter. County Road F and Snelling Avenue In reply to an inquiry from Trustee Nethercut, Mr. Snyker informed the Council that present plans do not include an island at this inter- section; he does not believe there is sufficient traffic at this time to justify an island. REPORT OF ATTY. COURTNEY Condemnation Matters Atty. Courtney reported that he had sent a letter to Dr. Farkas, Village Health Officer, answering his inquiries and included the procedure of condemnation under the State Statutes. Atty. Courtney suggested that letter be sent from Dr. Farkas to the owners of the three properties designating a time limit for cleaning up the premises before proceeding according to the Statutes. The Council authorized the Atty. to assist Dr. Farkas with any legal assistance he might need. Oak Avenue Improvement ~ Ashbach Vacation Trustee Nethercut moved that the Atty. be authorized to contact the survevor to obtain the legal description of the easement from Robert Asnbach before proceeding with another survey; seconded by Clerk Lorraine Stromquist; motion carried. Reiling Easement Trustee Crepeau moved the adoption of a resolution, as per attached. authorizing the Mayor and Clerk to sign a modification of an easement from Mr. Reiling; the previous easement contained an incorrect legal description; Banister Engineering Co. to submit the proper legal des~ cription to Atty. Courtney; seconded by Trustee Nethercut; motion carried. Butane Tank Matter Atty. Courtney informed the Council that Judge Fleming. White Bear. has not made a decision in the Wilsey Case involving the placement of a butane tank. . Drive-In bstablishments The matter of permitting drive-in restaurants in the Village was dis- cussed, and the Council felt that publiC hearings should probably be held before approval is given for such an establishment for public welfare reasons. Matter referred to Atty. Courtney for the study and drafting of an amendment to the Ordinance Which would provide for such a hear ing. Atty. Courtney informed the Council that a publiC hearing could be held without an amendment, but would proceed as the Coundil desires. Clerk request to so inform Mr. Anderson, who is considering the construction of such an establishment and suggest that he not exencise his option on the property until a determination is made. Vessey concerning the title policy and also the matter of' the easements which are to be obtained from Mr. Vessey before the sale is consumated. Clerk requested to inform Mrs. Thompson that she may have her check back until the matter is settled, REPORT OF ENGR. DONALD LUND (by letter) Presbyterian Homes . . t;lerk Lorraine Stromquist read a letier submitted by Engr. Lund con- cerning the Presbyterian Homes acquisition of additional property on the lake which they intend to fill end beautify. Engr.Lund informed the Council that the Village must maintain drainage across a portion of this property for Sandeen Ro~d. Mayor Kennedy info~ed the Council that the area could be filled only to the point where the cat-tails grow. The cost of the project was discussed and the Council felt that the Village should contribute some financial assistance since we should have some control of the project and must maintain drainage rights. Matter referred to Mr. Nixon to determine the number of feet to the catetails and also an estimate of cost. The Councll authorized Mayor Kennedy to report to the Presbyterian Homes the Village interest in the project. REPORT OF BUILDING INSPECIDOR - Clay Kelley Unauthorized Structure Mr. Kelley reported that the two buildihgs in the Industrial Park for Which building permits have been taken out by Mr. Eugene Colestock. have now been connected which haS increased the floor space consider- ably - no building permit has been taken out for this structure. Mr. Kelley informed the Council that Mr. Colestoc~ believed that he had permission for this construction from I~. Buetow, Chairman of the Planning Commission. Mayor Kennedy suggested that Trustee Nethercut confer with Mr. Cole- stock on this matter. REPORT OF TRUSTEb: N.ETHERCUT Planning Commission Appointment Trustee Nethercut reminded the Council that the appointment of a replacement of Jim Hill on the Planning Commission must be a member of the Welfare Committee. also. to act as a liason. Matter referred to Clerk Lorraine Stromquist. Rezoning Request Trustee Nethercut reported that Mssrs. Jurgenson. Lambert, Laverdiere . and Mr. Jurgenson's atty. attended the flanning Commission meeting regarding the request for rezoning 25 acres at the southeast corner of Highway No. 51 and County Road E to permit multiple dwellings. The Palnning Commission haa not received acceptable plans Which. in its opinion. would justify 8 recommendation of rezoning. Villa~e Planninf - Report No. 1 Mrs. issol dis ributed copies of R~ort No.1 to the members of the Council. She informed the Council that fifty copies are available and were to be distributed to the Village ~ngineer. Village Atty., Building Inspector, State Highway Dept. and two to the library. Additions to this list were suggested by the Council. Request for Skating Facilities In response to a written request from Mr. G. Harmon. Mounds View Recreation Director, Trustee Nethercut moved that Mr. Harmon's request be granted. subject to the approval of the Welfare Committee. and the same arrangements as last year be granted for the ice skating on Lake Johanna; seconded by Trustee Crepeau; motion carried. Turnlund. Roseville Administrator. informing of the resolution and requesting a review at this time ot their sewer rates charged to us. REPORT OF CLERK LClRRAINE STROMQUIST Connelly Avenue Drainage Matter Clerk read a copy of a letter from Don Lund. Village Engr., to Mr. Stepnitz. owner of the property on which a spring is located and causing a drainage problem in the area. Said letter requested correc= tion and recommended soil borings. Mr. Nixon informed the Council that men have been working at this site and believes that the problem has been corrected. Annual Village Election Clerk Lorraine Stromquist informed the Council that there were three filings to date _ Victor O. Pomerenke. incumbent Justice of the Peace; for trustee incumbent Robert Nethercut and James A. Lang. Clerk in- formed the Council that the last day for filing is Tuesday, November ~O" 1964. Gilchrist Residence cnLerk Lorraine Stromquist moved, seconded by Trustee Crepeau, that the Gilchrist residence, Lot 1, Block 9 - 0harewood Hills No.2, be allowed to be constructed not closer to the property line than adjoining houses, in line with other houses, but not closer than adjoining houses; adjoining neighbor has submitted his approval; motion carried. . James Majors Clerk Lorraine Stromquist moved, seconded by Trustee Crepeau, that the Major residence, Lot 1, Block 8 ~ Shorewood Hills #2, be allowed a variance in front set back from 40 to 30 feet; a note of approval has been received from adjoining property owners; motion carried. Richard A. Jensen Mrs. G. Harmon, member of the Board of Appeals, was present and requested that Mr. Jensen's request for a variance be tabled until approval has been received from adjoining property owners. Mr. Jensen had requested permission to move and add to his home at 1133 West County Road D. J..oren Sturgeon Clerk Lorraine Stromquist moved, seconded by Trustee Nethercut, that Loren Sturgeon, 3769 New Brighton Road, be allowed to construct a new garage on the site of the old one, allowing a five foot set back; approval had been received from the adjoining property owner; motion carried. W. R. Saar Clerk Lorraine Stromquist moved, seconded by Trustee Nethercut, that Mr. Saar, 1845 Stowe Avenue, be allowed to construct a double garage on the back of his lot, 10 feet fram the rear lot line and five feet from the side lot line; approval had been received from the adjoin~ ing property owners; motion carried. Easement Check - Rysgaard Clerk Lorraine Stromquist moved, seconded by Trustee Crepeau, that approval be given for the issuance of a check in the amount of $1,200 to John Rysgaard for an easement; motion carried. 11:40 p.m. ~ . lerk ..s= ----------- . . . RESOLUTION PERTAINING TO ShWER RATE STRUCTURE _.r ____. WHEREAS. the Village of Arden Hills discharges ge~age into the Roseville sanitary sewer system for the conveyance by the Village of Roseville to the City--ofSt.- P.auL. and WHEREAS, the sewer rates for the Village of Arden Hills are in part fixed by the City of St. raul. and WHEREAS, the Village of Arden Hills has been advised that the City of St. Paul will conduct a hearing on November 12. 1964, for the purpose of considering rate structures for the Village of Rose- . ville and other cities and villages in Ramsey County pursuant to recommendations contained in the Greeley and Hanson Report. NOW, THEREFORE, BE IT RESOLVED that the City of St. Paul at said hearing to be held on November 12. 1964, consider tha matter of sewer rates for the benefit of the Village of Roseville and/or other cities or villages discharging sewage into the St. Paul san- itary sewer system be also extended to the Village of Arden Hills to become effective for the year 1965. BE IT FURTHER RESOLVED that the Clerk of the Village of Arden Hills forward a copy of this resolution to the Mayor and Councilmen of the City of St. Paul. The foregoing res&lution adopted by the Village of Arden Hills by the Council at a meetit;g held on November 9, 1964. RESOLUTION RELEASING GEORGE J. REILING EASEMENT IN SANITARY SEWER IMPROVEMENT NO.6, SAID EASEMENT BEING DATED JULY 13, 1964, .AND AUTHORIZING EXECUTION BY THE VILLAGE OF EASEMENT DATED NOVEMBER 9. 1964. WHEREAS, in the construction of Arden Hills Sanitary Sewer Improvement No.6 the Village of Arden Hills necessarily obtained from George J. Reiling and Mary Jane Reiling, his wife, a certain easement dated July 13, 1964, filed . with the Registrar of Titles of Ramsey County as Document No. 473389 on July 14 1964, over and across certain property described therein, and WHEREAS, it has developed that an erroneous description was contained in said easement, and that the sewer as actually constructed upon the Reiling property is outside the easement as described in said Document No. 473389, and WHEREAS, the Rei1ings, as owners of said property, and the Village propose to enter into a new easement containing the corrected description of the easement within which the sewer has actually been constructed, and it is necessary that the Village release any and all rights granted to it under said Document No. 473389, NOW THEREFORE, BE IT RESOLVED, that the easement dated November 9, 1964, by and between George J. Reiling and Mary Jane Reiling, his wife, parties of the first part; and Village of Arden Rills, a municipal corporation, party of the second part, which easement grants to the Village a perpetual easement for sewer purposes as more fully set forth therein, and also recites the correction of the erroneous description in Document No. 473389, and further recites that Arden Hills joins in the execution of said easement for the purpose of releasing any and all rights obtained by it under said Document No. 473389, be and it hereby is in all things approved, and the proper officers of the Village are authorized and directed to execute the same on behalf of . the Village of Arden Hills. BE IT FURTHER RESOLVED, that the Clerk shall cause a certified copy of - 1 - . , - , . this Resolution to be recorded with the Registrar of Titles of Ramsey County upon filing of the aforesaid Easement of November 9, 1964. . . - 2 - . . . .
