MINUTES OF REGULAR COUNCIL MEETING
Village of Arden Hills
Monday - 22 May 1967 - 8:00 p.m.
Ca II to Order
Meeting was called to order by Mayor Nethercut at 8:00 p.m.

Present - Mayor Nethercut, Trustees Hollenhorst, Crepeau and Olmen.
Absent - Trustee Bjorndahl.
Also Present - Attorney Vincent P. Courtney, EngIneer Donald Lund, Administra-
tive Clerk Lorraine Stromquist and Deputy Clerk Florence Honan.

The mtnute~ of the Regular CouncIl meetIng of 8 May 1967 were approved as
amended.
Public Hearlng - Hem Radio Tower
Wal lace Karjaiahtl was present and Informed the Council that he had written
approval to Install a ham radIo tower on his property from 21 of the 25 land-
owners within a 250' radius of hIs property; one onwer did not sign, but wil I
not attempt to stop the project - three of the owners were out of town. Mayor
Nethercut asked If anyone at the meeting had any comments on the matter - no
response.
Trustee Hol lenhorst moved approval, as recommended by the Planning Commission,
of granting ~ Conditional Use Permit to Mr. Karjalshtl, 1745 Crystal Avenue, to
Install a 6~ ft. ham radio tower on his property; seconded by Trustee Olmen;
motion carried.
Attorney Courtney stated that the Ordinance calls for a $25.00 fee for this
permit; Mr. Karjalahti was agreeable to paying this amount. Mayor Nethercut
requested the BuIlding Inspector to tour the Village for other antennae In-
stallations which mIght be in violation of the Ordinance.
Mr. KarJalahtl informed the Counci I that the base of the tower will be In
place wIthin a week, but InstallatIon will not be completed until August when
he returns from a trip.
Valentine Lake View Plat
Gale Hendrickson presented the final plat of hls~alentine Lake View Plat.
Trustee Hollenhorst Informed the Council that tha Planning Commission held a
special meeting last Thursday evening and concurred with Attorney Courtney's
recommendation, restricting any building within 10 feet of the road easement.
Trustee Hol lenhorst moved acdeptance of the final plat, subject to the provision
that no bui Idlng be constructed within 10 feet of, the westerly road easement;
seconded by Trustee Crepeau; motion carried. Final plat was signed by Mayor
and Clerk and Village seal affixed. Attorney Courtney returned the abstract
and title for the property to Mr. Hendrickson.
BUSINESS FROM THE FLOOR
ert Maintenance Com laint
ge Salltros, 3625 North Hamllne Avenue, voiced disapproval of trucks,
Is and/or building material on the following properties: 1423 County Road
E, 1401 County Road E; debris on a portion of the Flaherty's Bowl property
and debris and building material on the Arden Lumber Yard's property between
the building and freeway; he stated that these last two locations can be seen
from the freeway. Mr. Salltros also Informed the Council that the large light
on the parkIng lot at Flaherty's shines on his property and is disturbing.
The I ight matter was referred to the Publ Ie Safety Commlt+ee and the matters
of debris to the Arden Hil Is Community Improvement Committee.
Cummlnqs Lane Matt~
Mr. Jerome Timm, 1400 Cummings Lane, asked several questions concerning the
area. Engineer Lund informed him that the Village maintenance crew would
seal coat Cummings Lane; the seal coating work is scheduled so one-third of
the Vi Ilage Is done each year. Engineer Lund also informed him that money
has been retained from the road contractor until such time as the curbing is
completed satisfactorily. Mr. Tlmm requested that if the mercury light planned
for Snelling Avenue and Cummings Lane Is not to be instal led soon, the resi-
dents would like the present light replaced; this light has been out for

about 5 weeks. Councl I requested the Clerk to check Into the matter.
Mr. Timm noticed that the "For Sale" sign Is no longer on the Sklldum
property He requests that the building material on this site be removed
and the area cleaned of weeds and debris.
Shorewood Drive Problems
Mr. Don Reloux, 3209 Shorewood Drive, informed the Council that a number of
people congregate and picnic on their front lawn, even though signs are
posted that this is private property. He stated that there are conservation
Id drainage easements on this property, but no other. He inquired If this
ea could be declared a nuisance area and thereby posted by the Police
, partment.
Clerk Stromquist Informed the Counci I that this is a perennial problem wIth
the property owners In this area.
Matter referred to Attorney Courtney to recommend a solution to the policing
matter and also the types and sizes of easements.
REPORT OF ATTORNEY COURTNEY
Case No. 66-28, Elbner-Starr Plat
The Misses Elbner and Starr were present and there was discussion concerning
ownership of the proposed road easement; he believes that this cannot be
dedicated as a public road, unless the people who have the right to use it
as a private road agree to the dedication for public use. Attorney Courtney
will continue to pursue the matter.

Helman Property Assessments
Trustee Crepeau moved the adoption of a ResolutIon as attached, relating to
abatement of assessments on the Heiman property acquired by the Village of
arden. Hi I Is; seconded by Trustee Olmen; motion carrled.~
The original and two copies were given by Attorney Court y to Clerk Strom-
quist with two copies of the Certificate for completion Attorney Courtney
also p~epared an application for relief of real esta taxes on the Helman
property for the year 1967 and subsequent years. Het:informed the Councll
that the 1966 real estate taxes wi II remain on the property, unless the
Village determl~~5 to pay them.
Trustee Olmen moved Clerk Stromquist be authorIzed to execute and process
the applicatIon, seconded by Trustee Crepeau; motion carried.
LIbrary Site Purchase Resolution
Trustee Olmen moved the adoption of a ResolutIon authorizing acquisitIon
of property from Bethel College for a library site; seconded by Trustee
4itepeau; motion carried.
Library Site Earnest Money Contract
Trustee Olmen moved the edoptlon of a Resolution authorizing executIon of
an Ernest Money Contract between the Vii lage of Arden Hi I Is and Bethel
Col lege and authorizing the Vii lage Attorney to make changes as necessary
In the contract; seconded by Trustee Crepeau; motion carrIed.
The total purchase price of the site is $25,000.00; amount cal led for In
Earnest Money Contract - $500.00. The closing date Is tentatively set for
the end of June,by quit claim deed and not be abstract of title. The
Village will have the option to voId the contract if no commitment Is made

Proposed Sewer Cont~nct - St. Pee!
Trustee Olmen and Clerk Lorraine Stromquist attended a meeting In Rosevll Ie
to discuss the proposed sewer contract with St. Paul. Under the proposed
contract, sewage rate to the Village would be based on the ultimate volume
of sewage rather than number of connections. Meters wil I have to be re-
activated which will be checked by the Village of Rosevll Ie. Clerk submitted
a written report on the meeting to each of the CouncIl members. The pro-
posed contract was referred to the Finance Committee, Public Works Committee,
Village Attorney, and VI I IHge Engineer for recommendations. Another meeting
for submitting the Villages' decisions has been set In two weeks In Rose-
Ille. ,
uncil requested Clerk to ask Rosevllle for a delay In the meeting date
pending the recommendations from the referrals.
Proposed Amendment to PiattlnQ Ordinance,
Trustee Hol lenhorst moved that an amendment to the Platting Ordinance be
drafted by the Vii lage Attorney regarding restrictions on road easements;
seconded by Trustee Crepeau; motion carried.
REPORT OF ENGINEER LUND
Drainage Ditch No.4
Engineer Lund reported that the residents are concerned about an erosion
problem as a result of t~e ditch project; he thinks this is a good time to
present the question to the County Engineer and suggested Clerk Lorraine
Stromquist write to him concerning this matter. Engineer Lund believes they
do plan on deepening and possibly widening the channel.
Mr. Reioux expressed his concern about the appearance of a box culvert 5 ft.
high and 15 ft. long and also about debris and slit.
Engineer Lund Informed him that RosGville will pr0~Gnt plans to Arden Hills
for approval before goIng ahead with the project; the County has been re-
quested to check the outlet means.
Trustee Hollenhorst suggested that Mr. Reioux be notified as soon' as the
plans are available and requested Mr. Reloux to send 6 letter to the Council
with a copy to Banister Engineering Company listing his specific matters of
concern.
DriveWay Entrances on Trunk HiQhways.
Letter from the Minnesota State Highway Department regarding rules and regu-
lations on driveway entrances on trunk highways was referred to the Clerk and
the Planning Commission.

Engineer Lund submitted a plan for this drainage project, stating that it Is

one pondlng area. These would be open ditches. Clerk Informed the Council
that the maIntenance department has access to free fl! I from Highway projects;
the District felt this would be an alternate solution to el iminatlng the
breeding ponds, but this would be financed by the Village; the open ~!?chlng

Police Department
Trustee Crepeau informed the Council that the police department material
from the Village stroage building on New Brighton Road will be moved to
the house located on the recently purchased Helman property on Lexington
Avenue; this move is agreeable to both the Public Safety and Parks and
Recreation CommIttees. Clerk was requested to order a sign reading
"Arden HI lis Police Department" for the Lexington Avenue bui Idlng.
Arden Hills Jaycees

REPORT OF MAYOR NETHERCUT
Mayor Nethercut reported a letter dated 16 May 1967, had been received from
the Minnesota Safety Council, Inc. informing us that Arden HI I Is has been
awarded the Merltorlus Achievement Honors In traffic safety law enforcement
with presentation of the award to be made In the Village; they requested
a date for the presentation. Trustee Crepeau s~ggested the presentation be
made at one of the Council meetings in June. He wi II request the polIce
officers to be present. He expressed appreciation to the Village administra-
tive staff for their efficiency In submitting reports which was a definite
factor In getting the award and requested they be present at the time of
presentation. Clerk Lorraine Stromquist reported that Mrs. Charlotte
McNlesh and Mrs. Dorothy Zehm work with the Police Department. Matter re-
ferred to Clerk Lorraine Stromquist to arrange for presentation date.
1967 Legislative ProQram
Notification from the League of Minnesota Municipalities stating the 1967
Legislative Program will be held at the University of Minnesota on June 10,
1967; fee for the program Is $5.00. The Council agreed that the fee would
be paid by the Village for Planning Commission members, Mayor, members of
the Council and the Clerk and staff If they wish to attend.
Water Study Committee
Mayor Nethercut reported that Bob McNlesh, Chalr~~n of the Water Study
Committee, stated that completion of this study Is pending reports from
Banister Engineering Company and representatives of the Industrial Area;
however, he does expect the Banister report about the 1st of June, and progress
Is being made regarding reports from the Industrial area.

License Renewals
Trustee Crepeau moved, seconded by Trustee Hollenhorst, that the following
licenses be granted:
Phillips 66 Station, Highway 8 and 96 - restaurant
Arden Hills Texaco, 3130 N. Cleveland - soft drinks
motion carried.
Apportionment Resolutions
Trustee Crepeau moved the adoption of Resolutions as attached, relating to
apportIonment of assessm3~ts relating to Senltary Se~er Improvement Nos. I,
3 and 6; seconded by Trustee Olmen; motion carried.
County Road F LIQhtlng
Clerk Lorraine Stromquist Informed the Council that Mr. Reeder, Mounds VIew
High School, requests the replacement of a street light on County Road F
near the tennis courts of the school. He stated that the light was removed
during road construction and not replaced. The area Is hazardous for both
pedestrians and vehicular travel. Matter referred to Clerk LorraIne Strom-

Request for Street Dance
The Council granted the request of Mr. Grubb, 1261 Tiller Lane, to use
the dead end area of Cannon Avenue for a neighborhood street dance to honor
the Baumans, 1249 Tiller Lane, who are leaving for California. This Is to
be held on May 29, between the hours of 4 and about 10 p.m. Clerk to so'
Inform Mr. Grubb.

RESOLUTION AUTHORIZING ACQUISITION OF PROPERTY
FOR LIBRARY SITE
WHEREAS, the Council of the Village of Arden Hills has discussed
with the Ramsey County Library Board the construction of a Ramsey County
branch library on the following-described property in the Village of
Arden Hills, to-wit:
Subject to roads, the Easterly 120 feet of the Southerly
363 feet of the Southwest Quarter (SW~) of the Northwest
Quarter (NW~); and the Westerly 289 feet of the
Southerly 363 feet of the Southeast Quarter (SE~) of the
Northwest Quarter (NW~), all being in Section Twenty-eight
(28), Township Thirty North (30N), Range Twenty-three
West (23W), and
WHEREAS, it is the understanding of the Council that the Ramsey County
Library Board approves the construction of a branch lib~ry thereon but
requires that conveyance of said parcel be made to Ramsey County free of
charge, and
WHEREAS, the Council of Arden Hills has this day authorized the
execution of an Earnest Money Contract for the acqusition of said parcel,
and
WHEREAS, upon acquisition of said parcel it is the intention of
the Council to convey said parcel to Ramsey County for the purpose of
constructing said branch library thereon,
NOW THEREFORE, BE IT RESOLVED that it is the intention of Arden Hills
to acquire the aforesaid Tract and then to convey said Tract to Ramsey
County in order that Ramsey County, through the Ramsey County Library
.
Board, may construct thereon a branch library, and
BE IT FURTHER RESOLVED, that the Administrative Clerk is hereby
authorized and directed to transmit a certified copy of this Resolution
to the Ramsey County Library Board in order that they may commence the
preparation of necessary plans for the construction of said branch library.

WHEREAS, the assessment roll for Sanitary Sewer Improvement
No. 1 as last finally amended and adopted on September 9, 1960,
was filed and certified to the County Auditor of Ramsey County
on October 26, 1960, for the purpose of including installments
thereof to be collected along with real estate taxes commenCing

WHEREAS, a hearing on supplemental assessments. re-
assessments, and apportionment of previous assessments in
respect to Sanitary Sewer Improvement No. 1 was held on
