Minutes or Regular Council Meeting Village of Arden Hilla June 6, 1964 Mayor Kennedy called the meeting to order at 6:00 p.m. Roll Call: Present - Mayor Kennec1y, Trustees Crepeau and Olman. Clerk Lorraine Stromquist Absent - Trustee Nethercut Also Present g Village Atty. Courtney, Engineer Donalc1 Lund and Clay Kelley, Building Inspector. The minutes of the Regular Council Meeting of May 25. 1964 wen approved ss submittedo . Sewer Connection - 5459 Siems Court Mrs. Leon Sabine, 3464 Siems Court, was present and requested that the house she owns at 3459 Siems Court be allowed to use its present sawer facilities and not connect to the sanitary sewer system. She informed the Council that she has reoeived a minimum estimate of $725.00 which would not include a guarantee of satisfactory perform- ance; it would cost about $500.00 more for a system that would give any assurance of satisfaction. Mrs. Sabine informed the Council that they may build a new home on this property and the new house house would be so located as to receive service without any problems. Mayor Kennedy stated that he did not believe that the Counoil has the authority to grant this request. Matter referred to the Village Atty. Rezoning Request. - Tr~steeCrepeau moved that the request of Mr. John Daubney, who was present, to rezone property from Commercial to Industrial and dSSg cribed as follows: All that part of the W 250 ft. of the SE t of the SE t of Section 27, Township 30. Range 23, lying southerly of the Minneapolis. St. Paul and Saulte Ste warie Railway right of way, except the south 243 ft. thereof, be granted, subject to the approval of the Village Attorney, and if approved by the Atty., authorized the Atty. to make the necessary arrangements for a Public Hearing on the rezoning for June 29, 1964. 8:00 p.m. at the Village Hall; seconded by Trustee Olmen} motion carried. The Building Permit for the proposed building on this site will be considered by the Council at the meeting of June 29. 1964. Request to Move House Trustee Olmen moved to accept the recommendation of the Planning Commission and deny the request of the W. F. Stepnitz Co. to move theWm. Zilliox house, 126l W. County Roed E.. 100 feet north of its present site; seconded by'Trustee Crepeau} motion carried. Reason for denial being that this house is and would still be a non~onforming use and would be surrounded by commercial and indus~ trial activities. Uniform Bullding Code As reootllll1en<led by the Planning Cajmission. Clerk Lorrlline StromqUist moved tbat the Uniform Building Code be re~erred to Atty. Uniform BuildinR Code (cont'd) The Planning Commission reported that they would come forth with recommendations concerning amendments. Mayor Kennedy stated that the Council would have to oonsider fees and procedures to be included or amended. Red Fox Road Mayor Kennedy read a letter. dated May 27, 1964, from A~. and Mrso Boss, 1315 Red Fox Road, in which they stated their concern of the future construction of Red Fox Road, which might be constructed too close to their home. Mayor Kennedy offerec1 to telephone Mr. Boss and explain that the present Council and Planning Commission will be most considerate regarding the construotion of this road so as not to interfere with their living, but could not make a oommittment for future Councils or Planning Commissions. Butane Tank Problem Trustee Crepeau reported that he and Lt. Pat Sexton, Fire Chief Ehlers and Bldg. Inspector Clay Kelley had inspected the exposed butane tank at the rear of the Wilsey residence, 1178 ~iller Lane; this tank faoes Carlton Drive. Fire Chief Ehlers thought it coo= stituted a hazardous condition and all agreed that it was unsightly. Several property owners of the area were present and expressed their desire to have the tank moved so it would not be seen from Car 1 ton Dri ve. Trustee Crepeau informed the Counoil that he had talked with Mr. Wilsey and Mr. Wilsey has offered to screen the tank for esthetio reasons, end would move the tank if it is in violation. Trustee Crepeau moved that the matter be referred to Atty. Courtney and requested Building Inspector Clay Kelley to acquaint the Atty. with the facts ooncerning the matter; seoonded by Trustee Olmen; motion carried. . Vessey Gara,e Matter Clerk Lorra ne StromqUist read a report, dated May 30, 1964, from the Board of Appeals, whioh stated that it would, at this time, be willing to grant svarianoe to the building oode to allow Mr. Vessey to build a garage on property adjaoent to his home, if the Village is willing to sell Mr. Vessey all or a portion of this lot. As recommended by the Board of Appeals, the Council requested Atty. Courtney to again write to Mr. Thompson regarding his interest in purchasing a portion of this lot to give the Thompson home the re~ quire6 side yard setbaok. Request to Purchase Village Owned Lot Clerk Lorraine Stromquist read a letter from Mr. Wm. Binger. 1802 W. COtlnty Road D., which requested the Village to allow him to buy Lot l~\, Auditors' Subdivision No. 80 (same property as disoussed aboveLn the Vessey matter). Mr. Bingel' also submitted proposed house tlnd site plans for this lot. Mayor Kennedy stated that he does not believe a variance should be allowed to permit the construotion of a house on this lot as it measuref' only.50 ft. on Sandeen Road, 12 l/2 ft. on Lake Johanna and is 1.84 ft. deep. Atty. Courtney informed the Counoil that possibly bids might have to be talcen on the sale of' this lot sinoe more than one buyer is interest.~d. Matter rE'ferred to Atty. This could possibly be ~ ~esult of the lift station near the site not operating properlr~ However. both times the pl'ob;Lem was reported. Mr. Nixon stated that the station was alright. Matter referred to Trustee Olmen and the Village Engineer. Mr. Nixon also informed the Council that the red light on the lift station which is supposed to light when trouble occurs. has never been connected. Perry Plat I.J1ck Jones was present and informed the Council that he had contacted Banister Engineering regarding the sewer and road work in the Per~ Plat. Engr. Don Luac1 submitted the followingtigures: Street Bond - .3.890.62; Sewer Bond - $3.572.50. Trustee Crepeau moved that final approval be given the Perry Plat, subject to the approval of Trustee Nethercut and the Village Atty.; seconded by Trustee Olmen; motion carried. Bethel College Dra1nap;e Problem Clerk Lorraine Stromquist read a letter, dated June 5, 1964, from Engr. Don Lund which recommended approval of the drainage plans, dated ~flb. 12, 1964. for the Bethel College dte. Council decided to witnnolc1 approval of these plans until the submission of the building plans for Bethel College. Sewer Service - 3456 Siems Court ~lerk Lorraine stromqUist read a letter, dated June 5, 1964. from Engr. Lund, which informed the Council that Engrs. Lund and Short met with Wally Hermes, Rosetown Sanitation, and a representative from the Peter Lametti Construction Co. It was decidec1 that the main sewer line was too high for service and an agreement was reached whereby Mr. Hermes woulc1 lower the line and would be paid by Lametti Construction Co. Erosila Problem - Ridgewood Road C.Lerk Lorraine StromqUist read a letter, dated June 5, 1964. from Engr. Lund concerning an erosion prOblem in the drainage ditch north of 3l6l Ridgewood Road. Said letter informed the Council thBt the culvert was plugged with debris and the ditch showed signs of erosion which could possi~ly under.mine the bituminous blacktop road. Matter of cleaning out the culvert referred to RBed Nilllon. The matter of correcting the ditch problem was ~eferred to Trustee Olmen for a cost est1rr~te. Clerk requested to send Trustee Olmen a copy of this letter. ~idg~.OOd Court Road Problem ngr. Lund reported that the "bird bath" on ltidgewooc1 Court would requ',re a grade change to correct. Trustee Crepeau moved that Banister Engineering Co. be authorized to prepare plans and speci- fioations and also to obtain a cost estimate for the repair of the "bird bath" area and also the repair of Ridgewood Road near the 11ft stationl seconded by Trustee Olmen; motion carried . The C(lunoil suggested that the Oak Avenue Improvement contractor might consider doing this repair work. Lakeshore Place J:!;ngr. -wnd informed the Council that a rough estimate for the construotion base and surfacing of Lakesbore Place would be about $5.50J.ooI this would include correcting the drainage problem. Clerk requested to notify the affected residents of this cost estimate. - oontinued - . . Control Data Draina~e Gl'er,k informed the ounoil that Enp:r. ROlter Short had called and reported that no progress has been made oonceming the drainage problem from the Control Data constructioD. Cummings Lane Sewer Clerk also reported that Engr. Roger Short stated that he believes the sewer on Cummings Lane oould be installec1. Engr. Lund informed the Council that the State has easement rights until Dec. l. 1964, but suggested that the property owners could request the State to give up this easement at an earlier date. Clerk offered to consult with the property owners to ascertain it they desire sewer this year. . Wesslund. 3167 ~hor.l1ne Usne. has informed Mr. Kelley that he has two bids for the construction of the required retaining wall and the wall 8hould b.~ompleted about the 15th of June. lloberts' Warehouse Building Permit Mr. Kelley informed the Council that the building plans for the warehouse to be built by Roberts Construction Co. have been approved and oonstruction has begun. ~nacas t. Inc. . Kelley infonned the Counoil that Dynacast. Inc. hnA moved into their new building on Lexington Avenue. Mayor Kennedy requested Mr. Kelley to ask them to remove the oonstruction debris around the building. . Temporary Chairman - Board of Appeals Mr. Kelley was informed thet Mrs. G. Harmon is the temporary chair- .IIIan of the Board of Appeals. while Mr. Schmaedeke is vacationing. Hemline Avenue Traffio Trustee CJ:'epeau in.formed the Counoil that the traffIo on Hamline Avenue had been obecked by radar at various time intervals, fo~ a total of 8 hours, and there were only two speeding violators.
