Roll Call: Present - Mayor Kennedy, Trustees Nethercut, Crepe~m. Olman Clerk Lorraine Stromouist . Absent - None Also Present - Atty. Courtney, Engrs. Donald Lund and Norman Hendrickson, Fiscal Agent Popovich -_ The minutes of the SpeCial Meeting of October 1, 1964 were approved as submitted; the minutes of the Regular Council Meeting of October l~ 1964 were approved as amended. PUBLIC HEARING Sanitary Sewer No.7 and Street Improvement No.6 Minutes as per attached. FROM THE: FLOOR Request for Sewer Mr. John Gregorich, 1609 Lake Johanna Blvd., stated his desire to connect to the sanitary sewer system. Matter referred to Atty, CourtnEU as an easement is involved. and to Banister Engineering Co. for a recommendation on the connection. Kelly=Thompson Easement Mr. John Kelly, 4029 Fairview Avenue, inquired as to the status of ~n easement which was being negotiated sometime agao. Atty. Courtney recol1'lIllended that this easement hot be ltcquired at this ti.Lle and the / matter be reconsidered at the time that the Village intends to assume the responsibility of the sewer line. REPORT OF ATTY. COURTNEY Condemnation Matters Letter from Dr. F'arkas, Health Officer, recommended that three prop- erties in the Village be condemned. Atty. Courtney info~ed the Council that the only means of condemnation the Village has is the Building Code, but the State Statute states that the Health Officer can serve notice to the residents giving them 10 days ~~~ clean up t.he area, and if this is not accomplished, th . an proceed and charge it against the property. Mayor Kennedy s ggested that, if agreeable with Dr. Farkas, Atty. courtn~ be authorized to write letters on two of the properties for Dr. Fa kes' signature; the third property concerned could possibly be burne by the Fire Dept. Trustee Crepeau~mentioned that an old house and barn located on Lex~ .- ington Avenue could also possibly be used as a demonstration for the Fire Dept. Copies or Atty. Courtney's letter containin~ his oBinions be sJnt to Dr. Farkas, the Building Inspector and the olice ept. Uniform Building Code Atty. Courtney submitted a letter concerning the Uniform Building Code. Clerk Lorraine Stromquist moved that copies of this letter be referred to the Building Inspector, the Planning Commission and Mr. Dale; seconded by Trustee Nethercut; motion carried. Clerk requested to send copies of same to members of the Council. Atty. "No Thorofare" S:tgD In reply to an inquiry from Trustee Crepeau at the last Council meeta ing, Atty. Courtney informed the Cou~cil that he finds that State Aid is used for maintenance of pUblic roads according to the Statute, and believes that this fund might be reduced if such a sign were posted. PLANNING COMMiSSION Mrs. Carolyn Tissol, secretary of the Planning Commission, reported that five members had attended the Planning Conference held recently in Mpls. She informed the Council that the Planning Commission vrould like approval and help from the Council to send letters to other municipal- ities to request support of a legislative bill concerning Planning Commissions. Mrs. Tissol also submitted a draft of such letter and e a copy of the bill. The Council authorized Clerk Lorraine Stromquist to write such letter and present it to the hamsey County League of Municipalities meet':'ng to be held on October 27, 19M, and a similar letter be sent to the Hennepin Co. League of Municipalities. Trustee Crepeau moved, seconded b;r Trustee Nethercut. that all members attending the local Planning Conference be reimbursed; motion carried. REPORT OF ENGR. DONALD LUND Valentine Crest Road 'rrus tee Olmen moved, seco nded b;r Trus tee Crepe au, and as recommended byh:ngr. LU':l d, the Valentine Cres t Road be accepted by the Village and the bonds released; motion carried.. Draina~e Problem Engr. und reported that the flow of water neer the Rysgaard property was probably started again by the dumping of fill during the construc- tion of the Texaco station causing a drainage problem in the area. Mayor Kennedy stated that this apparently is a p!'ivate matter unless it affects our streets. Matter referred to Bngr. Lund to confer with Mr. Stepnitz, the owner of the property on which the spring is located, for a solution. Oak Ave. Street Improvement Engr. Lund presented a letter from Engr. Hendrickson, which was read by Clerk Lorra~ne Stromquist. This letter was in reply to an inqui:ry concerning inadequate supervision of the Oak Avenue blacktopping por- tion of the street improvement. Engr. Hendrickson stated that fllll till.e supervision was not called for in the contract and actually was not necessary; that the amou!Jt of tine spent in supervising was based on the knowledge of the contracto:r's work and the fact that the paving was on the surfaca and readil;r visible for inspection after it was laide REPORT OF TRUSTEE NJnHERCUT County Road F Playground Trustee Nethercut reported that Clerk Lorraine Stromquist had received a call from Ryan Landscaping requesting authorization to seed the area iIImediately with a guarantee that t he seed would ~ow or there would . be no cost to the Village; therefore, with his approval. permission was granted. Drive-in Re~uest informed the Council that an application had been Trustee Net ercut received by the Planning COmmission from Mr. Anderson to construct an A & W Drive-in re staurant on County Road E near the Texaco Station. REPORT OF TRUSTEE CREPEAU Letter of Appreciation Trustee Crepeau moved, seconded by Mayor Kennedy, that G letter of appreciation be sent to Mr. Carl Nimis, who is moving from the Village; motion carried. Trustee Crepeau stated that Mr. Nimis had been a member of the Public Safety Committee for many years. REPORT OF MAYOR KENNEDY Ordinance - Public Works Reserve Fund Mayor Kennedy moved that the rules be suspended, and the "Ordinance establishing the Public Works Reserve Fund designating capital improve- ments for which the fund may be ased and other purposes for which the fund may be used, and authorizing the levy of taxes for the support e of the fur.d," as attached, be given its final readlng and authorIzed the publication of same; seconded by Trustee Crepeau; motion carried. Planning Commission AaPointment Mayor Kennedy informe the Coun cil that Mr. Buetow, Cha :LFman of the Planning Commission, has requested a replacement for .Tin; Hill on the COll1lniSB ion. The Council suggested reviewing the list of recommenda~ tions as on file. Secretary for Planning Commission Mrs. 'I'issol also requ.ested that she be relieved of the responsibility of taking the minutes of the Planning Commission. Cler k Lorrai ne Stromquist suggested that since this is a very active commission, par ~ haps someone from the Village Hall staff be assigned this task. Matter referred to Clerk Lorraine Stromquist. REPORT OF CLmK WRRAINE STROMQUIST Si~n Ordinance Enforcement Clerk Lorraine Stromquist has many questions concerning the interpre- tation of the sign ordinance and the procedure to follow on violationso Mayor Kennedy suggested that a letter ~f explanation be requested from those who have ignored previous correscpondence concerning signs lis ted to them. Trustee Nethercut stated, in his opinion, signs which are not visible from the street should be exempt. Mrs. Tissol informed the Council that !~. Dale will be studying the sign ordinance. Election Board - Precinct No. 1 Clerk Lorraine ~tromquist moved that Mrs. Joseph North. 1136 Carlton Drive, be appointed to the Election Board of Precinct No.1 to re- place Mrs. Gene Richter; seconded by Trustee Olmen; motion Carried. BE IT RESOLVED by the Village Council of the Village of I Arden Hills, Minnesota, as follows: 1. The amount proper and necessary to be specially assessed at this time for S'tJr..t IIIpJrov..nt No. 6 (Oak Avenue) against every assessable lot, piece or parcel of land affected thereby has been duly calculated upon the basis of benefits, without regard to cash valuation, in accordance with the pro- visions of Minnesota Statutes, Chapter 429, and notice has been duly published, as required by law, that this Council would meet to hear, consider and p~ss upon all objections, if any, and said proposed assessment has at all times since its filing been open for public inspection, and an opportunity has been given to all proposed assessments. 2. This Council, having heard and considered all objections so presented, and being fully advised in the premises, finds that each of the lots, pieces and parcels of land enumerated in the proposed assessment was and is specially benefited by the construction of said improvement in not less than the amount of the assessment set opposite the description of each such lot, piece and parcel of land, respectively, 8nd such amount so set out is hereby levied against each of the re~rective lots, pieces and parcels of land therein. 3. The proposed assessments are hereby adopted and confirmed as the proper special assess~nts for each of said lots, pieces and parcels of land respectively, and the assessment against each parcel, togethe? with interest at the rate of 5% per annum accruing on the full amount thereof from time to time unpaid, shall be a lien concurrent with general taxes upon such parcel and all thereof. The total amount of each such assessment shall be payable in equal annual principal installments extending over a period of t,n ~ years, the first of said installments, together with lnterest on entire assessment from the date hereof to December 31, 1965, to be payable with general taxes for the year 1964, collectible in 1965, and one of each of the remaining installments, together with one year's interest on that and all other unpaid installments, to be payable with general taxes for each consecutive year thereafter until the entire assessment is paid. , 4. Prior to certification of the assessment to the County Auditor, the owner of any lot, piece or parcel of land assessed hereby may at any t i.me pay the whole of such assessment, with interest to the date of payment, to the Village Treasurer, but no interest shall be charged if such payment is made within 30 days after th2 date of this resolution. 5. MIO .HiN to ..... ,. .",laeu c._ tbt r tnn. , After a discussion of th'e comments made, Trustee Crepeau then introduced the following resolution and moved its adoption: RESOLUTION ADOPTING AND CONFIRMING ASSESSMENTS FOR SANITARY SEWER IMPROVEMENT NO.7 (OAK AVENUE) BE IT RESOLVED by the Village Council of the Village of . Arden Hills, Minnesota, as follows: l. The amount proper and necessary to be specially assessed at this time for Sanitary Sewer Improvement No. 7 (Oak Avenue) against every assessable lot, pie~e or parcel of land affected thereby has been duly calculated upon the basis of benefits, without regard to cash valuation, in accordance with the pro- visions of Minnesota Statutes, Chapter 429, and notice has been duly published, as required by law, that this Council would meet to hear, consider and puss upon all objections, if any, and said proposed assessment has at all times since its filing been open for public inspection, and an opportunity has been given to all proposed assessments, 2. This Council, having heard and considered all objections so presented, and being fully advised in the premises, finds that each of the lots, pieces and parcels of land enumerated in the proposed assessment was and is specially benefited by the construction of said improvement in not less than the amount of the assessment set opposite the description of each such lot, piece and parcel of land, respectively, and such amount so set out is hereby levied against each of the re~rective lots, pieces and parcels of land therein. 3. The proposed assessments are hereby adopted and confirmed as the proper special assess~nts for each of said lots, pieces and parcels of land respectively, and the assessment against each . parcel, together with interest at the rate of 5% per annum accruing on the full amount thereof from time to time unpaid, shall be a lien concurrent with general taxes upon such parcel and all thereof. The total amount of each such assessment shall be payable in equal annual principal installment s extending over a period of twentv ( 20) years, the first of sa id insta llment s, together with interest on the entire assessment from the date hereof to December 31, 1965, to be payable with general taxes for the year 1964, collectible in 1965, and one of each of the remaining installments, together with one year's interest on that and all other unpaid installments, to be payable with general taxes fOr each consecutive year thereafter until the entire assessment is paid. ~ 4. Prior to certification of the assessment to the County Auditor, the owner of any lot, piece or parcel of land assessed hereby may at any time pay the whole of such assessment, with interest to the date of payment, to the Village Treasurer, but no interest shall be charged if such payment is made within 30 days after the date of this resolution, 5. The Village Clerk shall, as soon as may be, prepare and transmit to the County Auditor a certified duplicate of the assessment roll, with each installment and interest on each unpaid assessment set forth separately, to be extended upon the proper tax lists of the County, and the County Auditor shall thereafter collect said assessments in the manner provided by law.
