Approval of MInutes The minutes of the Special Council Meetings of 2 October 1967 and 9 Novembe r 1967 were approved as submitted; the minutes of the Regular Council meeting of 13 November 1967 were approved as amended. Sale of Temporary Improvement Bonds Resolution Resolution read by Mayor Nethercut: the amount of the sale would In- clude Water Imrpovements 67-1 and 67-2, Sanitary Sewer Improvements 7 and 8, and Street Improvements 6 and 7. Councilman Crepeau moved the adoption of a Resolution providing for public sale of-temporary Improvement bonds, Series I, as per attached, date of the sale wi I I be 4 January 1968 at 8:00 p.m. ; seconded by Counc II man Bjorndahl; motion carried. BUSINESS FROM THE FLOOR Request for Christmas Tree Sales Counci Iman Crepeau moved approval of the request of Gerald McCauley, 1925 Jerrold Avenue, to store and se I I Christmas trees from his property through December 1967; seconded by Councilman Olmen; motion car"rled. -. Counci Iman Crepeau Informed the Counc II that this reque~t was also granted last year and there were no repurcusslons. REPORT OF ATTORNEY COURTNEY Water Meter Bids Atty. Courtney returned the four bids for water meters to Clerk Lorraine Stromquist with a letter, dated 27 November 1967, which explained the bids. He Informed the Council that he had rev I ewed the bldswlth Engrs. Short and Liebenow from Banister Engineering Co. Representatives from Power Process Equipment, Inc. and Badger Meter Mfg. Co. were present and commented on the bid forms. Atty. Courtney stated that he recommends the acceptance of the Badger Meter Mfg. Co. 's bid as it showed exactly what the village would be paying. Councilman Olmen moved the awarding of the water meter contract to Badger Meter Manufacturing Co., Mi Iwaukee, Wi s.; seconded by Council- man Bjorndahl; motion carried. Engineer Short to prepare the contract for the water meter purchase. -1- ::..., -' ..,. Regular COlJnci I r"inutes -2- 27 Nov. 1967 Arden Hi Ils-Rosevi lie Water Contract Atty. Courtney informed the Council that he received the latest version of the draft of this contract from Rosevllle late this afternoon. Atty, Courtney summarized the provisions of the contrect and noted changes from the 17 November draft. Counci Iman Crepeau moved the adoption of a contract between the village of ARden Hil Is and Rosevi lie relating to the sale,of water, " subject to minor typing corrections, verification of either $25.00 o~ $15.00 hydrant charge, and the approval of the contract by Rose- vilie and the city of St. Paul; seconded by Councilman Bjorndahi; motion carried. Atty. Courtney stated that this contract will not be valid until It is accepted by Rosevl lie and the city of St. Paul. He believed that Rosevllle wil I possibly act on this con~ract tonight. Library Site Councilman Olmen moved the ado;tlon of a Resolution, as attached, authorizing the conveyance of land to Ramsey County for library purposes; seconded by Mayor Nethercut; motion carried. Mayor NethlH'cli'!, reported that he and Counci Iman Olmen had transferred the deed to the Ramsey County Library Board this evening. The Board wi II take bids for the building in January and expect completion within a year. St. Paul Bible Colle~e Public Hearing Atty. Courtney reported that he wi II write directly to the Planning Commission concerning this matter. N.S.P. Co. Land Donation - Pedestrian Trai I ~ Atty. Courtney Informed the Council he has received two tltl88 from N~S.P. Co. concerning a 50' strip of land they propose to donate to the vi I lage for the pedestrian trail; however, he has not had time to examine these tj.IB:S,~. Councilman BJorndahl moved the adoption of a Resolution, as attached, accepting certain described property from N.S.P. Co. for a pedestrian trail, subject to examination of the titles by the attorney; seconded by Councilman Crepeau; motton carried. Lake Johanna Outlet Clerk Lorralne~tromqulst read a letter, dated 27 November 1967, from Engr. Lund which outlined a procedure for financing this project, as recommended by Mr. QuaYI~,~count~.Attorney's office; this would be to proceed under the JII t~~ - iltf. Matter referred to Atty. Courtney to meet with Engr. Lund and Mr. Quayle. Change of Councl I Meeting Date . The Council acted to hold the second meeting In December on Tuesday, December 26, rather than the scheduled Monday - Christmas night. REPORT OF ENGINEER LUND 1620 Oak Avenue - Culvert Request Clerk Lorraine Stromquist read ai<;tter, dated 26 November 1967, from Engr. Lund In reply to this request. Ensr. Lund does not believe a culvert Is the answer; he believes the driveway could be graded to the roadway. Engr. Lund reported he would have a survey made of the 9rada~ and report again to the Counci I. Jurgenson Preliminary Plat Engr. Lund reported he had received a copy of this plat and pointed out that some of the proposed lots are in the pondlng area. He expressed the importance to the village of retaining the right to use this drainage area as the fil Itng of this pond would greatly affect the proposed Lake Josephine drainage matter. Engr. Lund recommended the vi I lage negotiate with Mr. Jurgenson to keep this ponding area. Counci Iman Bjerndahl informed the Counci I that Councilman Hollenhorst Is well aware of the situation and it would certainly be considored. -2- Regular Council Minutes -3- 27 Nov. 1967 Rld!jewood Road DrainaQe Estimate Engr. Lund submitted the 1st and final estimate for the Lambros- Schacker drainage project in the amount of $2,306.00 payable to Rosetown Sanitation. ~Iate r Impr. 67-2, Estimate No. I Eng r. Lund submitted a change order regarding this project from the State Highway Dept. which requ I red relocating of the water main and the use of heavier pipe; this would add an estimated $4,617.50 to the cost of the improvement. Engr. Lund explained that the Highway Dept. would not approve the project unless this change order was approved. Engr. Lund Informed the Councl I that the change has been approved by the contractor and Engr. Hendrickson. Counc II man BJorndahl moved approval of Change Order No. I, Water Improvement 67-1, as attached; seconded by Councilman Olmen; motion carried. In response to Councilman Crepeau's Inquiry, Eng r. Lundwlil check the contract to ascertain If the contractor is required to sweep the streets which they have disturbed. Sewer Connection Time Extension - 1543 Oak Avenue Letter had been rece I ved from David Kublatowlcz, 1543 Oak AVenue, wh I ch Included a schematic of the conttructlon of the sewer line; a copy of this was sent to Engr. Lund. Letter stated that no service line was provided for his property; he also would I I ke to know who Is to be responsible for the returning the road and driveway to Its present condition after being disturbed by the sewer construction. Engr. Lund stated he had informed Mr. Kublatowlcz of this situation before he purchased the property; Mr. \Walter Mack, owner of the property at that time, determl ned that he wanted only one service line. Councilman Crepeau moved that David Kublatowlcz be granted untl I I ,1 una 1968 to connect to the sewer system because of the weather; seconded by Councilman Dlmen; motion carried. Counc I I authorized Engr. Lund to write to Mr. Kublatowkcz to explain the situation and also to inform him of the time extension. Sewer Time ExtensIon - 3459 Siems Court Clerk Lorraine Stromquist read a letter from Engr. Lund which explained that gravity service Is not available to this residence; he checked the site and was convinced that It Is not connected to the sewer . system. Councilman Crepeau expressed his opinIon that, due to the pollution of Lake Johanna, this house should be connected to the sewer, even if the village has to pay tOf' a pump, whiCh the vii lage had agreed to subsidize a few yea rs ago. There would be no street damage to make this connection. Councilman Crepeau moved that the house at 3459 Siems Court, owned by Leon Sabine - now I-esldlng out of state, be connected to the sewer system by I June 1968, after which time the Ordinance will be enforced; the vi I lage to pay an amount not to exceed $250.00 toward the pump purchase and the owner wI II be responsible for the maintenance of the pump; seconded by Tf'ustee Dlmen; motion carried. Council requested Engr. Lund to obtain costs for this pump and also to notify Mr. Sabine of the Councl I 's decision. Caretaker's House - Bethel Property Counc i I requested Engr. Invoices as fol lows: Inv. No. 3816 - $12,659.59 I nv. No. 3815 - 2,514.44 Inv. No. 3814 - 4,9'80.0U These are covered under the warranty; seconded by Trustee Oimen; motion carried, These will be shown on the December disbursement listing. ~sement No. 07-12 - Krannak Councilman Crepeau moved approval as recommended by Engineer and Attorney of payment of $750.00 to Steve Krannak for easement adjacent to Control Data property; seconded by Councilman Bjorn- dah i ; motion carried, REPORT OF COUNCILMAN HOLLENHORST - Planning (absent) Variance Request - Case No. 67-26 Councilman Crepeau moved approval as recommended by the Planning Commission and Board of Appeals of a request from RIchard Thrasher, 3200 Lake Lane, to I nsta II a 36" chain I ink fence; seconded by Councilman Olmen; motIon carried. REPORT OF COUNCILMAN CREPEAU - Safety Slqn Request - Skiles Lane The matter of having a "Slow, Chi Idren" sign Installed on Skiles Lane near Glenarden Court was referred to Administrative Clerk Lorraine Stromquist. Complaint Checked Councilman Crepeau reported that the Pollee Department had checked the property at 1353 County Road E' the owner owns about four lots , and the area appeared to be very neat. Some lumber on the property, which I s to be used next spring, was arranged wel I; the owner does own two trucks which he uses In his business and these are kept on the property. Mayor Nethercut suggested that since the Village did receive a complaint concerning a rat problem that a closer InvestI- gation be madeo Referred to Public Safety. REPORT OF COUNCILMAN BJORNDAHL - Parks and Recreation . Ska1"lnq Rinks reported that he has starj"ed Fred Nixon, Road Maintenance Dept., to flood the two Village rinks and they should be ready for skating by this weekend, Councilman BJrondahl stated that there are reports to be made to the State Conservation Dept. Informing them of the number of gallons being' pumped from Lake Valentine for the Valentine Park rink. REPORT OF COUNCILMAN OLMEN - Public Works Publ ic Works Committee Meetln~ Councilman Olmen reported that a meeting had been held on Wednesday, November 15. 1967. The Committee concurred with the Council's action to employ Wayne Brunette In the Water Department and recom- mended further training I f necessar'y; they also recommended that the Water Department be separate from the Maintenance Department. -4- . Regular Councl i Mil1ui"es -5- Nov. 27, 1967 The Committee determined that the recently purchased Vi I lage pick-up truck be equiped with studded snow tires and also a trai ler h !-tch. A speciai sub-committee composed of Public Works members has been appo!nted to study Mr. Nixon's sa~ary and equipment rental charges I for possible adjustment before the first of the year. Wa-rer Department The matter of personnel to i nsta II water meters In the Village was discussed. Rosevll Ie Is Installing the meters in the 67-2 improvement. Matter referred to Public Works Committee for study as there will be much more work Involved in the Water Department as the water Improvements progress through the Village. R~PORT O~ MAVOR N~TH~R~lrr Ramsey County Lea!1ue MeetlnQ Mayor Nethercut reported on the recent Iy held Ramsey County League meet- Ing during which a c I v i I rights open housing type ordinance was discussed, Although the state law a I ready covers the matters included in these ordinances, the speakers believed that the suburbs should show their dedication and Intent by adopting open housing ordinances and establishing H u ma n RI!1hts Commissions. Mayor Nethercut expressed be II et that the matter deserves serious consideration, especially on the Human Rights Commission. _ ..... -.-.-. Mayor Nethercuflnformedthe Council he has a copy of the Civil Rights OrdInance ot St. Pau! , which goes beyond the State Law in some cases. The State has authority to designate a Civil Rights CommIssion, If the municipalIty does not have one within a speci- fied time. He stated that the verbatIm minutes of this meeting shou~d be Interesting to read. Ramsey County Street Lighting proposal was on the agenda, but was not discussed because of lack of time. Zip Code Letter Letter from the postmaster regarding zip code use was referred to the Planning Commission. Haml Ine Avenue Street SIQns Worth Read, 3162 Hamline Avenue, informed the Council of the con- fusion ~aused by the dlsect!ng of Hamllne Avenue because of the freeway constructIon. He believes that the Hamllne street signs should designate the numbers It Includes, or one of the Hamline Avenues should have a different name. . REPORT OF ADMINISTRATIVE CLERK LORRAINE STROMQUIST Rodent PI-ob lam - County Road D and C i eve land Ave. Clerk read a letter from Rosevllle Village Manager Turnlund which stai'ed that the rats are no doubt coming from the adjacent pig farm, but this farm is voluntari Iy being phased out and should bo completely phased out by December 31, 1968; there Is no legal way to eliminate the farm. Clerk requested to so inform the com- p'lainants. Reapportionment Resolution~ Councilman Olmen moved, seconded by Councilman BJ~rndahl the adoption of Resolutions as attached relating to apportionment of assessments relating to sanitary sewer Improvements Nos. i, 3 and 6; motion carried. CO X '" 011 ~ . r m ~ ~ ~ I~~~~ ~ ~ ~~x41~ ~: ~ ~ r ~ ~ l~ ~ ~~~~ ~ ~ ~~x~ u,. - 1- .-- - - - ,- - - - 1- - - - x _ STATE OF MINNESOTA COUNTY OF RAMSEY VILIAGE OF ARDEN RILLS I RESOLUTION AUTHORIZING CONVEYANCE OF LAND FOR LIBRARY PURl'OSES WHEREAS, by Resolution dated June 19, 1967 the Ramsey County Public Library Board agreed to accept from the Village of Arden Rills the conveyance of certain land in Arden Rills, hereinafter described, and to construct a branch library on said site, and WHEREAS, Arden Rills has acquired the title to said land, which is described as follows, to-wit: Subject to roads, the Easterly 120 feet of the Southerly 363 feet of the Southwest Quarter (SW~) of the Northwest Quarter (NW~); and the Westerly 289 feet of the Southerly 363 feet of the Southeast Quarter (SE~) of the Northwest Quarter (NW~), all being in Section Twenty-eight (28), Township Thirty North (30N), Range Twenty-three West (23W), and WHEREAS, it appears to the Council of Arden Hills that conveyance of the aforesaid land to the County of Ramsey for library purposes is a worthy public purpose and will be particularly beneficial in the future to the people of Arden Rills, NOW THEREFORE, BE IT RESOLVED, that the Mayor and Administrative Clerk of the Village of Arden Rills are hereby authorized and directed to execute and deliver to the County of Ramsey, State of Minnesota, a warranty deed to the aforesaid property, subject to roads and easements of record and upon the additional condition that a branch library should be constructed .. upon said site within two years from this date or, if it is not constructed within said time, the property should revert to the Village; that said conveyance shall be without dollar consideration; that the proper officers of the Village are also authorized to deliver to the County of Ramsey the Abstract of Title to said property and to take such other and further steps as may be necessary to conclude this transaction, including delivery of a -1- ~ ..... .. - - .. . .. . certified copy of this Resolution if it be deemed necessary. The Village Council, pursuant to statute, has ordered, after public hearing, Water Improvements No. 67~1 and 67-2 in the estimated amounts of $630,250 and $62,,200. Pursuant to resolutions dated September 25, 1967 and October 2, 1967, the Council has received and entered into contracts on certain phases of said improvements as follows: Improvement No. 67-1 $291,484.85 Improvement 1-10. 67-2 $ 57,894.50 In connection with said improvements the village has incurred other expenses and will incur additional expenses as well as enter into other construction contracts pursuant to advertisement for bids. .. 2. The Village of Arden Hills is preparing to request bids on General Improvement Bonds to be dated January 1, 1968 and to mature January 1, 1971 in accordance with Minnesota Statutes, Chapter 429, as amended. Pending advertisement and sale of said bonds and receipt of he proceedS thereof, it will be necessary for the Village to receive temporary financing to cover the costs of construction already performed as certified to by the village engineer, Banister Engineering Company. . . 3. The Mayor and:he village administrative clerk are hereby authorized and directed to make and execute orders on the fund established for each improvement as contemplated by "''l.S. 429.091, Subd. 4, and to make and execute such Orders to the Village Treasurer for payments of authorized claims for the benefit of each improvement. Said Orders shall be drawn on the respective water improvement funds and to which there are hereby appropriated all of the proceeds of the bonds to be .. issued pursuant to statutory authority, and together with such other moneys as the Council may direct to be credited to said funds for the payment of items which by accepted accounting practice constitute attributable costs for the construction of each improvement. In the event that said Orders or any other Orders issued pursuant to the resolution of the Council for payment of claims for '.he benefit of each improvement cannot be paid from cash on hand in said fund on the respective dates of the presentation of said Orders, the Treasurer shall endorse on the back thereof the words "Not paid for want of funds", the date of the endorsement, and the Treasurer's signature. The Treasurer shall make a record of each such presentment, non- payment, and endorsement. Bach such order shall bear interest at the rate of 4.25 " per annum from the date of such present- ment until paid. 4. The Village has received a proposal from the Pirst National Bank of Saint PaUl, St. Paul, Minnesota, to purchase Orders issued pursuant to this resolution at the principal amount thereof, upon assignment of such Orders by respective payees to said bank. The Treasurer is authorized to so advise such payees. When sufficient moneys are appropriated and credited to said fund pursuant to further resolution of this Council, from the proceeds of sale of bonds or otherwise, for the payment of one or more of said orders, the Treasurer shall serve written notice upon said bank and to any other payee or assignee of such orders who has requested such notice, that he is prepared to pay the same, and aftu service of such notice, interest on the orders so endorsed shall cease. Said orders shall be paid only in order of presentment and registration thereof. 5. The Village Administrative Clerk is directed to furnish certified copies of this re.olu~ion to said bank and to the payee of any Order issued pursuant hereto.
