MINUTES OF REGULAR COUNCIL MEETING Vi Ilage of Arden Hi lis Monday - 24 April 1967 - 8:00 p.m. Call to Order Meeting was called to order by Mayor Nethercut ~t 8:00 p.m. Roll Call Present - Mayor Nethercut, Trustees Crepeau, Hollenhorst and Olmen. Absent - Trustee BJorndahl Also Present - . Village Attorney Vincent P. Courtney (arrived at 9:00 p.m.) Engineer Donald Lund, Building Inspector Clay Kel ley, Administrative Clerk Lorraine Stromquist and Deputy Clerk Florence Honan. Approval of Minutes The minutes of the Regular Council Meeting of 10 April 1967, were approved as submitted. Squad Car Bid OpeninQ Clerk Lorraine Stromquist opened the one bid received for a new squad car; this bid from Ron Saxon Ford, Inc. in the amount of $3,574 less $700.00 trade In.1 lowance. Trustee Crepeau moved approval of the bId, subject to review by Attorney Courtney, and authorized the attorney to write up the contract; seconded by Trustee Hollenhorst: motion carried. Public Hearing - Lake Terrace Plat Misses Elbner and Starr, owners of the property, were present and stated they had submitted all the necessary maps and reports. However, their attorney Is still checking an easement m~tter. Trustee Hol lenhorst g~ve the background of the application, stating that the property Is located between Snelling Avenue and Lake Johanna and consists of about 5 acres about 185' wide and about 500' deep; variances were requested to eliminate a cul-de-sac and to construct a 30' road rather than the required 60' until such time as abutting property Is developed. The owner of the abutting property north of .the proposed plat stated he had no objections to the plat. Eugene Gazelka. 3263 North Snelling Avenue. another abutting property. owner. stated the plat appears satisfactory to him with the exception of the road easement; he does not believe the 30' which Is to be dedicated is actually located entirely on this property. Miss starr again Informed him that their attorney will check this matter further. Trustee Hollenhorst referred to a letter from Mr. Gazelka. dated 4-5-67. In which he requested an overall study of the subdivIsion of the area and also s~~._p I~~s.. T~tee Hollenhorat does not believe that this plat will attectD.aiioolTl_rL p .''i;i. {Engineer Lund reported that It would not be feasible to sewer th two lots adjacent to Snelling Avenue. but the subject would be reconsidered when further development occurs. He stated that .~raln fields would work at these two sites according to soil tests taken. "'rustee Olmen stated his concern regardIng snow plowing of this narrow street and no turn around area for the equipment. Miss Starr informed him that equipment could turn around on their present property. and a temporary easement would be given the VIllage untIl such time as the street Is widened. Trustee Hollenhorst moved approval of the preliminary plat subject to ~pproval of Attorney Courtney. ~he plat revIsed to show the maintenance turn around, and the verification of the ownership of the 30' proposed easement to be dedicated to the Village for road purposes; seconded by Trustee Crepeau; motion carried. County Ditch No.4 Engineer Lund explained that a box culvert is planned for Installation between Lake Johanna and Little Lake Johanna; Rosevi"e will pay the entire cost. Engineer Lund stated the effect on the lake level cannot be predic- ted, but believes Arden Hills should contact the County regardIng future .,1- Council Meeting Minu-j'os - April 24, 1967 - continued problems as a result of this installation. He Informed the Council that a hearing before the Ramsey County Board will be held on May I, 1967 _ these meetIngs usually start at 10:00 a.m. The contracts for the work between County Road C and County Road C2 have already been let. but the balance is proposed. There are about 1.117 acres to be draIned Into Lake Johanna, which Is the same area as at the present time, but the drainage project would allow the drainage to flow much faster; Lake Johanna does have a large storage capacity. Robert McNiesh, 3447 Siems Court, stated he has no opposition to the drainage, but does oppose more drainage into Lake Johanna with no plans for outlets. Trustee Hollenhorst moved that Arden Hills be represented at the County Board hearIng on May I, .1967, regarding the project of the water level of Lake Johanna; seconded by Trustee Olmen; motion carried. Trustee Crepeau volunteered to represent the Village at thIs meeting. BUSINESS FROM THE FLOOR LIcense Applications - 4760 Highway 8 Ronald Blomquist from Blomquist Realty Company requested an answer as to why the license applications to operate a cafe at 4760 Highway #8 had been denied at the last Council meeting. Trustee Crepeau Informed him that Mrs. Kessler. the applIcant, had stated that uniess she was granted the on and off sale non-IntoxIcating malt liquor lIcenses, she was not Interested In opening the establishment; there- fore the licenses were denied because of previous Public Safety proqlems at this location. Mr. Blomquist then informed the Council that the applicant had operated such a business for many years In an adjoining village with no problems; that the malt liquor license was needed to make the business pay and requested the Council to reconsider the applications. Mr. Markoe, another representative from the Blomquist Company, stated that they have had people in the cafe and that restaurant license alone Is not sufficient; it needs a 3.2 license. Mrs. Kessler was present and stated that in the last eight years while she held a license in Shoreview there had been no violations. Trustee Crepeau moved that the Council reconsider Its previous deCision regarding I icenses; seconded by Trustee Hollenhorst; motion carried. Trustee Crepeau moved that Mrs. Antoinette Kessler be granted cafe, Juke box, soft drink and on and off sale non-intoxIcating malt liquor licenses for the establishment at 4760 Highway 88, effective through 12-31-67; seconded by Trustee Olmen; motion carried. Proposed Apartment Bui Iding Attorney Dick Jones was present In behalf of the applicants who propose to build a 234 unit apartment building on the northeast corner of County Road E and New Brighton Road; the Planning Commission had recommended ,nial of the request. Attorney Jones requested the Council to again delay eir decision on this matter until further plans are submitted to the anning Commission for re-consideratlon. REPORT OF ENGINEER LUND Ramsey County Leaque Engineer Lund reported that Mr. Elliot from Banister Engineering Company has attended two meetings of the Sol id Waste Disposal Study Committee of the Ramsey County League, and is wi I ling to represent Arden Hills If re- quested. Mayor Nethercut and the Council agreed that this would be fine to have Mr. Elliot represent the Village at these meetings. Trustee Crepeau moved, seconded by Trustee Hollenhorst. that Trustee Olmen -2- Counci I r~<ilet;ng Minu'res - Apri I 24, 1967 - continued act as Council representative for the Village at the meetings; motion carrIed. Clerk Lorraine Stromquist requested to inform the League of the above deci _ sions. TelemeterinQ Service Engineer Lund reported that the final hOOk-up of the telemeterlng service at the sheriff's office has not been completed as they are waiting for the equipment; he believes, however, that this will be accomplished In the near future. ~Lake Josephine Oralnaqe Problems Engineer Lund reported on the meeting at the site of the draInage problems in thIs area; also in attendance at this meeting were Ramsey County Engin- eering Deane Ankl~n, Trustees Olmen and Bjorndahl. Engineer Lund was re- quested to estimate the costs on two plans to solve the problem. Engineer Lund submitted the cost estimates with a copy to each Council member. The estimated fJgures were as follows: Project A - to cover entire ditch, in cludlng leads to new catch basins on Ingerson Court and Fernwood Court _ $12,300.00 Project B - to cover only the northerly 250 feet of the ditch 4,700.00. The estimate also showed the proportionate amounts to be paid by the County and the Village. Trustee Olmen Informed the Counc!1 that Trustee Bjorndahl was to check with the Lake Josephine Association regarding their share of the cost; therefore, because of Trustee Bjorndahl's absence at this Counci I meeting, the matter was tabled pending this report. Engineer Lund also reported that this group also checked the area north of the homes on Tiller Lane; the Village of Shorevlew is mostly responsible for this drainage problem. He recommended that we wait for Shoreview's decision regarding the Lambros draInage matter before pursuing this problem with them. Attorney Courtney stated that he had received a cal I from the new Clerk Administrator requesting Information regardIng the Lambros matter, but had heard nothing further on the matter. Red Fox Road Improvement Engineer Lund reported that Mr. Snyker believes arrangements could be made with the County Board regarding the Vii lage improving this road with the cost to be considered as the Village's share of the final improvement. Trustee Crepeau reported that the County is waiting for a decision from the State Highway Department concerning an outlet from Red Fox Road to Highway 51. Mayor Nethercut felt we should Improve the road If we can be assured of cost reimbursement or consideration from the County. Attorney Courtney informed the Council that the Daubney and Reiling ease- ment were given on condition that the County acquire the road, which would cause a problem if this acquisition did not materIalize. Engineer Lund reported that the County would assume the cost for the center 24' and the balance of 44' would be assessed 100% against the abutting property owners. The County would hold the assessment hearing. Attorney Courtney did not tIlelieve the Village could do anything under these conditions. Matter referred to Attorney Courtney to determine the Vi Ilage's position and also to contact the State Highway Department regarding the access to Highway 51. REPORT OF ATTORNEY COURTNEY Maintenance of Recreation Property outside VIIIJ!.B.!.. Attorney Courtney covered this subject In a written report. dated April 24, !967, In which he stated it would be possible to lease the ballfield from Pipkorn Mfg. Company, located at County Road 0 and Highway 35, and then maIntain it. The property must be listed In the insurance blanket policy. The VIllage should obtain a written lease and could be for a specified period of time (such as 90 or 120 days); thIs should be done by resolution. Clerk requested to send copy of this letter to Mr. Lagerstrom. County Road F Sewer Assessments Attorney Courtney submitted a written report, dated April 24, 1967, on this subject. Engineer Lund reported that sewer construction to service two 100' 101's on County Road F has been comp I eted, th i s 110rk was done at the -3- Counci I Meeting Minutes - April 24, 1967 - continued request of one of the owners. Clerk Lorraine Stromquist informed the Council r that the property has already been assessed $3.10, which leaves a balance of 56.90. Council requested Clerk Lorraine Stromquist to submit Information to Attorney Courtney; Attorney Courtney requested to write to the two property owners regarding the assessment. Proposed Valentine Lake View Plat. Attorney Courtney submitted to Clerk Lorraine Stromquist the title opinion regarding this proposed plat. He reported that O. J. Husby and Sons is listed as the owner; Gale Hendrickson, applicant for the platting, Is not listed as an owner. ~Clerk Lorraine StromquIst will check the plat for compliance with the new Ordinance, and send copies to Banister EngIneering Company and the utilIties companies, (Attorney Courtney took his copy), as outlined in the Ordinance; two copies wIll also be submitted to the Planning Commission for their con- sideratIon. Attorney Courtney informed the Councl I that ~ere Is an N.S.P. easement on record; this easement Is located on the north line of the property. Attor- ney will check with N.S.P: Fernwood Avenue Tax Abatement Attorney Courtney submitted to Clerk Lorraine StromquIst the application which Is to be signed and returned to him requesting the abatement of taxes on Fernwood Avenue. Trustee Crepeau moved approval of the petition for the abatement of taxes on Fernwood Avenue and authorized the Clerk to sIgn semel seconded by Trustee Hollenhorst; motion carried. Pedestrian Trail Attorney Courtney covered this subject In h!s written report to the Council, dated 24 April 1967. He reported that in his conversation with representa- tives from Bethel College, he was informed that Bethel College was not contac- ted regarding an easement for the PedestrIan Trail and they would object to the trail around Valentine Lake. Clerk to check with Trustee Bjorndahl on this matter. Attorney Courtney Informed the Council he had received a letter from N.S.P. regarding an easement for the trail, which included proposed quit claIm deed to Arden HII Is In the form of a resolution. Attorney Courtney, after checking the map, does not believe the Village desires the extended easement which they offer; the vi Ilage acceptance of their offer would relieve them from tax liability on this property. Matter tabled until report from Trustee Bjorndahl. Attorney Courtney stated we should have written consent from record owners of property, Including Ramsey County for trail through Tony Schmidt Park, because of the Village's attempt to police the trail. Council referred the matter to Attorney Courtney to confer with Trustee Bjorndah I. Proposed Drive-In Ordinance .-t.ttorney Courtney submitted four copies of the proposed Drive-In Ordinance ~hich he had re-drafted. Trustee Hollenhorst moved that Council action be withheld pending further study by the Planning Commission; seconded by Trustee Crepeau; motion carried. Clerk requested to send copies to Carl Dale and Larry Brodie. Mr. Kel ley Informed the Council that construction has been halted pending the Council's decision; he recommends that tIe Counci I receive approval from al I the home owners on the street before granting this variance. . County Road F a!}J Lex I nqton Odor Mr. Kelley repo.ted that there is no apparent odor at this location at this time. Request for Sracial Use Permit Mr Kelley reported that Stewart Lumber Company is requesting a special use permit to corstruct a wood preservative plant on Highway #8 on the property on which thel are now located. The necessary forms are to be completed and s u bm i ti" d . Annual Rep,rt Mr. Kelley gave the Bui Iding Inspector's Annual Report as required under the new odinance. He Informed the Council that 1966 was a rather slow year wit' only 40 permits Issued; the average home valuation was $26,000 which I~ In keeping with the other homes in the Vii lage. He will check with Attorney Salland on this matter. Mr. Kelley also reported that junked cars are a problem and this Is covered In the new ordinance; there are about 15 junked cars in three locations in the Vi Ilage. Trustee Crepeau submitted a le).ter, dated 13 April /967, from the District Traffic Engineer of the State Highway Department which gave the statistics regardIng accidents at the Intersection of Highway 10 and 96. He stated that funds have been tentatively provided for the revision of the existing signals to include left turn arrows for Highway 10 traffic, hoping that this will eliminate the number of accidents at this Intersection.
