Present - Mayor Nethercut, Trustees Crepeau, Bjorndahl and Hoi lenhorst Absent - None Also Present - Village Attorney Vincent P. Courtney, Village Engineer Donald Lund, Village Treasurer Worth G. Read, Building Inspector Clay Kelley, Administrative Clerk Lorraine Stromquist and Deputy Clerk Florence Honan. Approval of Minutes The minutes of the Regular Counci I Meeting of September II, 1967, and the minutes of the water hearing for Improvement No. 67-1, held August 29, 1967, were approved as submitted. REPORT OF ATTORNEY COURTNEY Ramsey County Library Attorney Courtney reported he has a map of the property to be conveyed to Ramsey County Library Board; however, this map shows a strip along the southern boundary, 43 feet wide and 400 feet long, which has already been conveyed to Ramsey County A portion of this strip has been used for County Road E2. Attorney Courtney Informed the Council that the mlltters he questioned regarding the title have now been satisfactorily checked as reported In his letter of September 25, 1967. Engineer Lund assured the Council that the area is 3 acres outside of the right-of-way; a survey of the property would show this exception. As recommended by Attorney Courtney, the Council authorized Attorney Courtney to close the transaction with Bethel Baptist Conference Friday, September 29, 1967. Lambrqs Drainaqe Matter _~ Attorney Courtney reported he had written a letter, dated September J 2. 1967, to Eng i neer Lund, in wh I ch he recommended cons i derat Ion of other drainage problems on lake Johanna which would Involve other municipalities; he felt a policy should be adopted. Council referred the matter to Engineer Lund for a report. Engineer Lund stated that Shoreview has already agreed to participate finllnclally. Vii laqe Hall Parklnq Lot AttorneyCourtn0Y submitted to Clerk Lorraine Stromquist four copies of the signed and sealed contract between Hennepin Blacktopping Co., Inc. and the Village. '. Firemen's Benefit A~ciation. Inc. Clerk Lorraine Stromquist informed the Council a cheek had been received from the State of Minnesota in the amount of $4,859.30 which is to be re-Issued by the Village to the Lake Johanna Volunteer Firemen's Rei ief Association, Inc. The financial report of the association was also submitted as required by law. Financial report given to Attorney Courtney for his oplnJon. REPORT OF ENGiNEER LUND Bethel Colleqe Revised~wer Rate Trustee BJorndahl moved, as recommended by Engineer Lund, that the Arden Hil Is supplemental sewer charge for Bethel College be revised to include the three apartment bulldi~gs for student housing; this amount to be $304.80 plus the annual charge of the three inch meter of $51.00 for a total Arden Hills charge of $355.80; seconded by Trustee Crepeau; motion carried. -1- Larson-Schacker Draina~e Matter Engineer Lund Informed the Counci' that the Warren Larsons, 3161 Ridgewood Road, are agreeable to delay construction of their driveway until after construction of the water main. REPORT OF B~ILDING ,NSPECTOR CLAY ~.llEY Unfinished Buildin~ Mr. Kelley reported thllt the exterior completion date for the John Canniff residence, 3964 Glenview, was September 24; However, much progress has been made and will take only about three weeks more to complete. He recommended a 30 day extension. . Trustee Hol lenhorst moved that John Canniff be granted a 30 day ext~nsion to complete the exterior of his residence; seconded by Trustee Olmen; motion carried. Mr. Kel ley Informed the Council that condemnation notices had been served for the properties at 3155 and 1624 Lake Johllnnll Boulevard, and he hils received several calls on these matters. Attorney Courtney informed the Council that correction must be started within 48 hours after serving of the notices. Clerk reported that the attorney for Bernice Beckler, owner of the property lit 1624 Lake Johanna Boulevard, has requested a two- week delay. Mr. Kelley stated thllt the property Is hazardous and especllllly so because of Its proximity to the Ramsey County picnic area and entrance to the building is easily accessible. Trustee Crepeau moved, seconded by Trustee Hollenhorst, that the request for a two week delay be denied; motion carried. WATER IMPORVEMENT NO. 67-1. Project No. I BIDS Engineer Roger Short, Bllnister Engineering Co., submitted the nine (9) bids received for this project to Clerk Lorraine Stromquist and submitted copies of the tabulation of the bids to the Clerk and Councl I. Tne Engineer's estimate of the bid was about $320,000. Bids received ranged from $291,484.85 to $362,860.00. Mr. Short stated thllt the booster station and the wllter tower Is not Included in this bid. Engineer Short enumerated several projects satlsfllc- torily done by McDonald and Associates, Inc., and recommended they, as low bidder, be awarded the bid. Engineer Short will send II copy of the previously proposed comtract from Roseville to Attorney Courtney, who will work with Rosevllle on this matter. . Trustee Oimen moved the adoption of a Resolution, as attached, awarding the bid for Water Improvement No. 67-1, Project No. I to McDonald and Assoc., Inc. for the amount of $291,484.85; required completion date as stated In the specifications to be December 31, 1967; seconded by Trustee Bjorndahl; motion carried. Engineer Short informed the Council that Rosevii Ie hilS an 8" dual meter which they wll I rent to Arden Hills for a nomlnlll charge; this would el imlnate the necessity of Arden HII Is purchasing this expen- sive meter which would eventually be inadequate. Mr. Jurgenson, 1301 Cannon Avenue, was referred to Engineer Short to check the location of the water mains. REPORT OF TRUSTEE HOLLENHORST No. report. RF.PORT OF TRUSTEE CREPEAU First Aid Meetl~ Trustee Crepeau reported that he and the police officers attended the Minnesota Rescue and First Aid Meeting held at the Twin City Arsenal last Saturday and Sunday. -2- REPORT OF TRUSTEE BJORNDAHL . the 1961-68 Season a report on this season's skating facilities HIQhway 51 - comblnlltion hockey rink and free skating. free skating only; this rink will be lighted with 4 to 6 lights - the same as lit the County Road E and Highway 51 rinks. The warming house which was previously used at Lake Johanna will be locllted at this site. None. It was determined that lake Ice Is too costly to maintain. Trustee Bjornd~hl reported that Dr. Witter, Superintendant of Mounds View School District 621, has informed the Village that 1"he site at the Lake Johanna Junior High School, which Trustee Bjorndllhl has requested conslderlltion for a free sklltlng rink, will be used for a second hockey rink. However, Dr. Witter offered his cooperation on another site, if Trustee Bjorndahl so wishes. This matter will be pursued by Trustee Bjorndllhl. SkatlnQ Facilities for Trustee Bjorndahl gave as fol lows: County Road E and Valentine Park - Lake Johllnna - NotificatIon of Absence Trustee Bjorndahl informed the Council that he will be unllble to attend the next Council meeting. Lake Josephine DrainaQe Ditch Trustee Bjorndahl reported on the meeting held with the residents concerned with the drainage problem at Fernwood and Ingerson Road lellding into Lake Josephine. Engineer Lund and Trustee Bjorndahl attended this informational meeting. The residents presented an entirely different plan than the one proposed; the feasibility of this new plan was referred to Engineer Lund. If Engineer Lund gives a favorable report, the legal pl-ocedure of another public hearing wi I I have to be followed. REPORT OF TRUSTEE OLMEN . Trustee Olmen informed the Counc:il thllt Roseville requested that 1"he sewermeters be activated when the new sewer rate contract goes into effect. Council requested Clerk Lorraine Stromquist to check the status of this propc~ed sewer rate contract with Rosevllle. . Council authorized the meters to be activated Immediately under the direction of Engineer Lund; referred to Clerk Lorraine Stromquist to check with Engineer Lund. Publ ic Works Committee Mayor Nethercut proposed strengthening of the Publ Ie Works Committee and asking them to study in depth, the problems relating to Public Works. He requested a recommendation from the Engineer on the subject. Special MeetinQ . The Council agreed with Engineer Short's recommendation that a meeting be held with Mayor Nethercut, Trustee Olmen and any of the Council available, representlltion from Banister Engineering Co., and Robert McNiesh from the Public Works Committee, to discu~s procedures re- lating to the water Improvement. Clerk Lorraine Stromquist was re- quested to arrange this meeting within the next two weeks. Water Contract and Ordinance C'ounc j f'auth'or j zed Attorney Courtney to work with Rosev III e on a Water Contract. REPORT OF MAYOR NETHERCUT Kostohryz Variance Request Mr. Kostohryz stated that It took four years to obtllln this property; It is a very unusual piece of land. He hilS consulted with mllny architects both in and out of the Vii lage. He proposes to build on Lot 4 and portion of Lot 5, and this is the property for which he Is requesting the variance. He Informed the Council he has gone through the deed restrictions and bel ieves the origInal developer anticipated a bui Iding problem on certain lots, including these. He pre~~~ted a copy of a portion of the deed restrictIons to the property which he hel ieva!, substantiates his bel ief, to the Council. -,,- Mr. Kostohryz believes this property could be sewered without a lift station. He stated he had reached an agreement with Mr. Blomquist regarding the purchase of the lot between them, but negotiations have fallen through. Mr. McGuire, architect for Mr. Kostohryz, stated that he had checked the property before commitment with Mr. Kostohryz; the house was planned considering the surroundings. He quoted a portion of the Ordinance regarding reasons for granting variances. . Mr. Smith, Attorney for Mr. Blomquist, put Into perspective the proposals and objections, regarding Lots 4,5 and 6. At present there is no agreement between Kostohryz and Blomquist regarding the purchase of the adjacent lot, which Mr. Blomquist considers buying as a buffer zone. This mlltter is stili being negotiated. Mr. Smith believes the Council should be I. looking at two variances - present and the future of the lldjacent lot. 2. The Planning Commis- sion and the Board of Appeals should have studied the problem In perspective, not as a buffer zone, but as two vllriances, and 3. Is the proposal the only solution to the problem? The garage position should have been explored. He requested the Counci I to consider the problem In perspective and determine whether the parties could solve the problem between them; the Council should give the mlltter more time for sonslderation. Mr. Blomquist stated he Is attempting to reach a solution without burdening the CounCil; he does not intend to buy for speculation, but would landscape the area to minimize the difference in set-back. A second variance In the future Is of great concern to him as It would certainly devaluate his property. Howard Erickson, President of the Island Belich Club, believes the request Is for too grellt a variance to be grllnted. Mr. and Mrs. Alvin Falteisek stated that thay believed there should be a compromise, which Mr. Kostohryz hilS not attempted to do. They believe the requestor of the variance should make some concessions. Trustee Olmen informed the Council that he had looked over the site llnd believes the garage could be set farther back; It appears the neighbor to the north drives in from Rldgewood Road and he believes Mr. Kostohryz could also come in from there. Mr. Kostohryz stated he does not own property on Rldgewood; there- fore has no access there. He believes a lot 125' x 250' is enough property to build a house. . Mayor Nethercut stated that he had looked at the site with Mr. Kostohryz llnd Trustee Crepeau, and, at thllt time, felt there was no problem if that lot were the only consideration, but the possibility of a second lot future variance request creates a problem. He believes Mr. Kostohryz should compromise some because of the adjacent lot - some agreement should be reached regarding this. Trustee Crepeau expressed that he felt this way too. Mayor Nethercut stated the Planning Commission felt the proposed placement of the garage Is the best solution. Trustee Hollenhorst reviewed the Planning Commission's recommendation, but felt he could not agree with the present propoSlll. Trustee Hollenhorst moved the matter be postponed until llnllgreeable pact can be reached between the parties Involved; seconded by Trustee BJorndahl; motion carried. Mr. Kostohryz Inquired as to what variance would be granted for the property in event no pact was reached, and what procedure would have to be followed If changes were mllde In his present proposal. Mayor Nethercut replied that any significant changes would necessi- tate appearing again before the Planning Commission. -4- . . REPORT OF AD~INISTRATIVE CLERK LORRAINE STROMQUIST g~Lat~LL Area in New Brighton Clerk Lorraine Stromquist reported that Manager Schaefer of New Brighton clllled to inform her that there will probllbly be no early solution to the cleaning up of the Gladltsch property and the proper1"y to the north of this site, but he will continue to pursue the ma1"ter. He doubted If the rats were coming from this arell as there is not food eVllilable for them there. Council requested CI.rk 1"0 request New Brighton to have their Helllth Officer check the area. Sewer Connections Clerk Lorraine Stromquls1" referred to a letter, dated September 7, 1967, from James Lombard, 1600 Oak Avenue. (copIes of this had been distributed to the Council.) Mr. Lombllrd requested that his resi- dence end also the John Bachmlln residence, 1608 Oak Avenue, be granted a two-year extension of 1"ime 1"0 hook up 1"0 the sewer system. He explained that each of them had installed more than adequate systems, anticIpating that It would be some time before service would be avail- able to them. Trustee Crepeau expressed his thought that these homes are possibly draining In1"o the Johanna Gralnage area. Trustees Crepeau and Dlmen ~elieve that the home at 343; SI&ffiS Court, which had been granted an extension of time to connect is now connected. Referred to Clerk Lorraine Stromquist to check on this and also list others who have been granted extentions. Action was postponed on the Lombard-Bachman pending the Clerk's report on the existing extensions. Fiscal AQent Fees Clerk Lorraine Stromquist presented a letter, dated August 24, 1967, from Peter Popovich of Peterson and Popovich regarding fiscal agent fees connected with the water improvement bond progrllm. The fee would be on the same basis as previously charged for similar services In connection with bond issues or assessment proceedings. Trustee Crepeau moved, seconded by Trustee Dlmen, thllt the proposal be accepted In connection with the pending water Improvemen1"; mo1"ion carried. Varlllnce Request - Placement of Trailer Trustee Olmen moved approval of granting the Jos. Callahans, 1895 Jerrold Avenue, permission to pllrk a 19 foot trailer, d~lng the winter months, In their side yard Instead of the required back yard lls,thls site woulG be less obvious; motion carried. Request for Water Mrs. Paul, 2009 West County Road D, objects to paying Rosevllle the entire llssessment 111' one time as required b, Rosevllle; she feels Arden Hil Is Is now seriously considering the llvallablllty of water and these residents will have the option of having the assessment sprelld over a certain number of years. Mayor Nethercut felt Arden Hills could not do anything at 1"hls time llbout this situation; she would still have to hook up to Rosevllle regardless of an Arden Hills water system. There was some discussion of possibly servicing homes on Coanty Road D from an Arden Hills system by bringing the mains in from the north rather than Install- ing another main along County Road D. Matter referred to Engineer for possible Arden Hills hook up. Request for RIQht-of-way Vacation Mr. James Wingert, owner of Lot I, Block 3, Shorewood Hills No.6, requests the Vlllllge vaca1"e a short rlgh1"-of-WllY off Rolling Hills ROlld, which Is adjacent to his property. This right-of-way was originally planned for a road but has never been developed and does not seem feasible to be used as such because of the change In surround- ing area. Discussion followed regarding retaining anough of the rlght- of-way for a pedestrian walk In view of the proposed librllry site. Matter referred to the Planning Commission. -5- Phillips Service Station - Junked Cars Clerk Lorraine Stromquist reported that a representlltlve of the Phillips Petroleum Company has informed her by telephone that this station will be under new management and that the Junked cars lire being moved today. . SIQn Request Clerk Lorraine Stromquist Informed the CouncIl of a letter, dated September 15, 1967, from P. W. Mowrey, Twin Sign Company, requesting reconsideration of their sign request for a sign at the Phillips station at HighwllYS 96 and 35 W. No action taken at this time. Police Officer Resigna!l2n Trus1"ee Crepeau Informed the Council that James LaValle has resigned from the pollee force as of August 19, 1967. Bgdent Complaints Clerk Lorraine Stromquist reported that numerous complaints have been received concerning rats In the Cleveland and County Road 0 area. Matter referred to the Health Officer llnd Police Department. Mrs. Monte Arhart, 2014 Glenpaul Avenue, WllS the most recent complainant. She reported tha1" a large rat hlld bi1"1"en their dog; her husbllnd killed the rat. Officer Sexton was called In and referred the matter to the B. and E. Patrol. No report has been receIved to date. Mat1"er referred to Helllth Officer, Dr. Farkas. Clerk Lorraine Stromquist has a list of complalnllnts concerning this problem; Sergellnt Sexton felt the rats were comIng from the pig farm, and not from the dog kennel which many suspected.
