Courtney stated that he had studied both the Building Code and the Zoning Ordinances and repOl'ted the following findings and opinions: definition of a structure cUffers and. in his opinion.. the sw1mm1ng pool is a st1'l1ctare aooording to the Building Code and, therefore. a building permit should have been taken out; t.b.e tank i8 a struoture acoording to the Zoning Ordlnanca, as the Ordinanoe state. that the set baok and side lot areas should be open areas and fre. of structu1's; therefore, this tank should be set back at least 40 ft. ~ the Carlton Drive side. Atty. Courtney suggested that a study be given on swimming pools to be inoorporated in the proposed new Building Code. Clen~ Lorraine Stromquist informed the Counoil that Mr. B&ugh~ Village Heating Inspeotor. reported that a permit should have been taken out for the tank and the pipeline. Two oontractors were involved in this installation. The Council authOl'ized Atty. Courtney to write to Mr. Wilsey and inform him of these findings. Thci:l,Pson are the onl,. two interes ted parties. The Council agreed not to aooept bids and authorized Atty. Co~tney to send a registered letter to Mr. Thompson offering for sale a strip of this lot measuring 10ft on Sandeen Boad and narrowing down to 2 ft. on the lakeshore for the price of $100.00, and to request a decision from Mr. Thompson within two weeks. The drainage easement on this property was discussed and it was decided that a five ft. easement from each divisiOn be retained by the Village. . TrUstee Crepeau moved, seconded b,. Trustee crepeau stated that this constant~enf.orcement is neoessary because of the oongestion at the beach oausing emergency vehicles problems. . REPORT OF CLERK LORRAINE STROMQUIST Crystal Avenue - Sewer Connection Clerk Lorraine Stroraquist read a letter, dated JurA 22, 1964, from Engr. Lund whioh stated that the property desoribed as Lot 13, Block 2, Shorewood Hilla, was oonsidered a non-buildable lot, at the time of sewer construct lon, as the slte was low snd ~ampy and a dralnage ditch was orossing the proper~J therefore, no service was provided for this lot. Later the owner installed a drainage pipe line and filled In the lot and now 1l!I having a home cODl.ltt'ucted on 1t. Pfeilsllcker, 1431 Arden Plaoe. whlch thanked the Council for thelr oonsideration in the matter of the Weigele garage matter. They also informed the Council that the garage is stl11 inoomplete. and they have heard that the Intention of Mr. Beigele is to enlarge the struoture to a two oar garage aga1n when the Pfeilsticker's sell the property. Trustee Crepeau moved that the letter be plaoed on tl1e; seoonded by Clerk Lorraine Stromquist; motion oarried. BOARD OF MPRALS RECOMMENDATIONS . Kachel Side Lot Varianoe Trustee Netherout moved to aocept the reoommendation of the Board of Appeals and grant a side lot varianoe to Warner Kachel, 2002 Stowe Avenue, to oonstruct an additlon of a breeze=way and garage , to hls exlsting house; this would result in a slde lot distance of 7 ft. instead of the required 10 fto This variance granted subJeot to Mr. Kachel obtaining written permission from the proQ perty owner adjaoent to his lot on the west side. VILLAGE OF ARDEN HILLS COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION AUTHORIZING CERTAIN WATER MAIN CONSTRUCTION BY THE VILLAGE OF ROSEVILLE IN ARDEN HILLS, AND AUTHORIZING CERTAIN CONNECTIONS FROM ARDEN HILLS TO ROSEVILLE WATER SYSTEM WHEREAS, the southerly boudary of Arden Hills abuts on the Village of Rosevi11e, and it consists in part of County Road D and Glen Hill Road, and WHEREAS, by letters of June 18, 1964 and June 26, 1964 the Village Administrator of the Village of Rosevi1le has requested permission from Arden Hills to construct certain water mains in County Road D and Glen Hill Road within the boundaries of Arden Hills, and has offered to permit connection to the Rosevi11e water system from property in Arden Hills abutting on said water system along County Road D and Glen Hill Road, and WHEREAS, the Council of Arden Hills is willing to grant said permission upon the terms and conditions hereinafter set forth, NOW THEREFORE, BE IT RESOLVED by the Council of Arden Hills as follows, to-wit: (1) Permission is hereby granted to the Village of Rosevi11e, its contractors, agents, and employees, to construct, maintain and service water mains with the necessary appurtenances thereto in the portions of the public streets known as County Road D and Glen Hill Road included within the boundaries of the Village of Arden Hills, it being understood that said water mains will be located within the boundaries of Arden Hills substantially on Glen Hill Road between Snelling and Ham1ine, and on County Road D between Fairview and Wheeler. Said permission is expressly conditioned upon said installation, maintenance and service being at the sole expense of the Village of Rosevil1e, and upon the further condition that the necessary restoration of said public roads within the Village of Arden Hills shall be promptly performed at the expense of the Village of Rosevi11e after completion of the - 1 - - . . installation of said water main. (2) Permission is hereby granted to the owners of homes or businesses in Arden Hills located upon property which is immediately adjacent to and abuts upon County Road D or Glen Hill Road to connect to the Roseville water system as constructed within said public roads. In each particular instance where such a connection is desired by a property-owner in Arden Hills, applica- tion for a connection permit shall be made to the Clerk of Arden Hills, and the Clerk shall determine whether the property which is the subject of the application is an abutting and adjacent property within the terms of this Resolution, arid the Clerk shall further determine whether Roseville has entered in to an agreement with the applicant to permit such connection. (3) No such connection application shall be approved by the Clerk of Arden Hills until the Village of Roseville has advised the Clerk thatit has entered in to an agreement with the applicant for the furnishing of such water service from the Roseville water system. (4) Permission for property-owners in Arden Hills to connect to said Roseville water system is given upon the express understanding, as set forth in the letter from the Roseville Village Administrator dated June 26, 1964, that water will be furnished and sold to property-owners in Arden Hills from the Roseville water system upon rates and charges similar in all respects to similar rates and charges made by Roseville to property-owners in the Village of Roseville. (5) No connection to the Roseville water system from property within the Village of Arden Hills shall be permitted by Roseville until a permit therefor has been issued by Arden Hills, signed by the Clerk of Arden Hills, in accordance with the terms of this Resolution. (6) This Resolution shall be in full force and effect from and after the date of receipt by Arden Hills of a Resolution by the Council of Roseville approving the terms and conditions that are contained herein and accepting the permission contained herein subject to said terms and conditions. - 2 - . - ~ .
