MINUTES OF REGULAR COUNCIL MEETING Village of Arden Hills Monday, June 26, 1967 - 8:00 p.m. Call to Order Meeting was callad to order by Mayor Nethercut at 8:00 p.m. Roll Call Present - Mayor Nethercut, Trustees Hollenhorst, Crepeau, Olmen and BJorndah I. Absent - None Also Present - Village Attorney Vincent P. Courtney, Village Engineer D~nald Lund, Administrative Clerk Lorraine Stromquist and Deputy Clerk Florence Honan. Approval of Minutes The minutes of the Regular Council Meeting of 12 June 1967 were approved as amended. BUSINESS FROM THE FLOOR Dwight Peterson, 1536 Edgewater Avenue, presented a petition to the Council, which read "The undersigned hereby petition the Village Council of Arden Hills to take appropriate actlon(s) which will permit the residents of Arden Hills No.3 to connect to the Rosevllle system, which now extends Into Arden Hills No.3. This Is requested as separate action from other studies now under- way In the Council." Twenty seven families had signed the petition. Trustee Crepeau moved, seconded by Trustee Olmen that the Resolution on this matter which was passed Msy 22, 1967 be rescinded, and substitute the revised Resolution; motion carried. " Sunday Liquor Llce~es Attorney Courtney submItted a letter, dated June 26, 1967, to Clerk LorraIne Stromquist, concernIng his opInions regarding this matter. Subjects covered were the general procedure, hours for voting, effect of an adverse vote, amendment of our present liquor ordinance and a proposed sample ballot. Clerk Lorraine Stromquist Informed the Council that she had contacted other municipalities on the subject and obtained the following Information: Rosevllle and New Brighton haye municipal liquor; Shore- view may have a special election; Mounds View hss no speclfl~~lens~ the matter has not been discussed by the Council; St. Paul has had no formal requests; therefore, has no plans; Mpls. has had In- quiries, but no formal requests, unlikely to hold a special election. Mayor Nethercut stated he would like the VIllage to hold off wIth an election until the central cities have their elections; no reflec- tion on McGuire's - he feels they operate a very fine and trouble- free establIshment. There was some discussion on thIs matter; the council members felT that since a forma' request was msde to the Council for a special election, the voters should make the decision. Trustee BJorndahl moved the adoption of a resolution, as attached, setting July 25, 1967 as the date for a special election to deter- mine whether liquor wi! I be permitted to be sold on Sundays In Arden Hi lIs; '(he polls shall be open on that day from 2:00 p.m. until 8:00 p.m.; the polling places shall be the Village Hall and -,- Minutes of Regul~r Council Mseting - June 26, 1967 - contlnu~d . the Lake Jcha~na Elementary School; tho eight elections judges were named, as attached; (four at each pol ling place) and authorized the clerk to cause the posting and publication of the notice as re- quired by law; seconded ~y Trustee Crepeau. Those voting In favor of the motion: Trustee ~ollenhorst, Crepeau, Olmen and BJorndahl; opposed: Mayor Nethercut; motion carrIed. The Council agreed with Trustee BJorndahl's recommendation that Mrs. Schiller prepare a news artIcle for publication on this subject. Ordinance No. 92 Amendment Attorney Courtney Informed the Council that our present Ordinance No. 92 will have to be amended to allow liquor to be sold on Sun- days and presented such an ordinance. Trustee Bjorndahl Introduced by title and gave the first reading to an Ordinance amendIng OrdInance No. 92, relatIng to the sale and Consumption of intoxicatIng liquors, to authorize granting of special licenses for sale of liquor on Sundays, and setting the license fee therefor; seconded by Trustee Crepeau; motion carried. St. Paul - Roseville Sewer Rate Contract Attorney Courtney submitted a letter, dated June 26, 1967, to Clerk LorraIne Stromquist with caples to the CouncIl members and Engineer Lund regarding the proposed St. Paul - Rosevllfe sewer rate contract. He summarized the tetter and suggested the Council study it. At Engineer Lund's request, The CouncIl authorized him to check the amount of flow from the area north of County Road E. The Council authorized Attorney Courtney to discuss the questions raised In his letter with Mr. Bell, Rosevllle's attorney. Trustee Olmen reported that the Publ Ie Works Committee thinks the Village should rely on the hired consultants' opinions; that every effort should be made to eliminate storm water flowing through the system Including the raising of the man holes especially In the swampy areas; also the meters be activated as soon as possible. Mayor Nethercut reported that the Finance Committee had no unfavor- able reaction. Clerk Lorraine Stromquist Informed the Council that Rosevllle Administrator Richard Turnlund has stated that he will attempt to get answers from St. Paul regarding any questions from Arden Hills, and was anxious to get a decIsion from the Arden Hills Council. The Council informally approves the contract, subject to the find- Ings of Attorney Courtney. Adoption of Drive-In Ordinance Attorney Courtney read the Drive-In Ordinance with revisions as recommended by the Planning Commission. e Trusteo ~o!lenhorst moved th~t the rules be waived and the second and flna! reading be given to an OrdInance regulating and licensing the operation of drIve-In businesses within the Village of Arden Hills, providing for license fees, and prescribing penalties for violations; seconded by Trustee Dlmen; motion carried. Non-Support Matters Clerk Lorraine Stromquist reported that she had checked surrounding villages regarding their positions regardIng non-support cases and was Informed by New Brighton that the villages are required to prose- cute such eases. Attorney Courtney informed the Council that he now has another request for prosecution; he will check the statutes, inform the Counci I in writing and proceed with prosecution. Case 67-4, Multi-Dwelllnq Attorney Courtney reported that he received a call from Attorney Dick Jones, representing the Developers for the proposed apartment complex; Mr. Jones has not decided If he wants to proceed under the new or old Zoning Ordinance, Under the old Ordinance, the public hearing would be held by the Council; under the new Ordinance, the Planning CommissIon would hold the publIc hearing. Attorney Courtney stated that he does have a choice since the proposal was Initiated while the old Ordinance was In effect. -2~ Minutes of Regular Council Meeting - June 26, 1967 - continued Trustee Hollenhorst moved, seconded by Trustee Crepeau, that the matter be re-referred to the Planning Commission; motion carried. Pedestrian Tral I In response to an Inquiry from Trustee Bjorndahl, Attorney Courtney stated that the Village would not have the right to prohibit motor- ized vehicles on public rlght-of-ways; the Village could only enforce this where posted and this would have to be defined In the Ordin- ance. REPORT OF ENGINEER LUND . Larson-Schacker Drainaqe ProJect Trustee Olmen moved the advertisement for bids be published with the acceptance of bids on July 10, 1967, until 8:00 p.m. Bid opening to be at the Regular Council Meeting of July 10, 1967; seconded by Trustee Hollenhorst; motion carried. County Road F Sewer Assessment Engineer Lund wll I submit to Attorney Courtney the name of the third party requesting sewer service on County Road F; Attorney Courtney will then attempt to get a waiver of the public hearIng from this person. Hlqhw8Y Liqhtlnq Plans Engineer Lund Informed the Council that he will have a report on the proposed State Highway Department plans for the lighting of the Intersection at Highway 51 and County Road E. REPORT OF TRUSTEE OLMEN Amble Road Trustee Olmen reported that the Pub! Ic Works Committee would like a study made to determine which is more economical, to continue patching or a complete improvement. They feel the cost should not exceed the cost of maintenance of the improved roads (sweeping and seal coating> over a three year period. Matter referred to Engineer Lund for cost estimates and feaSibiliTy report. Fred Nixon suggested that Thom Drive be given the same considera- tion. Trustee Olmen assured the residents of Amble Road that temporary patching will be done this week. Street MaIntenance Trustee Olmen reported that the seal coating planned for this year has been completed. , Lake Josephine Drainage Ditch Trustee Olmen informed the Council that the Public Works Committee recommends Plan B as prepared by Banister Engineering Company as this plan required only one easement. In response to Trustee Olmen's inquiry, Engineer Lund believes the pipe will not clog, but should probably be cleaned about once a year as preventative maintenance. REPORT OF BUILDING INSPECTOR CLAY KELLEY (given by Clerk Lorraine Stromquist) The following written report was submitted by Mr. Kelley on the !4th of June, 1967, copies of whIch were given to the Council. 1933 County Road D - the exterior siding and trim has been painted; refuse will be removed this week when the interior is finished. Edqewater Motel - New owner has taken possessIon and the refuse cleaned up satisfactorily. Peterson Residence - located at Cannon and Tiller Lane. The siding has been instal ted and partially primed. The outdoor toilet has been removed. The garage doors have been ,delivered and will be installed within the next ten days. Circle S ranch - the area which was burned Is stili quite littered and does not comply with our standards. The owner has been given until June 3D, 1967 by the Court to meet our requirements. Amble Road - will report at the next Council meeting on two small dilapidated buildings located at the corner of Hamllne and Amble Road. -3- Minutes of Regu:ar Council M09+ing - June 26, 1967 - continued Arden Place - recolved six calls concerning the erection of a small playbouso on Arden Place - cost: $240.00 total. This required no . permit; buildIng complies wlth"slde yard requirements. Clerk Lorraine Stromquist read a report submitted June 26, 1967, from Mr. Kelley regarding the dilapidated buildings and excavations on Amble Road. He stated that the property on the southeast corner of Hamllne and Amble Road is detrimental to the public welfare and presents s hazard to public safety. . The trailer 1nd outbuildings located Just west of 1245 Amble Road is also a hazard to public safety and health. He recommended that this property be condemned under Sec. 203 of our Building Code. Trustee Crepeau moved, seconded by Trustee Hollenhorst, that condem- nation proceedings be Initiated by Attorney Courtney on both of these properties; motion carried. Richard Pederson, 1224 Amble Road, offered to submit to Clerk Lorraine Stromquist the names of the o~ners of these properties. REPORT OF TRUSTEE CREPEAU Request for Fireworks Display Trustee Crepeau moved, seconded by Trustee Olmen, that the Lske Johanna Beach Association be allowed to conduct a fireworks display on the fourth of July at Lake Johanna; motion carried. Circle S. Ranch Trustee Crepeau recommended, Council concurred, that Clerk Lorraine Stromquist be directed to write to the owner of the Circle S Ranch reminding him of the June 30, 1967 deadline for the removal of the debris at this site. REPORT OF TRUSTEE BJORNDAHL Oak Wilt Proposed Prolect Trustee BJorndahl reported that Dr. French, University of MJn~esota, attended the Parks and Recreation Committee meeting. The oak wilt procedure was discussed. Dr. French recommended that only the populated areas and village owned property be Included In the survey; he belIeves the Dutch elm disease Is as a minImum this year because of the late freeze, but the survey wll! note SUCh disease. Trustee BJorndahf moved. ~s reco~mcndcd by th~ Commfttee, that a $500.00 expenditure be al lowed for the survey, an Ordinance be adopted to permit the survey team to inspect on private property, and the Village to enforce the removal of the diseased trees; seconded by Trustee Hollenhorst; motion carried. e Trustee BJorndahl recommended, and the Council concurred, that the residents be Informed by means of a flyer and that z public meeting be held after completion of the survey. He stated that the survey will be made the latter part of August; the affected trees should be ~arked with yellow paint. Clerk Lorraine Stromquist was requested to obtain copies of the North Oaks Ordinance for Trustee BJorndahl and Attorney Courtney; also to request Mrs. Sch!iler to publicize the project in the newspapers. Mounds View School District- RecreatIonal Department BJorndahl reported that Roy Anderson, lIaison between the Council and the Mounds View Recreational Department has requested Council endorsement of a letter to the School ~o~rd outlining recommended Improvements In facilities, and would I ike the Board to receive the letter In sufficient time to Include the costs in Its budget. The Parks and Recreation CommIttee concurred with Mr. Anderson's recom- mendations. TrustaeCrepeay and Mr. Lagerstrom, Chairman of the Committee, st.ted they felt the Improvements are necessary. Grey Fox Rosd and Dunlap Street Clerk Lorrslne Stromquist Informed the Council regarding the ststus of these two streets. She had contacted John Dsubney and was told that he Is working with the Stste Hlghwsy Department concerning Grey Fox Rosd and the streets should be resdy for Vlllsge acceptance before the end of the year. Council requested the Clerk to check with Engineer Lund regarding the engineering problem. WHEREAS, Ch. 691 of the 1967 Session Laws of the State of Minnesota provides for submission to the voters of a municipality at a special or general election of the question whether Sunday liquor should be permitted within certain hours and in certain establishments, and WHEREAS, the Council has been requested to set such a special election, NOW THEREFORE, BE IT RESOLVED that a special election shall be held in the Village of Arden Hills on July 25, 1967 wherein the voters of Arden Hills shall be permitted to vote on the following question, to-wit: Shall special licenses be granted for the sale of intoxicating liquor on Sundays in the Village of Arden Hills. BE IT FURTHER RESOLVED that a ballot in the form recommended by the Village Attorney in his letter of June 26 shall be prepared by the Clerk, that the polls shall be open on said July 25 from 2 o'clock p.m. until 8 o'clock p.m., that the polling places shall be the Village Hall and the Lake Johanna Elementary School, as has been the custom in the past, and that the following shall be judges of election at the places set opposite their name: Lake Johanna Elementary School - Myrtle Schiller Betty Kronstedt Fern Christofferson Betty Stanton , Village Hall - Hope Henderson Barbara Sewall Agnes Meyers Beverly LaValle -1- '--~..-
