Meeting waa oalled to order by Mayor Kennedy at 6:15 p.mo Roll Calls Present - Mayor Kennedy, Trustee Olmen and Clerk Lorraine Stromquist Absent - Trustees Crepeau and Neth61'out Also Present - Village Atty. Vinoent P. Courtney, Bldgo Inspeotor Clay Kelley and Engineer Donald Lund. The minutes of the Regular COWIoil Meeting ot July 27, 1964, were approved as amended. FROM THE FLOOR Binger Residence Severa~ residents from the Ingerson Road-Ingerson Court area were present and voiced theil' opposition to the architecture of the Binger residence now under oonstruction. Mayor Kennedy explained the procedure relative to the granting of a Building Permit when a variance is involved. He informed the resi- dents that he and Trustee Crepeau had cohtacted the eurrounding home owners oonoerning the construction of a home on this triangular lot, these oontacts and approvals were not necessary according to the Ordinanoeo The oonaensus was that this oonstruction would be an improvement in the area as the lot was an eyesore with tall weeds, etc. Following are some of the comments and matters disoussed: B. J. Lazan,~ Ingerson Road, requested a oopy of the Ordinanoe whioh states that the aftected property owners do not have to be oontacted ulder these conditions. He inquil'ed as to the funotion of the Planning and Zoning Commission. Mrs. Carol1D Tissol, Seoretary of the Planning and Zoning Commission, explained the functions of the COI:III1i88ion and informed h1m of the d.ates of the Comm1asioo's meetings. George Ott, 1225 Ingerson Road, stated he was agreeable to the oon- struotion on the lot, blit objeots to the arohitecture - looks like the -Berlin wall- and bloCks his view of the lake, that other resi- dents were not allowed to vary trom the Ordinanoe and gave as an example the Swensoo home whioh was not allowed to face Ingerson Ct. instead of the Roado . John Kennedy, 1280 Ingersoo Road, inquired 88 to the grading ot the log and the amount of ooncrete block which will remain exposed~ He also volced conoern regarding variances belng granted withoUt their approval. John Goetsoh or the Big John Construction Co~, contraotor for tbe Binger res1denoe, was present and gave this intormatlonQ H~ stated that Mr. Binger was out of town and regretted that he oould not attend this meeting. Allen Beeeth. 1201 Ingerson Road, and Mr. Kelth Ewy, 1176 Carlton Drive, both 1nquired as to wb1 the deed restriotlon concerning two story homes WaS not adhered too Village Atty. Courtney explained that the Council does not have the respons1b1lity of enforcing deed restrictions; any aotion on this matter mUlIt be processed by a clvll su11l. He also informed the resi~ dents that the Counol1 does not have the authority to deny the approval of a building permit toresthet1o 1'88800S. ..1- . . Building Inspector Clay Kelley stated that ine only change was in the size of the windows facing Ingerson Road. Clerk Lorraine Stromquist suggested that possibly the owner could be persuaded to bave the windows as originally planned. if this would make the structure more pleasing to the residents. Jrfl's. Don French. 12Z3 Ingerson Road. inquired whether Mr. Binger had been informed of the request that he not plant any large plantings which might obstruct their view of the lake. Mayor Kennedy inf01'llled her tha t Jrfl'. Binger was aware of this.. The COWlcl1 sugges~. that the residents meet with Mr. Blnger and d1acuss tbeir prob~; tbe OOWlcil does not have any oontrol on the arohitecture of a bame. theretore, no action by them. Water Servloe Request X8Dne~ Lukaska, 312~Asbury Ave., inquired as to the status of water service for the Arden Hills No.3 area, stating that this cO$Plete area is halt In Arden Hills and half in Roseville. He stated his dissatisfactlon or tbe 00uaol1 tor not approving water faoillties for Arden Hills. Be Inquired as to the Counoil's aotlon it 50% of the Arden Hilla No.3 resldents requested water sergice. Mayor Kennedy explained the Water StudJ Committee's reoommendatlon and Informed h1m that if a request from the residents waa .subr11tted, ine COWlol1 would oonsider 1t. . Salland and the oomplaint had been sent to Building Inspector Clay Hvlley who will serve it. Mr. Franke. en advis Th~sonQvessey needs At y. ~ourtney informed the Council that Mr. Vessey is having the property description checked em the piece of Lot 19 which he i. oon- sidering purchasing. He doeenot intend to give the Village the two small easements which were originally inoluded in this sale. Mro Vesu7 is also having these lega. oheoked. Atty. Matter referred to ~Dgineer Lund to contact Mr. Peterson to request the cost of the complete job be specified; an estimate of between $500 and $600 had been given previously. ~eoial Mid-Decade Census -Atty_ courtney 1nf01'll1ed the Council that a mid"'deoade census would entitle the Village to a larger liquor and digarette apportionment, but would not afrect the Road and Bridge apportionment until 1970 even if we did reach a population of 5,000 in 1965. A letter OD this matter will be forthooming trom the Atty.. Proposed Uniform BUild~ Code Atty. Courtney reporte hat he has revIewed the recommendations of the Planning Commission and the rough draft from Whi te Bear, which ls now in the hands of thelr attorney for final drafting. There were discusslons by the Counoil and the Atty. on possible deviations. Atty_ Courtaeyinformed the Council that he would gi ve a oomplete report at the completion of his study_ ~gaard Easement U1erk Lorraine stromquist informed the Council that John Rysgaard is not satisfied wlth the amount offered for an easement. Village council Village of Arden Hills County of Ramsey State of Minnesota Pursuant to due call and notice thereof, a J:oQUlaJ: _tit19 of the Village Council of the Village of Arden Hills, Ramsey County, . Mirmesota, was duly held in the Village Hall at 1450 West Highway 96, St. Paul, Minnesota. on Monday, the 10th day of August, 1964, at 8100 o'clock P.M. The fOllowing members were presenu: Kennedl, OlmeR & Stromquist and the following were absent: Crepeau & Hetherout StromQuist introduced the following reso1u- tion and moved its adoption: RESOLUTION REIATING TO APPORTIQNMBNT OF ASSESSMENTS RELATING TO SANITARY SEWER IMPROVEMENT NO. 2 BE IT RESOLVED by the Village Council of the village of Arden Hills. Minnesota, as follows: WHEREAS the assessment roll for Sanitary Sewer Improvement No. 2 as last finally amaded and adopted on October 12, 1961. was filed and certified to the Couty Auditor of Ramsey County on November 8, 1961 for the purpose of including installments thereof to be collected along with real estate taxes commencing in 1962. and WHEREAS, a hearing on supplemental assessments, reassessments, . and apportionment of previous assessments in respect to Sanitary Sewer Dmprovement No. 2 was held on July 16. 1962 at which time assessments for Sanitary Sewer Improvement No. 2 were amended as provided by said resolution of said date and certified and filed in the office of the County Auditor of Ramsey County on October 3, 1962 and . . WBE~S since that date a number of parcels of property con- tained within said assessment roll as amended have been divided and conveyed by previous property owners and WBE~S, the County Auditor of Ramsey County requires that apportionment of the original assessment against each original tract where it has later been divided, sold or conveyed, be made 4It by the Village Council of the Village of Arden Bills in order that the proper assessment can be extended by the County Auditor against each parcel of property thereafter, cOllllll8ncing with an assessment to be collected in the year 1963 and thereafter: NOW THEREFORE, the Village Council of the village of Arden Hills does hereby make the following apportionment of original assessments as contained in said assessment roll of October 12, 1961, and as amended as of July 16, 1962 against the following described properties: Original Assessment: A) Auditor's Subdivision No. 80 $3,080.00 S 271 ft of N 1101 ft of E 184.8 ft of lot 32 & S 396 ft of N 1226 ft of W 85.2 ft of E 270 ft of lot 32 Division 33615 B) S 125 ft of N 1226 ft of E 184.8 1,300.00 ft of Lot 32.
