Roll Call Present - Mayor Nethercut, Trustees Hollenhorst, Crepeau, Olmen and Bjorndahl Absent - None Also Present - Village Atty. J. Salland, Village Engineer D. lund, Deputy Clerk Florence Honan and Accounting Clerk Charlotte McNlesh Approval of Minutes The minutes of the Regular Council Meeting of 10 July 1967 were approved as amended. The minutes of the Special Counei I Meeting of 27 July 1967 werE approvad as submitted. BUSINESS FROM THE FLOOR Kostohryz Variance Request - C~se 6J-23 D. W. Kostohryz and his architect, G. McGuire, discussed the front or rear yard variance request as detailed in Case 67-23. The variance is requested for lot 4 and the northerly half of lot 5, Arden Hi lis Addition. G. McGuire informed t~e Council that County Engineer Anklan will send a letter to Al'den Hills stating that the county has no objection to the proposed location of residence and garage. Mr. McGUire also said the county plans to reduce the present 100 ft. right of way to 80 ft. at some future date tor this portion of Old Snelling Avenue. Trustee Crepeau moved that the variance requested In Caso 67-23 be approved, provided thet both the Board of Appeals and the Planning Commission approve the variance; seconded by Trustee Olmon; motion carried. ];lumping and Traffic Central J. Besch, 1966 Edgewater Avenue, complained th~t private property, located at the west end of Edgew*ter Avenue Is being used as a dump. . it was also noted the an area adjacent to County Road E-2 Is being usee for dumping. The CouncIl suggested that owners of the properties involved be contacted and the debris be re,moved, "Private Property - No Dumping" slgns~e posted In areas, and ?hat tne Pol Ice Department patrol areas frequen' 'yo r : . I, Mr. Besch also complained that Prior Avenue, from County Road D to Jerrold Avenue, was becoming a speed zone, heavily travelled by motorists to avoid stop sIgns at County Road D and New Brighton Road. He suggested placing additional stop signs on this route. Matter referred to the Public Satety Committee. lake Josephine DralnaQe Improvement Upon motion by Crepeau, seconded by Olmen, the Council, as per attached resolution, ordered the engineer to prepare a feasibility report on the proposed lake Josephine drainage Improvement; carried. .~.---C , , , . Minutes of Cotincl I Meeting -2- 31 July 1967 ~ake Josephine Outlet T. Lynch, 3210 N. Hamllne Ave., reported that approximately 100 ft. of culvert (serving as an outlet for lake Josephine) traverse his property. There are no easements shown on any abstract nor does the County Engineer's Office have any records of Installation of the culvert, etc. Matter referred to Engineer Lund. . Incinerator for Twin Parks, Inc. - Case 67-24_ Mrs. J. Adams requested Counci I approval to Install a Joseph Goder Incinerator to be housed In a Butler bui Idlng at their Trai ler Park. Mrs. Adams reported that this model met St. Paul and Minneapolis requirements regarding air pollution. Councl I requested Mrs. Adams to make required application at the Village Hall on August I and to appear at the Planning Commission meeting of August I. Amble Road Matters R. Pederson, 1224 Amble Road, Inquired about the status of condemnat- Ion proceedings on bu! Idings located on Amble Road and Hamllne Ave. Atty. Salland reported that this matter Is being pursued. He further stated that he was dissatisfaction with recent patching repairs on Amble Road. Trustee Dlmen reported that he had Inspected Amble Road, found all chuck hcles filled and sur'face as smtloth as could be expected considering the road-base and amount of money recently authorized for malnten~nce. Trustee Dlmen agreed to try to schedule spring repairs at an earlier date next year In an attempt to minimize chuck holes, etc. Water ~1atter E. Colestock representing an associatIon of ARden Hills business and profe'sslonal men stressed the urqent need fOI" water In the commercial-Industrial area. C. Lund or Roberts Properties 6x?ressed an urgent need for water to'accomo~a sprinkler systEm required by a prospective tenant of' i'heir new warehouse building. R. McNlesh, Chairman of the Water Study Committee, reviewed activitIes of the Committee as dete! led In his memorandum of July 31, 1967. Atty. J. Salland advised .that to his knowledge, Atty. Courtney has no written commitment from Ros0vIlle as yet. Trustee Crepeau, EngIneer Short and R. ~'1cNlesh will s(:hedule amee+ing as soon as possible with Rosev! I Ie representatives to obtaIn a brief expression of Intent. . Atty. J. Salland advised that the size of a project can be reduced, but cannot be increased after publ icatlon of the publ ic hearing. He also noted that mailed notices to effected property owners Is a legai requirement. Trustee BJorndehl moved that the VIllage IHty. be author-l zed to publ i6h the necessary notices for a public hearing to be held Tuesday, August 29, 1967, at 7:30 p.m. at the Lake Johanna Elementary School; notices of hearing to be published In the New Brighton Bulletin on August 10 and 17, 1967. Purpose of the hearing is to present plans and costs for municIpal water In Arden Hills under Plan A and A~terna-re Plan B; seconded by Trustee Crepeau; carrled,fJ..v ~~~ Trustee Crepeau moved that Banister Engineering Co. be authorized to advertise for bids for a municipal water project identified as Plan A and A ~nate Plan B, which includes booster pumps and storage tank. In his letter of July 31, 1967, Attorney Courtney advised that a map showIng the route of the pedestrian trail should probably be part of the Ordinance and that several clearances have not as yet been obtained; final readIng should be delayed until these matters are resolved. Trustee BJorndahl moved that an Ordinance designatIng the Pedestrian Trail, prohIbiting motorized travel thereon with certain exceptIons, providIng for the posting of warnIng sIgns thereon, and provIding penalties for violation thereof, be given its second readIng; seconded by Trustee Crepeau; motion carried. Oak WIlt OrdInance Trustee BJorndahl Informed. the CouncIl that tentative schedules Indicate that a survey of oak wi It should be conducted on or about August 23, 1967. Flnald reading of the Oak Wilt Ordinance should precede the survey date. Trustee BJorndahl also requested that residents of the areas to be Included In the survey be Informed prIor to this date. Trustee BJorndahl moved that an OrdInance provIding for the preventIon of oak wIlt tree dIsease In the Village of Arden Hills and providing penalties for violation thereof; be Introduced by tItle and gIven Its first reading; seconded by Trustee Hollenhorst; carried. Matter referred to Parks and RecreatIon Committee. REPORT OF ENGINEER LUND Red Fox Road EngIneer Lund reported that he had advised Bituminous Roa~ways to cease grading, etc. of Red Fox Road. Apparently the depth and quality of gravel Is less than Indicated by Roberts Development at the July 10, 1967 Council meeting. EngIneer Lund was requested to contact C. Lund of Roberts' Development Co. on the matter. If Roberts' Development Co. furnIshes requIred amount and quality of gravel, temporary Improvement of the road will proceed as outlined In July 10, 1966 Council meetIng. If necessary gravel Is not furnished, Council suggested that ~he authorized $700.00 be spent for oilIng, etc. and that the road be posted for three-ton limIt. . Villa~e Hall ParklnQ Lot Engineer Lund reported that he will check on status of this pending Improvement. lIft StatIon TelemeterinQ ServIce Engineer Lund reported that the "hook up" to Ramsey County Sheriff's office Should be completed this week. The Administrative Clerk's office was requested to inform Rosevllle that complete plans for the County Ditch 64 Improvement had not been received ty the Village of Arden HIlls, and that the Village of Arden HII Is has Dot approved these plans. Council will schedule consideration of the plans for the August 14, 1967 Council meeting. It was suggested that interested property owners by so Informed and the County Engineer be Invited to attend the Council meeting. Matter to be on the agenda for approximately 10 o'clock p.m. . REPORT OF TRUSTEE CREPEAU Letter of Appreciation A letter of a-preclatlon from Mrs. Geo. Dean1was read complimenting the Police Dept. on effIcIent aod courteous services recently rendered. Twin City Arsenal Strike Trustee Crepeau com.mended the Arden HIlls Police Officers on handling of traffic due to the current Twin City Arseaal strike. REPORT OF TRUSTEE OLMEN Previously covered. Dep*ty Clerk Florence Honan read a letter of appreciation from the Fire Dept. for subscriptions to the Minnesota Fire Chief Ass'n magazine. These were furnished to the department by the Village of Arden Hills. Ordinance No. 100 Copies of this Ordinance concerning drive Ins were distributed to the Council. The following members were present: Mayor Nethercut, Trustees ~repeau, Dlmen, B~orndahl and ~ee+- Hol lenhorst and the following were absent: None TrusteeBJorndahl introduced thefollow~esolu- tion and moved its adoption: RESOLUTION APPROVING ENGINEERS PRELIM- INARY REPORT AND PROVIDING FOR PUBLIC HEARING ON WATER IMPROVEMENT NO. 67-1 BE IT RESOLVED by the Council of the Village of Arden Hilla as follows: . 1. The Council has directed Banister Engineering company to prepare a preliminary report as to the feasibility of water improve- ments within the Village of Arden Hills, and particularly in that area of the village lying easterly of Trunk Highway 51 and west of Lexington Avenue, consisting of the construction of a connecting feeder water main to the Roseville water system at Glenhill Road and ~amline Avenue, and extending northerly and easterly to terminate at *,n elevated storage tank adjacent to Fernwood Avenue approximately 2000 feet north of County Road F, together with certain necessary distribution mains, largely located within the commercial and industrial area of the village which will also provide service connections to the property line, a meter station at the south village limits and a water booster station at approximately Red Fox Road, plus necessary fire hydrants and control valves and other appurtenances, and the estimated cost thereof and whether such improvement should best be made as proposed or in connection with some other improvement. The preliminary and cost estimate have been submitted by the engineers, considered by theCouncil, and are hereby approved and directed to be placed on file in the office of the Clerk. The improvement proposed to be made in the general manner set forth in the report is designated as Water Improvement No. 67-1. 2. The Council shall meet at the Lake Johanna Elementary School on August 29, 1967 at 8:00 o'clock p. m. for the purpose of holding a public hearing on the proposed improvement under and pursuant to the provisions of Minnesota Statutes Chapter 429, as amended. Clerk is hereby authorized and directed to cause notice of the time, place and purpose of that meeting to be publiShed twice in the official newspaper of the village, New Brighton Bulletin, which publications shall be a week apart and the second publication shall be no less than three days before the date of hearing. 3. NOTICE OF HEARING ON WATER IMPROVEMENT NO. 67-1 VILLAGE OF ARDEN BILLS, MINNESOl'A NOTICE IS HEREBY GIVEN that the Council of the Village of Arden Hills, Minnesota, will meet at the Lake Johanna Elementary School, 3120 Lake Johanna Boulevard, in said village, on the 29th day of August, 1967, at 8:00 o'clock p. m., to hold a public hearing pursuant to Minnesota Statutes, Chapter 429, as amended, on proposed Water Improvement No. 67-1 consisting of the construction of a connecting feeder water main to the Roseville water system at Glenhill Road and Bamline Avenue, and extending northerly and easterly to terminate at an elevated storage tank adjacent to Fernwood Avenue approximately 2000 feet north of County Road F, together with certain necessary distribution mains~ largely located within the commercial and industrial area of the village which will also provide service connections to theproperty line, a meter station at the south village limits and a water booster station at approximately Red Fox Road, plus necessary fire hydrants and control valVes and other appurtenances: all substantially in accordance with a preliminary engineering report which is now on file and open to public inspection in the office of the Village Clerk. The cost of the improvement is presently estimated at approxi- mately $630,250. The area proposed to be assessed for the improvement includes the properties situated within the following described area: The Southeast quarter (SE 1/4) of Section 22, T 30, R 23: the east one-half (E 1/2) of Section 27, T 30, R 23: and all that portion of the East one-half (E 1/2) of Section 34, T 30, R 23, lying northerly of Josephine Hills Plat 2 and Josephine Hills No.3. RESOLUTION ORDERING PREPARATION OF REPORT ON PROPOSED LAKE JOSEPHINE DRAINAGE DITCH WHEREAS, it is proposed to consider improvement of an existing open drainage ditch extending towards Lake Josephine from the intersection of Ingerson Road and Fernwood Street, and to assess the benefited property for all or a portion of the cost of said improvement, pursuant to Minnesota Statutes Chapter 429, as amended, NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF ARDEN HILLS, MINNESOTA: That the proposed improvement be referred to Banister Engineering Company, Village Engineers, for study and that they be instructed to report to the Council with all convenient speed advising the Council in a preliminary way as to whether the proposed improvement is feasible and as to whether it should best be made as proposed or in connection with some other improvement, and the estimated cost of the improvement as recommended.
