MeetIng was called to order by Mayor Nethercut at 8:00 p.m.

An addItional amendment to the Regular CouncIl MeetIng Minutes
of June 12, 1967 was approved. Minutes of the Regular Council
MeetIng of June 26, 1967 were approved as amended.

John Rysgaard, Eugene Colestock and Worth Read (members of the
Water Study CommIttee) dIscussed:

Mr. Rysgaard and Mr. Colestock stated that water needs are urgent
In the commercial-IndustrIal area. After some discussion,
Trustee Cre~eau moved that a Special Meeting be held July 13,
1967 at 7:30 p.m. at the Village Hall. This Is to be a JoInt
meeting with CouncIl and Water Study Committee, a representative
from Attorney Courtney's office, Fiscal Consultant Peter Popovich,
and Engineer Roger Short In attendance; seconded by Trustee
Hollenhorst; motion carried.

Bids were opened at 8:30 p.m. and reported by Administrative
Clerk StromquIst as follows:

Trustee Olmen moved acceptance of the apparent low bid, subject
to approval by EngIneer Lund and Attorney Courtney; seconded by
Trustee Crepeau; carried.
ProDosed Robert's Warehouses (Cases 67-17 and 67-18)
Trustee Hollenhorst moved that the Council approve plans of the
warehouses subject to Village EngIneer's approval ot drainage
and PlannIng CommissIon approval of landscape plans prior to con-
structIon; seconded by Trustee Crepeau; carrIed.
REPORT OF ATTORNEY COURTNEY

Boulevard Tree Ordinance
Trustee Hollenhorst moved IntroductIon by tItle of an Ordinance
Regulating the PlantIng of Trees In Boulevard areas In the Village
of Arden Hills, providIng a permit procedure, establishing regu-
lations for such planting, and providIng penaltIes for violation:
seconded by Trustee Olmen; carrIed. Matter referred to PlannIng
Commission and Parks and Recreation CommIttee..
Knowd Request for Property PUi"c:h:n;g
Attorney Courtney reported that the area In question Is a 30foot
platted roadway which has not been vacated. The Council, there-
fore, has no authorIty to sell It. He stated that when a street
Is vacated It reverts to abutting property owners.
Shorewood Drive Area Easements ~
Attorney Courtney r~ported that easements . n the sect~

rIght for maintenance. Public crossovers of the area norma! Iy
are not Included In this type of easement. Mr. Reloux, 3209
Shorewood Drive, discussed the easements existing on Lot I, Blockl.
Attorney Courtney further stated that Arden HIlls does not have
a trespass ordinance and consequently would be governed by State
Statute. This statute requires that the property owner request

trespassor to leave premises; and If said trespasser refuses
to leave, he Is In vIolation and subject to prosecution, Attorney
Courtney was requested to advise the Council and Pollee Depart-
ment as to the exIstIng easements in a four-lot area and pub! Ic
rights, if any, to cross over said easements.

Non-support ProsecutIon
Attorney Courtney reported that In cases of non-support, classi-
fied as misdemeanors, where Justice of Peace Court systems exist,
complainant may file a complaInt and be heard by the local Justice
of Peace. If a change of venue Is requested, the prosecuting
attorney would be Involved. Attorney Courtney was requested to
report on an Attorney General's opinion relative to the need
for a prosecuting attorney If a complaInt Is heard by a Justice
of Peace. He was further requested to advise Council and JustIces
of Peace on the matter.
Library Site Contract
Trustee Crepeau moved that Mayor Nethercut, Administrative Clerk
Stromquist and Attorney Courtney be empowered to enter Into a
contract with Bethel College for purchase of the site and to
pay S500.00 In earnest money when and If there Is a wrItten commit-
ment of Intent by the Ramsey County Library Board to buIld on
the site; seccnded by Trustee Olman: carried.
Rosevllle-St. Paul Sewer Rates
-Attorney Courtney stated that he wrote to Mr. Turnlund of Rose-
vllle on July 10, 1967 concerning the proposed rate contract
between Rosevllle and St. Paul. Attorney Courtney expects to
have a rough draft of the proposed agreement shortly.

Attorney Courtney advIsed the CouncIl that this PublIc Hearing
wIll ~roceed under Ordinance No. 20 and will requIre a S25.00
fee. Trustee Hollenborst moved that the PublIc Hearing for
Case 67-4 be set for July 31,1967, notIces to be published:
seconded by Trustee Crepeau; carried. Attorney Courtney advised
the Council he will be out of town July 31. Trustee Hollenhorst
moved that the Public HearIng date for Case 67-4 be changed from
July 31 to August 14, 1967: seconded by Trustee Crepeau: carried.
Attorney Courtney was requested to check and advise Council as
to whether thIs would Involve a rezonIng or special use permit.
Conflict of Interest
Attorney Courtney's letter of July 10, 1967 was submitted, givIng
legal InterpretatIons of statutes relatIng to conflIct of Interest
Items.

Easement on Standard 011 Service Road
The Council authorized Attorney Courtney to obtain an abstract
of tItle to the property Involved on County Road E. EstImated
cost of abstract Is SIOO.OO.
Pedestrian Trail
Attorney Courtney reported on the status of pending easements
for the pedestrian trail. Trustee BJorndahl was requested to
contact Bethel College on the matter. The CouncIl requested
Attorney Courtney to prepare the PedestrIan Trail Ordinance In
fI na i form.
County Road F Sewer Extension
Engineer Lund reported that a sewer extensIon to Lot 13, Block 2
as requested In Mr. Robert Roetz's letter of 6-6-67 Is feasible,
estimated cost is S910.00. Matter referred to Attorney Courtney.
Group Insurance
Trustee Crepeau reported that hehhad met with several Insurance
representatives relative to a group health-life Insurance pian
for Village employees. No Village participation In premIum
costs are involved In the present plan. The Council requested
that a copy of the proposed contract be submitted to Attorney
Courtnev for review. Trustee Creoaau moved aooroval of the

Trustee Hollenhorst requested that Attorney Courtney advise
the Council relative to Village responsibility resulting from
building plan approval.
ENGINEER LUND'S REPORT
Burled Cable under Grav Fox Road
EngIneer Lund recommended approval of N. W. Bell Telephone
Company's request to construct burled cable under Gray Fox Road.
Trustee BJorndahl moved approval of the application detaIled
In attached sketch; seconded by Trustee Olmen; carrIed.
Lighting Plans - T.H. 51 and Countv Road E
Administrative Clerk Stromquist read Banister Engineering Co.
letter of July la, 1967. No lights are shown at County Road E
and Hamllne Avenue and the single standard at Connelly Avenue
and County Road E appear Inadequate.
Trustee Crepeau moved that the Counc II reques.t the State Highway
Department to consider the changes recommended by the VIllage
EngIneer; seconded by Trustee BJorndahl; carried.
Red Fox Road
EngIneer Donald Lund reported that an estimated cost of $700
(covering the regradIng, crowning, oiling and Installing of a
culvert on Red Fox Roadl should provIde a temporary road for
lIght vehicular traffic. Additional oIlIng and grading main-
tenance by Village Maintenance Department would be requIred.
Engineer Lund was requested to determine a reasonable load limit
for the temporary road. Trustee Olmen moved authorization of
thIs work on Red Fox Road and also mOved that the road be posted
for load lImit, to be determined by EngIneer Lund; seconded by
Trustee Crepeau; carrIed.
Telemeterlng Svstem
EngIneer Lund reported that the Sheriff's offIce connectIon to
the Village system will be completed when necessary new equip-
ment Is Installed at the sherIff's station.

Grav Fox Road and Dunlap Street
Engineer Lund reported that Roberts Development Company has been
advised of the VIllage requirements for acceptance of Gray Fox
Road and Dunlap Street as Village straets.
AdminIstrative Clerk Stromquist was requested to write Roberts
Development Company on this matter and to Include a copy of the
former letter, dated 3/30/67 to Roberts, whIch detaIled VIllage
requirements for acceptance of streets.
Gazelka Request for Sewer and Gas
Engineer Lund was requested to consult orally with Mr. Gazelka
relative to his letter of June 29. 1967.
Feaslbllltv Report for Water Improvement In Arden Hills 13
Engineer Lund submitted copIes of a feasibility report for a
water Improvement In Arden HIlls 13. Estimated cost of the
project Is $52,700.rO which Includes $18,000.00 for street
repairs. A copy of the report was submitted to the Water Study
CommIttee for comment.
Amble Road
AdmInistrative Clerk StromquIst read a letter from Banister Engin-
eering detailing several alternatives for Impoovlng Amble Road.
Council requested that the Administrative Clerk advise resIdents
of alternatives and Include a copy of the Banister letter of
July 10, 1967.

Arden HIlls 13 Beach Association ComplaInt
EngIneer lund reported that he had Inspected the Arden HIlls
13 beach area and the natural draInage dItch area between
lake Josephine and Lake Johanna. The water In lake JosephIne
Is green; water In the swamp area, thru whIch the natural drain-
age ditch flows, Is very green; the flow from lake JosephIne
to Lake Johanna was quIte rapId. These condItIons account for
the concentration of green water In the Arden HIlls 13 Beach
area. The recent Lambros ditch Improvement has no bearIng on
the matter. Trustee Crepeau commented that the publIc beach
on Lake Johanna has been green recently and he felt thIs was
caused by algae. It was recommended that the Beach AssociatIon
contact the Conservation Department for permis~lon and advIce
on chemical treatment.

The Village of New BrIghton has InvIted the VIllage of Arden
HIlls to attend a hea~lng on July 18, 1967 concernIng the re-
zonIng to multIple family d.elllngs on a New BrIghton tract of
land at Old HIghway 18 and Highway 96. Matter referred to the
Planning CommIssIon.
Ryal's VarIance ReQuest - Case 67-13
Trustee BJorndahl moved approval of the Ryal's varIance request
as recommended by the Board of Appeals and the Planning CommissIon;
seconded by Trustee Olmen; carrIed.

Mayor Nethercut reported that he wll' represent the VIllage of
Arden HIlls on July 13, 1967 to select three nomInees for the
posItIon of CommIssioner to represent Ramsey County on the newly
created MetropolItan TransIt CommIssIon.

of the Village Council of the Village of Arden Hills, RamSey
county, Minnesota, was duly held in the Village Hall at 1450
West Highway 96, St. paul, Minnesota, on Monday, the 10
day of July, 1967, at BIOO o'clock p.m.

BE IT RESOLVED by the Village Council of the Village of
Arden Hills, Minnesota, as follows:
WHEREAS, the assessment roll for Sanitary Sewer Improvement
No. 6 as last finally adopted on November 1, 1963, was filed
and certified to the county Auditor of RamSey county on December
3, 1963, for the purpose of including installments thereof to
be collected along with real estate taxes commencing in 1964r
and
WHEREAS, since that date a number of parcels of property
contained within said assessment roll have been divided and
conveyed by previous property ownersr and
WHEREAS, the county Auditor of Ramsey County requires
that apportionment of the original assessment. against each
original tract where it has later been divided, sold or con-
veyed, be made by the Village Council of the Village of Arden
