Pub!lc Hearlnq- Lake.Josephine Draineqe Ditch Mayor Nethercut reviewed requests from residents in the area over the past several years concerning possibie ditch Improvement. Reasons for requested improvement centered prlmari Iy around safety for smal I chi Idren and objections to stagnant water. Engineer Lund stated that the proposed project would cover about 250 feet of open ditch to approximately Ingerson Court and that pipe could be added, at a later date, extending to Lake Josephine. Cost is estimated at $4700.00, of which Ramsey County's share is about $570.00. if the balance were assessed to residents in the water shed area, this would amount to $52.20 per lot. Trustee Bjorndahl no"i"ed that this is a storm "ster drainage problem, and that the Vi Ilage has paid 30% .of the cost in simi lar projects. This would reduce the assessed cost to $37.00 per lot. R. Peterson-L I I 12 Carlton Drive, asked who instigated the project. Mayor Nethercut and Trustee Bjorndahl stated that the Council had instigated the proposal as a result of requests con~ernlng danger to toddlers and stagnant water which wus odiferous in hot weather. Attorney Courtney advised that in the past assessments have not been spread over less than 5 years. Mr. Peterson stated he was not necessari Iy opposed to the project, but was seeking additional information. Mayor Nethercut stated that the Council was not "pushing" the project; and if residents felt the need for further study or alternate salutions, this was agreeable. There was no reply to Mayor Nethercut's invitation for residents to speak in favor of the proposed project. Howard Haas, 1138 Ingerson Road, stated that the area residents did not feel that any individual would benefit from this type of Improvement, but were primarily interested in preventing possible drowning of toddlers. He also questioned where the responsibility would lie if a drowning occurred. '. Allen E. Beseth, 1201 Ingerson Road, questioned whether the pro- posed design wouid el imlnate sl It-buildup in Lake Josephine at the end of the ditch. After some discussion Trustee Bjorndahl moved that the Councit. adjourn the public hearing until October 9,1967; seconded by Trustee Hollenhorst; carried. Mr. Beseth expressed the gratitude of area residents to Council for its cooperation. Wrecked Cars at Phlli ips 66 Station R. McKenna, lessee of the station at Highway No.8 and Highway No. 96 stated that he stores wrecked cars until the owner or insurance companies pick them up or until they go to salvage. He does "cut up" some cars, has been unsuccessful to date in securing an industrial site where the wrecked cars could be stored. Attorney I. 2. BUSINESS FROM THE FLfCR . ~luniciD"i Water Mr. Casanova presented a petition from residents in the Stowe, Jerrold, Cleveland and Edgewater area, requesting that this area be included in a i967 Water improvement. Clerk Stromquist presented a similar petition from residents on Glenpnul Road. Mayor Netharcut noted that residents in Arden Hi lis 63 had presented a similar petition in July and that Banister Engineering had com- pleted a feDsibi I ity report on this area. Engineer Short has stated that the Arden Hi 1 Is 13 project could be completed before winter. Mayor Nethercut noted that at the resent Public Hearing, a large number of residents spoke in favor of an immediate water Improve- ment in populated areES of the Vii lage. However, with the excep- tion of the Commercial -Industrial Qrea and Arden Hi 115 113, It appears that construction could not proceed before the spring of 1968. Mrs. G. Harmon stated that she felt residents not in favor of immediute residential municipal water did not attend the recent water hearing. Trustoe Hollsnhorst moved approval of the variance request; seconded by Trustee Olmen; cartied. D. Kosto~ - Case 67-23 Trustee Hollonhorst reviewed the variance request, stating that the Board ot Appeals had recommended against granting ot the variance due largely to the petition for denial from residents to the south. He reported that at the Planning Commission meeting on September 5, 1967, Dr. Blomquist and M.. Kostohryz had discussed an agreement involving purchase of a "buffer zone' by Dr. Blomquist. George McGuire, architect for Mr. Kostohryz, reviewed the proposed site plan, stating th~t a 38 foot variance in front yard set back ~Ias r8~uested due to difffculty of terrain. Dr. A. Blomquist statod that the structure would be 42 feet in front of houses to the south, that he had a tentative agreement to purchase 0 buffer zone from Mr. Kostohryz for $2,000.00 (buffer zone to bo an unbuildablo site by privata agreement. This agreo- mant has not been consumated to date. He stated that Building Codes sre designed to establ ish the orderly development of property and quastloned whother the requested variance would weaken the code. Attorney Courtney advised the Counci I to Ignore the private agreement regarding the buffer zone In arriving at a decision. A discussion followed on possibility of changing the garage loca- tion which might reduce the variance requested. ~ Mayor Nethercut moved that the matter be reconsidered at the meeting of Septamber 25, at which time al I Council members would be present; seconded by Trustee BJorndahl; carried. Thrasher Variance Request - Case 67-26 Councl I advised Mr. Thrasher that action on this request would be delayed pending recommendation of the Board of Appeals and Plan- ning CommIssion. REPORT OF ENGINEER LUND Village Hall Parking Lot Engineer Lund reported that Attorney Courtney has found the bids and bonds In order, that four bids were received - the lowest of which was $1,760.00 by Hennepin Blacktopping, Inc. Trustee Olmen moved accpetance of the bid of Hennepin Blacktopping, Inc. for $1,760.00 and authorized Banister Engineering Company to prepare the contract; seconded by Trustee BJorndahl; carried. Drainage Survey Engineer Lund reported on a letter of August 21,1967, from Milner Carley r~iatlng to a drainage study for an area abutting Arden Hills. Clerk Stromquist read Mr. Ostlund's letter of September I ~, 1967 re drainage of SEt Sec. 32-30-23. Engineer Lund to furnish Vi Ilage with a copy of the letter for Village fi Ie. Lake Johanna Outlet Engineer Lund reported that detailed report of this problem could be comp1eted by February 1968. The Council advised Engineer Lund that he should first determine what procedure Is necessary to enjoin neighboring villages, Conservation Department and Ramsey County in the matter. No detailed engineering study shou~d be made at this point. REPORT OF TRUSTEE OLMEN Krueqer Drainage Ditch Trustee Olmen advised the Council that he feels this open ditch Is a Village problem, that Mr. Krueger has agreed to cover and sod the area If the Village piaces the required culvert in the area. Trustee Olmen moved that the Village put in a culvert for the distance necessary to adequately take care of the drainage (not to exceed 115 feet). Village is to put In said pipe, Mr. Kr'ueger to cover and sod area; seconded by Trustee Hollenhorst; carried. . REPORT OF TRUSTEE HOLLENHORST Trustee Hollenhorst reported that a representative of the State Planning Commission observed the fast Planning Commission meeting. He stated that Federal Funds were available for up to 50% of park programs. The Village Council of the Village of Arden Hills duly met in the regular session at the Village Ball on Monday, September 11, 1967, at 8:00 o'clock p.m. The following members were present: Nethercut, Olmen, Bjorndahl, and HollenhQrst, and the following was absent: crepeau. Hollenharst introduced the following resolution and moved its adoption: RESOLUTION APPROVING ENGINEERS PRELIMINARY REPOaT AND PROVIDING FOR PUBLIC HEARING ON WATER IMPROVEMENT NO. 67-2 BE IT RESOLVED by the Council of the Village of Arden Hills as follows: 1. The Council has heretofore directed Banister Engineering Company, village consulting engineers, 310 Snelling Avenue, Saint paul, Minnesota, to prepare a preliminary report as to the feasibility of a proposed improvement consisting of connections to the Roseville water system at the southern boundary of Arden Hills, and water main and appurtenances will be constructed with- in the platted streets and highways to serve the benefited area, water services will be constructed from the main in the street to approximately the lot line to serve the individual lots. . The Council also directed Banister Engineering Company to determine the estimated cost of the improvement, and whether such improvement should best be made as proposed or in connection with some other improvement. The preliminary report and cost estimate have been submitted by the engineers and considered by the Council and are hereby approved and directed to be placed on file in the office of the village administrative clerk. The improvement proposed to be made in the general manner set forth in the report is designated as water Improvement No. 67-2. . . . 2. The Council shall meet at the village Council Chambers, 1450 N. Highway 96, on october 2, 1967, at aioo o'clock p.m. for the purpo~e of hold~ng a public hearing on the proposed ifuprovement Uhder and pursuant to the ptovisions of Minnesota Statutes, Chapter 4291 as amendedj and the administrative clerk is hereby authorized and directed to cause ~otice of the time, place and purpose of that meeting to be publiShed twice in the official newspaper, New Brighton B~l1etini which publications shall be a week apart, and the second publication shall be not less than three days before the da~ of the hearing. Pursuant to M.S. 429.031, Subd~Visio~l, notice shall also be mailed to the owner of each parcel within ~e area propdsed to be assessed not less than 10 days prior to such hearing. 3. NOTICE IS HEREBY GIVEN that the Council of the Village of Arden Hills, Minnesota, will meet at the Village Council Chambers, 1450 ~. Highway 96, on the 2nd day of OCtober, 1967, at 8:00 o'clock p.m., to hold a publiC hearing pursuant to Minnesota Statutes, Chapter 429, as amended, on proposed Water Improvement No. 67-2 consisttng of connections to the aoseville water system at the southern boundary of Arden Hills, and water main and appurtenances will be constructed within the platted streets and highways to serve the benefited area; water services will be constructed from the main in the street to approximately the lot line to serve the individual lots. The foregoing is all sUbstantially in accordance with a preliminary engineering report which is now on file and open to public inspection in the office of the Village Administrative Clerk. The -cost of the improvement is presently estimated at approximately $62,200. The area proposed to be assessed for the improvement is that part of Arden Hills No. 3 lying within the Southwest Quarter of Section 34, Township 30, Range 23; that part of Arden Hills No. 4 lying within the Southwest Quarter of Section 34, Township 30, Nange 23; and Government Lot 6 lying within the Southeast QuaEter of Section 33, Town- Ship 30, Range 23. All persons desiring to be heard with reference to the improvement and the area proposed to be assessed therefor may appear and be heard by the Village Council at the time and place stated above. Pur8Uaftt to due call and notice thereof, a QQg,,1 "r meeting of the Village Council of the Village of Arden &lls, M1nnesota, was duly held at the Village Hall in said Village on Mon'day the ...1!- day of September . 1967, at c-, 8:00; p.m. o'clock p.m. The following members were present: ~ayor Nethe rcut, Councilmen Dlmen, Bjorndahl and Hollenhorst and the following were absent: CO.l,lncilman Crepeau Member Hollenhorst introduced and llIOY8d the adoption of the following resolution, RESOLUTION ORDERING PREPARATION OF REPORT ON WATER IMPROVEMENT NO. 67-2 WHEREAS, it is proposed to improve a portion of the Village of Arden Hills in that part of Arden Hills No.3 lying within the Southwest Quarter of Section 34, Township 30, Range 23 and that part of Arden Hills No.4 lying within the Southwest QUarter of Section 34, Township 30, Rang-e 23, and Government Lot 6 lying within the Southeast Quarter of Section 33, Township 30, Rang-e 23 by the <Dnstruction of connections to the Roseville water system at the southern boundary of Arden &lls, and water main and appurtenances -. to be constructed within the platted streets and highways to serve the benefited area, with water services to be constructed from the main in the street to approximately the lot line to serve the individual lots, and to assess the benefited property for all or a portioD of the cost of the improvement pursuant to Minnesota Statutes 429 as amended. , I NOl-l, THEREFORE. BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF ARDEN HILLS, MINNESOTA: . That the proposed :l.mprovement be referred to Banister Engineering Company for study and that they are instructed to report to the Council with all convenient speed, advising the Council in a preliminary way as to whether the proposed 1mprovement is feasible and as to whether it should best be made as proposed or in connection with some other 1mprovement, and the est1mated cost of the 1mprovement as recommended.
