Clerk raaa a letter, dated March 4, 1904, from Dorsey, Owen, Marquart, Windhorst and West, which proposed a transfer of sssots of McGui~e's Liquors, Inc. to Truck Grane Service Co. Atty. Courtney informed the Council this transfer would require new liquOt' license applic~tions, changing of the bond and notification to the Liquor Control. He also stated that accol'di,ng to Village Ordinance there is a $100.00 fee to change the on-sala and also the off-sale licenses. Clerk requested to send applications to McGuire's Liquors, Inc. Villsge liall Improvement Contract On recommendation of Atty, Courtney, Trustee Nethercut moved thE,t the Mayor and Glerk be authorIzed to sign the contract for the Village Hall Improvement in behalf of the Village; subject to the bond being properly e~eouted and the obtaining of an additional certificate of insurance to cover the period beyond April 1, 1901; seconded by Trustee Crepeau; motion carried. ENGINEER I S REPORT Sewer Gas ~roblem - 1475 Skiles Lene l!:ngineer Lun(l Inl'01'llled the Council that he again chs!\ked the manuol" behind thh residence snddetected only the normal amoUrlt of gas odor; he also discussed this problem with other enginears at the Banister office. As recou~ended by Engr. Lund, the Council requested the Cleri( to write to Mr. Mol'lamee, the owner, and request that the vent pipes from his hame be raised to attempt to eliminate the pro- blem before any fUrther study is made. BUILDING INSP~CTOR'S REPORT Clay Kelley, Building Inspector. informed the Council that he has received many calls aoncerning the construction of epartment build~ ings near Control Data. Trustee Nethercut will alert the Planning Commission of these requests. TRUSTEE CRE1-l!:P.U'S hEPORT Dog Complaint Trustee Crepeau reported that the dog complaint as registered by MI'S. Melgren, 1420 W. Highway No. 96 has been satisfiod. Complaint on Radar. Us 0 Trustee Crepeau read a letter he had written to Mr. Donold Duncan~ 2 Chipmunk Lane, Nnrth Oaks, in reply to a complaint on using radar at Ramlins Avenue and Highway No. 51. Junked Cars Problem ~~stee Crepeau stated his concern about junked cars in the are~. Atty. Courtney stated thBt this problem could possibly be 00 ntr'o11ed under the Nuisance Ordinace as detennined at a previous study of this prOblem. Clerk requested to find the sample ordinances as submitted by the attorney some time ago. Tax Forfeited Land Clerk Lorraine Stromquist read 8 letter, dated Feb. 26, 1964, from Mrs. Hallie Wannamaker. Secretery for the Public Welfare Committee. recommending that the tax forfeited land on the north sIde of Lake Johanna not be purchased for recreational purposes. Trustee Nethercut moved the. adoption of a resolution, as attachedg authorizing the County to sell two parcels of tas forfeited lands located in Arden Hills; seconded by Trustee Crepeau, motion carried. Midway 5-3927 Village of Arden Hills Page Two been several interpretations of the recent changes made as respects Liability of political sub-divisions in Minnesota made bv the state legislature in 1963. Our insurance compa-des "ave interpretated these changes to require Bodily Injury limits of $50,000 eacl, person, ~300,OOO each occurrence for Automobile and General Liability; Property Damage limits of ~300,OOO each occllrrence and $300,000 aggregate for both Automobile and General Liability. In view of the above, I WOll'd suggest P,at the Bodil y Injury limits remain as is as they are more than satis- factory, and the Propertv Damage limits for Automobile and General Liability should be increased to ~300,OOO eac" occurrence with $300,000 aggregate. This would bring the policv in line with the limits required as well as amending the wording from per accident to per occurrence for Property Damage. The additional premium would be approximately ~75.00 per year. The present Comprehensive General Liability coverage p~ovides protection for the village for any activity necessary in the conduct of village business which would include the planning commission, voting committees etc. The policy would not provide any coverage for the individual as tl'ev would obtai n it from their own person- a~ I ialrl'itv insurance. In most cases the primary I iabil ity would no doubt falJ upon the viI! age, and coverage would be obtained through your policy. As respects accidents on village owned playgrounds, the Comrehensive General Liability Policv provides coverage on all properties owned by, leased to, or used by the village or any recreational use. and the Cllrrent po'icy includes coverage for one (I) park at this time. If additional park areas are obtained or leased or used during the policy period, coverage is automatic and the premium is charged at the end of the policy period. .. , . , . Whether the contract hetween Lake Johanna's Fire Department and the village impf'ses any Contractural Liability upon the Village of Arden Hills could be rletermined by reviewing the contract. Accorrling to Mr. Ehlers, it is his intention to assume liabil ity for the complete operat ion of his department. wnRKIHf'N'S COMPENS."T!rN INSUl],~NCE The pf'licy now written to cover employees of the village prf'vides statutf'ry coverage and benefits for policemen, clerical office. civiJ defense, street cleaning, and any other municipal employees. The Workmen's Compensation Act provides no coverage for elected officials, and there is no provision ff'r providing coverage for them at this time. !kcordingly, no charge was made in the final audit of the Workmen's Compensatif'n Policy for the year 1962 to 1963. The Employers Liability section of this policy provides ~25,OOO of coverage in the event an employee wishes to tf' refuse the statutory hen",fi ts of the Wf'rkmen' s Compen- sation Act and file a Claim for his injllries through common law procedures. In view of the new limits of Liability imrosed "pon' pf'litical sub-divisions as pre- vif'l1s1y f"entionerl, I would suggest that this 1 imits of Liahi'ity be increased to Slnn.oon. Hite WHH/sj n ./,.'" ./ STATE OF MINNESOTA COUNTY OF RAMSEY VILLAGE OF ARDEN HILLS RESOLUTION DIRECTING COMMENCEMENT OF CONDEMNATION PROCEEDINGS ON GROTTO CLUB . WHEREAS, on August 15, 1963, at 8:00 o'clock P.M., the Council of Arden Hills held a public hearing to detemine the advisability of condemning and demolishing certain buildings situated on the following land in Arden Hills, to-wit: Hackney Park Plat 2 subject to new boulevard and easements - the south half of old boulevard vacated adjoining and following part of lots 2 and 3, westerly of a line run from point on south line of and 20 feet from southeasterly corner of said lot 3 to point on north line of and 25 feet from northwesterly corner of said lot 2 and all of lots 4 and 5; also Hackney Park Plat 2 subject to new Johanna Boulevard - the south half of old Johanna Boulevard vacated and ad- joining and following east 20 feet of lot 7 and all of 6, and WHEREAS, said proceeding was initiated upon the basis of a written report by Clay Kelley. Arden Hills Building Inspector, dated June 22, 1963, advising that the buildings on the premises were beyond repair, were in a very hazardous condition, and should be condemned and demolished, and WHEREAS, said hearing was preceded by written notice by certified mail to the record owner of the property, which notice was duly received by the owner on July 20, 1963, and WHEREAS, at the hearing held on said date and place the owner of the property, Mrs. Margaret Arneson, appeared and was heard on the matter; that Mrs. Arneson made no objection to the demolition of said buildings and stated I that the buildings were a detriment to the property, and WHEREAS, the hearing was duly closed on August 15, 1963 and action thereon was subsequently postponed by the Council to permit the property owner to sell said property to a purchaser who would guarantee demolition of the buildings thereon, and WHEREAS, in the opinion of the Council more than a reasonable time has - 1 - ~ elapsed to permit said sale of the property, NOW THEREFORE, BE IT RESOLVED, that the condition of the buildings upon the aforesaid premises does constitute a public hazard, and the Village Attorney is hereby instructed and authorized to proceed forthwith with a court action to accomplish condemnation and demolition of said buildings, . with the entire expense of said proceeding and said demolition to be assessed against the above property, enforceable by sale as provided in Ordinance No. 16, known as the Building Code. BE IT FURTHER RESOLVED, that the Mayor and Clerk are authorized and directed to execute such papers and take such steps as the Village Attorney may deem proper and advisable to carry out the provisions hereof.
