Angineer Donald Lund Absent - None The minutes of the Regular Council meeting of September 28, 1964 were approved as amended. -. Rezoning Petition Atty. Courtney reported that he had rec~d a petition. applica- tion and survey regarding the rezoning R-3 to Multiple DwelUng the ~opert7 in the NW * of the NE t of Sed 34. T 30, R 23. Atty. ourtney was requested to check the material and forward it to the Planning COlImiasion. Atty. Courtney informed the Counoil that Mr. Joa. Lembert, who is requesting the rezoning had not signed the petition. Clerk requested to obtain h18 signa- ture. REPORT OF ATTY. COURTNEY PUblio Works Reserve Fund Ordinanoe Mayor Kennedy introduced by title and moved the first reading be given to an Ordinance, aa submitted by Atty. Courtney. establish- ing the Public Works Reserve Fund, designating capital improve- ments for which the fund may be u8ed and other purposes for whllch the fund may be used. and uathorizing the levy of taxes for the support of the fund, seconded by Clerk Lorraine Stromquist, motion oarried. Siuad Car Contract A ty. Courtney informed the COU~lcil thBt the contraot with Midway Ford Company for a new squad C81' i8 in the man. Oak Avenue Improvements A1lty. COU1'1lney 1nrormed the Council that he belives Mr. Kaldahl is agreeable to signing an easement for the Oak Avenue 1mproveme.t, but he is not completely utisfied with the grade of his driveway. Atty. Courtney stated that Robert A8hbach had given the ea8ement on the ea8t 8ide of the road on oondition that the Village vacste the corre8pOnding property on the west side in front of Kaldahl's property.The Council requested Banister Engineering Co. to submit the leagl description of the Ksldahl property to Atty. Courtneyo Bagr. Donald Lund informed the Council of a request from Mr. Lcmbard to have the area between the driveway and the property Une be 80dded rather than 8eeded. The Couaoil denied the request as there 18 no steep 8lope 1nvolved and there would be additional expense. Uniform Build1ng Code >. Atty. Oourtney stated that he is still waiting for the legal draft of the White Bear Ordinance regarding the Uniform Building Code, but e.,peots to have this for the next Council meeting. Clay Kelley informed tl~ Council that Mr. Colestock is expected to request a building permit for the construction of another buildtng north of Dynacast. Police Officer Appointment Trustee crepeau moved, seconded by Trustee Nethercut, that Keith . Purdy, 139 Richardson St., New Brighton, be appointed tl_~_ _ry ~~ police officer; motion carried.. ~1S;lq"1. REPORT OF TRUS E N BERCnT Resi~nations Trus ee I'lethercut informed the Council that. Jim Hill had asked h1m to verbally tender his resignation from the Planning Commission and alao his ohairmanship of the Public Welfare Committee as he is moving from the Village. Trustee Nethercut moved, aeconded by Trustee Crepeau, that a letter of appreciation be sent to Mr. Hill. Trustee Nethercut informed the Council that Justin Smalley wil~ be Acting Chairman of the Welfare Committee. Planning Commiasioft Trus tee Meth.rcut distributed to the Council material 1'rOZll the Planning Commission and requested that the Cle1k attend the next Planning Commission meeting to familiarize the Commission with the various forms used by the Village. Clerk Lorraine Stromquist read a letter, dated October 9, 1904, from the Planning Commission which recommended approval of the Perry Plat subject to several changes aa described in their minutes. REPORT OF MAYOR KENNEDY Mayor Kennedy discussed Amendment No.1, the Taconite Amendment, which will be on the ballot on November 3, and had literature which had been sent to him. This meeting was held to discuss the proposed 1965 Village Budget~ She reported that the Finance COlIII1ittee reoommended aooeptanoe of the budget. The Clerk read . the budget which.ill decreese the Village will rete to about 21 mills, which 1s about 5 mills less than last year.. This re~ . duotion due to the inoreaeed valuation of the Village. Trustee Olmen moved.the approval of a resolution acoepting the 1965 budget and proposed tax levy, as attaohed; trustee Nethercut seconded; motion carried. It is hereby determined that theT'e are weed eradication charges against the properties hereinafter set forth, in the amounts set . forth opposite the description of such properties. 2. A special assessment in the amount hereinafter set forth is hereby levied against each of such tracts respectively. 3. The total amount of such special assessment, in each case, shall be payable with the 1964 real estate taxes due and payable during 1965. 4. The Clerk shall forthwith transmit a certified copy of the assessment to the County Audi tor to be extended on the proper tax lists of the County and such assessments shall be collected and paid over in the same manner as other municipal taxes. 5.
